II. General Information & Status Update
A. Bureau of Land Management Lease Sale—On June 16, Council approved a Resolution
authorizing the Mayor to sign a Letter of Protest,pursuant to 43 C.F.R. section 3120.1-
3, regarding the proposed auction by the Bureau of Land Management of Parcel TX-
2 for the purposes of oil and gas development. Several other entities have
filed similar comments and/ or letters of protest. Staff filed Denton's letter of protest
with the Bureau of Land Management following approval of the resolution, and
received a reply this week from the Bureau of Land Management that the parcel has

B. After Action Report: TCEO Landfill Expansion Permit Public Meeting — The Texas
Commission on Environmental Quality(TCEQ)held a virtual public meeting to receive
citizen comments on the City's proposed expansion of the Denton Landfill(1590B) on
the evening of June 25.The meeting started about 7:00 p.m.and ran until approximately

10:00 p.m. with approximately 60 members of the public,local and non-local residents
participating. After introductory comments by the TCEQ, the meeting was opened for
an hour of questions and answers followed by approximately 90 minutes of"on the
record"comments. Approximately 35 attendees provided formal comments. The close
of the public meeting marked the close of the public comment period on this permit.
The TCEQ will spend the next 45 to 60 days responding to all the written and verbal
comments received. At that time, the Executive Director will prepare a
recommendation, which will be sent to all those who submitted comments. 30 days
following the Executive Directors decision, the recommendation will be submitted to
the TCEQ Commissioners for consideration.Affected parties,as defined by the TCEQ,
have the right to file for a contested case hearing throughout the process. Staff contact:

C. Denton Fire Department Entrance into Long-Term Care Facilities — On June 22,
Council Member Meltzer forwarded a concern from a resident inquiring about Fire
Department staff s protocols on entering long-term care facilities. During this COVID-
19 emergency response period, the Denton Fire Department (DFD) made operational
adjustments to limit exposure to employees and residents at long term care facilities.
This decision was approved by Dr. Tom Olmsted, the contracted Medical Control
Director for the Denton Fire Department, as a control measure. The DFD
communicated with all of the local care facilities about changes to our lift assist
policies. The changes were focused on occurrences of residents falling, who were
uninjured,but the onsite staff at the facility chose not to perform the lift and called 911
instead.
The DFD asked these facilities to provide the assistance without the help from
emergency services, and in the initial communication,the DFD suggested each facility
develop a new plan to address lift assists.
The reason behind this change was to reduce exposure to the facility staff and residents
from our personnel and also to reduce exposure to our personnel from their facility.
The DFD continues to provide assistance to facilities that do not have staff to assist
residents. Fire Department staff continue to provide assistance when injuries are
involved or the facility requests the additional resources. Staff contact: Kenneth

D. Protests—Police Overtime Summary—The Police Department is currently tracking all
overtime associated with protests around the City. Since May 30, the Police
Department has incurred a total of $151,607 in overtime expense associated with
protests. If protests continue, Staff will continue to provide Council a weekly update
regarding overtime expenses in the coming weeks. Staff contacts: Nick Vincent,

E. Construction Communication Protocols—To further enhance communication for City-
planned construction projects to residents and property owners, staff updated the
construction communication protocols for capital infrastructure projects, infrastructure

maintenance projects, and major facility construction projects. Additional categories
for DME and emergency repair projects will be updated in the coming weeks.
The updated protocols outline outreach efforts at the following project milestones:
• 30% design,
• 90% design,
1-2 moth from construction start,
• 2 weeks prior to construction start,
• Within 1 week of any new lane closures,
• With 2-4 weeks of new road segment,
• Substantial progress communications,
• Overall scope or schedule changes,
Project completion, and
• Optional/as needed outreach activities.
Based on the anticipated impacts to residents and property owners, all or a select few
of the following communication methods will be implemented at the above milestones
for existing current and future construction projects; public meetings, letters to
impacted properties, social media posts, neighborhood group outreach, council
committee updates, key stakeholder outreach, Friday report updates, email updates,
project signage,post-construction surveys, and project webpages.
Major infrastructure and planned maintenance projects will also have unique
communication plans based off the updated protocols, with flexibility for its specific
communication needs.
In the coming weeks, City staff will be working to further implement these protocols
for current projects and provide for residents to view online. Staff contact: Stephanie

