B. DCTA Board Appointment-As part of the February 21,2018,Mobility Committee
staff presented the reappointment of General Richard Huckaby (USMC Retired)
to the Denton County Board of Directors. Mr. Huckaby has served in this position
since December 2013 and is currently the serving as the Vice-Chair of the DCTA
Board and the Chair of the Finance Committee. The Mobility Committee gave
staff direction to bring this item forward as a Council Work Session item and open
the nomination process for the board appointment. Staff has targeted the March 6,
2018, Council Work Session Agenda for this item. Staff contact: Mark Nelson
C. Oak Gateway Area Plan Workshop — Last night, staff hosted a Community
Workshop for the Oak Gateway Area Plan. The purpose of the workshop was to
gather input from the community on several topic areas. Over 125 people attended
the event. There were a lot of different stakeholders in attendance, from property
owners, residents, business owners, developers, students, bicyclists, to citizens
that were just interested in learning about the Plan.
The Steering Committee members were there to help facilitate the discussion at
the six topic area exercise stations. The stations were set up with informational
boards,maps,post-its, stickers,markers, comment cards, etc.to make sure that the
staff and consultants were able to capture as much information as possible. The
next step is to compile and summarize what we heard from the community and
start to prepare for an upcoming Open House to share the results of the workshop,
as well as additional information received on the City's dedicated website for the

D. US RadioPharmaceuticals — In Dec. 2017, Council inquired about the status of a
former business called US RadioPharmaceuticals ("USR") that has been storing
radioactive material at its facility since it ceased operations in 2009. A memo was
provided to Council in the Friday, Dec. 22 staff report with a status update. The
Texas Department of State Health Services ("DSHS")had recently issued a notice
of violation to USR with a state administrative hearing scheduled for Jan.26,2018.
The state administrate law judge granted an extension of that hearing to Feb. 28,
2018. Staff will continue to monitor and provide an update on the outcome of the
scheduled hearing. The hearing date for compliance may be further extended or
DSHS may seek enforcement action against USR at that time. Staff contact: Sarah

E. DEC Update — Mechanical and Electrical construction on the Denton Energy
Center(DEC) is approximately 95% complete.
The facility is entering testing and commissioning phase of the project, scheduled
to continue through spring 2018. Site finish and cleanup phase of the project is
scheduled to be completed during late spring 2018. Expenditures to date are
approximately 76.9% of the allocated project funds.
The target date to begin performance testing operations is early spring 2018, and
is ERCOT controlled. The target date for emissions testing, during engine testing,
is approximately May 2018 and ERCOT controlled. The target date for
commercial operations remains early summer of 2018 with ERCOT approval.

F. Mayor's Summer Youth Job Program—The Mayor's Summer Youth Job Program
will be from June 11 to August 3. The City has 25 positions identified for the
Program in the Animal Shelter, Library, Parks, Finance, Human Resources,
Development Services, Utilities, and other City departments. Applications will be
available on the City's website March 2 through April 6. Staff will be working
with Denton ISD to help market the program through the schools,information was
provided in the February-March issue of the Resident Update, and staff will be
providing information through the website and social media. More information

A Community Business Partnership meeting was held at the United Way on Feb.
14 for businesses to learn more about how they can participate in the Mayor's
Summer Youth Job Program. The United Way already has commitments from a
number of community businesses to employ students this summer, but they are
seeking additional support. If you know of business owners in the community

III. Community Events
A. Read across America Day with Denton ISD—National Read Across America Day,
or Dr. Seuss Day, is an event designed to encourage reading throughout
elementary schools. The event takes place annually on the birthday of Theodor
Seuss Geisel (Dr. Seuss) and is scheduled for Friday, March 2 from 9:30 to 11
a.m. Denton ISD and United Way of Denton County coordinate the event at
Denton area schools and are still seeking volunteers. To sign up as a volunteer go

