IL General Information & Status Update
A. Pending Council Requests Work Session Topics—Pursuant to Ordinance No. 19-2026,
the following items will be discussed during the May 19 City Council work session.
Each week, the topics that will be presented during the next week's agenda will be

1. Drafting and passing an ordinance requiring all towing companies to provide
vehicle owners of all required notifications orally and in writing following a
non-consensual tow.
• Requestor: Council Member Armintor
• Council Member Request: Request for a work session on drafting and passing
an ordinance"requiring all towing companies towing on either private or public
property to inform towees (or whatever the term is for people whose cars have
been towed, surely not "customers,"but not "victims" either unless the towing
is illegal) *orally and in writing, and before any payment is made* of federal,
state, and city towing law and reporting agencies, contact info, and statute of
limitations (or whatever the appropriate term is in this case for the reporting
period window). The oral and written statement should begin by specifying that
under city of Denton law all towing companies are required to provide you with
the following information before any payment is made so that you will know
your rights and your options. To protect both towees and towing companies,
there should be a form for people to initial and sign by hand or with an online
signature saying that they have been read this statement orally and received it
in writing(one copy should go to the company for its files as proof, and another
copy to the towee). On the receipt for payment, it should say that if you were
not given this information both orally and in writing, and if you did not sign the
form, then the tow was illegal, and they need to report it to the appropriate
reporting authority and specify their contact information and their options for
public and private tows."
• Staff Information: The City Attorney's Office produced Informal Staff Report
No. 2020-050(attached)that outlines State statute and current local ordinance
provisions regarding the requirements for tow trucks and vehicle storage
facilities upon non-consensual tows. If Council consensus is reached to pursue
the drafting of an ordinance on this topic, staff can bring forward a work session
in the upcoming weeks.

B. Green Tree Estates Extension Notification — On May 12, the Council approved an
ordinance extending the declaration of local disaster for Green Tree Estates to July 31,
2020. Within this extension, were milestone deadlines that property owners must
complete if they elect to connect to the City water system. The attached
communication has been drafted and sent to each Green Tree Estates residence and
each property owner on record with the Denton Central Appraisal District. This

communication has also been provided to neighborhood advocates. Staff contact:Ryan

C. Election Petition Conveyed to Governor Abbott — On April 30, the City Council
approved a resolution requesting the State of Texas provide additional options for
municipal elections that are in addition to the November 3, 2020 uniform election
date. The attached letter, which included the Council's resolution, has been conveyed
to both Governor Abbott and the Office of the Secretary of State for their consideration.
Staff will work with our state legislative consultants to engage and communicate with
Denton's legislative delegation on this issue. Council will be notified of any updates or

D. UWDC COVID-19 Relief Fund Update—Please see below for an update of the United
Way of Denton County's (UWDC) COVID-19 Relief Fund Eviction Prevention
program as of Wednesday, May 13 at noon. As a reminder, if funds restricted for
Denton or Lewisville residents are expended, unrestricted funds may be used to assist
Denton and Lewisville residents.
The attached flyer intends to assist with promotion of the fund and to provide more
clarification of the overall process. UWDC has connected with the Apartment
Association of Greater Dallas (AAGD) to share this information, and both
organizations agreed to participate in a webinar with area landlords and property
managers to discuss and provide information about the fund. Staff contact: Sarah

E. Weekly Unemployment Update — Staff is working to assemble, review, and analyze
unemployment and labor data each week. Staff will provide ongoing updates
throughout the COVID-19 pandemic as data is made available.

o DOL released its weekly unemployment report on Thursday, May 14.

o BLS releases area economic summaries with data regarding local area
employment/unemployment, wages, consumer price index, and more.
The current summary for the DFW area includes data through March
2020. The summary is available here.
• Texas Workforce Commission(TWC)
o TWC has created a UI Claimant Dashboard to provide updated
graphical representations of data and datasets for download. The
dashboard is available here.
o April local unemployment data will be made available on the Texas
Labor Market Information(www.texasLMI.com) system on May 22.
TWC also provides data on weekly unemployment claims filed and how the claim was
received. The chart with data as of May 15 is below.

F. Voluntary Separation Program VSP) Status Update — On April 21, the City Council
approved the criteria for the Voluntary Separation Program (VSP). The criteria for
eligibility included:
• A regular full-time employee (as defined in Policy No. 103.01), and
• Have been employed with the City, in a full-time capacity, for at least twelve
full, consecutive months as of April 22, 2020.

On April 23, employees were provided information regarding the VSP. Employees
were given until April 30 to submit their interest form to Human Resources (HR). A
total of 114 employees expressed an interest in the VSP. Employees who submitted a
VSP interest form were notified that HR received their interest form, which constituted
their"application" for the VSP. They were also informed that they would be receiving
a VSP incentive package that would include a Separation Agreement for their
consideration.
All 114 employees who submitted an interest form timely (by the April 30 deadline)
were sent a Voluntary Separation Agreement on May 4 and told that they could begin
turning in their signed, notarized original Separation Agreement documents to HR
beginning May 6, at 10:00 a.m. Notaries were made available on-site to provide notary
service to employees. As of May 14, a total of 76 employees have submitted signed,
notarized Separation Agreements to HR. Approved employees will separate on either
May 15, May 29, June 12, or June 19.
The final date for employees who submitted an interest form and received a Voluntary
Separation Agreement to turn in their signed, notarized Separation Agreement is on
June 19 at 5:00 p.m. Staff Contact: Stephanie Lang, Human Resources
G. CARES Act and Funding Opportunities Update — Staff is working with the City's
assigned Texas Department of Energy Management contact to finalize the first FEMA
reimbursement project application. As the application progresses, staff will report on
the exact expenses and amount submitted in the next few weeks. Staff is also
coordinating and finalizing applications for several first responder grants. A chart
outlining the current status of funding opportunities is attached. Staff contact: Erin