F. Update on Denton County OPEN Grants—Denton County opened Phase 2 of the OPEN
grant program on June 22,including some changes to the grant application process and
eligibility. The attached document outlines the changes implemented in Phase 2 of the
program. Due to the program changes in Phase 2, the County is requiring any business
that was awarded a grant during Phase 1 to submit a new application in Phase 2 if they
believe they will qualify for more money. Even if a business qualified for the
maximum grant award ($10,000) under Phase 1, they must submit another
application under Phase 2 to be considered for additional funding.
Businesses opened by May 1, 2020, with no more than 100 full-time employees, will
be eligible under Phase 2. The County will require bank statements from January 2020
through June 2020 to determine financial losses due to COVID-19, if applicable. The
focus will be on providing financial relief for businesses that have suffered any negative
financial impact due to COVID-19. Businesses with revenues exceeding $15 million
are ineligible to apply during Phase 2. The deadline for applications is noon,Monday,

G. Windsor Drive Street Reconstruction Communication— On June 19, residents shared
concerns regarding advance notice of traffic impacts for the active phase of the 2019
Street Reconstruction CIP on Windsor Drive. The following outreach efforts were

The most recent communication was a letter to impacted properties within the project
area on June 22. To further enhance future communication to residents and property
owners for City-planned construction projects, City staff is developing an improved
construction communication protocol that continues to incorporate public meetings,
stakeholder notification, traffic signage, neighborhood group outreach, and additional
communication elements at select project milestones. Information on this effort is

H. Curbside Diversion of Textiles and Other Materials — On June 22, Council Member
Briggs inquired about potentially partnering with non-profits and the curbside pickup
of collected materials for donation. The City of Austin recently implemented a
partnership with Goodwill where the City collects unwanted clothing, shoes,
accessories,toys, linens, and housewares, and delivers the material for sorting and sale
either at Austin area Goodwill stores or baling for sale on the commodities market. As
part of the City of Denton's upcoming Comprehensive Solid Waste Management
Strategy, consultants will evaluate this and other materials diversion programs.
While the City of Denton does not currently offer this level of service, several local
non-profit organizations do offer residents the ability to arrange for the collection of
unwanted clothing, shoes, accessories, toys, linens, and housewares at their homes.
Similarly, non-profit organizations provide storefront opportunities for residents to
divert this material via drop-off. Finally, several non-profits cooperate with Denton
Independent School District(DISD) and local business owners to site collection boxes
at their facilities that the public can use to divert materials. Each of these non-profits
either process this material for direct sale through their outlets and/or bale for sale as a

I. Traffic Signage Request for Amistad Lane and New Ballinger Drive — On June 22,
Council Member Davis requested that staff look into placing a stop sign at the
intersection of Amistad Lane and New Ballinger Drive. Traffic Engineering staff
visited the location and will conduct a traffic volume and speed study on Amistad and
New Ballinger. This study will take approximately 3-4 weeks, after which a decision
will be made as to whether an all-way STOP is needed or just a two-way STOP. Staff
can install temporary STOP signs on Amistad until the study is complete. In addition,
pursuant to our `no uncontrolled intersections' policy, staff will canvas the entire

neighborhood in an effort to identify all missing or uninstalled STOP signs. Staff

J. Traffic Calming Solution on Thunderbird Drive—On June 22, Council Member Davis
requested staff look into a solution for traffic calming on Thunderbird Drive. Traffic
Engineering staff visited the location and will conduct a traffic volume and speed study
on Thunderbird near Greenway. This study will take approximately 2-3 weeks, after
which a decision will be made as to what traffic calming measure is most appropriate.

K. Mobility Plan Neighborhood Meeting Update—On June 23, Council Members Briggs
forwarded a resident's inquiry about when the Mobility Plan neighborhood meetings
might be rescheduled. Traffic Engineering staff is working with Public Affairs to
establish new dates and a platform for these meetings. We would like to complete the

L. Comparative Auto Accident Data on West Oak—On June 22, Council Member Davis
requested comparative data on auto accidents on West Oak before and after it went one-
way. Traffic Engineering staff researched the availability of crash records for West Oak
and have only been able to find records back to 2010. Oak Street was converted to one-
way prior to this, so we do not have crash data for West Oak as a two-way street. Staff

M. Sediment in Creeks—On June 23, Council Members Briggs forwarded concerns from
residents regarding sediment buildup in a local creek. The visual assessment
(cloudiness and color)is typically a sufficient assessment of the problem because other
issues (like nutrients) are understood to have a relationship with the soil and sediment.
When staff makes a site visit for sediment from a construction site, they will observe
whether there is an unexpected environmental/ecosystem impact during the
investigation/information gathering process. In a situation like this one, where extra
sediment was a result of the rain event, staff said that fish in our streams can be stressed
but will usually survive because the effects are short-term. Turtles and other reptiles
can leave the water as needed and have the ability to move from one habitat to another.

