1. Citizen Police Review Boards
a. Request for an Informal Staff Report with information about how other
cities in the area conduct citizen police review boards.
b. Staff anticipates this request to take 20 hours to develop this report. Staff
will need to research whether the City's charter requires that this board
would need to be created through meet and confer, whether staff
positions would be required to support the panel, and discuss the
operations in-depth with Dallas, Fort Worth, and other large cities.

B. Woodrow Site Clean Up — Staff is recommending clean-up of a site in the wooded
areas surrounding 300 S. Woodrow Ln. due to significant growth, excessive trash
and debris, health and safety concerns, watershed concerns, complaints from
residents and neighbors, continued public safety calls at this location and, the
assessment related to outreach services. The site is an active encampment. The
attached memo outlines the history and actions taken at the site, explains the
recommendation from an interdepartmental team,and next steps. Staff contact:Dani

C. Citizen Police Review Boards — Council Member Armintor will be presenting an
ISR request to study how other cities in the area conduct citizen police review boards
at the November 12 council meeting.While a full ISR will take more than two hours
to complete, staff wanted to briefly provide some background information to
Council regarding this request. Typically, cities form citizen police review boards
in response to an officer-involved shooting or a questionable use of force. The board
reviews both these cases and other complaints filed against the police department.
Some form of citizen police review boards are in the process of being established in
Fort Worth and revised in Dallas (in response to officer-involved shootings). When
staff conducted an initial survey of other smaller metroplex cities with comparable
populations to Denton, no such citizen police review boards were found (see table
below). Staff will proceed with an in-depth report regarding the operations of these
boards if directed to do so by during the November 12 work session presentation.

D. Drug Paraphernalia Cases —On November 7, Council Member Armintor requested
information about all drug paraphernalia cases that are in the municipal court
database for the past year.From November 1,2018 to November 1,2019,there were
391 Possession of Drug Paraphernalia cases filed with the Denton Municipal Court.
This total only indicates the number of cases within the system, and does not take

into account other Police interactions for that time period which may have included
an officer using discretion not to cite the citizen or take other action. Staff contact:

E. Dental Office Rezoning—Earlier this week, some elected officials received an email
from a business owner who was concerned that their dental office fronting on
Teasley Ln., which they are proposing to tear down and rebuild, was transitioned
from NRMU12 to R7 which does not allow medical offices. Staff is continuing to
explore options for this case. More information of what is allowed in R7 zoning can
be found in the attached Informal Staff Report No. 2019-186. Staff contact: Scott

F. Online Police Reports — On Thursday, November 7, the City of Denton Police
Department temporarily disabled the online police reporting system. This planned
outage is part of the implementation process for the new computer automated
dispatch and records management system (CAD/RMS), and, specifically, the
transition from the Lexis Nexis Coplogic on-line reporting system to a new
system. The new system will provide an entirely new system for filing, managing,
and releasing reports. Staff estimates that the on-line reporting system will be up
and running no later than February 1 st, 2020. Residents may still file reports by
calling the non-emergency number at 940-349-8181. For emergencies, residents

G. Inclement Weather Overview — As inclement weather may be approaching soon,
staff has drafted a summary of the policy decisions approved by Council last year
for 1) the use of City facilities as inclement weather stations and related
communications plan, and 2) requested use of Parks and Recreation Department
facilities after regular business hours by nonprofit agencies. The attached summary
will be used to help guide staff and address inquiries that may be received for the
use of facilities.
As a reminder, when non-profit agencies decide to extend their own nights, hours,
or services because of inclement weather, Community Development staff helps to
facilitate communication and sends out an email to all stakeholders including
nonprofits, cities, county, public safety agencies, DCTA, library, active volunteers,
etc, to inform them of the inclement weather openings that have been confirmed.
This helps to spread the word to clients,especially those that may be at City facilities
or Our Daily Bread during the day. In addition, the information is shared on social
media channels of the non-profit agencies and the City. Staff contact: Sarah

H. MKOC Transition Update — Monsignor King Outreach Center has begun the
transition to full implementation of the enhance shelter program and opening the
emergency shelter seven nights a week. It is on track to open full-time by the
expected January 15,2020 launch date. MKOC has hired Katherine Gonzales as the
shelter director. She will begin on November 18.
In the coming weeks, interviews will be held for the Assistant Director and Case
Management positions.The facility improvements necessary to support the full-time

shelter operation are also underway. Painting has been completed. A portable
building is being installed to accommodate the additional space needed for staff
including the housing-focused case management. The portable should be
operational by November 15. Electrical upgrades to the main shelter building are in
the process of being bid out to contractors and the hard-wearing durable flooring
able to withstand heavy and continuous traffic will be bid out in the next few weeks.
Storage lockers for residents' personal items will be purchased after Thanksgiving.
MKOC is now seeking grant and donation support for much needed roof repairs.
The shelter has and will continue to seek volunteers especially as cooler
temperatures are expected and inclement weather shelter will be needed In

