Update on Cedar Street Parking Lot — The Cedar Street Parking Lot Project remains on schedule to be substantially complete and open before the end of April in advance of the Arts & Jazz festival weekend. This week the contractor completed the sidewalks and formed up tree wells for the streetscape, and DME crews installed perimeter pedestrian lighting. Staff contact: Dean Hartley C. Spencer Road Closure — Beginning April 2, Zachry Construction Company, a contractor for the City of Denton, will begin street construction on Spencer Road between Mayhill Road and the east driveway into the Lowe's parking lot (see image below). Weather conditions and contractor scheduling may impact the plans, but the project should be complete by September 29. During this time, this portion of Spencer Road will be closed to thru traffic. A marked detour route will direct motorists to use Morse Street between Loop 288 and Mayhill Road. Staff met with the management of the impacted apartment homes and notifications have been provided to impacted residents and businesses. Digital sign boards have been placed alerting motorists of this closure. Additionally,notifications were provided to DCTA, DISD, emergency personnel, and City of Denton Landfill and Wastewater Treatment Plant staff. This construction will replace the water and wastewater utilities that cross under Spencer Road,and is part of the larger Mayhill Road construction project. Votina Locations — During City Council discussion on February 20 regarding voting locations for the May 5 City Council election, Mayor Pro Tem Bagheri and Council Member Briggs requested that Council consider additional early voting locations on the UNT and TWU campuses. Denton County began a search to identify potential locations following that Council meeting. Unfortunately, they have not been successful in securing adequate facilities. Standards for voting locations, such as a locked secure room when voting is not in progress, suitable size to accommodate equipment and voters, length of usage (up to 8 days with varying hours), ADA accessibility, and satisfactory parking, can make finding locations difficult. The search was also constricted due to the primary election being conducted by the County and the response times from the universities regarding locations. Staff s recommendation is to look ahead to the May 2019 election for possible voting locations at UNT/TWU and begin discussions with City Council early enough in the process to determine if the consensus of the Council is to provide voting locations at the universities and to allow for adequate time to coordinate with UNT/TWU and the County. Council Rules of Procedure Pilot Program — At the December 12, 2017 City Council meeting, Council adopted Ordinance No. 2017-402 enacting a pilot program for citizen reports and comments during City Council meetings. At the City Council work session on April 3, there will be an item for discussion to see if Council wants to permanently adopt the pilot program. If affirmative direction is provided, an item will then be placed on the April 17 agenda for consideration. Staff contact: Jennifer Walters F. DISD and Police Initiative — DISD and the Police Department are collaborating on a new initiative this spring. DISD will offer uniformed law enforcement, fire, and military service personnel a free lunch at any one of their 41 school campus cafeterias. "A Hero's Helping" seeks to provide additional opportunities for students and staff to build positive relationships while providing an extra sense of security. On-duty personnel can stop by for lunch, and will be welcomed on campus at any time to provide a more visible presence. Chief Howell will join Dr. Jamie Wilson on Monday for lunch at Wilson Elementary to kick off the partnership. DISD plans to issue a press release on the program. Staff contact: Chief Lee Howell G. DEC Update — Mechanical and electrical construction of the (DEC) is approximately 97% complete. The facility has entered the "testing and commissioning" phase of the project which is scheduled to continue through spring 2018. The site is averaging 90-100 workers daily. The site "finish and cleanup"phase of the project is also scheduled to be completed during late spring 2018.Expenditures to date are approximately 78.1%of the allocated project funds. The ERCOT(Electric Reliability Council of Texas)controlled target date to begin performance operation testing is early spring 2018. The ERCOT controlled target date for emissions testing, which will be done during engine testing, is approximately May 2018. The target date for commercial operations remains early summer of 2018 with ERCOT approval. Major Project Accomplishments: • Enterprise Products has completed the natural gas supply spur construction. • The plant's sanitary sewer line installation has been completed and is currently being tested. • The DME Plant staff has permanently occupied the office section of the DEC. • The transformers used to connect the DEC to the ERCOT grid have been energized. Staff contact: George Morrow H. Carl Young Splash Park— Staff is working to plan an opening event for the Carl Young Splash Park. The tentative date is set for Saturday, May 12; this would be the first day the splash park would be operational for the season as well. Cemetery Monuments and Fencing Update—Phase II of the monument repairs at the cemeteries is now complete. In February, 35 monument repairs were completed at Oakwood Cemetery and 147 were completed at IOOF Cemetery this month. The project was completed within the estimated date of April 1, 2018. Fencing work continues at both cemetery sites. Removal of the existing fence is complete for both sites. Installation of concrete mow strips at Oakwood Cemetery is underway. Ornamental iron fence panels are 30% complete on the south side of Prairie Street. Additional work at IOOF Cemetery is awaiting location transition of work crews from Oakwood to IOOF. Arched entry structural support piers have been poured at Oakwood and IOOF and certified by D&S Engineering. Pouring of the 14 foot concrete structural supports and erection of the ornamental entry are pending. The projected completion date is June 1, 