II. General Information & Status Update
A. Pending Council Requests Work Session Topics – The following item will be discussed
during the January 7 City Council work session. Each week, the topics that will be
presented during the next week’s agenda will be included in the Friday Report the prior

1. Tree Survey
• Requestor: Council Member Meltzer
• Council Member Request: Provide a report of a cursory sizing of tree coverage
on all City and Denton ISD owned parcels. Would want staff to identify any
trees or stands of trees that might be candidates for landmarking.
• Information from Staff: Staff could complete this request in 3 hours using a GIS
layer from the 2016 tree study. However, this data would be based on 2014
aerial photos so would be approximately 5 years old at this point. This survey
however did not identify the age or species of trees which are required to
determine whether a specific tree can be landmarked. In order to determine
whether trees could be landmarked on City-owned or DISD property a tree
survey would be required. For reference of cost for a survey, the 2016 Tree
Study used primarily satellite images to perform the analysis and cost
approximately $93,000. The Urban Forester could conduct a targeted approach
in survey trees that would be likely candidates for landmarking in areas with
larger trees and species. For example, staff could survey trees in the area of City
Hall which have larger, older trees and would be more likely to meet the criteria
for landmarking. We could determine multiple areas like this and determine the
approximate time to survey these areas in a future informal staff report.

2. Tree Ordinance Revisions
• Requestor: Council Member Briggs
• Council Member Request: Work Session to discuss and give staff direction to
revise the current Tree Ordinance.
• Staff Information: Council Member Briggs requested that this topic be broad so
that it can inclusive of any other input that Council would like to include in the
discussion. The current Tree Preservation and Landscape requirements is
available here, and was adopted by the City Council on March 19, 2019.

3. Ethics Ordinance Revision
• Requestor: Council Member Davis
• Council Member Request: Work session on amending Chapter 2, Article XI
(Ethics), Sec. 2-269 (Definitions), to add the words “discussions, conversations,
correspondence, or” and “polling places” to the definition of “Deliberations,”
to read as follows: “Deliberations: Discussions at the dais; voting as a member
of the board or commission; or presentations as a member of the audience
before any city board or commission; conversing or corresponding with other
city officials or staff. This term does not apply to discussions, conversations,
correspondence, or a general vote on a broad, comprehensive, or omnibus
motion, such as approval of the city budget or polling places.”

B. Rules of Procedure Revisions Update – Staff continues to make progress on the
Council-requested Rules of Procedure Revisions that were most recently discussed at
the December 3 City Council meeting. The ordinance revisions remain under staff
review. Staff plans to present the revised ordinances at the January 14 City Council
meeting followed by Council consideration on January 28. All Rules of Procedure
revisions require a presentation to City Council prior to Council consideration. Staff

C. Police Department Online Reporting System – On December 28, the Denton Record-
Chronicle published information about the Police online reporting system in the “Hugs
and Shrugs” column. Please see the attached response memo from Chief Dixon.
Technology Services is working diligently with the online reporting system vendor and
should have the jail online access online by mid-January. This was a challenging
project as staff move towards this newer technology platform. The project required
collaboration and integration with various vendors during the holidays which caused
some delays. Staff apologize for the inconvenience and appreciate patience as they
work towards getting this crucial service back online. Staff contacts: Chief Frank

D. Proposed Concrete Crushing Plant – Staff will present a work session on January 7 to
discuss the proposed concrete crushing plant to be located at 5120 East McKinney. As
you may recall, Ken Banks received a notification last week that Mutual First LLC of
Celina, Texas, recently applied for a standard air quality permit through the TCEQ
which would authorize a permanent concrete crushing plant. This property is not within
the City limits, but is in the City’s ETJ. At this time, the property can only be accessed
from University Drive through two other properties owned by CCR Equity Holdings
Four, LLC – the parent company of Blue Star Recycling. You may recall that in July
2019, the property caused some controversy because it had roofing shingles stored on
it by Blue Star Recycling. Blue Star Recycling was also responsible for “shingle
mountain” in Dallas, which is an operation that has stored and processed recycled
asphalt shingles. The TCEQ permit process requires a 30-day public comment period
after a notice is published in the local newspaper. The public notice was published in
the Denton Record-Chronicle on December 25. Therefore, the comment period will
conclude on January 24, 2020.