N. Solid Waste and Recycling Website and Waste Wizard App Clarifications — On
June 16,Council Member Briggs inquired as to the usability of the specified yard waste
carts for organic material. It was recently brought to the department's attention that the
City of Denton's solid waste, yard waste, and brush web page and the attached Waste
Wizard app was unclear/confusing to some readers regarding the ability of residents to
place raw,uncooked vegetative waste and coffee grounds into a yard waste cart or kraft
bags. Additional information has been added for clarity. While not required, this is an
option available for yard waste subscription service customers. Vegetative wastes may
also be diverted into backyard composting. Staff Contact: Brian Boemer, Solid Waste

O. Radio(Remote) Controlled Vehicles—On June 24, Council Member Briggs forwarded
a resident's question regarding radio (remote) controlled (RC) vehicles in City parks.
The topic of a RC course was brought up during the Parks and Recreation's master plan
public meeting and information gathering process. Parks and Recreation likes the idea

of designating a pond for this activity. One difficulty that presents itself is that many
City ponds need to be dredged. The north pond at North Lakes Park could be a possible
location with the airfield being adjacent to the pond. A location near the airfield could
also be identified for RC cars as well. Parks and Recreation staff recently talked to the
RC airplane group about future needs and the possibility of including it into the
department's planning efforts.
Moving forward, a plan could be created with an overall site design and potential costs.
This would allow the project to be considered with other potential park projects and
funding considerations. In addition, the project would have to be prioritized based on
staffing and maintenance resources available to the department. Staff contact: Drew

P. Locust and Elm Construction Debris—On June 24,Council Member Meltzer forwarded
a business owner's concern about the amount of dust materializing from construction
on Locust and Elm. Capital Projects staff reported this is a TxDOT project and that,
weather permitting, all should be complete within the next 3 weeks. Communication
was sent to the over 1200 addresses in the impacted area on June 22. Due to the recent
rain, the paving of the roadway had to be delayed,which unfortunately meant the road
was not sealed off completely. The rain then caused some areas to require additional
base repair, including cement stabilization. TxDOT anticipates asphalt paving to begin
next week, if we don't receive more rain. Staff confirmed there is no asbestos in any of
the materials being disturbed or used on this roadway. It is staffs understanding that
the influx of dust stems from the Broom. Workers must keep the travel lane clear of
rocks and debris in order to save windshields. These concerns should all be resolved
next week when TxDOT switches traffic to the newly paved lane. Staff contact: Todd

Q. Discontinued and Fragmented Streets—On May 19, Council Member Davis requested
information about the fragmented and discontinued streets, or roads that have multiple
names along their routes. Staff from Public Works and Technology Services used GIS
maps to identify the street segments that match with this criteria, and have prepared the
attached map and street listing.Disconnected streets can be caused by multiple factors.
In Denton, some streets around school campuses are disconnected to provide greater
pedestrian protection. Other streets can be disconnected because of development
phases that are either not complete or that have changed direction during the build

R. Beehive Removal — On June 25, Council Member Briggs requested that a beehive be
safely removed and relocated from a tree on City property on the corner of Texas Street
and Ruddell Street. Staff contacted a bee keeper to complete this request, and the work
began on Friday,July 26,and is scheduled to be completed by the middle of next week.

S. Flexible Pavement Options — On June 22, Council Member Briggs inquired about
potential flexible pavement options. City staff are aware that several vendors offer
flexible pavement options that could be beneficial, particularly in areas around the
community where pavement is being installed or replaced in close proximity to trees,
to reduce or eliminate future pavement damage from tree roots, and to protect street
trees. Staff has not yet had the opportunity to test the KBI Flexi-Pave product,or similar
products, but plans to pilot flexible pavement options for future downtown sidewalk
projects where appropriate, particularly in areas with street trees. The purpose of the
trial is to assess the durability of the product prior to larger applications across the City.
Once a pilot location has been identified to test flexible pavement products, staff will