B. Denton Open Data Day — The City of Denton is embracing data in an effort to
enhance community services and empower its citizens by participating in Denton
Open Data Day. Open Data Day is an opportunity for local programmers and
designers to collaborate and develop new tools for accessibility, economic
development,and sustainability for all that call Denton home.Last year,we looked
at the areas of mobile applications, transportation, permitting efficiency and
responsiveness. The event is free for anyone wishing to attend or participate. Join

C. Touch a Truck — The Explorium Denton Children's Museum will hold its 4t'
Annual Touch a Truck event on Saturday, March 3, from 10 a.m. to I p.m. in
the parking lot of C. H. Collins Stadium. Additionally, organizers have set aside
the hour from 9 a.m. to 10 a.m. for families with special needs children during
which engines, lights, and sirens will be turned off. Many city departments

Hickory Creek Pump Station Overflow
Heavy rain and damage leads to City of Denton sewer overflows
DENTON, TX, Feb. 23, 2018—The City of Denton Wastewater Utility reported that a foreign
object in the wastewater system caused damage to pumps at the Hickory Creek Pump Station
near the Old Alton Bridge, resulting in sewer overflows in the vicinity.
The Texas Commission on Environmental Quality(TCEQ) requires the City to notify the public
and all appropriate government officials of overflows that exceed 100,000 gallons in a single
drainage basin. This overflow was measured at 720,750 gallons.
Staff from the City's Watershed division have sampled the stream upstream and downstream of
the discharge, and have noted no impacts. General Manager Dr. Kenneth Banks stressed that
none of the overflows of diluted wastewater appear to have affected the stream or Lake
Lewisville. However, staff are adding oxygen to the stream as a precautionary measure to ensure
protection of Hickory Creek.

SUBJECT: Hickory Creek Pump Station Overflow
The Hickory Creek Pump Station is at the end of the Hickory Creek Interceptor sewer and pumps
all wastewater flows from the Hickory Creek sewer basin through a 12,000 feet long pressure
main to a gravity sewer line located near Denton State School.
Over the last several days, there has been a very large amount of rain in the Denton area and
Hickory Creek watershed. During this rain event, it appears a large object(possibly chunk of
concrete from a new construction area)washed down into the Hickory Creek Interceptor sewer
and travelled to the pump station. As this got object got drawn into the operating Pump No. 1, it
significantly damaged the pump, causing a severe leak from the pump housing in the pump
station dry well. The leak submerged the all pumps in the pump station.
The on-call person received a high level alarm and went to check the pump station. He found the
dry well flooded and the Pump No. 1 still running but also leaking substantial amount of water in
the drywell. The on-call person then started the Pump No. 2 but the pump failed because the
valve control solenoid was submerged. The on- call person then called for help from other plant
and collection system staff.
Tanker trucks were called in, and submersible pumps were lowered into the dry well to pump out
the water so plant staff could access the pumps and the electrical system. Staff also bypassed
some of the flow coming into the system by pumping the flow into a nearby sewer system
operated by the Upper Trinity Regional Water District. When the water level in the dry well was
down to waist level,plant staff started working on the Pump No. 2 (the undamaged pump) and
replaced the hydraulic solenoid assembly with a new one. This allowed Pump No. 2 to begin
pumping. Once Pump No. 2 was operable, it had enough pumping capacity to pump all the
flows coming to the pump station. Plant staff is currently working on the damaged Pump No. I
and expect to have it back in service today.
During the failure of the pump station, flows backed up in the interceptor sewer and manholes
and used up the available storage capacity of the sewer lines. Eventually the manholes in the
vicinity of the pump station started overflowing. The total duration of the overflow was over 7
hours, and the estimated overflow amount is 720,750 gallons. Per our protocol, the Texas
Commission on Environmental Quality and Texas Parks and Wildlife Department have been
notified. Staff will also send out public notification shortly. Staff from the Watershed division
have sampled the stream near and down flow of the discharge at multiple points and have noted
no impacts to the stream due to low oxygen, changes in pH, or changes in conductivity. Staff
anticipated that this would be the case due to dilution of the discharge by stormwater flows in
Hickory Creek. Although it appears that impacts from the wastewater discharge are minimal,
we are still applying oxygen to the stream near the discharge as a precautionary measure.
The Hickory Creek Pump Station is in a remote area far from any available gravity sewer
manhole that can be used for bypass pumping. This incident is unique and has occurred only
once wherein the pump station became totally inoperable. Staff has been reviewing the
possibility of such occurrence and looking for available temporary storage options where bypass
pumps can be used to temporarily store incoming flows while the pumps are repaired. This work
will continue with higher priority to deal with such emergency in the future.

