Pending Council Requests Work Session Topics—Pursuant to Ordinance No. 19-2026, the following items will be discussed during the August 25 City Council work session. Repealing the prohibition on sleeping in cars. a. Requestor: Council Member Armintor b. Council Member Request: Section 17-101 of our city code states that it is "unlawful to use a vehicle for living or sleeping quarters, or for the storage of trash, debris or personal property not normally associated with the vehicle." Municipal laws like this that criminalize sleeping in cars are among the laws singled out by the Texas Homeless Network (THN) as in need of repeal for effectively criminalizing homelessness. We should not ignore such recommendations from THN, a highly respected organization that the Denton County Homeless Coalition lists as an essential collaborator (see: hops:Hendhomelessnessdenton.com/: "DCHC is comprised of representatives from nonprofit agencies, Denton County cities, school districts and other community stakeholders. The coalition works with the Texas Homeless Network (linked), the lead agency for Denton County's Continuum of Care (CoQ, the Texas Balance of State (BoS). DCHC implements CoC strategies and Denton County and promotes collaborative strategies for state and federal homeless funding opportunities." Before COVID49, I tried and failed to get majority consensus on Council to repeal all of our laws that criminalize homelessness, having corresponded with THN to consult with them beforehand,and suggested repealing them to Council all at once. Now under COVID-19, with our shelters only open at limited capacity,and only 70 or so rooms available, and encampments being razed, I am trying again,but this time bringing each law before you individually, one at a time, in the hope that I can get consensus to at least temporarily repeal this one prohibition against sleeping in cars, and then take each subsequent law criminalizing homelessness one at a time so that Council won't feel pressured to consider them together as an all-or-nothing bundled proposition. Although sleeping in a car nightly and living out of a car is far from safe or ideal, I think we would all agree that if we found ourselves without a home and nowhere else to go, sleeping in a car on public property (or on private property or in a Walmart parking lot) would be safer under COVID49, in inclement weather, or under any other circumstances than the alternative of resting your body and possessions out in the street or in an outdoor encampment on public property. Many people living out of their cars are employed, which makes sense if you look at what people are making and compare that to the price of rent and life. 2 Please keep in mind that trespassing on private property would still be illegal and would still require a complaint by the property owner. So, repealing the prohibition on sleeping in cars does not prevent a private property owner from calling police on somebody trespassing on their private property in a vehicle or on foot, sleeping or awake. I would like us to have a work session considering permanently repealing this law or at the very least temporarily suspending it or making it no-priority enforcement for the duration of our COVID-19 emergency or until we can guarantee a safe hotel room or safe shelter for everyone to shelter in place. Housing first; but until we have sufficient safe housing and shelter available, a car with a roof, walls, and a lock, is safer for Denton residents without homes than sleeping out on the street or in a tent. Thank you for considering my request. Thanks to my constituents experiencing homelessness who tell me about their lives now and before they were homeless.And thanks to everyone out there in the public who sees them as people who once had homes too. Please consider that, and the power we have to make a difference by removing unnecessary barriers, as you consider this modest request to repeal a law that harms people and helps no one. c. Staff Information: Staff reviewed records from the Municipal Court database and were unable to locate any citations that were processed for an individual sleeping in a vehicle within the past five years. Specifically,the City Code section that Council Member Armintor cites is a Property Maintenance Code (PMC) provision. This code sets forth certain property maintenance requirements for industrial, commercial and residential property owners. Any violations of the PMC may result in a citation issued against the property owner. In the example cited above, it is not the occupants sleeping in the vehicle that are being cited. Rather the property owner who allowed this to happen is the one cited. Because this is a PMC issue, Community Improvement Services respond to this issue. In the last five years, there has not been a citation/summons for persons sleeping in vehicles. While there have been some cases reported, the majority of these involve people staying in RV's or trailers in private driveways or backyards. d. Date Requested: June 15, 2020 e. Requested Format for Response: Work Session B. Utility Assistance