H. Business Solid Waste Service — On May 10, Council Member Briggs requested
information regarding billing and service to businesses that have been closed for
COVID-19 who have not created trash or recycling to be collected. City ordinance
requires that customers receiving utility services (such as electric and/or water) are
required to maintain solid waste services of at least once per week. As the department
is contacted by a business, Solid Waste staff works with the business to "right size"
their Solid Waste services and expenses due to impacts resulting from COVID-19. The
majority of customers that have contacted the department were able to be reduced to
the lowest levels of service offered by the department, which is a commercial cart at a
rate of$33.00 per month.
Over the past six weeks, staff has been in contact with the Main Street Association and
several individual businesses to help them reduce service and save money where

I. Pledge of Allegiance — During the closing comments of the May 12 City Council
meeting, Council Member Davis asked whether the Pledge of Allegiance could be
reinserted into the Council meeting agendas. Staff added this section to each Council
meeting that includes the 6:30 regular session, beginning with the meeting next week

J. Traffic Alert: North and Southbound US 377 Between Roselawn Drive and Massey
Street — Weather permitting, the Texas Department of Transportation (TxDOT) will
temporarily close north and southbound lanes of US 377 between Roselawn Drive and
Massey Street to through traffic overnight from 9 p.m. to 6 a.m. on Tuesday, May 19
through Friday, May 22 and Tuesday, May 26 through Saturday, May 30. The closure
will allow crews to safely continue railroad bridge demolition.
A detour route for through traffic will be in place (see map attached). Message boards
will be placed to alert drivers of the temporary closure. Drivers are reminded to be alert
when traveling in the area. For more information and future updates for TxDOT road

K. Shipping Container Storage— On May 9, Council Member Briggs forward a resident's
question to staff regarding whether shipping containers could be placed in a backyard
to be used for storage.A shipping container would be allowed for storage in a resident's
backyard if it meets the conditions listed below. The resident will also need to obtain a
building permit, have a permanent concrete foundation to set the container on, and
provide a foundation plan outlining elevations and setbacks. More information about

L. Chaparral Court —On May 13, Council Member Briggs forwarded a resident concern
about the condition of the road on Chaparral Court. Staff visited the street to assess the
condition of the surface, which was identified for reconstruction as part of the 2019
Bond Package.. Staff will temporarily patch the road within the next 7-to 10-days. This
will allow time to schedule a proper base failure repair within the next 60 days which

will provide an adequate driving surface until the reconstruction is started. Staff

M. New Virtual Programming — Registration is now open for "Rec Box Rocks," a fun
interactive recreation program in a box. Included in each box will be the instructions
and materials needed for four-weeks of activities. Starting in June, you can join Parks
and Recreation staff weekly for a virtual walk-through of each activity. The weekly
themes include Dinos Rock, Soaring Into Summer, Cool Cookie Cutters, and Nothing
but Nature. Registration is open online at dentonparks.com and is limited to 30
participants. Rec Box Rocks pickup for June will be curbside in the Civic Center
parking lot during designated times on May 25 and May 27. Staff contact: Caroline

N. Virtual Yankee Doodle Parade—Parks and Recreation is reorganizing the annual event
into an online parade video, which will premiere on Facebook July 4. Anyone who
would like to participate is asked to submit a picture or short video/animation (30
seconds or less with no music) of their version of a float. Participants are asked to have
fun and be creative. There will be awards for multiple categories, including Most
Patriotic Baby,Pet,Vehicle,Yard, and more. All entries must be submitted by June 14.

O. Summer Food Programming— The Denton Parks and Recreation Department (PARD)
will host the summer food program from MLK Jr. and Denia Recreation Centers.
PARD contracts annually with STH Project, a nonprofit organization, to operate the
service. STHP will serve breakfast and lunch with milk and fruit cups daily from the
recreation centers in a `grab and go"style. STHP will need limited access to the facility
during this time. The target date for service is June 1. This year's STHP contract will
be a consent agenda item for City Council on May 19.
PARD has been working directly with STHP and the Denton Independent School
District (DISD) to coordinate efforts and ensure food services continue through the
summer. Denton will have a total of 12 sites and two additional service points at local
mobile home communities. A clarification on the planned service sites and the
providers was submitted to the Denton Record-Chronicle after incorrect information
was provided in a recently published article. The proposed service sites in Denton are:
• PARD: MLK, Jr. Recreation Center, Denia Recreation Center
• STHP: McMath Middle School, Alexander Middle School, Calhoun Middle
School, Strickland Middle School, Evers Park Elementary, Hodge Elementary,

