2. Municipal broadband
• Requestor: Council Member Briggs
• Council Member Request: Council Member Briggs requested a discussion
regarding municipal broadband, specifically regarding Frontier filing for
bankruptcy while areas of town are still without broadband access,what
municipal broadband is, the laws regarding it, a statement to our
representatives, and the process to hold an election.
• Staff Information: Section 12.01 of the City Charter addresses the need for a
vote from the citizens if the City were to take on a new utility.
i. Sec. 12.01. - General powers respecting utilities.
(a) The City of Denton may license, regulate, fix the rates, control
and supervise public utilities of all kinds.
(b) In addition to such public utilities as it may now own, the City
of Denton may own, acquire, construct, maintain, and operate any
other public utility that may be approved by a majority of the
qualified voters of the City voting therefor at an election held for
such purpose; and shall have power for the purpose of operating and
maintaining any such utility, and for distributing such service
throughout the city or any portion thereof,but in such condemnation
proceedings no allowance shall be made for the value of any
franchise and only the actual physical assets shall be purchased by
the City.

B. Facilities Management Project Update —The attached details updates to the status of
varying City facilities. Staff contact: Sara Hensley, City Manager's Office
C. RUzor Ranch Town Center Development Update — At the August 27, 2019 City
Council meeting, staff presented information related to the Rayzor Ranch Town Center
development. Council provided direction to bring back additional information
regarding the site plan, future tenants, and additional plans for the development once
the City Manager and City staff had time to discuss these items with the developer,
Fidelis Realty Partners. Since that time, staff met with the Fidelis representatives
multiple times to discuss plans. The developer has been working to secure additional
tenants. To date, conversations have been productive, and the developer is in
discussions with a number of possible retail and restaurant tenants. In order to allow
those negotiations to continue, the developer and staff have agreed that more time is
needed to secure tenants prior to returning to Council with an updated site plan. Staff
will keep the Council apprised of any updates and expect to return to Council with a

D. Point-in-Time Count—January 23, 2020—Under the leadership of the United Way of
Denton County (UWDC), the 2020 Point-In-Time Count was held Thursday,
January 23. Volunteer teams started the day as early as 4:30 a.m. and throughout the
day teams did outreach across the county gathering vital information from people

experiencing homelessness. The last volunteer teams wrapped around 8 p.m. Thursday
night. UWDC staff and interns along with and all the community volunteers are to be
commended for their hard work organizing and preparing for the count, as well as the
dedication and commitment to making everyone count on Thursday! Everyone worked
very hard and came together to make the count a success including the largest volunteer
turn out and highest level of financial donations to support the count.
Our community Partner and Point-In-Time Count lead agency, the Texas Homeless
Network (THN), will review the data, account for any duplicates, and certify the data
for final reporting to the community. The final numbers and data report will be
published in the coming months.
Initial data:
• 92 total volunteers (112 registered)
• 17 cities/towns were canvassed by volunteers in Denton County
• There were 5 hubs where volunteers checked in to get their supplies depending
on their survey location: Denton (UWDC), Lewisville (Next Steps Center),
Sanger(Library), Argyle (Cross Timbers Church) and Pilot Point (Library)
• Collaboration occurred with multiple libraries and police departments in the
planning process
• Denton PD dedicated 10 plain clothes officers during the morning
• Lewisville PD dedicated 1 officer

E. Polling Locations for May 2, 2020 General & Special Elections — At the January 14
Work Session, staff presented information on proposed early voting/election day
polling locations for the upcoming May 2 General and Special Elections. The
information provided a comparison of locations used for elections held during 2018-
2019. City Council consensus was to continue using locations that would keep
continuity with those used in previous years. Denton Independent School locations
have been confirmed, with L.A. Elementary School being available in District 4. Staff
was initially informed by Robson Ranch that their location would not be available for
election day (May 2). On January 22, Robson Ranch reported they are looking at an
alternative location within their facility to use as an election day location, and also
advised their facility would not be available for early voting on April 24 (along with
the reported day of April 25). Staff will report back on their final determination. The
attached provides the breakdown of the locations to be used with the understanding that
once all joint-election participants are determined,precinct assignments to election day
locations will be finalized by Denton County Elections Department. Staff contact:Rosa