Communications — At their August 25 meeting, the City Council requested staff engage in a communications campaign to encourage utility customers to address outstanding payments prior to service interruptions. Utility assistance has been a key topic throughout the City's communication efforts in response to the COVID-19-19 pandemic. Information about service interruptions and/or utilities- related relief funds has been shared on the City's official social media channels on a weekly basis from April through June, and on a biweekly basis in July and August. Additionally,information was provided to the community in the special COVID-19-19 3 and August/September issues of the Resident Update newsletter,which were mailed to Denton households in May and August, respectively. In the coming weeks, additional social media messaging regarding utility assistance funds; payment options, including Pay As You Go; and the United Way COVID-19-19 Relief and Recovery funds will continue to be shared. Future communications will also include dedicated, featured images/links on the homepage of the City's official website, continued print communications to utility customers, and a press release encouraging customers to call City of Denton Customer Service to avoid service interruption. The City has also reached out to community partners, such as the Denton Independent School District to amplify this critical message. Evaluation of Dyno Dirt — The City of Denton converted from land application of wastewater treatment plant sludge to 100%composting of the sludge in the mid-1990s. To create the compost, sludge is mixed with wood waste and is composted to produce a product that meets all requirements to designate the product as a"Class A Biosolid". The Class A Biosolid designation is the highest classification attainable for biosolids under 40 CFR (Code of Federal Regulations) Part 503. To meet these requirements, Dyno Dirt products undergo rigorous testing to ensure that both biosolids and finished compost meet the requirements of both 40 CFR Part 503 and 30 Texas Administrative Code (TAC) Chapter 312. Dyno Dirt (and related product Dyno Soil) are the only products produced by Denton's Beneficial Reuse Program that contain sludge from the wastewater treatment plant. Staff conducted extensive research regarding the use of an external parry to evaluate the Dyno Dirt sampling data and program. Staff approached this evaluation with the idea of having two independent researchers that are recognized experts in the field of risks associated with biosolids perform the evaluations. Since one of the issues of concern is the presence of unregulated contaminants, staff also sought out individuals that had knowledge of the topic of risks associated with non-regulatory compounds based on biosolids research done across the United States.With these variables in mind, staff identified Dr. Sally Brown,University of Washington, and Ben Davis with Renda Environmental as potential candidates. Staff contacted both individuals, and both are willing to examine Denton's regulatory sampling data (recent data is available at https://www.cityofdenton.com/en-us/residents/services/dyno-dirt). These researchers will also discuss the broader context of risks associated with non-regulatory contaminants (which are currently not sampled for Dyno Dirt)based on their research. Dr. Brown is a well-known researcher on the issue of municipal biosolids and has published many papers on this subject. Ben Davis served as the chair of the Sustainable Residuals Use Subcommittee for the Water Environment Federation's Residuals and Biosolids Committee and was one of the authors of a 2017 research paper entitled "Land Application of Biosolids: Human Health Risk Assessment Related to Microconstituents". He has worked on numerous projects associated with biosolids and has been on several panels discussing these issues Dr. Brown and Mr. Davis are currently evaluating sampling and operational data provided by staff, which includes data on all regulated contaminants from sampling conducted over the last approximately 25 years. They will also discuss the relative risks of non-regulated contaminants based on their evaluations of data from similar 4 operations. Staff also requested that they provide any operational recommendations that may improve our products. Schedules for presentations of findings are still being finalized but should be able to be presented in late September to early October. Staff contact: Kenneth Banks, Environmental Services D. Request for Extension of Green Tree Estates Disaster Declaration—On August 27,staff received an email from a Green Tree Estates advocate notifying the City that they had completed the process of establishing private easements for the installation of the private service lines that will connect properties to the City water system. In the email the advocate also requested that the declaration of disaster for the neighborhood be extended two weeks (to September 14) to allow temporary water service to continue while the private lines are installed. The advocate noted that signature