Green Tree Estates — Recently, the owner of Green Tree Estates has notified residents within the community that he would cease providing them water service from his privately-owned well on November 15, 2019. For several months, City staff have been communicating with the Green Tree Estates owner and the Public Utility Commission of Texas in an effort to ensure a sufficient notification is provided to residents prior to the cessation of services (staff considers such a notification to be similar to the 120-days required by the PUC for retail public utilities), which the property owner has not done. Staff have sent an informational letter to residents and scheduled a public meeting to hear their concerns. This is a complex issue with several regulatory components. To help provide background on the issue, staff has created a fact sheet (attached). Also attached are a letter and OUR CORE VALUES Integrity • Fiscal Responsibility • Transparency • Outstanding Customer Service public meeting notification sent to residents. North South Water Main Project Update — On October 23, the City was informed by residents and motorists traveling in the area that posted detour signage incorrectly stated Roselawn Drive was accessible from Bonnie Brae Street. As a result, motorists traveling to Roselawn Drive from Bonnie Brae Street were directed toward a dead end. The City's project manager immediately contacted and met on- site with the Contractor, and it was determined that the Contractor did not complete a planned update to message boards and signage, resulting in motorists being directed to the incorrect detour route. The City received confirmation at 5:30 p.m. on that same day that the Contractor had made all necessary corrections to the signage and detour route. The correct detour route (see attached map)is now safely accessible and has been shared on the City's website and social media platforms. Residents located off of S. Bonnie Brae at Goodson Way, and Solar Way were hand delivered update notices with correct detour information Thursday, October 24; and all residents located in the immediate area will be receiving the same project update letter by mail. Crews will continue to make necessary accommodations to ensure all residents living within the construction zones continue to maintain access to their homes at all times. Weather permitting, the street closure on Bonnie Brae Street from Roselawn Drive to Corbin Road is scheduled to reopen to thru traffic on or before Friday,November 8. In addition, the railroad bore on Bonnie Brae Street from Willowwood Street to Highland Park Road is now approximately 85 percent complete, and on-track to be reopened on or before Thursday, November 14. Day of the Dead Valet Trash and Recycling Service Plan—On Saturday October 26, 2019, the Day of the Dead Festival will take place near the downtown square. As Council may recall,the Solid Waste and Recycling department has been working to convert downtown businesses and residents to the department's new valet service model. As dumpsters in the downtown area have been replaced with refuse and recycling carts, the Streets and Traffic divisions have coordinated efforts to resurface and restripe the roadways and parking areas along Cedar, Pecan, Austin, and Mulberry Streets (picture below). While staff is excited for the public to see the positive changes made downtown, the event will require some adjustments to the department's normal valet operating plan. Typically,valet collections occur seven days per week between 7:00 a.m. and 11:00 p.m. In anticipation of increased waste volumes at surrounding businesses, Solid Waste will expand Saturday's operating hours to 5:00 a.m. Saturday to 2:00 a.m. Sunday morning. To work around crowded and closed streets, staff will be utilizing a"mini"rear load truck(pictures attached)to collect the refuse and a pick-up truck and trailer (pictures attached) to collect recycling. A rear load truck (pictures/map attached) will be staged near the Civic Center to allow for faster unloading of full carts. Staff will monitor business' service needs during the event and provide additional containers as needed. 2 Regarding waste generated as a direct result of the event, event organizers have ordered a trash and recycling dumpster and will be deploying 25 Clear Stream containers to collect attendee recyclables. The Day of the Dead Festival is a great opportunity to showcase the changes made to downtown area. Staff is looking forward to servicing our downtown customers and receiving the community's feedback. Magnolia Drainage Phase II CIP Update — As street and drainage improvements continue on the active Magnolia Drainage capital improvement project,W.Windsor Drive from just west of Hinkle Drive to Mesquite Street will be temporarily closed beginning Thursday, October 25 through Monday, November 25. This temporary closure will allow crews to safely complete waterline upgrades needed for the drainage pipe installation portion of the project, as well as street reconstruction. Due to the closure, a temporary driveway will be put in place to allow access to the City of Denton Recycling Center at North Lakes Park.Access will be maintained at all times to residents and property owners. Property owners and residents in the area are being notified of the temporary closure and current detour route in place (see attached). Message boards at each end of the project will alert motorists of the temporary closure and detour information. Denton Municipal Electric Aids Neighboring_ CitX—On October 20,the North Texas region experienced severe thunderstorms and tornadoes.Like other cities in the area, 3 the City of Garland was affected by the high-speed winds that brought down trees, powerlines, and caused wide spread power outages to the greater Dallas area. As part of the Mutual Aid Agreement between the City of Denton and Garland, on Tuesday, October 22, DME responded to Garland's municipal electric company request to help with the recovering efforts. For two days,DME crews cleared debris and repaired electrical infrastructure like transformers, poles, cross arms, and service drops. The assistance provided by DME was well received and appreciated. Stub Pole Removal — On October 18, Council Member Briggs asked how many poles would remain after DME pole replacement on Windsor and Nottingham Dr. These two ongoing construction projects allowed for DME crews to transfer the cable TV and other communication lines from old utility poles to the new ones. Once those lines were transferred, the old poles were removed or will be by DME. The stubbed poles that will be remaining due to communication and cable TV underground risers will need to be transferred by their owners, and will remain until they can be transferred. These poles will be documented and the appropriate owners will be notified. There are currently 11 poles that DME is unable to remove at this time (6 on Nottingham, 1 on Windsor, 1 on Hanover, and 3 poles on Emerson). Attached are pictures of some of the issues that DME has encountered and are currently working with the appropriate owners to try to resolve. Staff contact: Tony Puente, DME G. Animal Services Update — Each year, an inspection for the Animal Shelter, Impoundment, and