F. Library Staff Development Day— Each year Denton Public Library conducts all-staff
training in February. The 2020 Library Staff Development Day will be Friday,
February 7. Employees from all three locations will learn new skills and share best
practices. Library staff development day is an invaluable tool for creating a cohesive
vision for library service, and this will be the 25th year we have coordinated the training
event for staff. This practice is in part responsible for the exemplary service for which
Denton Public Library is known. This year the focus of the training will be customer

service and engagement through mindfulness, teamwork, and communication. All
library branches will be closed all day Friday, February 7. Library closings will be
posted at all locations, on our automated phone system, on our website and through
social media, and submitted to the through a press release. Materials on hold will be
extended during times of closure to avoid penalizing customers. Staff contact: Jennifer

G. Comprehensive Solid Waste Management Strategy — The Request for Proposals for
obtaining professional services to prepare a Comprehensive Solid Waste Management
Strategy is scheduled to be released the week of January 27 (copy attached). A grant
application to fund this effort was submitted to the North Central Texas Council of
Governments on January 6 but was not awarded. Since grant funding was unsuccessful,
the Department of Solid Waste and Recycling will identify other funding sources to
complete the project. The project is anticipated to take approximately a year from the
time of contracting and will be completed no later than February 12, 2021. Staff

H. Pedestrian Lights at Mulberry & Carroll — On January 8, Mayor Pro Tern Hudspeth
requested staff investigate the operational status of the pedestrian lights at the
intersection of Mulberry and Carroll. Staff visited the location and corrected the issue

L Status of Improvements at Greenwood and Kayewood — On January 3, Council
Member Briggs requested information on the status of improvements to the circle
intersection at Greenwood and Kayewood (aerial photo shown below). Staff reviewed
this issue but could find no previously-taken action. Therefore, staff will prepare 2-3
alternative solutions that can be shared with the neighborhood for their review and
ultimate approval. Staff proposes to take this issue to the Traffic Safety Commission
meeting scheduled for March 2. Staff contact: Brian Jahn, Capital Projects
J. Traffic and Parking Concerns at 1712 Hickory—On January 9,Mayor Watts requested
that staff look at the on-street parking allowances and visibility for traffic exiting
1712 Hickory(aerial photo shown below). Staff reviewed the existing on-street parking
and available visibility for exiting traffic at 1712 Hickory and proposes to remove one
(1) parking space west of the driveway serving that property. No removal east of the
drive is required because Hickory is a one-way street eastbound. The markings
adjustment will be complete by the end of January, weather permitting. Staff contact:

K. Driver Feedback Signs on Speed Limit Signs—On January 14,Council Member Briggs
requested information regarding whether staff purchases and/or installs driver feedback
signs on speed limit signs. While the City does not currently have a program
specifically directed at driver feedback signs, we are developing one. Staff plans to
purchase solar powered driver feedback signs and install them as a tool to address
speeding and general traffic calming issues. In addition, we are developing a
partnership with UNT's police department to install driver feedback signs for them in

L. Medical City Denton Requested Signs — On January 16, Council Member Briggs
requested information regarding NO THRU TRAFFIC and directional signs requested
by Medical City Denton. Staff is developing a proposal to install 4-5 signs in the City
right-of-way directing traffic on Colorado and/or Mayhill. This plan should be ready
for the hospital's review in early February. Staff contact: Brian Jahn, Capital Projects
M. Traffic Signage at Oak and Avenue C — On January 17, Council Member Briggs
requested information regarding the ALL WAY STOP control at Oak and Avenue C.
Staff researched the request and believes it refers to Oak at Jagoe. This intersection as
well as the intersection of Fry and Oak are currently under construction to replace the
existing traffic signals and both are being operated as ALL WAY STOPs in the interim.
This has been the case for approximately three months. The signal contractor has
revised the estimated completion dates to February 10 for Jagoe and March 2 for Fry
due to poor weather conditions.Until that time, staff will continue to monitor the STOP
signs and ensure that they are in place and properly installed and visible. Staff contact:

N. Traffic Calming on Cornell — On January 21, Council Member Davis requested
information on traffic calming/speeding on Cornell near Amhurst. Staff will review
this location and collect speed and volume data to determine the severity and frequency
of the problem. This study will be complete by the end of February, at which time, staff
will be able to offer potential solutions. Staff contact: Brian Jahn, Capital Projects
O. Library Homebound Service Changes — Denton Public Library has provided mail
delivery homebound services since 2010. Patrons requesting homebound services
coordinate with a library staff member to request materials be mailed to their residence.
Prepaid postage return envelopes were included in the package, allowing homebound
patrons to return library items by mail. In FYI 8/19, sixteen(16)patrons participated in
the homebound program, receiving an average of 10 (ten) items each that year.