I. Development Review Fees — The Development Services Department conducted a
cost of services analysis in summer 2019. Once the analysis was completed, cost
recovery data was shared with the City Council at their August 20th work session.
Following the work session presentation, City Council directed staff to increase
development fees to the following cost recovery levels for Fiscal Year 2019-2020:
Planning— 84%
Building—93%
Engineering— 100%
Revised development fees went into effect on October 1, 2019. While development
fees increased, the fee structure remained unchanged from prior years. Due to the
fee increases, several developers reviewed Denton's development fee schedule for
the first time and misinterpreted how to calculate development fees. Since the new
fees went into effect, City of Denton staff have met with developers one-on-one to
answer their specific questions and provided a detailed development fee overview
to the Denton Community Development Alliance on October 14. Development fee
information was also provided at the November 4 Developer Town Hall meeting.
Staff is currently restructuring the online fee schedule to help clarify how to
calculate development fees and is developing an online calculator that will provide
developers with a detailed estimate of all development and impact fees that will be
assessed for a proposed development project. Prior to submitting applications and
paying associated fees, developers are strongly encouraged to request a Pre-
Application Conference where staff can provide a detailed overview of the City of
Denton's development review process and discuss associated fees for a proposed

J. The Nook Design at Emily Fowler Library—On August 2, a summary of a proposed
project was provided in a Friday Report about a Quakertown Park project, which
the Parks and Recreation, Library, and Rotary Club (Noon) were considering. The
Rotary Club had reached out to staff about the possibility of working with the city

for a potential improvement project in the park that would also celebrate the 100th
Anniversary of the organization.
Originally,staff provided two ideas that consisted of the enhancement to the existing
outdoor stage adjacent to the Senior Center, or the development of a small
performance nook and gathering space on the south side of the Emily Fowler
Library. Rotary Club was interested in working on the library concept to provide
additional opportunities to enhance and encourage lifelong learning and reading.
This performance venue will help improve opportunities for programs, special
events, and activities to take place at the Library, Quakertown Park, as well as the
city as a whole. The project supports the city's music heritage and cultural district
development efforts. The Library Board supports the project, and PARD staff will
be providing an update to the Parks, Recreation and Beautification Board in
December. Renderings of the venue are attached.
Since the last update to City Council, Rotary Club kicked off a campaign to raise
funds to support the project. In just a few months, they had approximately $50,000
pledged for the project. The concept design and video rendering, created by PARD,
is expected to cost between $50,000-$75,000. Once finalized at the end of the
month, the construction drawings will allow for a more accurate cost estimate.
In September and October, staff worked with Development Service and the Historic
Landmark Committee to ensure the design fit within the historical architecture of
the library. A Certificate of Appropriateness was provided in October when the
committee got the design concept, which was well received.
With the completed drawings,PARD will move forward with bids,and construction
would follow. If the project can be completed by the Arts and Jazz Festival in 2020,
it will move forward immediately; if not, staff would wait until after the event to

K. Tennis Tournament—This weekend,November 9-10, The Goldfield Tennis Center
will be hosting the third annual Denton Challenger Tennis Tournament. This
tournament is a sanctioned event by the United States Tennis Association(USTA).
There are 491 players registered that are from age 10-18 years old. Participants are

L. Criteria Manuals — In an effort to continue to improve the development review
process, enhance customer service, and improve efficiency new Criteria Manuals
and updates to existing Criteria Manuals have been drafted. When drafting the
proposed new and updated Criteria Manuals staff seeks to streamline the process,
clarify what is required, and involve the diverse stakeholders as much as possible.
Because these Manuals will be maintained and updated annually, the Manuals will
be reviewed frequently to ensure they are current and maintained consistent with
process improvements.

M. Texas Arbor Dam— The City of Denton Parks and Recreation Department, in
conjunction with Keep Denton Beautiful,celebrated Denton's first Texas Arbor Day
on Saturday, November 2, by planting 71 trees at the new North Lakes Dog Park
with the help of 84 volunteers. The commemoration continued with an official
Proclamation read by Mayor Chris Watts at the November 5 City Council meeting.
Texas first observed Arbor Day in 1889, under the leadership of the Texas Forestry
Foundation. While National Arbor Day is celebrated the last Friday in April, Texas
celebrates Texas Arbor Day on the first Friday of November. The cooler

temperatures of Fall are better for planting and establishing trees, which is why

N. Denton Sustainable School's Award Winners—The City of Denton had 32 schools
register for the Denton Sustainable Schools program during FY 2018-2019. Of these
schools, 26 continued to participate in the program after enrolling. The following
schools received awards for their outstanding participation in the program:

O. Nissan Leaf Rebate — The American Public Power Association has announced an
extension of a partnership with Nissan for rebates on the purchase of a 2019 Nissan
Leaf electric vehicle. Rebates of up to $3,500 are available to customers of public
power utilities through January 2, 2020. This rebate supplements the $300 rebate
offered by DME for the purchase of new electric vehicles. Information can be found
by visiting https://www.publicpower.org//public-power-rebates-nissan-leaf.
DME recently took advantage of this rebate to introduce a Nissan Leaf to the Electric
Metering fleet as a replacement for an outgoing gasoline-powered vehicle. Use of
electric vehicles for light-duty applications can provide a reduction in total cost of
ownership through decreased fuel and maintenance costs in addition to elimination
of tailpipe emissions and reduced environmental noise. Data gathered as part of this
vehicle's operation will be used to inform decisions regarding further addition of