T. Denton Receives National Main Street Accreditation—Local Main Street programs can
seek national accreditation through Main Street America m. To achieve national
accreditation in Texas, a program needs a recommendation by the Texas Main Street
Program of the Texas Historical Commission, which is achieved by demonstrating a
program has distinct strategies and performance related to a community commitment
to downtown; leadership and organizational capacity; diverse and sustainable funding;
strategy-driven programming; preservation-based economic development; and
demonstrated results. We are happy to announce that Denton was awarded the 2020
National Accreditation based upon the new national accreditation performance
standards for the December 2018 to December 2019 program year. Denton has
maintained the National Accreditation since 1999 and will celebrate our 30th year as a
certified city of the Texas Main Street Program in 2020. Staff contact: Christina Davis,

U. Pollinator Week — Sustainable Denton has scheduled a few activities to celebrate
pollinator week including a "Beekeeping Round Table" hosted by the Denton County
Beekeepers Association.On Wednesday,June 24,Clear Creek Natural Heritage Center
placed a new bug hotel in the prairie in partnership with the Denton County Master
Gardeners Association. At this time,they released 200 leaf cutter bees on the property.
Staff will release a pollinator themed story time recorded by Library staff on social
media on Saturday, June 27 at around 10:00 a.m. Staff Contact: Katherine Barnett,

V. Employees VolunteeringLcally — In response to the COVID-19 pandemic, the City
of Denton offered assistance to local nonprofit partners who experienced a drop in
volunteer involvement. This decrease was partially due to the CDC recommendations
for high-risk populations to stay home and socially distance. Employees volunteered at
numerous nonprofits assisting with childcare, meal preparation, and offering
translation services. City employees' efforts to provide essential services totaled 2,094
hours. From March 18 to June 21, 169 employees filled 565 shifts at Grace Like Rain,
Monsignor King Outreach Center, Our Daily Bread (ODB), and the Denton
Community Food Center. Over half of the hours worked were volunteered at ODB.
While volunteering at ODB (March 25-June 21), the organization served 9,180

W. Virtual Liberty— The 22nd Annual Liberty Run 5K and 1-Mile Walk is a virtual
run this year. Registration is free, or $12 for a T-shirt. Participants should complete
their run or walk by July 4. Runners and walkers can share pictures of themselves in
festive outfits and be entered to win $25 gift cards from local businesses. For more

X. Sterling Tree City Award—Arbor Day Foundation, a nonprofit, recognized Denton as
a Tree City USA community for its commitment to urban forestry. Denton has earned
this national recognition for 29 consecutive years, since 1991.Denton also received the
designation of Sterling Tree City USA for communities that have won ten Growth
Awards. Sterling communities are regarded as leaders in community forestry and
considered innovators. Denton is one of only ten cities in Texas to receive this
designation. The prestigious Growth Award honors highlight innovative programs,
projects, and an increased commitment of resources for urban forestry.
Communities honored with a Sterling Tree City USA designation demonstrate a strong
commitment to planting and caring for trees. Elected officials,volunteers, and citizens
all play a role in this effort. Tree City USA communities recognize that trees provide
numerous environmental, economic, and health benefits for the community every day.

Y. Summer Camps — Parks and Recreation has not been offering traditional summer
camps due to the pandemic. Instead, staff created multiple at-home camp activities for
residents to enjoy for low costs, such as Camp in a Bag. More online camps will
continue in July with a Fashionista Camp and a role-playing dice camp.

HOW IS DENTON COUNTY OPEN PHASE 2 DIFFERENT THAN PHASE 1 ?
Denton County OPEN Business Grants Phase 2
The Denton County OPEN Program was created to provide small businesses with grants to
compensate for economic losses due to COVID-19. The purpose of the program is to save jobs and
reduce economic hardships experienced by our Denton County businesses.
Under the CARES Act, local governments were given the authority to provide businesses with
economic relief using federal funding in the form of grants as long as the receiving businesses can
demonstrate economic hardship due to COVID-19. Denton County has allocated over $20 million for
the second phase of our OPEN program's business grants. The application for Phase 2 is open from
June 22, 2020, at noon to July 6, 2020, at noon. Many businesses that were ineligible to receive a
grant during Phase 1 will be eligible during Phase 2. We will award grants during the second phase of
up to $50,000 for those that qualify.
Businesses opened by May 1, 2020, with no more than 100 full-time employees, will be eligible under
Phase 2. We will require bank statements from January 2020 through June 2020 to determine
financial losses due to COVID-19, if applicable. Our focus will be on providing financial relief for
businesses that have suffered any negative financial impact due to COVID-19. Businesses with