On December 12,2019,Library staff became aware of changes in the US Postal Service
postage paid return services. Library staff researched alternate shipping options and
how other libraries are dealing with the shipping changes. No other library in Texas is
currently offering mail delivery homebound service with pre-paid return envelopes.
Some mail out materials and patrons pay for the return postage while others deliver to
residential facilities as part of their outreach services.
Homebound services will change for current participants. The Denton Public Library
provides regular DPL2Go outreach visits to several residential facilities in Denton.
Homebound patrons in those facilities will be able to receive and return library
materials at those monthly visits. Homebound patrons living in private residences or
other facilities will have the option to continue having materials mailed to them with
the patron affixing appropriate postage stamps to return the item or upgrade their
account to a full-service card. Letters notifying homebound patrons about the changes
have been mailed and library staff will be following up via phone the last week in

P. Red Flags Rule and Identification Requirements — On December 13, 2019,
Councilwoman Armintor provided Customer Service a citizen inquiry regarding the
identification required to establish utility service. As a result of the inquiry, Customer
Service began a review of our current Red Flags Rule practices.
The Red Flags Rule was passed by the Federal Trade Commission in January 2008 in
furtherance of the Fair and Accurate Credit Transactions Act ("FACT Act") to help
protect consumers from identity theft. The rule applies to all financial institutions and
creditors. It sets out how those organizations must develop, implement, and administer
their Identity Theft Prevention Programs.
Program Requirements include:
1. Identify Relevant Red Flags
2. Define Procedures to Detect Red Flags
3. Act to Prevent and Mitigate Identity Theft
4. Program Maintenance and Continuing Staff Training
During the review, it was discovered that Texas Municipal League drafted the outline
of an ordinance and program which meets all Red Flags Rule requirements and
recommended its adoption by Texas cities. In April 2009, Customer Service began
following the Red Flags Rule, but did not adopt the recommended ordinance and
program guide. Customer Service will be moving to formalize these documents in the
coming weeks.
With regards to the initial inquiry regarding required identification, Customer Service
has confirmed with Legal that the recommended program should outline the Red Flags
which are relevant to Customer Service. Additionally, detection, prevention,
mitigation,and customer identity protection measures should be outlined. Each of these
requirements are met through the TML recommended guideline.
Specific operational processes, however, are maintained in departmental policy which
better enables business continuity and ability to meet changing customer

needs. Effective immediately, to detect Red Flags under the program, Customer
Service policy allows acceptance of the following forms of customer identification for
account creation:
• Social Security Number
• US Government Issued ID
• Foreign or Universal Driver's License
• Official Passport
• Matricula Consular
• Any acceptable combination of identification as outlined in the I-9 form

Q. WaterNow Project Accelerator Programpdate — Sustainability received notification
from WaterNow that our application for their Project Accelerator program was not
selected for this round of projects. We were encouraged to apply for future rounds and
keep in touch with the WaterNow Alliance. Staff contact: Katherine Barnett,

R. Careers on Wheels Update — Careers on Wheels is one of the most successful youth
outreach initiatives held by the City. It is a partnership with Denton ISD Counselors
and elementary campuses. City departments that have participated in the 2019-2020
school year are: Solid Waste & Recycling, Watershed Protection, Animal Services,
Police, Fire, Bike and Pedestrian, Libraries, and Denton Municipal Electric. This fall
Careers on Wheels has visited four campuses and reached over 1,000 students. There
are 8 scheduled visits for the spring and 2 additional campuses that will be offered
make up dates due to bad weather days this fall. Each campus visit allows City of
Denton staff an opportunity to share information about safety and social responsibility,
education and teamwork and the skills that are used daily that were learned in grade
school. This event is two hours and takes place on Fridays. Staff contact: Vanessa

S. Water Works Park Season Pass Savings — The Parks and Recreation Department is
currently offering a 2020 Friends and Family Season Pass Sale which ends Friday,
January 31.Customers may purchase up to four passes for$50 per pass;each additional
pass is $40. Passes must be purchased together; offer expires January 31. Passes may
be purchased online at www.dentonwaterworks.com, in person at any recreational
facility, or by calling the Natatorium at (940) 349-8800. A payment plan is also