SUBJECT:
Appointment of Capital Improvements Advisory Committee for the mandated 2018 update
of the Water/Wastewater impact fees
BACKGROUND:
Denton collects impact fees on all new water and wastewater connections to help offset a portion
of the cost of new infrastructure to accommodate new demand. Under Chapter 395 of the Local
Government Code, Denton must update the land use assumptions and capital improvements plans
used to calculate its impact fees every five years. Denton completed its last impact fee study and
update in 2013.
As part of the update process, Chapter 395 requires appointment of a Capital Improvements
Advisory Committee to review and comment on land use assumptions, capital improvements
plans, and proposed impact fees.
Staff will be bringing an ordinance to appoint this committee before Council on March 20, 2018.
DISCUSSION:
Chapter 395 of the LGC governs all aspects of the impact fee update process, from development
of a capital improvements plan through advisory committee review, public notice and hearing,
adoption, and fee administration.
Denton has a City Council approved contract with Kimley Horn & Associates to complete the
impact fee update study required by Chapter 395. The consultant is currently working on the land
use assumptions and capital improvements plan updates needed for this study.
The next step in the update process required by Chapter 395 is to appoint the Capital Improvements
Advisory Committee which is charged with advising and assisting in adopting land use
assumptions, reviewing the proposed capital improvements plans for water and wastewater,
monitor the implementation of the capital improvements plan, and advise on the need to update
impact fees.
Section 395.058 of the Local Government Code allows for the Planning & Zoning Commission
(P&Z) plus a representative of the ETJ (Extra Territorial Jurisdiction) to serve as the Capital
Improvements Advisory Committee. Since the first implementation of the water/wastewater
impact fees in 1998 and the subsequent 5-year mandated updates in 2003,2008 and 2013,the P&Z
plus one member from the ETJ has been appointed by the City Council to serve as the Capital
Improvements Advisory Committee. Staff will be recommending that the Council appoint the
Planning and Zoning Commission plus one additional member to represent the City of Denton ETJ
interests.
Staff will further recommend that Robin Harris be appointed to serve as the ETJ member on the
Advisory Committee. Robin is a licensed Professional Engineer in Texas and an Associate in the

consulting firm Teague Nall & Perkins in the Denton office. Robin has been involved in several
water and wastewater design projects for Denton over the years, with the most recent one being
the Fort Worth Drive Utility Relocation project. Robin will bring the technical expertise to the
Capital Improvements Advisory Committee in evaluating the impact fee study results. His
knowledge of the city and ETJ area as well as his understanding of the issues facing Denton will
bring valuable insight to the impact fee process.
Once complete,the updated study and proposed impact fees will be presented to the Public Utilities
Board for review and an impact fee adoption recommendation to the City Council.
CONCLUSION:
Staff will be bringing an ordinance to appoint the Capital Improvements Advisory Committee
before Council on March 20, 2018. In addition, staff will reach out to the P&Z within a week of
the ISR to advise them of the Capital Improvements Advisory Committee appointment unless we
hear of any concerns from Council.