2018. Fourteen weather days have been noted by the contractor since the work began however no request has been made for an extension on time. Staff contact: Laura Behrens J. Tree Planting on University Drive — Phase I of the tree planting and irrigation project on University Drive is now complete (see images below). The contractor is currently doing some minor debris clean up and removal. Some of the newly planted trees are already starting to leaf out. In total, 73 trees were planted in the medians between Elm Street and Bonnie Brae Street. Staff contact: Laura Behrens 1 a r K. Employ-2-EMpower Program Update — Staff contacted the Employ-2-Empower (E2E) Program Pilot collaborative partners, Serve Denton, Monsignor King Outreach Center, Our Daily Bread, and Vision Ministries seeking follow-up information about the status of any ongoing or planned efforts to reintroduce E2E. While there was a single comment about the desire for the program if a redesign were to happen, the consensus from all other responses was that currently there is not enough capacity or interest in engaging in planning for updates to the program. At this time, staff recommends that the project be considered complete with the remaining funds returned for reallocation to other projects to assist the homeless or be returned to the general fund. The remaining balance is $14,490 FY2016-17 General Fund and $21,000 FY2017-18 General Fund. Staff contact: Sarah Kuechler/Dani Shaw L. Opportunity Zone Designation—A description of Opportunity Zones was included in last week's Friday report. By quick way of background, the recent federal tax reform bill included legislation authorizing the creation of"Opportunity Zones" with the goal of tapping a new source of investment dollars for economically disadvantaged areas by providing tax reductions to individuals and businesses who invest their capital gains for varying lengths of time in an Opportunity Zone. On Thursday, Governor Abbott submitted the state's Opportunity Zone designations to the U.S. Treasury Department. He nominated a total of 628 census tracts in 145 counties. Please see attached press release. There were 3 census tracts nominated in Denton County,with one census tract in the Denton city limits. Census tract 206.02, shown in the map below, was designated as an Opportunity Zone. Great American Cleanup—Denton's 30th annual Great American Cleanup(GAC) event will begin at 9 a.m. on Sat., March 24 with volunteers working to clean up litter at locations around the city. The event will be followed by a volunteer appreciation party from 11 a.m. to 1 p.m. at the Denton Civic Center. The Opportunity Zone program was created by the 2017 federal Tax Cuts and Jobs Act, and will encourage businesses to develop and invest in low-income communities in Texas. The submissions by Governor Abbott to the federal government will attract billions in investment and economic growth to cities across Texas. "This program will help highlight areas of Texas that are prime for business investment, and it will serve to bring more opportunities to hardworking families across the entire state," said Governor Abbott. "As we continue to recover after Harvey, these Opportunity Zone designations will also provide a much needed boost for local communities impacted by the storm. With the potential for billions in new investment, I look forward to our state continuing to flourish, bringing further growth and opportunity to the people of Texas." Each state may designate up to 25 percent of its eligible low-income census tracts as Opportunity Zones. After an extensive analysis of Texas' eligible tracts, and using a multi-step process to identify eligible areas in particular need due to chronic unemployment, lower population density, and significant economic disruptors such as natural disasters within the past two years, Texas designated 628 census tracts in 145 counties as Opportunity Zones. OVERVIEW: Mayor Watts requested information on the 2020 Census as a concluding item during the March 20 City Council meeting. The purpose of this informal staff report is to provide an overview of the information provided the Census Bureau,background on the CCC's, and next steps in the process. The Census Bureau has asked that municipalities begin creating CCC's. A CCC is a community based group that helps the federal initiative by coming up with ways to promote the Census, especially in hard to count areas. The Census Bureau's goal is to equip CCC leaders to form and manage CCC's. The Census Bureau has identified four unique phases of the process of completing the Census with the actual Census count taking place in April 2020: 1. Education Phase (Present-December 2019) During this period, key community and municipal leaders receive training, informational materials, and one-on-one meetings with the US Census Bureau partnership staff about the importance of the census and the need for local support to ensure a successful count. Also, CCC leadership develops a mission on how to bring awareness to the community. 2. Awareness Phase (January 2020-March 2020) This phase includes participation in actives that are meant to highlight the message that the 2020 Census is easy, important, and safe. 3. Motivation Phase (March 2020-April 2020) During this phase, CCC's implement activities of the work plan to guarantee that every person encounters the message of the census. 4. Census Phase (April 2020) The focus here is that every household takes ownership of the census, make a conscious decision to participate, know where to go for assistance in answering the census, and be poised and ready to answer questions on April 1, 2020. Low Response Areas The US Census Bureau have asked that the CCC's make a targeted effort in the areas of low response based on their research. Attachment 1 provides a map of the City of Denton highlighting areas of lower response in the dark blue with the highest response rate in yellow.More information on the non-response predictions can be found by visiting the Response Outreach Area Mapper (ROAM)created by the Census Bureau to assist in identifying low response areas. This tool allows the user to research specific low response areas, learn more about the demographics of that area, and create a targeted marketing strategy based on those demographics. Work Plans Creating a work plan will help inform the committee of the goals, objectives, and structure of how to operate. Components of a work plan have been provided by the Census Bureau as listed below: 1. Overview-Define goals and objectives of the CCC. Date: March 23, 2018 Report No. 2018-033 2. Committee Structure-Determine a structure including naming the committee,committee meeting frequency, and appointing subcommittees. 