T. Urban Forestry Master Plan Update — Attached is a presentation given at the public
meeting on January 9. The UFMP includes a comprehensive review of the existing
resource, forestry operations, funding,municipal code, and planning policy,along with

1. Resource Allocation Public Meeting — February 6 from 6 to 7 p.m. at the
Denton Civic Center, 321 E McKinney St. The public is invited to talk with
Parks and Recreation staff about the new resource allocation model.The policy
serves as the framework for future planning, budgeting, and pricing for
programs and facilities. This updated framework provides the department with

SCOPE OF WORK
BACKGROUND:
The City of Denton is seeking proposals from qualified solid waste consultants, individuals,
companies, and/or teams/cooperatives, to conduct necessary interviews and research for the
development of a COMPREHENSIVE SOLID WASTE MANAGEMENT STRATEGY.
Many municipalities, both locally and nationally, have created, to their detriment, a Solid Waste
Management Plan, which has tied their hands fiscally and operationally as they try to affect
diversion and solid waste management in their jurisdiction (i.e. the implementation of the
"Chinese National Sword" and the collapse of the national recycling market and its impact on
residential curbside recycling programs etc.). A Solid Waste Management Plan is very concrete in
nature and doesn't easily allow for deviation. A strategy, on the other hand, is very flexible and
open for adaptation and change when needed. It is a framework for making decisions about how
you will play the game of your business. The details on how we will affect the established
strategies will be contained in our local plan(s) and will flow from the strategy developed.
The purpose of the City of Denton's Comprehensive Solid Waste Management Strategy (the
"Solid Waste Strategy" or "Strategy') is to monitor, evaluate, and recommend local, state, and
federal solid waste and recycling characteristics, laws, paradigms, and best practices related to
managing activities and resulting efforts affecting:
• landfill disposal reduction and/or elimination, zero waste philosophies, and waste
material diversion,
• the promotion of ingenuity in reuse and recycling opportunities,
• the alignment of federal and state regulations with local solid waste reduction goals and
practices,
• the composition of residential and commercial waste streams,
• the creation of a robust construction, building, and operational environments/markets
that support solid waste reduction goals (innovation,)
• other waste management activities assigned to local government.
The Solid Waste Strategy is a forward looking document that will be used to help the City
strategize, identify, align, and set short- and long-term goals, policies, and actions to manage the
generation,diversion, and disposal of solid waste in the City of Denton, and the surrounding area,
over the next 25-30 years, improving the quality of life for Denton residents now and in the
future.

SCOPE OF WORK
This will be a holistic effort by the City of Denton to comprehensively evaluate waste generation,
manage solid waste activities, and strategically address personal, residential, commercial, and
corporate waste generation and diversion activities.
SERVICES TO BE PROVIDED:
The successful consultant shall be responsible for creating a complete Comprehensive Solid
Waste Management Strategy by completing, at a minimum, the following tasks:
Task 1—Communication (Listening and Reporting)
The Solid Waste Strategy roots itself not only in the best practices of the solid waste
industry or an understanding of what the City of Denton is currently undertaking to
manage its solid waste but, in the goals,wants,and needs of the City of Denton's residents
and commercial business customers.
To aid in the development of the Solid Waste Strategy,the successful proposer will initiate
and complete assessment in and among residents, business owners, elected officials, city
staff, and other interested communities to understand the current level of knowledge on
the solid waste environment, obtain an appreciation as to how far the City and its
residents are willing to go to undertake change in its solid waste management activities,
what we are willing to pay to implement program improvements, and determine a fiscal
tipping point, and other important knowledge related to program expansion and
improvement. Outreach events will include, but are not restricted to, individual
discussions, public meetings, focus groups, social media interaction, and other
opportunities that gather and engage groups of individuals of diverse backgrounds and
opinions.
Similarly, during the development of the Strategy, including its plan development
elements, the contractor will provide timely updates to the City (written and verbally) to
help ensure all deliverable remain within the scope and vision of the City.
Task 2— Data
Collection and evaluation of local and regional data related to the generation,
management, and ultimate disposition of solid waste materials. Data may include, but is
not limited to:
• Population growth and daily and seasonal population dynamics
• Changes in land area and land use
• Vacant and developable land