Individual OPEN grants of up to $50,000 may be awarded. Awards of individual OPEN grants will be
based on such factors as need, eligibility, number of employees and availability of funds. The grant
amount will be the sum of two categories: (Category 1) lost revenues and (Category 2) reimbursement
of money spent before Application Date on COVID-19 expenditures (both goods and services). As an
example:

Denton County OPEN Business Grants Phase 1
Phase 1 of our business grant program accepted applications from May 13, 2020, to May 20, 2020.
Denton County received more than 2,000 applications for Phase 1 of the OPEN Program. The first
phase offered a total of$2.2 million and awarded grants of up to $10,000. Businesses with more than
50 employees and open for less than one year were ineligible. Companies seeking relief from the
County were required to show economic loss due to COVID-19 during March and April 2020.
Applicants were required to submit bank statements from March & April 2019 and March & April 2020
to demonstrate their year over year loss. Businesses with revenues exceeding $7 million were
ineligible to receive a grant during Phase 1 . Our focus for the first phase was to provide financial relief
to the non-essential and partially open businesses.
Any business that applied during Phase 1 is encouraged to submit a new application for Phase 2.
Whether your application was awarded an amount or denied, we require resubmission for Phase 2.
Due to changes in the grant criteria and the calculation for grant amounts, we must require any
recipient of a Phase 1 grant to fill out a new application in Phase 2.

Documentary movie screening in Fred Moore Park on Sunday, July 5, 2020.
BACKGROUND:
On June 22, 2020, the Parks and Recreation Department (PARD) received an inquiry on the
possibility of getting approval for extended park hours on July 5, 2020 to hold a documentary
screening in Fred Moore Park. The request was originally sent to Council Member Keely Briggs
by Jessica Luther Rummel. The potential issue of noise volume was also raised related to the movie
screening.
While the activity may not fit what is normally thought of as a special event, the use of amplified
sound on a Sunday and the request to go past park hours are two criteria that require it to go through
the process. Staff reviewed the following applicable ordinances:
1. Park hours (22-27) — City parks are closed between the hours of 10:00 p.m. and 6 a.m.
"except for events approved or scheduled by the parks and recreation department or city
council". The approval is the special event permit.
2. Noise (17-20) — Amplified sound is prohibited on Sunday. Exceptions require Council
approval. The last meeting before the event is Tuesday, June 30th. Review and approval
places the City outside of the timelines required by the special event process and needed
for thoughtful consideration.
After reviewing the inquiry and ordinances, PARD staff determined the request for an extension
on park hours could be granted administratively if all other activities were within compliance. The
volume of noise for the screening was described as"not too loud"with a goal to"only amplify the
movie for those sitting right there at the bleachers" by Ms. Rummel in her email to Council
Member Briggs. With this information,decibel levels were not a concern,however,the prohibition
of amplified sound on Sunday remained.
Requests and approvals for exceptions to the noise ordinance for events held on city property are
routinely presented to City Council. The upcoming event date and one remaining Council meeting
presented a challenge for the appropriate approvals. In an effort to work with the event, staff s
approach was to ask the event organizer to consider an alternate day and request the neighborhood
be notified. With that and an administrative approval of the after hours, the event would proceed
without issue.
PARD staff reached out to Ms. Rummel on June 23 to discuss the event. The restriction of
amplified sound on Sunday was shared with her. PARD asked if an alternate date was possible or
if other options could be considered. Ms. Rummel stated she was only asking for permission to be
in the park after hours. Ms. Rummel called her movie screening "an act of civil disobedience" as
the City's ordinance against amplified sound on Sunday is meant to disenfranchise people and is

not equally enforced. Staff explained PARD would work with her on the hours in the park and
would even assist with the notification of the neighborhood.Ms.Rummel said the event date would
not change and would continue regardless of any requirements.
Understanding that an event will be held at Fred Moore Park on Sunday, July 5 from 8:00 p.m. to
11:00 p.m. that will include amplified sound, staff prepared an ordinance for a noise exception for
City Council's consideration. Staff reached out again to Ms. Rummel on June 25 to let her know
the exception would be presented to Council next week. Ms. Rummel provided additional
information on the event and explained she is assisting a community group whose goal is to
organize positive protests. A PBS documentary on Civil Rights will be shown and the target
audience is Southeast Denton residents. She confirmed that the volume is expected to be low and
the event would end by 11:00 p.m. The expected attendance is approximately 100-300 people.
Ms. Rummel appreciated the assistance and staff informed her if she had any addition questions
to please reach out to Parks and Recreation during the planning stages.
