Pending Council Requests Work Session Topics—Pursuant to Ordinance No. 19-2026, the following items will be discussed during the March 3 City Council work session. Each week, the topics that will be presented during the next week's agenda will be included in the Friday Report the prior week. Passing an "Engine Braking Prohibited" ordinance a. Requestor: Council Member Armintor b. Council Member Request: Council Member Armintor requested a work session to discuss drafting and passing an"Engine Braking Prohibited" ordinance pursuant to various residents' concerns pertaining to highway noise. c. Staff Information: On June 6, 2017, Council discussed an ordinance prohibiting the use of Engine Compression Brakes within the City of Denton. This type of braking, used by drivers of semi-truck tractors, utilizes the truck's diesel engine to provide additional braking power. It creates a distinctive sound at a considerable volume. Because of the amount of noise generated, the use of engine brakes is prohibited in a number of communities. During the last Council discussion, there was some concern for being able to enforce the ordinance. The violation must be detected by a police officer who can readily determine that the violation was committed by a specific truck. On crowded or congested roadways, such as the 1-35 corridor, this may prove to be problematic given the high volume of semi-truck traffic. Consensus of Council at the time was to move forward with the ordinance for future discussion; however, it did not come back forward for a discussion. d. Date Requested: March 3, 2020 e. Requested Format for Response: Work Session 2. Producing a City of Denton-specific public health study a. Requestor: Council Member Briggs Council Member Request: Council Member Briggs requested a discussion to potentially direct staff to produce a Citywide health study containing City of Denton-specific data and results only. There is data at the County and State levels, but there is less information specific to the city's residents. We need this information to make evidence-based policy decisions and to establish a baseline before we experience the rapid growth that is predicted for our area. Nine focus areas and examples of issues are proposed and included in the agenda item's backup. b. Staff Information: The Denton County Public Health Department collects data and prepares a County Health Assessment once every 3 years, the most recent of which was disseminated in 2017 (Exhibit 3 - link). As they begin planning for the coming assessment, they will be inviting the City to participate in key stakeholder interviews, the local public health system assessment (which would consist 1-2 public meetings), and the Health Summit. The County anticipates these activities will begin this fall. They will also be looking to integrate as much local and primary data as possible and the City can help contribute to this effort. c. Date Requested: February 28, 2020 d. Requested Format for Response: Work session and potential supplemental budget request for FY21 consideration 2 B. COVID-19 Update — The attached press release was disseminated to the public on March 13 as the City's response and announcement. Staff contact: Sarah Kuechler,City Manager's Office C. Bonnie Brae Roundabout Update—Over the past few weeks there have been comments made about the status of the Bonnie Brae and Scripture Roundabout and when will the project be fully completed. The following is a summary of activities to occur over the next several weeks. At the March 17 City Council meeting there will be an item on the agenda to consider a change order with DDM Construction Corporation who is the contractor working on the roundabout project. The purpose of the change order is for the contractor to install 80+street signs, stamped concrete, sod, and the erosion control measures which will the complete and close out the project. Some of the dirt from the large earthen mound stored in McKenna Park will be utilized to complete this work. If the change order is approved, the contractor is prepared to begin work March 18 and these items will be completed by the end of April(weather permitting)meaning that all lanes of traffic will be opened. The trees and other landscaping at the roundabout will be completed in conjunction with the development of McKenna Park which is being managed and coordinated by both Engineering and the Parks and Recreation Department. Both departments are working collaboratively to complete the design of the McKenna Park improvements with internal staff resources. The project includes the planting of trees, a trail, a parking lot,renovated pavilions,and the installation of a new playground. The design set should be finalized later this summer and work should commence in the fall. Once the work at the park begins the remaining mound of dirt will be incorporated into the project the dirt that remains will be removed from the site. Gas Well Setbacks Map—As of March 5,2020,the City of Denton's