Task 3 -Policy Analysis/Trending
Assessment of successes and shortcomings of key policies and actions in each of the Solid
Waste Strategy elements and how they relate to the issues identified in Task 2. Each
assessment should include a statement as to whether the objective or policy has been
implemented, its effectiveness, and whether it should be kept unchanged, revised, or
should be removed from the strategy. The assessment should include a summary of key
accomplishments, impediments encountered, and recommendations to further
implement the Solid Waste Strategy in terms of priorities, timing, and assigned
responsibilities.
Note: This task should not be a comprehensive assessment of all goals, policies and
actions in the strategy, only those having a direct impact on one or more of the identified
major, local issues. However, all elements of the Solid Waste Strategy should be assessed.
Task 4— Environmental Impacts/Sustainability
Identification and quantification of the primary, secondary, and tertiary environmental
impacts of known and anticipated program elements to include, but not limited to,
watershed protection, air quality/GHG, energy appropriateness and conservation, land
use and open/natural space utilization/protection, transportation, etc.

Using a full cost accounting model, a cost of service for each strategy shall be developed

The successful consultant will:
• Be responsible for the professional quality and technical accuracy of all documents
and data used or produced and shall correct or revise any errors or deficiencies as
appropriate. All data, documents, calculations, and models shall become the
property of the City of Denton to be used in any manner it sees fit.
• Coordinate with staff through regular communication for the duration of the
project.
• Complete a draft Solid Waste Strategy and Phase I implementation plan, with
input from staff.
• Attend applicable Public Utility Board workshops, present the Solid Waste
Strategy to the PUB and City Council, and prepare any revisions to the draft that
may result from these meetings.
• Attend adoption Strategy Work Session and Meetings as may be held by the
Denton City Council.
• Provide a final deliverable in both reproducible electronic copy and paper copies.
BUDGET:
The City Council has identified the update to the Solid Waste Strategy as a priority and has
allocated a budget of$100,000.00 to develop the Solid Waste Strategy and associated/ancillary
documents.
SCHEDULE:
The development of the Solid Waste Strategy should be completed with all deliverables and
billings submitted to the City of Denton Department of Solid Waste and Recycling no later than
February 12, 2021.

SCOPE OF WORK
SUBMITTAL CRITERIA:
The successful firm/team will have at least 10 years' collective experience in solid waste
strategies and solutions for local and state governments. The successful firm/team's submittal
shall not exceed 25 pages (exclusive of attachments) and shall include, but not be limited to:
1. A management summary of the firm/team assembled to produce this Strategy, including
a description and resumes of the project team, including the designation of a project
manager for this endeavor, organization chart and outline/assignment of each task/duty.
2. A work plan describing the technical plan for accomplishing the anticipated work including
a detailed description of how you will perform each task, how you will address the work
described in the Request for Proposal and your proposed scheduling and timeline to
complete the project. Describe your ability to leverage current business functions.
Indicate the number of staff hours you have allocated to each task and the detailed time
frame for the whole process in completing all tasks. Describe your proposed solutions to
efficiently provide service and keep costs managed.
3. Given the project objectives, the firm should demonstrate an established competence
with respect to preparing a solid waste management strategy . Detail the firm/team's
experience providing similar services by providing a minimum of 3 references and the
name, address, email, and phone number of the responsible official of the client
organization who may be contacted. Attach a copy of the final report/deliverable for each
contact.
4. Interested parties shall include a cost proposal for the completion of the proposed scope
of work.
CRITERIA FOR SELECTION
All proposals received shall be subject to an evaluation conducted by a diverse evaluation
committee in a manner appropriate to select a firm with the purpose of entering into an
agreement to perform this project. Selection will be based on the merits of the proposal
submitted to the City of Denton. The following factors will be considered in the selection:
• Demonstrated knowledge of compiling/creating a strategy
• Demonstrated proficiency in creating a strategy/plan
• Demonstrated capability in project management and completion
• Successful completion of similar projects
• Firm's qualifications and experience
• Staff qualifications
• Plan provided by firm for services
• Firm's understanding of the project