3. Citizen Comments on Ethics Related Work Session Report Items
The City Council has agreed to suspend the Rules of Procedure for citizen comment on Work Session Report
Items related to an ethics ordinance. This section of the agenda allows citizens to speak on Work Session
Report Items related to an ethics ordinance only. Each speaker will be given a total of three (3) minutes to
address any item related to an ethics ordinance he/she wishes that are listed on the Work Session Report. A

3. Work Session Reports
A. ID 18-333 Receive a report, hold a discussion, and give staff direction regarding a draft ethics
ordinance from attorney Alan Bojorquez.
B. ID 18-344 Receive a report, hold a discussion, and give staff direction regarding the FY 2017-18
Comprehensive Annual Financial Report and annual audit.
C. ID 18-369 Receive a report, hold a discussion and provide direction regarding nominations and the
appointment a Member to the Board of Directors of the Denton County Transportation
Authority.
Following the completion of the Work Session, the City Council will convene in a Closed Meeting to consider

B. Receive Scheduled Citizen Reports from Members of the Public. This section of the agenda permits
any person who has registered in advance to make a citizen report regarding a public business item he or
she wishes to be considered by the City Council. This is limited to no more than four (4) speakers per
meeting with each speaker allowed a maximum of three (3) minutes to present their report. At the
conclusion of each report, the City Council may pose questions to the speaker or may engage in
discussion. Such questions or discussion shall not exceed two (2) minutes. If the City Council believes a
speaker's report requires a more detailed review, the City Council will give the City Manager or City Staff
direction to place the item on a future work session or regular meeting agenda and advise staff as to the
background materials to be desired at such meeting.

Each of these items is recommended by the Staff and approval thereof will be strictly on the basis of the
Staff recommendations. Approval of the Consent Agenda authorizes the City Manager or his designee to
implement each item in accordance with the Staff recommendations. The City Council has received
background information and has had an opportunity to raise questions regarding these items prior to
consideration.
Listed below are bids, purchase orders, contracts, and other items to be approved under the Consent
Agenda (Agenda Items A — I). This listing is provided on the Consent Agenda to allow Council Members
to discuss or withdraw an item prior to approval of the Consent Agenda. If no items are pulled, Consent
Agenda Items A — I below will be approved with one motion. If items are pulled for separate discussion,
they may be considered as the first items following approval of the Consent Agenda.
A. ID 18-163 Consider adoption of an ordinance authorizing the City Manager to execute a Professional
Services Agreement for consulting services for transportation services for the City of
Denton including program management, design management assistance, strategic planning,
identifying and securing funding, community outreach and education, preparing and
submitting updates to the Statewide Transportation Improvement Plan, and monthly
reports to the City of Denton Mobility Committee and Executive Management; providing
for the expenditure of funds therefor; and providing an effective date (File 6610 awarded
to Innovative Transportation Services in the five (5) year not-to-exceed amount of
$630,000). The Mobility Committee recommends (0-0).
B. ID 18-284 Consider adoption of an ordinance of the City Council of the City of Denton, Texas, nunc
pro tunc correcting an inadvertent mistake in Ordinance 2016-172 relating to the dollar
amounts reflected in the back up provided for RFP 5641, awarded to Genuine Auto
Parts/NAPA Integrated Business Solutions,and providing for an effective date.
C. ID 18-289 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, rejecting all bids received under IFB 6621 - purchase of 138kv circuit
breakers and maintenance parts - pursuant to section 252.043 (f), Local Government
Code; authorizing the City Manager, or his designee, the authority to enter into a contract
with the Lower Colorado River Authority, through an Interlocal Cooperative Purchasing
Program participation agreement pursuant to section 271.102 of the Texas Local
Government Code, for the purchase of high voltage circuit breakers for Denton Municipal
Electric; providing for the expenditure of funds therefor; providing an effective date (File
6621-Interlocal Cooperative Purchasing Program participation agreement for the
purchase of electrical equipment with the Lower Colorado River Authority awarded to
Siemens Industry, Inc. In the not to exceed amount of $2,200,000). The Public Utilities
Board recommends approval
D. ID 18-323 Consider adoption of an ordinance of the City of Denton authorizing an agreement
between the City of Denton, Texas and Keep Denton Beautiful, Inc. for the sponsorship
of the Great American Cleanup, Denton Redbud Festival, Community Tree Giveaway,
Neighborhood Beautification Grants, Environmental Education Grants, and Mural Art
Initiative; providing for the expenditure of funds therefor; and providing for an effective
date. ($11,500)
E. ID 18-325 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal

