b. Council Member Request: This is to request a workshop to discuss and
give direction on the possibility of closing the square to vehicular traffic
Friday evening through Sunday evening for the duration of the
emergency order, other than for emergency access by police, fire, EMT
and utility vehicles. The purpose would be to facilitate safer, socially
distant dining and shopping opportunities. I would like to explore the
feasibility of allowing merchant and restaurant use of the sidewalks and
parking spaces during those times, similar to festival uses. If TXDOT
can't allow Locust and Elm closures, I would propose doing this just on
Oak and Hickory.

2. Using the Tree Fund to plant 100 or more oak trees in the IOOF Cemetery.
a. Requestor: Council Member Davis
b. Council Member Request: I would like the City Council to consider
making an expenditure from the Tree Fund to plant 100 or more oak
trees in the IOOF Cemetery. I prefer native species, like post oaks, but
the Parks and Rec Department should have flexibility to examine the
options. The cemetery is the final resting place of many prominent
citizens and heroic veterans. It is well maintained, and the recent
addition of the fence was a big improvement. But for such
an historical and centrally located place of remembrance, it is not
particularly beautiful or contemplative. Planting native oaks would
make the cemetery a place of natural beauty, create urban arboreal
habitat on protected City property, and properly honor the dead. In 30-
50 years I would like the IOOF Cemetery to resemble the beautifully
treed Oakwood Cemetery in Waco. If the plantings are successful and
fund allow,we could consider additional plantings in our own Oakwood
Cemetery.

3. Naming the new senior center in Southeast Denton the "Betty Kimble
Senior Center."
a. Requestor: Council Member Briggs
b. Council Member Request: Council Member Briggs is requesting to
name the new senior center in Southeast Denton the "Betty Kimble
Senior Center" after Betty Kimble, a lifelong Denton resident and
community activist. Additional information about Ms. Kimble can be

4. Repealing City ordinances that experts,advocacy groups,and my homeless
constituents both say criminalize homelessness. The public interest in law
enforcement reform and civil liberties.

a. Requestor: Council Member Armintor
b. Council Member Request: Section 17-101 of our city code states that it
is "unlawful to use a vehicle for living or sleeping quarters, or for the
storage of trash, debris or personal property not normally associated
with the vehicle." Municipal laws like this that criminalize sleeping in
cars are among the laws singled out by the Texas Homeless Network
(THN) as in need of repeal for effectively criminalizing homelessness.
We should not ignore such recommendations from THN, a highly
respected organization that the Denton County Homeless Coalition lists
as an essential collaborator ( see: https:Hendhomelessnessdenton.com/:
"DCHC is comprised of representatives from nonprofit agencies,
Denton County cities, school districts and other community
stakeholders. The coalition works with the Texas Homeless Network
(linked), the lead agency for Denton County's Continuum of Care
(CoC), the Texas Balance of State (BoS). DCHC implements CoC
strategies and Denton County and promotes collaborative strategies for
state and federal homeless funding opportunities." See also:

B. Courtney Cross Joins the City of Denton — Courtney Cross has joined the City of
Denton as the Assistant Community Services Manager. Courtney has a Bachelor of
Arts in Sociology from Southern Methodist University and a Master of Arts in
Community Organizing from Queen Mary, University of London. Courtney comes to
the City from the United Way where she was the Director of Mental Health&Housing
Initiatives leading two collective impact initiatives to improve systems to advocate for
overall mental health and to ensure homelessness is rare, brief and nonrecurring in
Denton County. As Assistant Community Services Manager, Courtney is responsible
for supporting Community Services including the Community Development and
Community Improvement Services teams in delivering outstanding community
programs and services creating stronger, more resilient neighborhoods. Staff Contact:

C. Update on Economic Development StrategicPlan—Based on the feedback received at
the August 18 work session, staff is working with TIP Strategies to prepare additional
analyses related to the funding options, industry targets, and action steps outlined in
the draft Economic Development Strategic Plan. Currently, a follow-up work session
is planned for mid-September. Staff contact: Jessica Rogers, Economic Development
D. Clear the Shelter Update—The annual Clear the Shelter event began on Monday,
August 17. In the adapted event,residents made appointments to see the animals. From
Monday through Wednesday, all animals were $30, and from Thursday through
Saturday, animals will be free.
The Denton Animal Shelter quickly began scheduling appointments, and currently has
144 appointments. That will take them past this event and to next Saturday,
August 29. As of Wednesday, August 20, 20 animals found their forever homes, and

many more are still up for adoption.In 2019,the shelter adopted 98 animals and expects
the modified event for 2020 to be just as successful.
To celebrate Clear the Shelter, Kona Ice will be at the shelter on Saturday, August 22.
Everyone is welcome to come and enjoy a shaved ice as animals are adopted. Staff