Dear Green Tree Estates Property Owner or Resident:
At the Tuesday, May 12, 2020 Denton City Council meeting, the declaration of local disaster was
extended by the City Council from May 22 to July 31,2020. During this time,the City of Denton
will continue to provide paid non-potable water service to the residents of Green Tree Estates three
times per week.
Council Action:
The ordinance approved by the Council states that:
1. The City of Denton will extend the declaration of disaster to July 31, 2020.
2. The City of Denton will waive the $9,204 cost of extending the nearest water line to the
Green Tree Estates boundary,provided:
a. By June 12, all Customer Service Inspections will have been requested and
completed on those properties that will connect to the City water system; and
b. By July 3, fee simple property owners of record who wish to connect to the City
water system must pay the $6,938 tap, meter, and impact fee.
3. On July 31, 2020, at 11:59 p.m., the emergency declaration and temporary water service
ceases at Green Tree Estates.
After May 5, no new customers in Green Tree Estates can establish water service with the City.
City Council directed that the head of households at Green Tree Estates should establish a water
accounts in their name by June 12, 2020. Residents may call Customer Service at(940) 349-8700
to discuss setting up their account.
Key Deadlines:
Residents and property owners should be aware of the following deadlines
June 12, 2020: Residents should call customer service at 940-349-8700 to set up water
accounts under the name of the head of the household.
June 12, 2020: Customer Service Inspections must be completed for those properties that
will connect to the City water system
July 3, 2020: Properties that will connect to the City water system must pay $6,938 tap,
meter, and impact fee
July 31, 2020: Last day for temporary water service to Green Tree Estates. Residences
must be connected to the City water system to continue to be legally
occupied.
The City stands ready to connect Green Tree Estates properties to the City water system. Property
owners interested in connecting are advised to contact City staff so that the milestones described

City staff intends to update the Council regarding Green Tree Estates on the following dates:

These discussions will be open to the public or, if City Council meetings continue to be held
virtually, streamed live. In each case, a Spanish language interpretation will be available. More
information regarding the meetings and access to the Spanish language interpretation will be

Re: Request to hold general& special elections prior to November 3, 2020
First,the City of Denton appreciates your tireless efforts over the past weeks to protect the health and safety
of the citizens of Texas. In respect to elections the City Council was unanimous in following your guidance
to postpone our municipal election to the November 3,2020 general election date. After reflection on our
goal of conducting our election in a manner that maximizes both voter safety and engagement, the City
Council has concluded that an alternate election date is necessary. This determination is not unique to the
CiV of Denton as we understand that approximately 10 other political subdivisions have made a similar
determination and request.The City of Denton's particular findings are set forth in detail in Resolution No.
20-852 included herein.
We submit this letter and Resolution and respectfully request that you exercise your constitutional and
statutory authority to issue a proclamation allowing the City of Denton to conduct the elections originally
scheduled for May 2, 2020 and postponed to November 3, 2020 to be held on September 19, 2020 or
September 26,2020. Either date will give Denton ample time to order and prepare for the election.
As I am sure you recognize the annual budget clearly reflects the legislative priorities of the city council.
The process involves active involvement by citizens and city staff as well as the city council. Once the
budget and tax rate are finalized and approved the course is set for the remainder of the fiscal year. Since
Denton's fiscal year begins October 1,the budget and tax rate must be adopted prior to that date. Members
of the city council elected at a November election will have no say or input into these critical matters.More
importantly, the voters will not be able to choose who will represent them in these matters. Calling the
election in September will give a voice to the voters and allow the newly elected officials to debate and
vote on the annual budget and tax rate which will be adopted in September. This is of particular importance
to Denton since as many as six(6)of seven(7)seats may change hands at this election.
From a public health and safety point of view, most experts agree that the Covid-19 virus will be less of a
problem in the hot summer months.Those same experts worry about a second wave of infections next fall.
For example,Dr. Anthony Fauci stated during the March 25,2020 White House press briefing that"What