E. Council Requests for Information – Stuart Birdseye, Assistant to the City Manager,
will be out of the office January 6 through January 31 on paternity leave. In his absence,

Rachel Balthrop Mendoza to ensure that requests are logged and that staff follow up

F. Civic Center Parking Lot – The Civic Center parking lot repairs will begin the week of
January 6. The parking lot will remain open during the repairs, although some areas
may be inaccessible. The repairs are anticipated to take a week; bad weather could shift

G. Revamped Citizen Connection – The Citizen Connection, the City’s mini-newsletter
stuffed in utility customers’ monthly bill, has been reengineered to provide more
relevant, and timely utility and residence-based information to customers. The
newsletter will feature articles, infographics, charts and important reminders from
departments such as DME, Water, Solid Waste & Recycling, Sustainability and
Community Improvement Services. Seven out of ten residents on average rate this
newsletter as a top source of information, so ensuring that content like holiday closures,
utility changes, and community events are included in this channel guarantees that our
most important information reaches residents. See the attachment for the January 2020

H. New Library Classes and Events Flyer – Each program season, the library puts out a
classes and events booklet containing class schedules, holiday closures, and upcoming
events. The latest spring flyer, covers classes from January-April 2020 and advertises
the library’s many services, including the new ebook and digital audiobook platform,
Cloudlibrary, and the new fine-free policy for late returns. To see all the programs and

III. Upcoming Community Events and Meetings
A. Events
1. Senior Center Open House – Saturday, January 11 from 10 a.m. to 1 p.m.
at Denton Senior Center, 509 N. Bell Ave. Celebrate being 50 and older by
seeing what the Denton Senior Center has to offer. Different activities and
exercise classes will be available to sample for free during the event.
Participants receive 10 percent off all activities and classes if they register at

2. Martin Luther King, Jr. Day – Monday, January 20 from 11 a.m. to
4:30 p.m. at MLK Jr. Rec Center, 1300 Wilson St. “We Still See the

I wanted to take a moment to address the attached article in the “Hugs and Shrugs” portion
of the Denton Record Chronicle that referenced the Denton Police Department having
ongoing issues with giving the public access to police reports, and the 1975 Appeals Court
decision surrounding public records. The column states that “City officials announced a
system change nearly two months ago,” giving the impression that we are either
intentionally restricting access, or are failing to address the issue, both of which being false.
We worked with city staff and provided a public release upon the initiation of the new
systems, and have continued to provide updates, in person, to DRC staff.
It is incredibly disingenuous for the DRC to make broad statements that continue to attempt
to drive a wedge between our police department and our community. We have continuously
remained transparent and gone above and beyond to physically sit with a DRC reporter
seven days a week to manually give them information requested. We continue to update
them on the progress of the technology upgrades. Every business or public safety
organization that implements new technology, faces challenges. Implementing two major
technological projects that were desperately needed for our police department, presents a
lot of other challenges.

While our Technology Services group continues to proactively and very aggressively
attempts to solve the challenges currently presented, most notably those impacting our
Municipal Courts, internal processes, and our external portals, we remain committed to
continuing to provide the best service to our community available.
Our Technology Services under the direction of Melissa Kraft should be commended for
their availability and their dedication to providing the best customer service to get all our
public safety agencies fully functional as quickly as possible. While there is no set timeline
for completion, Director Kraft said that she will have an update in the next week.

Through a rebate program, Denton Municipal
Electric (DME), in partnership with Sustainable
Denton, rewards customers who perform
qualifying energy efficiency and conservation
improvements to their properties. All customers,
including residential (single family and
multifamily) and commercial businesses, are
eligible to receive rebates and incentives.
In addition to providing customers with
incentives, this program helps reduce energy
consumption, promotes energy conservation,
reduces customer utility bills, decreases the load
of the City’s electric system, and lessens the
emissions produced from energy consumption.

Efficiency Updates
On Feb. 15, the City of Denton will host its
6th Annual Honey Run at Clear Creek Natural
Heritage Center. All ages may sign up for
the race, but due to limited trail space, all
participants will need to register ahead of time
for this free event. Individuals and families
may run the 1-mile fun run, 5K, or 10K. On the
day of the race, check-in will be from 8-8:45
a.m., and the race will begin at 9 a.m.
After the race, the public can learn more
about how to support and protect local honey
bee populations. Samples of honey will also
be available from local beekeepers.
At 11 a.m., the Introduction to Beekeeping
Class will be taught by the Denton County
Beekeepers Association. This free workshop
will teach participants the basics of
beekeeping and inform them about which
native plants help to attract honey bees.

To adequately plan and provide for the future
of Denton, the City is moving forward with a
process to amend the current landfill permit to
allow for expansion of the Denton Municipal
Landfill. The proposed expansion increases the
permitted space by 104.64 acres and extends the
life of the landfill by approximately 60 years.
The current landfill is estimated to have
approximately 17 years of landfill life available.
While the City works diligently to maximize
diversion and effectively use landfill space,
current waste tonnage and future growth
projections indicate that the space permitted for
disposal may be depleted as early as 2036.
The land marked for the expansion is owned by
the City, and the boundaries were selected based
on property lines, floodplain considerations, an
Atmos gas line to the north of the site, and other
geographic restrictions.
As of Nov. 26, 2019, the expansion permit
application (Permit #1590-B) was deemed
technically complete, and the Texas Commission
on Environmental Quality (TCEQ) has issued a
notice requesting public comment within a
30-day period by Jan. 17, 2020. The permit
application is available for viewing and copying
at 1527 S. Mayhill Road. Upon completion of the
comment period, the permit process is expected
to be complete by March 2020.