E. Customer Service Update—As reported to the City Council this week, interruptions of
utility service began Tuesday, August 18. Currently, there are 2,020 residential, multi-
family, and business accounts which are past due and eligible for interruption. The

No customer has received a late or interruption fee. Service restoration is being made
with partial payment, pay arrangements, and agency referrals as appropriate for the
individual customer's situation. No deposits are being assessed due to interruption of
service.
Customer referrals for agency assistance are being completed upon speaking to
customers. For the month of August to date, staff received a total of 493 pledges

F. Unemployment Update — Staff is working to assemble, review, and analyze
unemployment and labor data as releases are made. Staff will provide ongoing updates
throughout the COVID-19 pandemic as data is made available.

o DOL released its weekly unemployment report on Thursday,August 20.

• Texas Workforce Commission(TWC)

o TWC has created a UI Claimant Dashboard to provide updated
graphical representations of data and datasets for download. The
dashboard is available here.
o June local unemployment data was released on the Texas Labor Market
Information (www.texasLMI.com) system on August 21. The next
release is scheduled for September 18.
o TWC also provides data on weekly unemployment claims filed and how
the claim was received. The chart can be viewed here.

G. Walmart Drive-In Movie Event - The Walmart Store located at 2750 W. University
Drive will be hosting a Drive-In Movie event on October 13, 2020 and October 14,
2020. The event will be fully contained within their parking lot with a maximum
number of 75 vehicles allowed. The movie will be viewed on a screen that pops up
from a Walmart truck and audio will be transmitted through FM radio.
Walmart has provided a detailed plan for their event as well as a COVID-19 Mitigation
and Safety Plan. As proposed, the event is not subject to the City's Special Event
Ordinance and staff believes it does not conflict with the Governor's current orders.
Details of the plan include:
• 100% Contact Free - Tickets to enter will be electronic and scanned through
closed car windows for admittance.
• No Outdoor Gatherings - All attendees must remain in their vehicles at all
times. No outdoor chairs or sitting outside will be allowed.
• Bathroom Facilities-The store's indoor restrooms will be available for use by
movie attendees. Attendees exiting the vehicle to go into the store will be
required to wear a mask.
• Security and Staffing - Walmart will provide security and staffing to control
traffic and enforce the rules outlined in their plan. Security and staff will be
supplied with and wearing the appropriate personal protective equipment at all
times. A first aid station will also be provided.
• Emergency Access-Emergency access lanes will remain open and maintained
by the Walmart Security Team.

H. DISD Swim Teams at the Natatorium- Denton Independent School District (DISD)
will start their swim team practices at the Natatorium on Wednesday, August 26. This
is the first swimming activity at the Natatorium since the facility closed due to COVID-

19 concerns in March. The City and DISD operate the Natatorium through a
cooperative interlocal agreement. The DISD swim teams program restart is a part of
the first of three phases of the Natatorium reopening plan. The next reopening phase
will be in October. At that time, limited lap swimming, exercise sessions, and physical

I. Denton Tennis Center Grant Update— On August 18, the Parks and Recreation
Department received$10,000 in USTA Texas grant funds. These funds will go directly
towards the construction of the new tennis courts. This brings the total of grant funds
for the tennis center to $40,000. Staff contact: Jason Barrow, Parks and Recreation
J. COVID-19 Death Statistics by City — At the August 18 City Council Work Session,
Council members noted that,at the time, COVID-19 deaths reported by Denton County
did not list the number of deaths for each individual municipality. The Council inquired
as to whether this information was publicly available or could be made publicly
available. This week, Denton County updated its COVID-19 Statistics webpage to
include the number of COVID-19 deaths for each of its constituent municipalities.
Once on the webpage, a member of the public can then scroll down to the "Confirmed
Cases and Recovered by Location" section (see attached). One can hover over each
section of the stacked bar graph to see specific statistics for active cases, recovered
cases, and deaths. Additionally, those options can be selected or deselected within the
graph's legend. A link to the Denton County COVID-19 statistics page has been placed
on the City of Denton homepage at www.cityofdenton.com. The County webpage can