we're starting to see now in the Southern Hemisphere and southern African countries is that we're having
cases appearing as they go into their winter season. If in fact they have a substantial outbreak, it will be
inevitable that we need to be prepared for the next cycle. I think it very well might [be seasonal.]" CDC
Director Robert Redfield recently stated that "[T]here's a possibility that the assault of the virus on our
nation next winter will actually be even more difficult than the one we just went through,as we're going to
have the flu epidemic and the coronavirus epidemic at the same time." The sheer number of voters in a
presidential year November election will make it very difficult to conduct the election while respecting
social distancing guidelines. Adding our city election to the November ballot will exacerbate this difficulty
and pose a greater risk to our election workers and voters.
The safer option appears to be to conduct the election in September,rather than November.
In summary,please know that we have reached this conclusion after giving considerable thought and study
to the issue and considering input from our citizens. Please allow the Denton City Council to have the
flexibility to choose conducting the election on either September 19, 2020 or September 26, 2020.
Also included is a proposed Proclamation recognizing the emergency and suspending certain sections of
the Election Code to accomplish the City's objective of holding earlier elections. I have forwarded a copy
of this request to the Elections Division at the Secretary of State's Office in the event they wish to offer
guidance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DENTON FINDING THAT A
PUBLIC EMERGENCY EXISTS AND SETTING FORTH ITS SUPPORT FOR
DETERMINING THAT THE EMERGENCY WARRANTS A SPECIAL ELECTION; FOR
PETITIONING THE GOVERNOR FOR A SPECIAL ELECTION DATE; AUTHORIZING
THE MAYOR AND CITY MANAGER TO FORWARD THE RESOLUTION TO THE
GOVERNOR OF THE STATE OF TEXAS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,beginning in December 2019, a novel coronavirus, now designated COVID-
19, spread through the world and has now been declared a global pandemic by the World Health
Organization;and
WHEREAS, on March 13, 2020, the Governor Greg Abbott (the "Governor") declared a
statewide public health emergency; and
WHEREAS, the Commissioner of the Texas Department of State Health Services, Dr.
John Hellerstedt, has determined that COVID-19 represents a public health disaster within the
meaning of Chapter 81 of the Texas Health and Safety Code; and
WHEREAS, on March 13, 2020- Mayor Chris_Watts (the "Mayor")_issued a declaration
of local disaster for public health emergency related to the COVID-19 pandemic; and
WHEREAS, on March 17, 2020, the City Council through Ordinance No. 20-721
extended the state of emergency; and
WHEREAS, pursuant to Section 418.016 of the Texas Government Code, the Governor
has the express authority to suspend the provisions of any regulatory statute prescribing the
procedures for conduct of state business or the orders or rules of a state agency if strict
compliance with the provision, orders, or rules would in any way prevent, hinder, or delay
necessary action in coping with a disaster;and
WHEREAS,pursuant to Texas Attorney General Opinion No. KP-0191, Section 418.016
of the Texas Government Code provides legislative authorization for the Governor to
temporarily suspend provisions prescribing deadlines and timing requirements for calling a
special election; and
WHEREAS, on March 18, 2020, the Governor issued a proclamation suspending
Sections 41.0052(a) and 41.0052(b) of the Texas Election Code and allowing political
subdivisions to move their general election and special elections set on May 2, 2020 to the next
uniform election date,November 3,2020,without otherwise adjusting the terms of office; and
WHEREAS, on March 19, 2020, the Governor issued Executive Order No. GA-08
relating to COVID-19 preparedness and mitigation; and

WHEREAS, on March 20, 2020, the City Council adopted Ordinance No. 20-741
postponing an ordered general election for the purpose of electing council members for Places 5
and 6 and electing a Mayor to Place 7 from Saturday, May 2, 2020 to Tuesday, November 3,
2020;and
WHEREAS, on March 20, 2020, the City Council adopted Ordinance No. 20-742
postponing an ordered special election for the purpose of electing council members to fill the
unexpired terms, ending in May 2021 for Districts 1 and 2 from Saturday, May 2, 2020 to
Tuesday,November 3,2020; and
WHEREAS, in City Ordinance No. 20-741 and No. 20-742 the City Council authorized
the City Manager to petition the Governor with other Texas municipalities, requesting an
election date prior to November 3,2020; and
WHEREAS, on March 20, 2020, the City Council amended the declaration of local
disaster for public health emergency and extended such declaration until April 30, 2020; and
WHEREAS, on March 31, 2020 the Governor issued Executive Order No. GA-14
relating to statewide continuity of essential services and activities during the COVID-19 disaster;
and extended Executive Order No. GA-08 until April 30, 2020;and
WHEREAS, upon _study and deliberation. the _City Council determined that while
postponing the election was necessary to protect public health and safety, holding the election on
the uniform election date in November is not in the best interest of the citizens of the City of
Denton;and
WHEREAS, five (5) candidates have filed for District 2 creating a very high likelihood
of the necessity for a runoff because no candidate would receive the required majority vote; and
WHERAS, the pertinent part of Section 3.04(b) of the Charter of the City of Denton
provides that "If no candidate receives a majority, or if there is a tie for any one place, the
council shall order a runoff election which shall be held not earlier than the twentieth or later
than the thirtieth day after the date the final canvass of the regular election is completed or as
otherwise required by the Election Code and all other applicable laws," which means the
runoff election would fall sometime between Thanksgiving and Christmas 2020; and
WHEREAS, in a highly partisan presidential election year national candidates and issues
will dominate advertising and media coverage;and
WHEREAS, the City Council has determined that robust debate and thoughtful
consideration of local issues are best carried out in an environment that is not dominated by
partisan party politics;and
WHEREAS, historically the expense of political advertising is inflated during a
presidential election cycle;and

WHEREAS, local candidates are forced to raise additional money for advertising while
competing with national candidates for a finite amount of funds; and
WHEREAS,the City Council has determined that candidates should have the opportunity
to advocate and be a visible presence in a local campaign regardless of funding levels; and
WHEREAS, National Institute of Allergy and Infectious Diseases Director Anthony
Fauci predicts a resurgence of COVID-19 infections in the autumn of this year; and
WHEREAS, holding a local election on a date between May 2, 2020 and November 3,
2020 will allow the City to protect the health and safety of its citizens and also promote good
local governance; and
WHEREAS, the City Council has determined that these objectives will best be met by
ordering a special election for the purpose of electing council members to Places 5 and 6,
Districts 1 and 2,and a Mayor to Place 7;and
WHEREAS, this Resolution shall serve as a petition to the Governor requesting that
pursuant to his authority under Section 418.016 of the Texas Government Code and Section
41.0011 of the Texas Election Code he determine that an emergency exists and that said
emergency warrants that an election be held on a nonuniform election date earlier than the
general election date of November d
WHEREAS, the City Council respectfully requests that such election be held on one of