P. City of Denton "Fix it Clinic" — On April 14, 2020 from 6:00 to 8:00 p.m. at the
North Branch Library,the Sustainability Department will be hosting a clinic on how
to repair small electronics. This workshop includes the City's Technology Services
Department, various community members, and university students to help people
learn how to make repairs to their own small electronics. The goal of this program
is to reduce the number of electronics going into the landfill. More about this event
and others like it will be posted on the Sustainable Denton website as the events

Q. Temporary Parking Lot for School Construction — The City of Denton is working
with the Denton Independent School District on the potential use of a portion of
Avondale Park along Hanover Drive for a temporary parking lot during the Wilson
Elementary construction. The construction is expected to take up to two years. The
proposed temporary parking lot would return to open parkland after the construction
is completed.
The City and DISD are working closely to find a solution with the least amount of
negative impact to the neighborhood and park. To satisfy all internal policies and to
gather public feedback, the City and DISD are hosting several public meetings over

Staff is recommending clean-up of a site in the wooded areas surrounding 300 S. Woodrow Ln.
due to significant growth, excessive trash and debris, health and safety concerns, watershed
concerns, complaints from residents and neighbors, continued public safety calls at this location
and, the assessment related to outreach services. The site is an active encampment. The following
memo outlines the history and actions taken at the site, explains the recommendation from an
interdepartmental team, and next steps.
HISTORY
The site has been identified as an encampment of people experiencing homelessness. Please see
below a map showing the location of the site and photos (see additional photos in Attachment 1).

The Street Outreach team has visited the site at least monthly since November of 2018 to provide
social service outreach and referrals. Since August of 2019, the Street Outreach team has
encountered an increasing number of individuals during their visits. During prior visits, up to
March 2019, there were only three (3) tents and three (3) to four (4) people encountered on-site.

The number and size have grown considerably over the last six (6) months with the most recent
visit on October 18,2019 having approximately thirty-four(34)tents and twenty-five(25)or more
people on-site.
Various City departments including Police, Fire, Health Inspections and Water/Wastewater staff
have visited the site since the City was made aware of the trash and debris as well as the health
and safety concerns due to complaints from residents and neighboring properties, public safety
calls at this location, and visits to the site by Parks and Recreation staff working on the site. The
visits identified isolated areas of trash and debris with significant health and safety concerns. In
addition,the site has substantially expanded its overall footprint of trash and debris. Review of the
site and photos provide a vision of the appearance of the city property(Attachment 1).
STREET OUTREACH
By way of background, the Street Outreach Team is a cross-sector collaborative team with
representatives led by Giving Hope, Inc., Vision Ministries, and other nonprofit partners along
with Denton Police and a Denton Fire Paramedic conducting outreach to individuals living
unsheltered two (2) to four (4) times a month. Their goal is to meet homeless individuals in their
environment, provide them with information on housing, employment, and benefit resources they
may qualify to receive, and connect them to resources.
EVALUATION
The site has been evaluated by an interdepartmental team of Parks and Recreation, Community
Improvement Services, Health Inspections, Watershed, Police, Fire, Community Development,
Public Affairs, and Legal. This team collaboratively works together to address the impacts of
homelessness on City property and services and improve connections to available resources. Prior
to the City interdepartmental team evaluating this site, the Street Outreach Team visited this
location at least a dozen times and at least three(3)times within the last three(4)months to perform
Coordinated Entry assessments and get individuals connected to resources.
The recommendation of this interdepartmental team was not an easy or quick decision. It is made
understanding that it may impact some of our most vulnerable citizens. It is because of this that
the City has increasingly coordinated with the Street Outreach Team to assist those in need to find
services. However, their safety, and the safety of all citizens, is of primary concern and
responsibility. The data that has been gathered indicates that this is an increasingly unhealthy and
dangerous environment for those living on the site as well as those living/working/visiting near
the encampment. There is the likelihood of negative impacts to other areas including the
watershed,which is adjacent to this area. The intention is that the recommended clean-up process
be handled in a manner that is both transparent and respectful.
This interdepartmental team, in consultation with the Street Outreach Team,is recommending that
the site be cleaned up based upon the following considerations:
• The focus area is an active encampment:Based upon all visits,by the Street Outreach Team,
Denton Police Department,Fire/EMS,and Parks&Recreation,over a period of six(6)months,
twenty-five (25) or more individuals in thirty-four (34) tents have been located as a living or
staying at the site. As stated earlier, this has grown considerably in a short period of time as
visits from prior to March 2019,there were only three(3)tents and three (3)to four(4)people
encountered on-site.