online interactive GIS map has been updated to include a layer for Gas Well Drilling and Production Site Setbacks and Reverse Setbacks. These setback radii have been approximated based on aerial imagery for all active gas well sites within the City limits. This data is intended to assist residents, land owners, and developers better understand how these setbacks relate to their property. The screenshot (attached) shows where these layers can be access on the interactive map. Staff contact: Hayley Zagurski, Development Services E. Traffic Alert — US 377 will close nightly to through traffic between Roselawn Drive and Massey Street next week. Weather permitting, the Texas Department of Transportation (TxDOT) will temporarily close north and southbound US 377 to through traffic between Roselawn Drive and Massey Street nightly from 9 p.m. to 6 a.m. Monday, March 16 through Friday, March 27. Local access will be maintained during this time. The closure will allow crews to safely operate a crane to hang support beams for the new railroad bridge. A detour route for through traffic will be in place (attached). Message boards will be placed to alert drivers of the temporary closure. Drivers are reminded to be alert when traveling in the area. Changing Stations at South Lakes Park — On February 29, Council Member Briggs forwarded a request from a resident about the installation of changing stations at South Lakes Park. The changing stations were purchased and subsequently installed on March 4. Staff contact: Drew Huffman, Parks and Recreation G. Road Plate on Ryan Road — On March 9, Council Member Briggs requested information about a road plates on Ryan Road. City staff visited this site same day and spoke with the contractor. The plates belong to the contractor working on the new subdivision in the area. They will flip the plate and add a better patch to lessen the impact to traffic. There is currently a hole so that City crews can make a water tap for the residences,and once that is complete,they will be able to perform a more permanent fix. Fire Hydrant Inspection HistorX — On March 4, Mayor Pro Tem Hudspeth requested information about fire hydrant inspection history at the intersection of Wood and Hickory. The hydrant has a manufacturer date of 1979. It is currently operational and has work orders dating back to 2004. Water Distribution evaluated the hydrant in question on March 5 and determined there is some routine maintenance that needs to be completed including checking the oil level on this hydrant and replacing a couple of gaskets on the caps. This maintenance has been added to the schedule and will soon be complete. Staff contact: Becky Diviney, Water Distribution I. Ganzer Road Extension Update — On March 1, Council Member Meltzer requested a map detailing the proposed routing along the Ganzer Road Extension. Capital Projects recommended the maps included in the Denton County Thoroughfare Plan, which can be accessed at the below web site: htt2s:Hdentoncopgty.gov/Pages/Thoroughfare-Plan J. Windsor Drive Construction— On March 7, Mayor Watts forwarded a request from a resident about concerns with late night construction along Windsor Drive. The contractor neither requested nor received permission to work late from the City of Denton. When the project manager heard about the concern, all work was shut down on the project until the City could meet with the contactor on site and put a remediation plan in place to fix the lack of communication and judgment that created the situation. The Project Superintendent for the contractor worked late on his own accord without notifying either the City of Denton or his own company of his plans. All work was supposed to be shut down by 8:00 p.m. and the crew was to return the next day to complete that portion of the work. After learning about what happened, the project manager with the City of Denton insisted that the Project Superintendent be removed from this project; subsequently, the contracting company terminated the Project Superintendent.Everyone else involved in the late night activity has been appropriately disciplined. Capital Projects has also enacted a rule that if any work is to extend later than 6:30 p.m., the City is to be notified in advance and the contractor is required to notify all residents in the area as a courtesy. 