Denton’s Dyno Dirt
In North Texas, we are lucky to enjoy a long
growing season, which provides leafy coverage
for residences. In warmer months, many of us are
accustomed to having our backyards screened
from view by trees and brush. However, in late
fall through the winter, that natural screening
is greatly diminished, revealing items that must
remain screened.
During this season, it is important to make other
provisions to screen items that are not allowed
to be in public view. Any items that are for indoor
use such as appliances and furniture should
be kept indoors or screened. Ladders, tools,
lawnmowers, wheelbarrows, etc. must be stored
out of view when not in use. Other small items
may be kept in well-maintained storage boxes,
on shelving, or neatly stored against the walls of a
carport. The use of tarps to conceal items stored
outdoors is not allowed.

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Provide information on the Denton Christian Women’s Interracial Fellowship (DCWIF) and their
contributions to the City of Denton.
BACKGROUND:
At the Oct. 8, 2019 City Council work session meeting, the pending requests work session item
included a request presented from Council Member Meltzer for a discussion to recognize the
DCWIF. City Council requested additional information on the history of the DCWIF in order to
determine what would be the best path forward to engage the public and develop options for
recognition.
Summary of the History and Work of DCWIF
The DCWIF emerged in the early 1960s in response to the challenges of strained race relations in
Denton, particularly as they related to newly integrated schools. The shared experience of
motherhood strengthened the bond among the group members and propelled them to act to
challenge stereotypes and further interracial cooperation.
The efforts of DCWIF members had a significant impact on the lives of black Denton residents.
After Denton High School was integrated and Fred Douglass/Fred Moore High School was closed
in 1963, the members helped transport black children to and from the newly integrated high school,
because the high school was far away from where most black residents lived. The members also
held tutoring sessions for black students who were struggling in the new school. These efforts led
to higher and higher enrollments of black students at Denton High School.
Additionally, the DCWIF made it a priority to increase black political participation in all levels of
government. Periodically, they would send black and white pairs of fellowship members door to
door to assist residents in registering to vote. They also volunteered to drive black residents to and
from polls to increase turnout. This commitment to increase black political participation led to
more and more black candidates running for local and state positions and increased the trust black
Dentonites had in the political system.
Fellowship members also focused on the conditions of daily life that separated black and white
Denton residents. Basic services like paved streets, sidewalks, and water or sewer systems had
been long absent in black areas of the City. Through regular door to door canvassing, exposure of
the racist practices of certain white landlords and the circulation of petitions, the DCWIF was able
to secure the improvement and enlargement of existing water and sewer systems and the paving
of all streets in predominantly black areas of the City. Through these concerted efforts, members
of the DCWIF worked to ensure that black residents received the same services as white residents.

Staff had the chance to connect with Betty Kimble, an original DCWIF member. She was excited
about the opportunity to discuss the work of the DCWIF and about the potential to work with the
City further if they wished to memorialize the DCWIF.

SUBJECT:
Provide information about the Cross Timbers upland habitat environmentally sensitive areas
(ESAs) in the Cole Ranch and Hunter Ranch master planned communities (MPCs).
EXECUTIVE SUMMARY:
Council member Armintor requested staff information about the regulations protecting trees
located at Pilot Knob and the protection granted under the Cole Ranch and Hunter Ranch MPCs.
BACKGROUND:
The Pilot Knob area is designated as a Cross Timbers upland habitat, one of the four types of
environmentally sensitive areas (ESAs) protected in Denton. The protected habitat at Pilot Knob
is presumed to cover approximately 99 acres. However, field assessments are needed for
verifying this information. Denton Development Code (DDC) Section 7.4.8 regulates the
protection and permitted activities within this area. Current regulations require the preservation
of 50% of the contiguous habitat (this includes both trees and understory vegetation) for
residential land uses. This comprises all housing arrangements within the residential use
spectrum. For all non-residential uses, the preservation is set at 30%.
The proposed Hunter Ranch and Cole Ranch master planned communities have modified some
of the regulations pertaining the protection of Pilot Knob, and any Cross Timbers upland habitats
located throughout the MPCs.
Hunter Ranch has set different preservation targets for the four areas currently identified on the
ESA map as Cross Timbers upland habitats, including Pilot Knob. These four areas, depicted as
A through D on Exhibit 1, are aligned diagonally west of the I-35W corridor. Pilot Knob is
identified as area C on the map. The cumulative preservation efforts throughout Hunter Ranch
would result in 56.9% of the Cross Timbers habitat being preserved.

In addition, parks, open space, recreational uses, trails, walkways, and bike paths have been
added as permitted activities within areas designated as Cross Timbers upland habitats.
Currently DDC Section 7.4.8 does not list recreational activities as a permitted use.
Although Cole Ranch has adopted the same language for Cross Timbers upland habitat ESAs,
based on field assessments performed in 2008, Cross Timbers upland habitat is not present in the
Cole Ranch.