DRAFT PROCLAMATION
WHEREAS, on March 13, 2020, the Governor of Texas certified that the novel coronavirus
(COVID-19) poses an imminent threat of disaster and, under the authority vested in the
Governor by Section 418.014 of the Texas Government Code, declared a state of disaster for all
counties in Texas; and
WHEREAS, the Commissioner of the Texas Department of State Health Services has
determined that, as of March 19, 2020, COVID-19 represents a public health disaster within the
meaning of Chapter 81 of the Texas Health and Safety Code; and
WHEREAS, also on March 19, 2020 and March 31, 2020, the Governor issued executive orders
in accordance with the President's Coronavirus Guidelines for America, as promulgated by
President Donald J. Trump and the Centers for Disease Control and Prevention, and mandated
certain obligations for Texans that are recommended by federal guidelines and aimed at slowing
the spread of COVID-19; and
WHEREAS, Section 41.001(a)(2) of the Texas Election Code provides that a general or special
election in this state shall be held on a uniform election date, and the next uniform election date
occurring was on May 2, 2020; and
WHEREAS, on March 18, 2020, the Governor suspended Sections 41.0052(a) and (b) of the
Texas Election Code and Section 49.103 of the Texas Water Code to the extent necessary to
allow political subdivisions that would otherwise hold elections on May 2, 2020, to move their
general and special elections for 2020 only to the next uniform election date, occurring on
November 3,2020; and
WHEREAS, the Texas Election Code defines a "general election" in Section 1.005(6) of the
Texas Election Code as "an election, other than a primary election, that regularly recurs on
faced dates" and a "special election" in Section 1.005(18) as "an election that is not a general
election or a primary election;" and
WHEREAS, as a result of the COVID-19 disaster, the City's general election ordered for May 2,
2020 for the purpose of electing a Mayor, Councilmembers at Large Places 5 and 6, the City's
special election for Councilmembers Districts 2 and 3 could not be held on the May uniform
election date as 'fixed" by the City's Charter, and therefore, can no longer can be defined as a
"general or special election;"and
WHEREAS, Section 41.0011 of the Texas Election Code provides that a special election may be
held as an emergency election before the appropriate uniform election date if a political
subdivision asks the Governor for permission to do so and the Governor determines that an
emergency exists; and
WHEREAS, the City of Denton desires to order an election as an emergency election of a Mayor

and Councilmembers at Large Places 5 and 6, the City's special election for Councilmembers
Districts 2 and 3 pursuant to Section 41.0011 of the Texas Election Code and has asked the
Governor for permission to hold such election prior to November 3, 2020; and
WHEREAS, an emergency exists under Section 41.0011 of the Texas Election Code due to the
circumstances presented by the COVID-19 disaster and because the City of Denton is not able to
wait until November 3, 2020,to hold its municipal election; and
WHEREAS, pursuant to Section 418.016 of the Texas Government Code, the Governor has the
express authority to suspend the provisions of any regulatory statute prescribing the procedures
for conduct of state business or the orders or rules of a state agency if strict compliance with the

TO MAYOR AND CITY COUNCIL
SUBJECT:
On April 19, 2020, Council Member Armintor sent in a request for a work session for the Council
to consider an ordinance to require certain notices to be provided by tow operators to individuals
whose motor vehicles have been towed from private or public property without their consent;
otherwise known as non-consensual tows. The exact request is worded as follows:
If the following is not already required by law, I would like to make a work session
proposal at the next posted City Council meeting for the city to pass a law requiring
all towing companies towing on either private or public property to inform towees
(or whatever the term is for people whose cars have been towed, surely not
"customers," but not "victims" either unless the towing is illegal) *orally and in
writing, and before any payment is made* of federal, state, and city towing law and
reporting agencies, contact info, and statute of limitations (or whatever the
appropriate term is in this case for the reporting period window). The oral and
written statement should begin by specifying that under city of Denton law all
towing companies are required to provide you with the following information
before any payment is made so that you will know your rights and your options. To
protect both towees and towing companies, there should be a form for people to
initial and sign by hand or with an online signature saying that they have been read
this statement orally and received it in writing(one copy should go to the company
for its files as proof, and another copy to the towee). On the receipt for payment, it
should say that if you were not given this information both orally and in writing,
and if you did not sign the form, then the tow was illegal and they need to report it
to the appropriate reporting authority and specify their the contact information and
their options for public and private tows.
BACKGROUND:
The operation of tow trucks and vehicle storage facilities (VSFs) is regulated by State law, and
regulations governing the majority of these issues are found at Chapter 2308 of the Texas
Occupations Code. More specifically, Subchapter J of that Chapter governs rights, notice, and
hearings.
Since the request desires to add more notification in connection with non-consensual tows, the
following are the notices that state law that tow operators are required to provide:
(1) a statement of:
(A) the person's right to submit a request within 14 days for a court hearing to
determine whether probable cause existed to remove, or install a boot on, the
vehicle;