3. Reporting - Create subcommittee reports of activities, strategies, and best practices. 4. Thank you - Include strategies for thanking committee members, the community, and others who provided support throughout the Census campaign. 5. Final Report - Prepare a final report of the CCC to report activities and success back to the Census Bureau to guide future committees. A list of promotional activities found useful by the CCC's in the prior census are listed below: 1. Public Service Announcements 2. Advertising Campaigns 3. Promotional Materials 4. Local Media Coverage Funding The Census Bureau will have a partnership specialist in the region that will serve as the primary resource for CCC's and also act as a technical advisor to assist in identifying the activities that would be most effective in increasing Census participation. The partnership specialist will be available to provide training and assistance in starting the CCC as the City begins this process. The Census encourages CCC's to leverage local funding,free and existing communications, social media, existing events, as well as reaching out to local philanthropic organizations and businesses to gather funding for items like promotional materials, training space, etc. The Census count helps determine how over $600 billion funding from the government will be apportioned. The Census Bureau estimates that for every person that is underreported through the census the State loses approximately$1,574 per year in funding. NEXT STEPS: Recommended next steps provided by the Census Bureau are listed below: 1. Officially sanction the CCC by ordinance or resolution 2. Appoint CCC members and chair 3. Coordinate training for CCC members 4. Create committee rules and procedures 5. Develop work plan and strategies to target low response areas Staff will work on a recommendation to City Council on the composition of a CCC that is reflective of the population of our community and will assist in the goal of reaching low response areas. Date: March 23, 2018 Report No. 2018-034 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Information regarding the Department of Public Safety(DPS) office on Loop 288 BACKGROUND: On March 6, 2018, City Council inquired about the State's DPS office located at 820 N Loop 288, Denton. Concerns have been received regarding building capacity,lack of parking,and pedestrians crossing the highway due to the lack of parking on-site. The property, owned by the State of Texas, is 1.571 acres in size with an approximate building size of 7,500 square feet and 44 parking spaces. See aerial image of site below. I � , - 1 DISCUSSION: The property is not platted with the City of Denton, nor is it required to be, since it is owned by the State. The State does not have to follow local building codes,but it does have to abide by State Fire Code.Any violations issued would need to be based off the state regulations and enforcement would be done through the State Fire Marshal's office. DPS appears to be abiding by State Fire Code by managing total number of occupants inside the building (by forming wait lines outside) and maintaining the required Fire lanes in their lot. The building itself appears to be undersized as witnessed by wait lines outside. Therefore, it is hard to compare what parking regulations would be if subject to local regulations since parking minimums in the DDC are currently based upon building size. For example, if categorized as a retail or service facility, a ratio of 1 parking space per 300 sq. ft. is required, and therefore 25 parking spaces would be required for 7,500 sq ft building. Date: March 23, 2018 Report No. 2018-034 Staff has reached out to State Representative Lynn Stucky's office to request assistance. Representative Stucky began contact and discussions with the Department of Public Safety more than a year ago,including traveling to meet with the Austin DPS office twice and continued follow- up discussions. His office will continue to advocate for solutions to be included in the appropriations process in the next 2019 legislative session.Until then,they are continuing to search out interim actions to alleviate pressure from this site, including discussions to add new services to other DPS offices to distribute use in the region. CONCLUSION: City staff will continue to stay in contact with Rep. Stucky's office and offer any assistance in their discussions with DPS. ID 18-422 Consider adoption of an ordinance of the City of Denton determining the public use, need, and necessity for the acquisition of temporary construction, grading and access easement encumbering 0.089 acre, 0.959 acre, and 0.028 acre tracts; for the public use of expanding, improving, and maintaining street and drainage of Hickory Creek Road and roadway located in City and County of Denton, Texas, generally located in the 2400 Block of Hickory Creek Road and situated in the A. Venters Survey, Abstract No. 1335, City of Denton, County of Denton, Texas, all as more particularly described on Attachment "1," attached hereto and made a part hereof, (collectively the "Property Interests") authorizing the City Manager and City Attorney, or their respective designees, to acquire the Property Interests by agreement, including making all offers required by law; authorizing the use of the power of eminent domain to condemn the Property Interests if an agreement cannot be reached; and authorizing the City attorney, or his designee, to file and prosecute eminent domain proceedings to acquire the Property Interests; authorizing the expenditure of funds therefore; making findings; providing a savings clause; and providing an effective date.