• Outreach Assistance: The Street Outreach Team most recently visited the site three(3)times
on August 9, September 6, and October 18. They estimate that approximately thirty-four (34)
tents and twenty-five (25) or more individuals are on-site. Due to the site conditions, volume
of trash, and severe health and safety concerns,representatives with the Street Outreach Team
support cleaning the area. The Street Outreach Team has been asked to make a concentrated
effort to visit the site this month to assist individuals and to provide notice that the site will be
cleaned up soon, so individuals can get connected to other resources or plan accordingly.
• Community Improvement Services: There are multiple sites of scattered loose trash and
debris making up approximately 20-25 cubic yards in total that creates a serious public health
and safety concern(MAP IMAGE).
• Health Concerns: There is a significant accumulation of junk, litter and trash associated with
the camp, including putrescible food waste, and some evidence of bodily waste in the
immediately surrounding area. This collection of trash, debris and waste meets the criteria of
unsanitary, unhealthful, and unsafe nuisance conditions as defined under Chapter 14 of the
City of Denton Code of Ordinances.
• Watershed Concerns: Due to this area being adjacent to the stream, there are some concerns
regarding flooding and contamination into nearby waterways. Tents and materials are located
150 to 200 feet from the stream. In the event of a large storm event,the water levels could rise
quickly and cause the material next to the embankments to become buoyant and get carried
downstream into the lake. Encampment is located within the floodplain, with the southern
camp and refuse areas in the floodway,which is the stream and adjacent land threat per FEMA
must remain free of obstruction for conveyance. This is a serious public safety hazard for any
individuals that may be staying there if water levels rise quickly, especially during overnight
hours.
• Fire/EMS Department: The Denton Fire Department has responded approximately 41 times
to the area from Oct. 2018 to Oct. 2019, including 22 EMS calls related to the encampment
site. When the EMS visited the site conducted street outreach on October 18,2019,they found
significant health issues and treated multiple people.
• Police Department: The Police Department has record of responding to 142 calls including
self-initiated with 23 reports taken at 300 S Woodrow since October 2018. Approximately five
(5) of the twenty-three (23) appear to be related to calls at Monsignor King Outreach Center,
while the others were for assaults, theft, drunkenness, drug/narcotic violations,
destructive/damage/vandalism of property, or assistance to PARKS/CIS to view the area.
• Resident Complaints: Because the site was somewhat hidden from public view by the street,
trail, or park, there is not a substantial history of complaints related to this site. However, in
the last two (2) months there have been an increasing number of resident complaints received
through the Engage Denton App and the site is now visible from the Woodrow thoroughfare.
• Denton County Juvenile Justice Center: The encampment is near the Denton County
Juvenile Detention Center at 210 S Woodrow Ln. The center has contacted the City with
concerns related to the proximity of the encampment to the school program hosted at that site,
the visibility of the encampment including more trash and debris,and the increasing foot traffic
behind the county building.
• Nearby Property Owners/Service Providers: As MKOC begins the final transition to
opening seven days a week with enhanced shelter services, there will be the opportunity for
emergency shelter beds available full-time to people currently living unsheltered and to
become part of the enhanced shelter program. MKOC has expressed concerns with the
encampment near their facility and inquired to City staff numerous times, with increasing
concern as the shelter approaches transitioning to be open full-time.

• Future Site Plans: As the Parks and Recreation Department is planning for the next 10 years
and beyond for the city,a series of trails are being proposed across Denton. One proposed trail
is the Pecan Creek Linear Trail. This linear park would connect the Katy Trail with numerous
parks including Moore, Young and Woodrow. The alignment of the trail would follow the
drainage ditch and proceed through the area in which is proposed to be cleaned up. This trail
would also provide connectivity to MKOC to downtown services. Currently, no funding is
allocated for this construction, but it is being included in the proposed Parks, Recreation and
Trails System Master Plan.
Due to the significant growth, excessive trash and debris, significant health and safety concerns,
health/illness risks, potential contamination to nearby waterways, potential flood risks, continued
public safety calls, complaints from residents, and concerns expressed from nearby property
owners and service providers, the team is recommending clean-up of the site.
CLEAN-UP PROCESS
Staff plans to proceed with the following steps to clean-up the site, but beforehand, give advance
notification to individuals who may be impacted by the clean-up of the site, and hopefully,provide
a connection to resources to individuals who may benefit from such resources.
• Street Outreach Visits: The City will request that the Street Outreach team visit the site prior
to clean-up to provide referrals and a final reminder that any personal property must be
removed before the scheduled clean-up. Community Development will work with Our Daily
Bread,Monsignor King Outreach Center, and Salvation Army to have an announcement of the
clean-up location made at shelters and during meal services.
• Post Signs: On December 2,2019, Parks and Recreation staff will post signs in various visible
locations around the impacted area to notify anyone who may have an ownership interest in
items located, on or around the impacted area which is City property that said City property
will be cleaned up on a specified date and time, which will be 14 days from the date the sign
is posted(December 16, 2019); that such items will be removed from the impacted area on the
specified date/time and may be subject to disposal provided the owner of the item cannot be
reasonably identified and/or fails to remove the items by the specified date and time on the
posted sign; and lastly, that any item that is debris, unusable, hazardous or pose a health or
safety risk, or is unsanitary or in soiled condition will be discarded. The signs shall include a
City contact person and phone number where an individual can contact the City with any
questions they may have pertaining to the notice on the sign. The signs will also include
identification of a contact person(s) to connect any individuals experiencing homelessness to
social services and available resources.
• Contractor Clean-up: Parks and Recreation will have a contractor begin clean-up of the area
on or about December 16, 2019. It is unknown how many days this process may take to
complete. Inclement weather could cause delays in the clean-up of the property. The estimated
cost of contractor clean-up is $7,000-$10,000.
• After the Site is Cleaned: Signs will be posted to be consistent with other Park property and
inform visitors that camping is not allowed. Parks, CIS and PD, along with support from the
Street Outreach Team,will continue to monitor the site for future activity to connect them with
resources and inform them that camping is not permitted.