(B) the information that a request for a hearing must contain;
(C) any filing fee for the hearing; and
(D) the person's right to request a hearing in any justice court in:
(i)the county from which the vehicle was towed; or
(ii) for booted vehicles, the county in which the parking facility is located;
(2) the name, address, and telephone number of the towing company that removed the
vehicle or the booting company that booted the vehicle;
(3)the name,address,telephone number,and county of the vehicle storage facility in which
the vehicle was placed;
(4) the name, street address including city, state, and zip code, and telephone number of
the person,parking facility owner, or law enforcement agency that authorized the removal
of the vehicle; and
(5)the name,address, and telephone number of each justice court in the county from which
the vehicle was towed or, for booted vehicles, the county in which the parking facility is
located, or the address of an Internet website maintained by the Office of Court
Administration of the Texas Judicial System that contains the name,address,and telephone
number of each justice court in that county
Any time that the State has passed regulations, preemption of municipal authority becomes a
concern. Generally speaking, in order to preempt the legislative authority of home-rule
municipalities like Denton, the Legislature's intention to preempt must appear with unmistakable
clarity.
Fortunately, in drafting the towing regulations, the Legislature anticipated and specifically
provided for local regulations at Subchapter E, provided that such local regulations do not try to
relax or undermine State standards and regulations. For example, at Section 2308.201 cities are
prohibited from regulating tow truck lighting standards or procedures relating to consent towing
(e.g., calling AAA), but it allows local authorities to require local registration of non-consent tow
operators (those who tow vehicles from private property) and their tow trucks.
Pursuant to that grant of authority, Denton passed Ordinance 2015-335, which placed additional
restrictions on non-consent tows, codified at Article V of Chapter 23 of Denton's Code. With
respect to notice, the State statute requires certain written notification previously described to the
owner/operator of a towed vehicle after a non-consent tow. Apart from the State statute, Denton's
ordinance also requires prompt notification to DPD, so that officers will know that the car was not
stolen.

DISCUSSION:
Even though both the City and the State require different notifications to take place, they are not
in conflict, because it is possible (and legally required) to obey both. With that in mind, we can
look at specific questions
1. Could a city require that a non-consent tow operator provide oral notice (or maybe written
notice in another language)in addition to State-required written notice? YES.It's possible
to do both.However,"possible"does not mean"recommended". First,having a redundant
oral requirement in our ordinance has no impact on State law, authority to tow, or state
permitting—even if they violate our ordinance, it doesn't matter or have any consequence
with respect to these issues (moreover, tow operators might try using it as an excuse at JP
court for failure to give written notice, claiming "confusion" about oral notice being
acceptable). Second, for purposes of municipal enforcement of the ordinance, it is very
difficult for the prosecution to carry the burden of proof on an issue where there is
conflicting testimony and no objective record.
2. Could a city provide that failure to provide this type of additional notice makes the tow
"illegal", and requires all fees to be refunded on the spot? NO, because the statute
provides for a hearing before a court, and such an automatic result is inconsistent
with that statutory right (and likely violates due process as well).
3. Could a city require the hearing on notice and probable cause for towing to take place in
the municipal court? NO — that's inconsistent with the statute providing for such a
hearing to take place in JP court.
4. Could a city alter the "limitations" for challenging a tow in JP court? NO, it would be
inconsistent with the statutory limitation if the city tried to lengthen, and inconsistent
with a citizen's statutory right to challenge if shortened.Impossible for both to apply.
5. Could a city require a VSF to notify an owner or operator of his or her right to challenge
the tow before money is paid, or require the owner/operator to acknowledge receipt with a
signature? Technically,yes,but such a requirement could not alter the statutory duty
to notify in writing, or the timing of statutory events that run from the written notice
under State law.In essence,it would be a redundant notice enforceable in municipal court
by fine or possible loss of city permit status for violation. It might be possible to do both,
but it could very well create a lot of unnecessary confusion for all concerned. Generally
speaking, any regulation that can be challenged as "confusing," "conflicting," or
"inconsistent" can benefit the person being regulated(in this case, the tow operator).
Be aware that the State has some very good consumer information fliers about citizens' rights that
arise out of non-consent tows, and a couple are attached.

III. RECOVERING YOUR CAR AT A VEHICLE STORAGE
FACILITY
To recover your car at a VSF you MUST:
• Provide your photo identification,
• Prove you are the owner or authorized user of the car,and
• Pay all fees for towing and storage.
Provide your photo identification.Acceptable forms of ID include:
• Any state issued driver's license or identification card
• Any photo ID issued by the Federal Government
• Any photo ID issued by a foreign government such as a Mexico driver's license or a"matricula consular"
Prove you own or have the owner's permission to use the car with any ONE of these:
• Your government issued driver's license that shows your name matches the owner information from the
DMV's car registration database
• An insurance card showing that you are a named insured for the car
• The certificate of title to the car showing your name as the owner
• A notarized power-of-attorney signed by the car owner
• A tax collector's receipt and a car registration renewal card with your conforming identification
• A current automobile lease or rental agreement signed by the operator of the car,or
• This TDLR form that you can download,print and fill out:http://www.tdlr.texas.gov/towingNSF011.pdf.
The VSF must also make this form available to you.
Pay all fees for towing and storage:
• The TOW CHARGE:The maximum charge for a private property tow is:
• $255 for a car weighing up to 10,000 Ibs
• $357 for a car weighing more than 10,000 but less than 25,000 Ibs
• $459 per unit for unit for cars weighing more than 25,000 Ibs with a$918 total maximum