K. Safety Issues at a Local Business in the Denton Center Shopping Mall—At the request
of Mayor Pro Tern Hudspeth, staff from Community Services and the Denton Police
Department met with the general manager (GM) of a business located in the Denton
Center Shopping Mall. The GM shared his concerns with the level of petty theft that is
occurring and the impact of people experiencing homelessness on business traffic in
the store. During the visit he mentioned that the store staff was hesitant to contact PD
when any theft has occurred typically because of the small amount taken and that the
perpetrators are gone before police could reasonably respond. Staff encouraged him to
make calls to PD any time there is criminal activity regardless of the dollar value of the
theft. Staff also let the GM know when individuals are being disruptive to store
operations, the store may request the individual be trespassed regardless of criminal
activity. Staff suggested that any increased enforcement actions may help deter future
activity. Staff also reviewed the City's homelessness initiatives and collaborative
activities such as the Homeless Outreach Team efforts to build positive relationships
with people experiencing homelessness with the goal of connecting people in need of
housing to housing services. The GM shared that while he understands it is just a small
number of people who are creating this concern for his business, he believes the store
is not doing well because customers may not be comfortable visiting due to the visible
presence of people experiencing homelessness and that the theft is affecting the store's
already slim margins.
While there, staff witnessed a man acting erratically in the parking lot near the store
and approximately six (6) individuals at an adjacent building sitting up against a wall

under an overhang that was providing protection from the heat. Behind the buildings
there was also an individual sleeping on the ground near the opening of the wooded
area located on private property that was the site of a previous cleared encampment that
CIS worked with the private property owner to abate. Staff contact: Dani Shaw,

L. Survey Requesting Downtown Denton Community Feedback—Friday,August 21, staff
will distribute a brief, informal survey requesting feedback from the Downtown Denton
community, including residents, businesses, and others. The survey requests feedback
on the Streatery Pilot, To-Go Parking, and any potential street closures stemming from
further Council direction on any pending Council requests reaching consensus.
Pertinent to any potential closures affecting Elm and Locust is that TxDOT would
require applying for a special use permit. It is further anticipated that TxDOT will
require information on the safety measures taken to ensure safety in order to minimize
liability as well as a traffic control or detour plan for US 77. Feedback received from
the survey will be shared with Council once received and compiled. Staff contact:

M. After School Programming — On August 14, Council Member Briggs requested
information about the number of students enrolled in the Parks and Recreation after-
school programming. The chart below includes information about the number of people
enrolled in the After School Action Site program from October 2019 to March 2020.
The program closed at the same time as Denton ISD stopped in-person classes this
spring.

The program's schedule follows Denton ISD's schedule, and staff has been closely
monitoring the district's opening plans. At this time, the plan is to reopen the After
School Action Site program during the second semester on January 4, 2021. This will
allow staff to continue to monitor the school's reopening progress, the local health
environment, COVID-19 recommendations for youth, as well as getting the
department's staffing in place and working out transportation logistics related to health

N. Solid Waste Service Days—On August 19, Council Member Meltzer inquired whether
residential Solid Waste &Recycling customers could request collection more than one
day per week. All service at any given household must be completed on their assigned
"service day." If a resident has too much material for their cart, they may bring that
material to the landfill (for a charge) or call Customer Service at (940) 349-8700 to
request a larger or additional trash cart(for a charge)or recycling cart(no charge). Staff

O. Curbside Election Ballot Drop-off—On August 19, Council Member Briggs requested
information about Denton County's plans for election ballot curbside drop-off. Staff
contacted the Denton County Elections office who responded that they are looking into
how they will address the needs for drop-off mail-in ballots. One of their considerations
is during early voting, when there will be true curbside voters, and staff is concerned
with changes that might slow the process. The process is complicated, and staff will
need to address how to obtain voters' information to fill out the hand-delivery forms in
order to accept the mail-in ballot. Elections Office staff are committed to finding a
solution for voters who want to hand deliver their ballots but have reasons that may
preclude them from leaving their vehicle. Additionally, the Denton County Elections
Administration office has added the information below to their website,which will also
be added to the City's elections webpage. The City Secretary's Office will provide

Mail ballot hand-delivery:
On July 27, 2020 Governor Gregg Abbott issued a proclamation that, beyond
extending the Early Voting period for the November 3rd General Election,
suspended Section 86.006(a-1) of the Texas Election Code for the election. This
means that hand delivery of mail ballots will be accepted in our office (address
below) from the time you receive your mail ballot, up until 7pm on Election Day
(November 3, 2020). A few things to keep in mind before hand delivering your ballot
is that you are only allowed to deliver,your own ballot. The Texas Election Code
does not allow delivery of a mail ballot from another voter. Also, you will be asked
to present one of the 7 forms of acceptable photo identification. If you do not
possess one of the acceptable form of photo identification, you will be asked to
present one of the supporting forms of identification and to complete a Reasonable
Impediment Declaration. After presenting your identification, you will then be asked
to sign a hand-delivery roster to complete the hand-delivery of your mail ballot.