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Timeline for the traffic signal installation at Sherman and Loop 288
BACKGROUND:
On Wednesday, January 15, Traffic Operations staff completed the installation of ALL-WAY
STOP signs at the intersection of Loop 288 and Sherman Drive(FM 428). These STOP signs were
installed with the concurrence of TxDOT as in interim safety measure while the permanent traffic
signal design and installation are completed.
On Saturday, January 18, the Denton Police Department was notified about dangerous driving
conditions at Sherman and Loop 288. The reported driving behavior included persons running
newly installed STOP signs at the intersections. Staff immediately passed the information on to
the Traffic Unit supervisor, Sergeant Bryan Cose,who began coordinating enforcement, education
and engineering into a response.
While researching the intersection, Sergeant Cose found that two crashes occurred in the
intersection on October 22, 2019 and October 23, 2019. Both of these occurred prior to the new
STOP signs being deployed and were caused by vehicles failing to yield the right of way while
turning left. The Traffic Unit began education operations on Sunday,January 19 by deploying two
electronic messaging boards to warn drivers of the new STOP signs ahead.
On January 20, DPD began enforcement operations and, to date, have issued 8 (eight) citations
and 6 (six) warnings. On January 23, a social media traffic safety post was disseminated to make
drivers aware of the new signage and the dangers of running the STOP signs.
OPTIONS:
Engineering staff will continue to work on the permanent traffic signal construction plans in
concert with a small transportation project that adds traffic lanes on Sherman at this interchange.
The estimate for the commencement of construction for this project is 5-6 months.
Staff has also investigated, however, the opportunity to install a temporary signal on wood poles
until the permanent signal is completed. This installation would take approximately 4-6 weeks and
would relieve the congestion by replacing the ALL WAY STOP signs with a traffic signal.
A third option would be to simply restripe Sherman to provide additional traffic lanes using the
existing shoulders. This work could be completed in less than 2 weeks and would also relieve the
congestion but retain the ALL WAY STOP signs at the intersection.
The last two options will require the approval of TxDOT and staff is currently in discussions with
TxDOT to determine their preferred path forward.

At this time, staff is not recommending the temporary signal due to potential conflicts with the
pending construction project. During this construction, it is likely that any temporary signal
installed would need to be removed to allow for the new improvements, and staff is concerned that
transitioning from a STOP condition to a signalized condition and back to a STOP condition would
further confuse motorists and lead to decreased safety at the interchange.
RECOMMENDATIONS:
Staff does, however, recommend that the City install additional signage including two driver
feedback signs on Sherman north and south of the interchange and additional beacons on the STOP
AHEAD signs located north and south of Loop 288 on Sherman. Staff is also investigating the
opportunity and benefit of adding pavement markings reinforcing the new STOP condition. These
changes can be made by mid-February.

A. ID 20-135 Consider adoption of an ordinance of the City of Denton authorizing the City Manager or
his designee to sign a Medical Office Building Lease and Second Amendment to Medical
Office Building Lease by and between Epic Development, Inc. and the City of Denton for
the use and occupancy of premises at 3537 South 1-35E, Denton, Texas for the City of
Denton Fire Department Station 8 for up to three years; authorizing the expenditure of
funds therefor; and providing an effective date.
B. ID 20-232 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a contract with HACH Company,
for the purchase of various items for the municipal laboratory, water production, water
reclamation, and wastewater collection departments, in accordance with Texas Local
Government Code 252.022, which provides that procurement of commodities and
services that are available from one source are exempt from competitive bidding, and if
over $50,000 shall be awarded by the governing body; and providing an effective date
(File 6898 - awarded to HACH Company, for one (1) year, with the option for two (2)
additional one (1) year extensions, in the total three (3) year not-to-exceed amount of
$300,000).
C. ID 20-233 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager, or his designee, to execute a contract with
Patterson Equipment Company, LLC, which is the authorized distributor for Subsite,
LLC, through the Buy Board Cooperative Purchasing Network Contract # 593-19, for
parts and labor cost, maintenance and spare components for the CCTV video inspection
units for the Water Utilities Department; providing for the expenditure of funds therefor;
and providing an effective date (File 7276- awarded to Patterson Equipment Company,
LLC,in the three(3)year not-to-exceed amount of$150,000).
D. ID 20-239 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager, or his designee, to execute a contract with
ITW, dba E.H. Wachs, through the Buy Board Cooperative Purchasing Network
Contract # 597-19, for the acquisition of two (2) Water Valve Maintenance Skids for the