Overview of Facilities During Inclement Weather
When inclement weather conditions are reached or when other severe weather conditions take place public
facilities, service provider locations, and emergency shelters are available for those living without a
warm/cool, dry, and safe place to escape the weather extremes.
Certain City of Denton facilities are made available for public use during inclement weather under policy
500.07 Use of City Facilities for Inclement Weather. Inclement weather is defined as abnormal weather
conditions with extreme temperatures or extreme weather conditions and meets one or more of the
following conditions:
• The temperature low is expected to fall below 32 degrees,
• When the temperature high is expected to exceed 100 degrees, or
• The City has declared an emergency for weather conditions such as snow/ice, hail,severe
flooding, etc.

Inclement Weather Stations-Various City facilities are designated as inclement weather stations and are
heated and/or air-conditioned with public access to restrooms,water fountains, and sitting area.The City
facilities designated for inclement weather stations are:

Communications—When City facilities are inclement weather stations and when non-profit agencies decide
to extend their own nights, hours, or services because of inclement weather,the City helps to facilitate
communication and sends out an email to all stakeholders including nonprofits, cities,county, public safety
agencies, DCTA, library, and active volunteers to inform them of the inclement weather openings that have
been confirmed.This helps to spread the word to clients, especially those that may be at City facilities or Our
Daily Bread during the day. In addition,the information is shared on social media channels of the non-profit
agencies and the City.

After-hour Requested Use of PARD Facilities
Inclement weather may also result in a need for the use of indoor facilities after operational hours. Parks and
Recreation Department(PARD)facilities may be used after-hours during inclement weather subject to
availability and requirements as set by policy.The use of Parks and Recreation Department(PARD)facilities
for overnight sheltering is only permitted under conditions set by of the City's Emergency Management Plan
for Shelter and Mass Care.
To request the use of a PARD facility after-hours due to inclement weather, contact the PARD Special Events
Supervisor at 940-349-8732 or 940-349-8736. PARD staff will review the general requirements, availability
criteria,and available support with the requestor and provide assistance as needed.
General Requirements- Inclement weather-related use of(PARD)facilities after-hours are subject to the
following:
• Requestor must be a local certified non-profit organization offering or delivering a service that is a
recognized need or adopted program by the City.
• A minimum of 48-hour notice is required to request the use of a PARD facility after hours due to
inclement weather. In most cases,weather forecasting will provide advanced warning of impending
weather conditions. Unforeseen weather conditions will be reviewed on a case-by-case basis.
• Use is subject to rental fees and associated requirements which include but are not limited to:
o Insurance
o Permits
o Security and minimum staffing—the level of security and staffing will be determined by the
nature of event and/or activity.
Availability-For inclement weather-related use of PARD facilities after-hours,the following conditions will
be considered:
• Weather conditions:
o Temperatures, actual or wind chill,fall below 32 degrees.
o Daytime heat index expected to meet or exceed 105 degrees or daytime air temperature
exceeds 103 degrees(National Weather Service Heat Advisory)
o Storm conditions that include hail
o Any amount of freezing rain,or when 2 to 4 inches of snow(alone or in combination with
sleet and freezing rain) is present(National Weather Service Winter Weather Advisory)
• Scheduled events and activities:
o A review of programs,activities, and special events will be performed by PARD staff to
identify and evaluate potential conflicts of the requested use with on-going and/or
scheduled events. Staff will provide direction and recommendations with the primary goal of
ensuring a safe environment for all users.
o City Policy 500.06 Use of City Facilities and Meeting Rooms Section 6.2 Priority will be used
as a guide in recommending and providing accommodations.
■ Parks Department programs and staff;
■ Community building rentals;
■ City sponsored or co-sponsored activities;
■ City Boards and Commission meetings;
■ Meetings of City staff;

■ Uses requested by agencies or officials of local, county,state, or federal
governments;
■ Not-for-profit and civic organizations; and
■ Other users with valid reservations.
Assistance and Support—City staff will assist all non-profit organizations through this process as well as
communicate information to organizations and members of our community on the services available during
inclement weather. Financial support is also available to non-profit organizations in the form of funding for
reimbursement of rental fees and personnel costs incurred for after-hour use of a PARD facility related to
inclement weather as set by policy. Funding and reimbursements are not guaranteed. Funding is contingent
on budget allocation and balance from use.All requests for reimbursement are reviewed by City Council and
subject to their approval. Eligibility and procedures for reimbursement include:
• Use must meet the weather conditions, availability, and general requirements of the policy.
• All fees associated with the rental, personnel, permits and any other applicable costs are due prior to
the use for inclement weather.
• A request for reimbursement of cost incurred specific to the after-hour use during inclement
weather must be made to the PARR Special Event Supervisor at the end of the use.The Special Event
Supervisor will prepare the required documentation and place the request on next available City
Council agenda for consideration.
• Upon approval, PARD staff will initiate the refund process within 7 business days of the date of
approval.