delays kept the easements, and thus the plumbing work, from being completed before the end of August. Due to the current declaration of disaster expiring on Monday, August 31, Council could not consider extending it at its September 1 meeting. As a result, Mayor Watts will issue a new declaration of disaster prior to the September 1 City Council meeting. During the meeting, council would have the opportunity to consider extending the Mayoral declaration through the period requested by the Green Tree Estates neighborhood. If approved by the council, temporary water service would continue in its current fashion until the declaration expires. Staff contact: Ryan Adams, Customer Service and Public Affairs E. Cooling Stations — Based on the forecasted weather, the Civic Center is open Friday, August 28 through Saturday, August 29 as a cooling station from noon to 5 p.m. The center is also preparing for Sunday and Monday if the temperatures remain high. When the weather reaches 100 degrees, the Civic Center opens to provide relief to anyone needing access to water,restrooms, and a place to be out of the sun. Masks are required for everyone who enters the building. Disposable masks and hand sanitizer are available, and chairs are six feet apart. The entrance is through the plaza, which faces Quakertown Park. More information can be found in the attached flyer. Customer Service Update — As reported to the City Council, interruptions of utility service began Tuesday,August 18. Currently,there are 1,511 residential, multi- family, and business accounts which are past due and eligible for interruption. No customer has received a late or interruption fee. Service restoration is being made with partial payment, pay arrangements, and agency referrals as appropriate for the individual customer's situation. No deposits are being assessed due to interruption of service. Upon speaking to customers, referrals for agency assistance are being submitted and the account exempted from interruption during processing. For the month of August to date we have received a total of 507 pledges totaling $95,013.93 in vital assistance for customers. Staff contact: Christa Foster, Customer Service and Public Affairs G. Denton Police Department Mental Health Division News—Denton PD's Mental Health Division is making progress towards being fully operational. The Division will house the Crisis Intervention Response Team and the Homeless Outreach Team. Both teams seek to provide critical services to vulnerable populations in the City of Denton and divert individuals away from the criminal justice system. Many people and organizations have contributed to this process and Denton PD would like to thank them publicly for all their work. The intent of the attached newsletter is to inform officers, partners, and citizens of the division's progress and goals. Staff contact: Frank Dixon, Police H. Hercules Construction Update — There are three separate segments that are either currently under construction or are planned for construction along Hercules Lane: Locust to Meadowtrail, Stuart to Locust, and Stuart to Sherman (see attached map). For the Locust to Meadowtrail segment, the roadway is complete and open to traffic. A speed study will be completed in fall 2020 and feedback signs have been ordered that will help calm traffic once installed. An LED stop sign will be placed at Locust and Hercules to make the intersection more visible. Sidewalks are being constructed along the north side of Hercules and should be completed by September 30, 2020. Bike lanes for this segment are programmed for instillation in Spring of 2021. The second segment under construction is Stuart to Locust. This section of roadway will include the addition of bike lines on either side of the road. Currently, one lane is open from Stuart to Redstone to allow access to the residences in the area. Work on the closed lane is scheduled to be completed by September 9,2020,when they will shift to the other lane to begin work. That lane is projected to be closed until October 25,2020. Construction on the entirely of the second segment is scheduled to be completed in early calendar year 2021. 6 The third segment under construction is Sherman to Stuart. This segment is being constructed as part of a public-private partnership and has been broken into two phases, phase one being Sherman to Sheraton and phase two being Sheraton to Stuart. Phase one includes a sidewalk installation on the north side of Hercules as well as a full reconstruction of the roadway. This phase is currently under construction and will be completed by the end of September 2020. The City is currently working with the developer regarding the reconstruction schedule of phase two, however, the work is scheduled to be completed by the summer of 2021. Bike lanes for both phases of this segment are also programmed for instillation in Spring of 2021. Staff contact: Todd Estes, Capital Projects I. Leaning Light Poles — On August 26, Council Member Meltzer forwarded concerns from residents regarding severely leaning light poles at four (4) different