• A DAILY STORAGE CHARGE of between$5.00 and$20 per day or part of a day for a car that is 25 feet long
or less.A VSF must charge$35 per day or part of a day for a car that is longer than 25 feet.Here are
some more facts about the daily storage charge:
• A daily storage fee may be charged for any part of the day,except that a daily storage fee may not
be charged for more than one day if the car remains at the VSF less than 12 hours.A day is
considered to begin and end at midnight.
• A VSF that accepts a car that is registered in Texas may not charge for more than five days of
storage fees unless a notice(prescribed in§85.703 of the rules)is mailed or published.The notice is
to inform the owner of the location of the car.
• A VSF that accepts a car that is not registered in Texas must not charge for more than five days
before the date a request for owner information is sent to the governmental entity with which the
car is registered.
• A VSF may charge a daily storage fee for each day or portion of a day the car is in storage after the
VSF mails the notice to the registered car owner(or publishes the notice if the owner's address is
unknown)until the car is removed and all accrued charges are paid.
• Reasonable storage efforts.A VSF must make reasonable efforts for the storage of a car,such as
locking doors,rolling up windows,and closing doors,hatchbacks,sunroofs,trunks,hoods,or
convertible tops.Such actions are included in the storage fee.
• A NOTIFICATION FEE.A VSF may charge up to$50 for notifying you that your car is at their VSF.If a
notification must be published,and the actual cost of publication exceeds 50%of the notification fee,the
VSF may recover the additional amount of the cost of publication.The publication fee is in addition to the
notification fee.The VSF may not charge a notification fee if a car is reclaimed by the owner within 24
hours or before notification is sent.
• An IMPOUNDMENT FEE.A VSF may charge a car owner an impoundment fee if impoundment is
performed.Impoundment means:
• If doors,windows,convertible tops,hatchbacks,sun roofs,trunks,or hoods are broken or
inoperative,materials such as plastic or canvas tarpaulins must be used to ensure the protection of
the stored car.To charge the impoundment fee,the VSF must also do at least one of the following:
• conduct a written inventory of any unsecured personal property contained in the car;or
• remove and store all such property for which safekeeping is necessary,and specifies such
removal and storage on the written inventory;or
• obtain the motor car registration information for the car from the Texas Department of Motor
Vehicles or analogous state agency.
• THE IMPOUNDMENT FEE MAY NOT EXCEED$20.If the VSF charges a fee for Impoundment,the
written bill for services must specify the exact services performed for that fee and the dates those
services were performed.
• GOVERNMENTAL OR LAW ENFORCEMENT FEES.A VSF may collect from a car owner any fee that must be
paid to a law enforcement agency,the agency's authorized agent,or a governmental entity.
• ADDITIONAL FEES.A VSF may NOT charge additional fees related to the storage of a car other than fees
listed above.
IV. WHAT INFORMATION AM I ENTITLED TO
REGARDING MY CAR BEING TOWED?
A consumer who has had a private property tow or any tow from a traffic accident is entitled to receive:
• A copy of the tow ticket.
A towing company must prepare and issue a tow ticket for each nonconsent tow.A copy of the tow ticket
must be given to the car owner,if the owner or operator is present and available at the time of the tow,
and a copy delivered to the car storage facility.

The tow ticket may only authorize charges directly related to towing the car.The tow ticket must itemize
each charge and must characterize the fees using the identical fee structure stated in the towing
company's nonconsent towing fee schedule on file with the VSF.
The tow ticket must contain the licensed name of the towing company,publicly listed telephone number,
towing company certificate of registration number,and the TDLR license number of the towing operator.
A towing company must provide its nonconsent towing fees schedule to all VSF where it delivers cars.
These fee schedules must be given to the public upon request.
• A statement of consumer rights to a tow hearing.
• The information needed to file for a tow hearing.
• Each VSF shall tell the car owner of TDLR's website and email address,mailing address,and telephone
number,for purposes of directing complaints about the car storage to the department.
V. WHAT HAPPENS IF I DID NOT CLAIM MY CAR?
A VSF may consider a car abandoned if it is not claimed by the owner.A VSF must mail or publish at least two
notices stating that they have the car and wait at least 30 days after the second notice before taking any
action.
A VSF may sell a car through a public sale 30 days after the VSF mailed or published the second notice.
Proceeds from the sale will be used to pay towing and storage charges.Any remaining proceeds may be paid
to the vehicle owner.Disputes over the sale or the payment of proceeds may be taken to court.
Special rules apply to a car that is more than 10 years old and in a condition to only be junked,crushed or
dismantled.A VSF with these abandoned nuisance vehicles is not required to send or publish a second notice
and may sell the car 30 days after the first notice.
VI. REQUEST A TOW HEARING
Consumers that have had their vehicle towed or booted without their consent are entitled to a hearing.The
VSF,towing,or booting company must provide consumers a notice that informs them of their right to a
hearing and that identifies the justice court having jurisdiction.This will be the court where you file a request
for a tow hearing.Consumers must file their request for a hearing before the 14th day(excluding
Saturdays,Sundays and national holidays)after the car was placed in the VSF or booted.
The notice on tow hearings to consumers must include:
(1)a statement that consumers have the right to submit a request within 14 days for a court hearing to
determine whether probable cause existed to remove or boot the car;
(2)a list of the information that must be included in a request for a hearing;
(3)the amount of the filing fee for the hearing;
(4)the name,address,and telephone number of the towing company that removed the car or the booting
company;
(5)the name,address,and telephone number of the VSF;
(6)the name,address,and telephone number of the person,property owner,or law enforcement agency
that authorized the tow;and
(7)the name,address,and telephone number of the justice court where the VSF is located or,for booted
cars,the name,address,and telephone number of the justice court where the car was booted.
A consumer's request for a tow hearing must contain the following information.The towing company or VSF is
required to provide you with the information necessary for you to complete items(2)through(6)below.
(1)the name,address,and telephone number of the owner or operator of the car;
(2)the location from which the car was removed or in which the car was booted;
(3)the date when the car was removed or booted;
(4)the name,address,and telephone number of the person or law enforcement agency that authorized
the removal or booting;
(5)the name,address,and telephone number of the car storage facility in which the car was placed;