Use regulations in R7 District
BACKGROUND:
Late in the development of the 2019 Denton Development Code (DDC), a new district, R7, was
introduced to provide a mixed-density district that permitted limited small-scale commercial uses.
The intent was to bridge the gap between purely residential districts and mixed-use districts for
targeted infill areas and in transitional contexts. The R7 District would allow development scale
to increase, but in a manner harmonious with nearby neighborhoods. Permitted residential uses
(with additional use-specific standards) include single-family detached dwellings, townhomes,
duplexes, triplexes, and fourplexes. Commercial uses are more limited, with day cares permitted
by right, and banks, offices, small retail, and laundries permitted only with a Specific Use Permit
(SUP)and use-specific standards.Medical Offices such as pediatricians,dentists, and psychiatrists
are not permitted.
The Transition Table adopted with the approval of the 2019 DDC outlined which 2002 zoning
districts would convert to R7 District, focusing on those districts which most closely aligned with
the purpose of the R7 District. They included DR-1,NRMU-12, and MF-1 (MF-1 was a hold-over
from the 1969 Development Code and only affected four properties). The transition was not a
perfect match,but rather an approximation of the appropriate uses and development scale typically
found in the areas previously zoned DR-1,NRMU-12, and MF-1 Districts.
DISCUSSION:
Under the 2002 DDC, DR-1 was primarily a moderate-density residential district, while NRMU-
12 permitted a variety of residential, commercial, and institutional uses. Permitted commercial
uses in NRMU-12 District were generally limited to professional and medical offices under 10,000
square feet and neighborhood-serving retail under 5,000 square feet. The purpose was to allow for
small-scale uses which support the day-to-day functioning of neighborhoods within walking
distance from residential areas. Landscaping,buffers,and adequate parking were required in order
to reduce potential impacts and increase compatibility.
Original drafts of the 2019 DDC removed DR-1 and NRMU-12 in favor of a more inclusive MN
District which permitted a large variety of higher density residential and commercial uses.
However, as the 2019 DDC came together, it became apparent that the menu of zoning districts
needed a bridge between residential districts and mixed-use districts to ensure compatibility. R7
District was a result.
This late-inclusion of R7 has created some issues with implementation. Generally, the
implementation for residential uses in R7 District has been straightforward; however, commercial
uses, and in particular offices and medical offices, have encountered more complexity with the
new use and development regulations. The SUP requirement for offices and the prohibition of

medical offices has created nonconformities for some property and business owners. While their
businesses were permitted legally in NRMU-12, they now cannot expand their businesses or
rebuild more modern facilities without complying with the nonconforming regulations outlined in
Section 1.5 of the 2019 DDC.
In order to address this issue, staff is revisiting the transition from the 2002 DDC to 2019 DDC to
more closely align with the previous NRMU-12 regulations and determine which gaps and
inconsistencies in the R7 District can be corrected. Immediate areas of concern include
Administrative, Professional, and Government Office and Medical Office. These were uses
permitted with a limitation on size in NRMU-12,but are now permitted with an SUP or prohibited
in R7. The potential correction would include the following DDC text amendments:

The major change is to permit small-scale Medical and Professional Offices in R7 along arterials,
but larger buildings and those uses in areas interior to neighborhoods would still require an SUP.
These proposed changes will assist with current non-conforming developments and would allow
the limited development of low-impact uses in R7 District with targeted City Council oversight to
ensure compatibility with surrounding neighborhoods.
CONCLUSION:
Staff will be bringing this proposal forward to City Council in the near future to discuss the R7
correction.

BACKGROUND:
Attached is the FY 2018-2019 Denton Energy Center Dashboard for September 2019. The
dashboard is intended to give a snapshot of relevant DEC metrics. The dashboard highlights the
following:
• The Emission Chart displays the September engine runtime hours, starts, stops, monthly
and annual emissions totals and limits.
o Cold Start—Emission system is below 115°. More emissions are produced from
cold starts than warmer starts.
o Warm Start— Emission system is between 116' and 170°.
o Hot Start - Emission system is above 170°.
o Stops—Emissions are produced each time the engine is stopped.
• DEC MWh Generation and Gross Revenue for FY 2018-2019 through September 2019.
• A DEC financial summary showing FY 2017-2018 Actuals, FY 2018-2019 Budget,
Fiscal Year End Projections and the FY 2018-2019 Preliminary Actuals by Expense
Category.
o The FY 2018-2019 Preliminary Actuals show that the DEC Net Income was
$14.22 Million which is higher than the estimated $(2.44)Net Loss. This was due
to higher DEC revenues in August & September, as well as lower fuel and
operating cost.
o DEC Debt Service principal and interest payments will exceed budget by$9.1M
this year in adherence to bond requirements. The variation does not change total
debt service paid over the life of the bond, but does increase the FY 2018-19 debt
service payment.
• The Plant Monthly Run Hour Comparison Graph illustrates the monthly plant run times.
• The Key Trends section explains the footnotes in the financial section and will be used to
explain variances in revenues and expenses.
o The DEC Gross Margin was $30.3 Million which is $8.9 Million higher than
budgeted. (The Gross Margin=DEC Revenue—Fuel cost—Variable Operating
&Maintenance cost.) Gross Margin represents the component of revenue
available to pay fixed cost including debt.
As we continue to gain historical data of DEC operations we'll be better able to identify trends in
future months.