P. Glenwood Traffic Flow—On August 14, Council Member Briggs requested additional
information about the traffic flow on Glenwood when school begins. The intersection
of Glenwood Dr. and Emerson is being converted to an all-way stop. The pedestrian-
activated, LED stop signs for this conversion are scheduled for installation by
August 25,and the crosswalks at this intersection will be remarked. Staff contact: Brian

1. #UniteDenton Virtual Event — August 29 from 9 to 10:00 a.m. on Zoom.
Denton resident, Paul Taylor with Camp Gladiator, reached out to Parks and
Recreation staff about a virtual workout event. Taylor will lead a virtual
workout for the community, although registration is required. Everyone
registered will be emailed a Zoom ID to join the virtual event. The event is

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
November 3, 2020 General and Special Elections
BACKGROUND:
The report provides information involving the November 3, 2020 General & Special Elections as
well as the December 8, 2020 Runoff Election, if needed.
DISCUSSION:
On March 20, 2020, the General (Places 5, 6, and 7/Mayor) and Special (Districts 1 and 2)
Elections were postponed to the November 3, 2020 Uniform Election date. The adopted
ordinances were written in a way that would have required no further action from the City Council.
On July 27, 2020, Governor Abbott extended the early voting period to three weeks. As a result,
the ordinances must be amended to update the early voting period dates and will be submitted for
adoption in September.
NOVEMBER 3, 2020 GENERAL & SPECIAL ELECTION
The early voting schedule is as follows:

Each year,the City contracts with the Denton County Elections Department(County)to administer
a joint election with other jurisdictions who will hold an election on any Uniform Election Date.
Unlike for elections held in May, local political subdivisions are required to use county election
precincts and county polling places for elections held on the November uniform date, pursuant to
Title 4, Chapter 42, Subchapter A, Section 42.002, and Subchapter C, Section 42.0621 of the
Election Code. The County does not anticipate having locations finalized until late September.
Exhibit A, outlines the proposed locations within the City of Denton. Confirmation on some
locations are still pending.
As was reported at the August 4, Work Session, the County is diligently working to identify
approximately 50 early voting locations as well as open a voting location in every county precinct
that has 750+registered voters.
Canvassing of the elections is scheduled for the Regular City Council Meeting on Tuesday,
November 17. The Runoff Election will be ordered at that time if necessary. More information
will be provided after November 3 on how the canvassing and related issuance of the Certificate

of Election and Oaths/Statements of Office will be handled as we will be better able to gage how
meetings need to be handled around that time.
COST
A cost estimate is not available at this time. The County confirmed participating jurisdictions that
postponed elections to November 3,will be charged as if the elections were still being held in May.

The contract with the County will also apply to the Runoff Election. Polling locations for early
voting/election day will be determined at the time the election is ordered. The City will have more
flexibility regarding the locations to be used.
A Special Called City Council meeting will be needed to canvass these results and is being
scheduled for Thursday, December 17. Outlook calendars will be updated. Again, more
information will be provided after November 3 on how the canvassing and related issuance of the
Certificate of Election and Oaths/Statements of Office will be handled as we will be better able to
gage how meetings need to be handled around that time.
COST
The cost estimate is not typically available in advance of a runoff election as they vary, and are
largely based on the number of participating jurisdictions.
SOCIAL DISTANCING & SAFEGUARDS
The County will provide a Personal Protective Equipment (PPE) station in all polling locations.
This includes sanitizing stations, hand sanitizer, cleaning solutions, gloves,protective shields, etc.
They remain committed toward ensuring social distancing to the extent possible at all polling
locations.

CANDIDATE PACKET—MODIFIED
The modified Candidate Packet is available here. It was modified to include information and
deadlines for candidate filings in accordance to the Election Code, Texas Secretary of State, and
Ethics Commission mandates which are applicable to any November 3, 2020 election candidate.
CONCLUSION:
As noted, the County has identified locations which must be used. However, if City Council
desires to add location(s), the request will be submitted to the County who will have the final say
on its potential use. Should they agree, the City will be obligated to pay the full cost for use of
that facility. For any Runoff election, that restriction does not apply.
Comments, suggestions or recommendations on the use of any locations within the City should be
sent to the City Secretary's Office by Friday,August 28. A work session will be scheduled in mid-
September to report the results of input received.