(6)the name,address,and telephone number of the towing company that removed the car or of the
booting company that installed a boot on the car;

states that parking is restricted;or a statement that no sign restricting parking was posted at the parking
facility.
The court may charge a filing fee of$20 for this hearing.These hearings must be held before 21 calendar days
after the court receives the request.
VII. FILING A COMPLAINT WITH TDLR
Consumers may file a complaint on-line through the TDLR website regarding a tow company,tow operator,car
storage facility or their employees,or a booting company or their employees.Here is the link for filing a

requesting a tow hearing;however,you may do both.

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Emerald Ash Borer confirmed in the City of Denton
BACKGROUND:
Emerald Ash Borer (EAB) is an invasive exotic beetle native to Asia that was first discovered
near Detroit, Michigan in 2002. EAB is responsible for the death of millions of ash trees across
the country due to larvae feeding on the inner bark of the tree and disrupting a tree's ability to
circulate and process water and nutrients. Trees are usually infested 2 — 3 years before showing
signs of decline.
Since it was first detected in Michigan, the beetle has spread to 35 States and 6 Canadian
provinces. As of December 2018, the Texas A&M Forest Service confirmed reports of EAB in
Tarrant County(northwest of Fort Worth). EAB has infested and killed ash trees in the Eagle
Mountain Lake area and now it has been identified in Denton.
DISCUSSION:
On Thursday May 7, 2020 the Urban Forester met with a homeowner in the Villages of Carmel
neighborhood who had concerns that his ash trees might have EAB. After meeting with the
homeowner, he was waiting to cross the street and noticed a bug land on a leaf of an ash tree. With
the assistance of the homeowner he was able to capture the bug and place it in ziploc bag. Upon
further investigation he had a strong notion that the bug was an adult EAB beetle. He informed the
homeowner that the Texas A&M Forest Service(TFS)would be contacted to get a second opinion.
Later that day he emailed pictures to Courtney Blevins, Urban Forester with the TSF. Courtney
replied that he thought the diagnosis of EAB was right and requested a meeting to pick up the
specimen the next day and send it to the TFS entomologist for positive identification.
On Friday May 8, 2020 the Urban Forester received a call from Allen Smith Entomologist with
the TFS who used the pictures to confirm the specimen is an EAB beetle. For it to be official the
specimen would have to be sent to a lab in Michigan for positive identification. Allen stated once
we receive positive identification, Denton County will be quarantined by the Texas Department of
Agriculture (TDA). This means that a protocol will be in place to reduce of the spread of the EAB.
TDA will also have to inspect and approve our wood waste recycling equipment/program at the
landfill to verify we are compliant with standards for processing EAB wood waste products for
resale. Mr. Smith also stated that there would be a meeting with communities, agencies and
businesses in Denton County that will be affected by the quarantine. Both Allen and Courtney
have offered their assistance to help the City of Denton deal with this pest.
The State of Denton Urban Forest 2016 report calculated Denton's urban forest to consist of about
4% (138,000) ash trees including public and private properties. Ash represent the eighth most
populous tree in Denton, most of which are located on private property, natural areas and near
riparian areas. As a part of Davey Resource Group's work on the Urban Forest Master Plan

(UFMP) a street tree (tree within the street right-of-way) count was performed on 10% of public
streets. Using this data, it was extrapolated that Denton has approximately 20,850 street trees
(between the curb and sidewalk). Utilizing data above it has been calculated the approximate
number of ash street trees is 834.
About 70% of City properties maintained by Parks and Recreation have been inventoried for ash
trees. A total of 59 ash trees have been inventoried, with most locations having only two or less
ash and the majority of those being less than 12 inches DBH, (Diameter by Breast Height). The
highest concentration of ash trees are in Lake Forest Park and Sequoia Park.
Standard industry options for managing EAB are:
1. Proactively remove the tree and replant with a non-ash species.
2. Treat ash via trunk injections or soil drench to allow for systematic removal and
replacement over time.
3. Commit to a preventative treatment program for the life of the tree.
Staff has the following recommendations:
On city maintained property:
1. Treat high profile ash greater than 14 inches DBH in maintained area, currently 2 ash are
recommended for treatment.
2. Proactively remove and replace all other ash in maintained areas over the next year.
Street trees:
1. Distribute educational materials to property owners informing them about EAB and their
options as stated above to address the EAB.
2. Explore options for replacing street trees.
Development Projects
1. Amend the Denton Development Code to list ash as a non-protected tree.
CONCLUSON:
While treatments can begin after infestation, generally by the time EAB is detected the infestation