List of Candidates for DCAD Board of Directors
BACKGROUND:
The Denton Central Appraisal District(DCAD)has provided the list of candidates for their Board
of Directors (memo attached). This item will be included on the December 3, 2019 City Council
Agenda. The purpose of this informal staff report is to notify you of the process and provide the
list of candidates in advance so that you can give adequate consideration before the Council vote
on December 3, 2019.
Board members serve two-year terms, and all five board member positions are subject to the
nomination process every two years. The number of votes a taxing unit has is determined by their
proportional share of the total levy in the district from the prior tax year. There are a total of 5,000
votes throughout the district. One thousand votes are the maximum number needed to elect a local
representative/nominee to the Board of Directors. In December of 2017, the City of Denton cast
191 votes for George Pryor to serve on the DCAD Board of Directors.
The current Board of Directors is as follows:

DISCUSSION:
This year, the City has 174 votes, DISD has 671 votes and Denton County has 548 votes. On
September 10, 2019, City Council voted to nominate Rick Woolfolk. City Council may elect to
cast all Denton's votes for one candidate, or split the 174 votes among multiple candidates. The
following is a summarization of DCAD's nomination process.
Prior to October Ist-DCAD notifies taxing entities of the number of votes they are entitled to cast
for appointing board members.
Prior to October 15th-Nominations are submitted to DCAD by each jurisdiction. Each jurisdiction
can nominate up to five candidates.

Prior to October 30th - DCAD compiles a comprehensive list of the nominees and forwards to
each taxing unit in the form of a ballot.
Prior to December 15 - The taxing jurisdictions choose by written resolution the candidate (s) of
their choice. The jurisdiction then submits the name (s) and the votes cast to DCAD.
Prior to December 31 st - DCAD tabulates the votes and forwards the results back to the
jurisdictions. The five candidates that receive the most votes become the Board of Directors as of
January 1 st.

Candidates to the Denton Central Appraisal District Board of Directors are listed below. The list is in

Each voting unit must cast its vote by written resolution and submit it to the Chief Appraiser before

practicing attorney in the State of Texas since 1981. 1 was a partner with the international law firm

My name is David Johnson. I am a 25-yr resident of Flower Mound and I would like to be nominated as one of LISD's
representatives to the Denton Central Appraisal District Board of Directors. I have been fascinated by the property tax
valuation process in Texas for several years and feel this position is a good way to get more involved.
I am sending this email since I have a prior commitment on the evening of Monday September 101h and cannot attend
your Board meeting. I realize most of you know me personally, but I thought it would be important to provide my
qualifications for this position.

DANNY R. MAYER
I believe that I am a highly qualified candidate that possesses a wealth of knowledge and
experience gained from his business experience, public service experience and his life
experiences.
I am a 6`h generation NATIVE TEXAN. My first years were spent on a cotton farm in the
Panhandle of Texas before my family moved to Fort Worth when I was seven.
Eventually, our family relocated to Smithfield, TX, which is now a part of North
Richland Hills. I attended Richland High School prior to enlisting in the US Navy. I
served honorably in the Navy, spent 21 months aboard two aircraft carriers, USS Kitty
Hawk and USS Hancock, on station in the Gulf of Tonkin during the Vietnam War. The
Air Group to which he I attached flew the first air strikes into North Vietnam. My entire
enlistment was spent attached to US Navy Aviation Squadron VAW-11.
Following my discharge from the US Navy I became a Peace Officer for the State of
Texas. My criminal justice training was received at the University of Texas in Austin.
Following this I was commissioned as a Texas State Peace Officer by the Texas
Commission on Law Enforcement Standards and Education. As rewarding as being a
peace office was it did not fulfill my desires to enter the business world and so I decided
to change careers and pursue my dreams.
In 1970 I found my future when hired as a truck salesman by Hudiburg Chevrolet in
North Richland Hills. During the next 41 years I served in many capacities within the
Automotive Industry including serving as a Regional Director of Operations and District
Vice President for AutoNation USA, the nation's largest automobile retailer. I also have
been a Dealer/Operator of several dealerships. My responsibilities have included being
totally accountable for producing annual revenues in excess of$800,000,000, budgets in
excess of 700,000,000 and the responsibility of 1,500 employees at 13 locations in 4
different states.
Over the years because of my ability to be innovative and creative I have received many
awards and accolades. In addition I have been invited to make presentations to many
dealer groups as well as being invited to be a presenter at the annual National Automobile
Dealers Association convention. General Motors of Canada contracted me to assist them
in designing a Customer Satisfaction Program that was implemented in every dealership
in Canada.

wounded soldiers and marines through a national charity. I joined the Towbin Auto
Group, in Las Vegas, to take over and turnaround their two Infiniti dealerships that were
failing in all departments. Positive results were almost immediate and we posted large
increases in all departments at both dealerships. I left Towbin only after it became
apparent that each time the profits increased the expense structure of the dealerships was
adjusted accordingly. Since a large portion of my income was based on net profit I
realized that this was not the organization I had hoped it would be.