the Buy Board Cooperative Purchasing Network Contract# 521-16 for the acquisition of
one (1) Altec model AM60 Articulating Over-center Aerial truck for $236,005 and one
(1) Altec model TA60 Articulating Telescopic Aerial truck for $236,948 for the Denton
Municipal Electric Distribution Department; providing for the expenditure of funds
therefor; and providing an effective date (File 6739- awarded to Freightliner of Austin, in
the amount of$472,953). The Public Utilities Board recommends approval
F. ID 18-326 Consider adoption of an ordinance of the City of Denton, Texas, a Texas home-rule
municipal corporation, authorizing the City Manager to execute a Donation Agreement
with the Denton Independent School District (DISD) Advanced Technology Center, Law
Enforcement Technology Program, in compliance with City of Denton Ordinance
2008-113; authorizing the donation of two (2) patrol units to DISD Advanced
Technology Center with an estimated value greater than Five Hundred Dollars ($500);
and providing an effective date (File 6656- Donation Agreement with the DISD
Advanced Technology Center).
G. ID 18-328 Consider adoption of an ordinance of the City of Denton authorizing an agreement
between the City of Denton, Texas and Texas Filmmakers Corporation for the
sponsorship of the Thin Line Festival; providing for the expenditure of funds therefor; and
providing for an effective date. ($5,000)
H. ID 18-331 Consider adoption of an ordinance of the City of Denton, Texas, a Texas home-rule
municipal corporation, for partial approval of a pre-qualified professional services list for
Project Management, Development Services, Roadways, and Traffic Signals/Street
Lighting design services; and providing an effective date(RFQ 6590)
1. ID 18-332 Consider adoption of an ordinance of the City of Denton, Texas providing for the
schedule of miscellaneous fees, deposits, billings, and procedures for administrative
services to City utility customers; providing for a repealer; providing for a severability
clause; providing for an effective date. The Public Utilities Board recommends approval

A. A17-0006c Conduct the first of two readings of an ordinance of the City of Denton for a voluntary
annexation of approximately 0.30 acres of land generally located east side of Old Alton
Road, south of the intersection of Old Alton Road and Teasley Lane by the City of
Denton,Texas.
B. ID 18-300 Consider adoption of an ordinance awarding a contract for the purchase of natural gas for
the Alternative Fuel Filling Station located at 1251 South Mayhill Road,Denton,TX.
C. ID 18-316 Consider nominations/appointments to the City's Boards and Commissions: Human
Services Advisory Committee and Public Art Committee.
D. ID 18-329 Consider approval of a resolution of the City Council of the City of Denton, Texas,

7. PUBLIC HEARINGS
A. Z18-0001b Hold a public hearing and consider adoption of an ordinance regarding an amendment to
the Rayzor Ranch Overlay District to provide standards and criteria for the residential
development within the Rayzor Ranch Marketplace Residential Area. The Rayzor Ranch
Marketplace Residential Area includes approximately 40.7 acres generally located on the
west side of North Bonnie Brae Street, approximately 1,400 feet north of West
University Drive (US 380) in the City of Denton, Denton County, Texas. (Z18-0001b,
Rayzor Ranch Marketplace Residential,Hayley Zagurski).
B. Z17-00271b Hold a public hearing and consider adoption of an ordinance to rezone approximately 2
acres from a Neighborhood Residential Mixed Use 12(NRMU-12) district to a
Community Mixed Use General (CM-G) district. The subject property is located at 1101
W. University Drive, in the City of Denton, Denton County, Texas (Z17-0027a, Pecan
Creek Crossing, Shandrian Jarvis Ugwoke). The Planning and Zoning Commission voted
6-0 to approve the request.