FYI 9-20 Second and Third Quarter Special Events Update.
BACKGROUND:
On June 18, 2019, the City Council approved Ordinance 19-1160, outlining requirements for
special events and implementing an improved application process. Additionally, $280,000 was
allocated in the current fiscal year budget to support in-kind requests for co-sponsorship that
historically were subsidized by impacted City departments. Of the budgeted amount, $250,000
went to special events, and $30,000 went towards inclement weather-related requests.
Under the new ordinance, the Denton Parks and Recreation Department (PARD) provides
Council with a quarterly report that includes information on the granting or denying of permit
applications and the status of the co-sponsorship budget.
DISCUSSION:
In the second quarter of FY 19-20, there were no denials of applications. PARD approved one
co-sponsorship to Tejas Storytelling Festival for $2,932 during the reporting period. By the end
of the second quarter, the City Council had authorized a total of$26,811 in co-sponsorship
support for six special events.
The COVID pandemic significantly impacted special events during the third quarter of FY 19-
20. The City suspended all special events, with gatherings of large groups largely restricted.
PARD approved one event for co-sponsorship during the reporting period. The event was
Juneteenth for $3,310. The City Council has authorized a total of$30,121 in co-sponsorship
support for the following seven special events:

CONCLUSION:

The COVID pandemic began to impact events towards the end of the second quarter. Special
events continue to be considerably restricted. PARD has suspended the permitting process at this
time; however, PARD staff is working with event organizers to plan future events while ensuring
compliance with the State's Minimum Standard Health Protocols. Upcoming requests for in-kind
services will be submitted to Council with detailed information on the budgetary impact and status
of available funds.

REGISTRATION GUIDELINES FOR ADDRESSING THE CITY COUNCIL
Due to COVID-19 precautions, members of the public will not be able to attend the September 1, 2020
City Council meeting in-person. To accommodate and receive input on agenda items, citizens will be able
to participate in one of the following ways (NOTE: Other than public hearings, citizens are only able to
comment one time per agenda item; citizens cannot use both methods to comment on a single agenda item.
Public comments are not held for work session reports.):
• Virtual White Card — On August 28, the agenda was posted online at
www.cityofdenton.com/publicmeetings. Once the agenda is posted, a link to the Virtual White Card, an
online form, will be made available under the main heading on the webpage. Within this form, citizens may
indicate support or opposition and submit a brief comment about a specific agenda item. Comments may
be submitted up until the start of the meeting, at which time, the Virtual White Card form will be closed.
Similar to when a citizen submits a white card to indicate their position on the item, these comment forms
will be sent directly to City Council members and recorded by the City Secretary.
City Council Members review comments received in advance of the meeting and take that public input into
consideration prior to voting on an agenda item. The Mayor will announce the number of Comment Cards
submitted in support or opposition to an item during the public comment period. Comments will not be
read during the meeting. The City Secretary will reflect the number of comments submitted in
favor/opposition to an item, the registrant's name, address, and (summary of) comments within the Minutes
of the Meeting, as applicable.

• By phone — Citizens wishing to speak over the phone during this Council meeting, may call (940)
349-7800 beginning 30 minutes prior to the meeting start time. Comments by phone will be accepted until
the item is opened for discussion by the Council. When the call is initially received, a staff member will
receive the caller's information and either: 1) offer to call the citizen back when it is time for them to speak,

municipal corporation, granting to Atmos Energy Corporation, Mid-Tex Division, a Texas
and Virginia Corporation, its successors and assigns, a non-exclusive franchise to furnish,
transport, and supply natural gas to the general public in the City of Denton and Denton
County, Texas, to construct maintain and operate pipelines and equipment in the City of
Denton, Texas, for the transportation, delivery, sale, and distribution of natural gas in, out
of and through said city for all purposes; providing for the payment of a fee or charge for
the use of the public rights-of-ways; providing that such fee shall be in lieu of other fees
and charges, excepting Ad valorem taxes; repealing all previous Atmos Energy Gas
Franchise Ordinances; prescribing the terms, conditions, obligations and limitations under
which such franchise shall be exercised; a most favored nations clause; a severability
clause; and providing an effective date.