Assumed the General Manager position of a dealership that had a CSI rating in the
bottom 25% in the Dallas Zone, turnover was in excess of 150% a year. In 1993 the
dealership set a record for profit, CSI improved and was in the top 10% nationally and,
turnover dropped to less than 25%. The dealership has been the recipient of numerous
awards for sales, service, and customer satisfaction and in 1994 awarded to the
prestigious Masters award for leasing excellence and was the featured dealership at
Chrysler Corporation's annual seminar held in Palm Springs in April 1994.
Rodger Meier Cadillac, Dallas, Texas
General Sales Manager, August 1986 to January 1991
A highly respected dealership with an impeccable reputation. The dealership had been
successful in the sale of new Cadillacs since opening in 1968 but had not shown a profit
in pre-owned sales for seventeen (17) years. An aggressive marketing plan was put into
effect that focused on three elements; sales personnel, advertising and inventory. The
success of the program was very rapid and exceeded all expectations. The dealership was
one of the premier used car operations in the DFW area. When Cadillac introduced
Allante in 1987 an in-house lease program was designed, to take advantage of the
Guaranteed Resale Value Plan. This plan was advertised nationally utilizing American
Way magazine. Rodger Meier Cadillac delivered more Allantes than any other dealership
in the nation up to the time that the car was discontinued.
In 1987 Rodger Meier surpassed Sewell Cadillac in CSI and maintained that position
until my departure in 1991.

in implementing Partnership 2000.

I have been in the financial business here in Denton for over 39 years. (Arrived in June 1980)
I have served on many boards and commissions in Denton,to include the Denton Enterprise
Airport Board for over 25 years,and was the Chair for most of those years. It was a time when
massive growth was experienced at the Airport. Other Boards include Denton Meals on
Wheels/Span Board; I was chair for over 4 years. I have been a member of the Denton Rotary Club
since October 1980, and have been Secretary,Vice President and President in 1987-1988. Other
Boards include Denton Civic Ballet,St Andrews Presbyterian Organ Committee, North Texas State
Fair Commercial Exhibits Committee Chad for five years.
I was elected to the Denton Independent School Board in May 1997 and served until May 2006;
1 was Secretary,Vice President and President for two years during my tenure. 1 was a major force in
changing the way the school district financed bonds and have been credited as saving the school
district over$200 million dollars since those changes were established in 1999. 1 was also elected to
the Texas Association of School Boards and served for six years. During that time,I was the Chair of
the Lone Star Investment Pool,a Money Management Fund. It was 2 billion dollar fund that grew to
6 billion dollars under my leadership as Chair. It was the largest municipal investment pool in

America at the time. I helped move the management of the money to two different providers to
achieve better returns for the school districts.
I previously was a member of the Denton Central Appraisal District for 4 or 5 years and
instituted several improvements in management during that time. We also reviewed the safety of
the retirement plan to insure the public entities would not get a surprise assessment to keep the
plan healthy in the future. I asked for a joint meeting between the public entities of all jurisdictions
and the CDAB to hear issues the taxing entities might have.
I was also appointed by the City of Denton to be the alternate representative to the Denton
County Transportation Authority and served about 18 months.
I own property in the City of Denton and have never filed a protest,when I was a member of the
Denton Central Appraisal Board,as I did not feel my case could be considered without pressure on
the staff.
I am a member of the Civil Air Patrol,an Auxiliary of the United State Air Force. 1 have held many
positions of leadership over the last 20 years. I was the Incident Commander for CAP's response to
Hurricane Harvey,overseeing 70 aircraft from 17 different states that took over 375,500
photographs to access the damage inflicted by the storm. These photographs helped the State of
Texas and FEMA respond to the damage that had been inflicted upon Texas. I am currently the
Logistics Section Chief for the Hurricane Dorian damage in Florida and other areas. i deal with
difficult situations and help solve problems to insure proper response when CAP is called upon to
respond.

A. Review of procedures for addressing the City Council.
B. Receive Scheduled Citizen Reports from Members of the Public. This section of the agenda permits
any person who has registered in advance to make a citizen report regarding a public business item he or
she wishes to be considered by the City Council. This is limited to no more than four (4) speakers per
meeting with each speaker allowed a maximum of four (4) minutes to present their report. At the
conclusion of each report, the City Council may pose questions to the speaker or may engage in
discussion. If the City Council believes that a speaker's report requires a more detailed review, the City
Council will give the City Manager or City Staff direction to place the item on a future work session or
regular meeting agenda and advise staff as to the background materials to be desired at such meeting.
C. Additional Citizen Reports - This section of the agenda, which is also known as the "open microphone"
section, permits any person who is not registered for a citizen report to make comments about public
business items not listed on the agenda. This section is limited to two open microphone speakers per
meeting with each speaker allowed a maximum of four (4) minutes. Such person(s) must file a "Blue Card"
requesting to speak during this period,prior to the calling of this agenda item.
During open microphone reports under this section of the agenda, the Council may listen to citizens speak.
However, because notice of the subject of the open microphone report has not been provided to the public
in advance, the Texas Open Meetings Act limits any deliberation or decision by the Council to: a proposal

through a grant from the US Department of Homeland Security for the period of