4 The project is very close to completion of the first layer of pavement and opening Windsor from Mesquite to the West, which should drastically minimize the impact. Public Art Community Meeting_Updates — Two new public art installation concepts will be unveiled at a community meeting at the MLK, Jr. Rec Center on Monday, March 23 at 7:30 p.m. Note this meeting may potentially be postponed upon further notice in response to COVID-19; additional announcements may be forthcoming. The first presentation will be by local artist Dan Black, who will be recreating his "Foundations of Our History"mural on the Robertson Street bridge. This mural,a joint effort between the Public Art Committee and Keep Denton Beautiful, Inc., was previously painted on a fence along Bonnie Brae Street and celebrates women who have significantly contributed to the Denton community. The second presentation will be from Madeline Wiener. Ms. Wiener has been commissioned to design one of her famous "Bench People" sculptures that will be placed on the front lawn of the MLK, Jr. Rec Center. Ms. Wiener's"Bench People"can be found in public places all over the U.S. and the world, and are designed to engage the public and invite interaction. Sustainability partnering with UNT Public Administration Students — The Sustainability office is working with a UNT Public Administration class that is developing a survey that could be used to study residents' concerns about Sustainability and the environment. This semester the class with be developing a survey and testing in on other students. If the survey and outreach methodology designed is successful, it could be used in conjunction with Sustainability surveys community wide. Note this program may potentially be postponed upon further notice in response to COVID-19; additional announcements may be forthcoming. Staff contact: Katherine Barnett, Sustainability M. Pulte Development— On February 20, Council Member Briggs requested information about the tree requirements for the Pulte Development. This development, located off of McKinney St., follows the guidelines of the former regulations, and will be planting 570 three-inch caliper trees and contributing to the tree mitigation fund. Staff has verified that the mature trees within the development are intact and appear to be consistent with the tree preservation plan. Staff contact: Richard Cannone, Development Services N. Application for Rezoning of Crow and Sena Streets—On February 4, staff received an application to rezone four parcels 1839 and 1931 Crow Street and 1910 and 1906 Sena Street from Residential 3 (R3) to Residential 4 (R4). This item was scheduled for consideration by the Planning and Zoning Commission for March 18. The applicant also was scheduling a community meeting to be held at the civic center on Monday March 16. Staff did provide the applicant with the sign posting affidavit that include a sample sign with the address of city hall. The applicant's sign company made an error in printing the sign and used the civic center address instead. In preparing for the Planning and Zoning Commission hearing, staff raised some concerns regarding the rezoning and the applicant requested that the rezoning be postponed to a date uncertain. To avoid any further confusion, the sign was removed. If the applicant decides to 5 continue with the rezoning, a new mailed notice, newspaper notice, web notice, and sign posting will be done in accordance with the DDC as well as a notice for a neighborhood meeting. Procurement Agenda Items—To further comply with the Sec.2-29(b)(6)of the Council Rules of Procedures, which requires all questions submitted for a City Council vote to contain one subject, each procurement contract will be placed on the Council agenda under an individual caption (item number) with its own unique ordinance, beginning on the March 17 Council meeting. The Procurement Department frequently recommends awarding contracts to multiple vendors for a single solicitation,by line or section, depending on the bids or proposals received. Previously, single solicitations with multiple awarded contracts were placed on the Council agenda as one item with the awarded contracts and awarded sections noted in the Agenda Information Sheet, caption, and Ordinance. With the new process, the captions on the agenda beginning on March 24 will contain the same File number(which references one solicitation)but will have different contract award amounts and different vendors listed in the caption. To help differentiate the captions, the section or lines of the bid/proposal along with a brief description will be included in the caption. An example is included below. Previous caption format: A. P. Early Voting Location Change for May 2, 2020 General & Special Elections — As detailed earlier this week, Denton County is now finalizing use of early voting/election day voting locations. They informed City staff there is a new legislative requirement that an early voting location must be available for the full early voting period and the same hours/days as the main early voting location(Denton County Elections),with the exception of Saturday and/or Sunday voting as those two days are optional. When the general/special elections were ordered,Robson Ranch was identified as an early voting location with the caveat that they would not be available on Friday, April 24. Staff again contacted Robson Ranch who reiterated the facility was not available for the full early voting period(weekdays)of April 20-24/April 27-28.However,staff was recently notified by both Robson Ranch and Denton County that they are reviewing a new facility within Robson