corporation, authorizing the City Manager, or his designee, to execute a contract with
Daktronics, Inc., through the Buy Board Cooperative Purchasing Network Contract #
592-19, for the replacement of outdated scoreboards at City of Denton outdoor athletic
facilities; providing for the expenditure of funds therefor; and providing an effective date
(File 7275 -awarded to Daktronics,Inc.,in the amount of$133,726).
F. ID 20-138 Consider adoption of an ordinance of the City of Denton authorizing the City Manager or
his designee to execute a Commercial Lease Amendment Early Termination Option to the
lease agreement with Rail Yard Partners, Ltd., to include an early termination option for
the lease at 608 East Hickory Street on behalf of Keep Denton Beautiful, and to exercise
said option.
5. ITEM(S)FOR INDIVIDUAL CONSIDERATION—CONSIDERATION OF THE USE OF
EMINENT DOMAIN TO CONDEMN REAL PROPERTY INTERESTS
A. ID 20-065 Consider adoption of an ordinance of the City of Denton determining the public use and
necessity for the acquisition of various (i)tracts of land for right of way, (ii) permanent
drainage easements, and (iii) temporary construction easements located along East
McKinney Street in the MEP and PRR Survey, Abstract 927, and in the Moreau Forrest
Survey, Abstract Number 417, City and County of Denton, Texas; and with the use,
purpose, and legal description of the properties being more particularly described in the
attached Exhibit "A" ("the Property Interests"); authorizing the City Manager and the City
Attorney, or their respective designees, to acquire the Property Interests by agreement if
possible, including making all offers required by law; and authorizing the City Attorney or
his designee to file eminent domain proceedings if necessary; authorizing the expenditure
of funds therefor; making findings, providing for severability; and providing an effective
date.
6. ITEMS FOR INDIVIDUAL CONSIDERATION
A. ID 20-234 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a contract with Rangeline Pipeline
Services, LLC, and Forterra Pipe & Precast, LLC, for various types of pipe for water
line construction and repair, concrete cylinder pressure pipe, standard and emergency
repair services for water reinforced concrete cylinder pipe, reinforced concrete pipe and
various drainage appurtenances such as box culverts, safety end treatments for reinforced
concrete pipe for the Water Utilities, Streets and Drainage Departments; providing for the
expenditure of funds therefor; and providing an effective date (RFP 7195 - awarded to
the lowest responsive bidder for each line item for three (3) years, with the option for two
(2) additional one (1) year extensions, for a Large Diameter Water Pipe and Repair
Services contract awarded to Rangeline Pipeline Services, LLC, in the total five (5) year
not-to-exceed amount of $7,356,716.20, and a Large Diameter Reinforced Concrete

corporation, authorizing the approval of Change Order No. 1 to the contract between the
City of Denton and Quality Excavation, LLC, for the Hinkle and Windsor Paving and
Drainage Project (Magnolia PH II); providing for the expenditure of funds therefor; and
providing an effective date (IFB 6902 - Change Order No. 1 in the not-to-exceed
amount of$518,744.21 for a total contract award aggregated to$6,746,003.21).
C. ID 20-236 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a contract with Anixter, Inc., for the
supply of Electric Utility Pad-Mounted Switchgear for the City of Denton Distribution
Center; providing for the expenditure of funds therefor; and providing an effective date
(RFP 7126- awarded to Anixter, Inc., in the four (4) year not-to-exceed amount of
$8,000,000).
D. ID 20-264 Consider adoption of an ordinance ordering an election to be held in the City of Denton,
Texas, on May 2, 2020 and, if a runoff election is required, on June 13, 2020, for the
purpose of electing Council Members to Places 5 and 6 and electing a Mayor to Place 7
of the City Council of the City of Denton, Texas; prescribing the time and manner of the
conduct of the election to be in accordance with joint election agreement and contract for
election services with the Election Administrator of Denton County; providing a
severability clause;providing an open meetings clause; and providing an effective date.
E. ID 20-265 Consider adoption of an ordinance ordering a special election to be held in the City of
Denton, Texas, on May 2, 2020 and, if a runoff election is required, on June 13, 2020, to
fill a vacancy in Districts 1 and 2 for the unexpired term ending in May, 2021 for the
purpose of electing Council Members to Districts 1 and 2 of the City Council of the City
of Denton, Texas; prescribing the time and manner of the conduct of the election to be in
accordance with joint election agreement and contract for election services with the