Rabies Quarantine Facilities is conducted by the Texas Department of State Health Services. On October 23,the Linda McNatt Animal Care & Adoption Center completed and passed their annual inspection. A total of 46 specific areas are reviewed and graded. He has informed the City and residents that he will stop operating the well Nov. 15, 2019—eliminating the only source of water for these residents. • The number of customers (26) is just above the threshold of being a public supply by TCEQ rules (25). Additionally, the well has a public water supply identification, which is currently listed as "inactive". • The 30-day notification falls short of the requirements specified by the Texas Public Utilities Commission's (PUC) 120-day notification requirement for public water suppliers. What are the City's requirements to provide water?: • Green Tree Estates was annexed into the City of Denton in 2013. The Service Plan that was part of the annexation agreement specifies a series of steps for the Owner to receive water from the City. These steps include paying for extension of service from the nearest City Water line connection to the existing tank system for the well. The tank system would then continue to be used to distribute water to the residents. • All roads in the subdivision and the well water distribution system are privately owned,therefore, the City is unable to directly connect to residences. • As developments occurred around Green Tree Estates, connection points were established on two sides of Green Tree estates to facilitate connection by Owner. • Since annexation in 2013, the Owner has declined to connect to the City of Denton system. City of Denton efforts on behalf of the residents: • Upon learning of the intent to cease water services, an outside law firm was contacted to advise the City on options to avoid a sudden and devastating loss of water services. • The Texas Commission on Environmental Quality(TCEQ) was contacted to assess the situation. The system at Green Tree Estates is currently listed as an "inactive" Public Water Supply with the TCEQ. TCEQ staff performed a site visit on August 5, 2019, and determined that the system has 11 connections serving 26 people, which meets the definition of a public water system. However,the TCEQ stated that the Owner claimed that some connections were illegal, and the TCEQs position was that illegal connections can be disconnected without notice. The TCEQ OUR CORE VALUES Integrity•Fiscal Responsibility• Transparency• Outstanding Customer Service ADA/EOE/ADEA www.cityofdenton.com TDD(800)735-2989 7 further stated that if there is no service agreement or contract with the people receiving water, the Owner can turn off the well if he wishes. • The Owner was issued a letter(attached) by the City outlining our position (and that of outside counsel)that discontinuation of services was governed by state law. • The City then contacted the PUC to request intervention on behalf of the residents. Specifically, the City requested a proper notice period in keeping with public water suppliers. • The City has held discussions with the PUC over the course of two months, with varying levels of responsiveness from the Commission. Initially, no less than 5 calls to the PUC were not returned; however,the PUC has since re-established contact with the City and is communicating regularly. Public Utility Commission involvement: • It is debatable whether the well system meets the requirements of a retail public utility under the jurisdiction of the Public Utility Commission (PUC). Although the PUC has worked with the Owner concerning notification and related activities to cease providing service,the PUC has not intervened to require compliance with State requirements for cessation of operations (16TAC 24.249). Current status: • The City will hold a public meeting (notice attached), with the requested participation of PUC,to allow residents to ask questions. The City will reiterate that without intervention of the PUC, they will lose water service on Nov. 15, 2019. • The Owner has no responsibility to re-house any individuals left without water service after he stops operating the water well. • Residents who are in need of emergency housing assistance may be connected to local agencies in the community providing housing assistance, should the residents qualify and if funding is available. The City of Denton has been in close contact with the Texas Commission on Environmental Quality and the Public Utility Commission of Texas to ensure that the discontinuation of water supply follows all applicable rules and regulations. The area including Green Tree Estates was annexed into the City of Denton via Ordinance 2013-096. Prior to the annexation, a Service Plan for the area was completed in 2011 and adopted via Ordinance 2011-136.The Service Plan specifically addressed requirements for providing municipal water to the well storage tanks owned by Mr. Roddy.The Service Plan specifies the completion of all actions to register as an active Public Water System. This includes paying all standard costs associated with extending water service from the nearest connection point to Denton's system, and securing the needed easements for the water line extension. As developments occurred,the City of Denton installed connection points to the water distribution system to the east and south of Green Tree Estates. However, Mr. Roddy who owns the Green Tree Estates water system chose not extend water service from these connection points. As a person effected by this discontinuation of the current water service,you may have rights from the Public Utility Commission of Texas. BACKGROUD DME will begin upgrading all current city street and security lights to LED technology. DME will also be implementing a wireless control system for LED light system. The control system that will be implemented is Smart City compatible. DISCUSSION During an annual breakfast meeting, information was presented to DME staff, city management, and several Council Members regarding the upcoming LED street light project. Smart City is group or suite of applications that utilizes localized cellular networks to perform certain functions that provide civic monitoring functions. The control system that was selected to control and monitor the city's LED lights does support the integration of smart city applications. Examples of available applications are as follows: • Traffic adaptive dimming—Utilizing radar the system can dim street lights when there are no vehicles are pedestrians are present • Environmental Monitor — sensors are placed around a city and can gather and relay readings • Gun shot triangulation — sensors can detect and locate gunshots and provide this information to public safety personnel • Security Cameras • People counter and density monitor This list is not exhaustive as additional applications exist and others will be developed, similar to smart phone apps development and deployment. CONCLUSION The cost and applicability of the Smart Cities applications was beyond the scope of the LED controller evaluation. Due to the utility scale of the implementation of Smart City applications, estimated cost and functionality of applications is currently unknown to staff.