Ranch that could possibly serve as a voting location. Both groups are meeting on Monday. Staff will report back once Denton County provides verification the site is available for early voting. Further, City staff has confirmed the location is open for Election Day. Q. Emerald Ash Borer— City of Denton Solid Waste and Recycling Department accepts clean brush and yard waste at the City of Denton Landfill as feedstock for the Wastewater Department's Beneficial Reuse program to manufacture DynoDirt and other related products. Recently, a company providing service in Tarrant County reached out to determine if they could bring a large quantity of clean brush and yard waste to the facility to manage. While Beneficial Reuse would be able to manage the anticipated volume of the material brought for processing, the City has decided not to accept the material due to the presence of the Emerald Ashe Borer in Tarrant County. The Emerald Ash Borer (EAB) is a small beetle that is native to north-eastern Asia. This beetle was first discovered in the Detroit area in 2002. It is believed to have made it to the U.S. on wooden packing materials from China. The adult beetle is typically '/Z 7 inch long and 1/8 inch wide. While this insect is small in size, it is capable of decimating ash tree populations. The larvae bore into ash trees and feed under the bark. The feeding disrupts the tree's ability to carry nutrients and can ultimately lead to the death of the tree. The EAB was first detected in Texas in April 2016 in Harrison County. In December 2018, an Emerald Ash Borer beetle was found near Eagle Mountain Lake in Tarrant County. In February 2019, the Texas Department of Agriculture issued an emergency quarantine restricting the transportation of all species of ash trees in Tarrant County. This quarantine has since expired, but the threat from the Emerald Ash Borer is still present. Due to the continued threat to our urban,suburban and rural ash tree populations,which in Texas accounts for about 5% of all trees, the City of Denton Solid Waste and Recycling Department along with the Wastewater Department's Beneficial Reuse program have decided not to accept brush or yard waste from Tarrant County. Also, while no official quarantine remains in effect, the Texas Dept. of Agriculture still discourages the movement of any species of ash tree out of Tarrant county. Cherrywood Lane Construction— On March 11, Council Member Briggs forwarded a citizen concern regarding Cherrywood Lane. The project is a sewer replacement that has just completed construction. Wastewater Collections put asphalt in the sanitary sewer service lateral ditch lines on March 11 and they were repacking and putting millings down today in the main trunk line until the Street Department arrives to patch with asphalt. An onsite meeting with Wastewater Collections and Streets is scheduled for tomorrow to discuss the pavement repair in the ditch line and the schedule for this work. Cherrywood Lane is one of several streets in which we have sewer line construction planned. We are breaking these into smaller segments for pavement repair instead of waiting until the entire neighborhood is completed with utility construction to help elevate some of these concerns. III. Certain City of Denton facilities will be closed, Municipal Court in-person proceedings will be temporarily suspended, and all City-sponsored events and programming at all facilities are temporarily suspended. The City is closing the Denton Senior Center and Denton Natatorium, effective Saturday, March 14,until further notice. In-person Municipal Court proceedings have been suspended until Wednesday, April 1, per advisory from the Texas Office of Court Administration(OCA). All City-sponsored events and programs are also suspended through Sunday, March 22. Certain areas of Parks and Recreation facilities will also be closed through Sunday, March 22, such as gymnasiums, fitness areas, meeting rooms, and the walking track at the Denton Civic Center. Signs will be posted at these facilities. As conditions change, these periods may be extended, and additional announcements may be made. At this time, City Council, board, and commission meetings remain scheduled. BACKGROUND: On June 18, 2019, the City Council approved Ordinance 19-1160 outlining requirements for special events and implementing an improved application process. Additionally, $280,000 was allocated in the current fiscal year budget to support in-kind requests for co-sponsorship that historically were subsidized by impacted City departments. Of the budgeted amount, $250,000 was allocated to special events and $30,000 was dedicated towards inclement weather-related requests. Under the new ordinance, Parks and Recreation will provide Council with a quarterly report that includes information on the granting or denying of permit applications and status of the co- sponsorship budget. DISCUSSION: In the first quarter of FY 19-20, there have been no denials of applications.