locations around the city. DME staff went out the same morning to check on the poles listed,and they have put in a work order to straighten the unguyed poles and the stub poles that belong to DME. The electrical corner pole that leans is guyed opposite the lean and is safe. The work to straighten these poles will be completed once crews return from Hurricane duty in the gulf. Staff contact: Tony Puente, Utilities J. Update for Yellowstone Place - On August 18, Council Member Briggs requested an update of the status and condition of Yellowstone Place. The section from Monterey Drive to Kings Row was reconstructed in May of 2019 and remains in exceptional shape, with an Overall Condition Index (OCI) of 97.5. The two remaining street segments on that stretch, Sun Valley Drive to Imperial Drive and Imperial Drive to Kings Row, have an OCI of 60.01 and 38.68 respectively. Maintenance for both sections is tentatively scheduled for Spring of 2021. The final northern section from Juno Lane to Hercules Lane will require a full reconstruction and is included as part of the 2019 bond program approved by Council last fall. Streets staff have been in contact with homeowners along this stretch and have completed patching and other interim repairs over the past year to provide interim condition improvements. Staff returned to investigate the site last week, based on staff s assessment, the road condition has not worsened since the repairs were completed. Based on current projections, staff anticipates construction will begin on Yellowstone Place as early as 2023. In the interim, staff will continue monitoring this segment and will expedite the reconstruction of Yellowstone Place if its condition further deteriorates. Information on Counterfeit Denominations—On August 27,Mayor Pro Tern Hudspeth forwarded an inquiry from a concerned citizen about counterfeit denominations. Particularly, the request asked if there are denominations that are counterfeited more than others. Police Department staff currently finds that the $50 and $100 denominations are counterfeited more than others. In the most recent cases, the bills are marked "for motion picture use only." Parks and Recreation Department Waivers — The Parks and Recreation Department (PARD) implemented a new process for all programming, including sports and field rentals,to address the COVID-19 pandemic. This new process includes the completion and submission of Return to Play Plans and COVID-19 waivers. The purpose is to ensure compliance with applicable federal, state, and local orders, implement the recommended health protocols, and provide notification to participants regarding COVID-19 risks. Contractors, organizers, and renters are now required to submit information or a plan that shows how they will comply with the current orders in place. This information is documented on a Return to Play Plan. Additionally, PARD COVID-19 waivers, available in English and Spanish,must be completed and submitted by every participant in their activity or event. COVID-19 waivers are also obtained from all participants in PARD programming. All documents are in fillable PDF form that can easily be shared electronically or printed as needed. The forms can be electronically completed and submitted. The documents can also be printed, completed and scanned to us. For those participating in a PARD program,the waiver is acknowledged and submitted as part of the online registration. Attached are samples of some of the required documentation. These documents are shared up front with our contractors and anyone wanting to host an activity or event on City property as allowed under the current orders. Staff works closely with them in providing detailed instructions and remaining available to assist throughout the process. While groups and organizations can have their own waiver and safety plan, PARD's Return to Play Plans and COVID-19 waivers have been reviewed and approved by the City's Legal Department and are required prior to holding the activity or event. M. Bike and Pedestrian Concerns on Sherman Drive — On August 20, Council Members Briggs, Armintor, and Meltzer forwarded citizen concerns regarding the bike and pedestrian safety on Sherman Drive. When the development at Stark Farms was approved, the addition of turn lanes on Sherman Dr. were a part of the approval. The developer accomplished this construction by using a part of the existing shoulder to provide the new traffic lanes. The remaining shoulder area does not provide a 8 comfortable space for bicyclists or pedestrians.While this is a standard TxDOT design, staff feels that improved bike/pedestrian accommodations can be provided. Staff is currently working with the developer and TxDOT to determine an appropriate solution to this issue. Because it may require adding pavement to Sherman Dr., the ultimate resolution to this issue may take several months. Staff contact: Brian Jahn, Capital Projects N. Requests for Traffic Calming at Various Intersections— On August 21, Council Member Briggs requested a 4-way stop at Emerson and Nottingham to provide a safe crossing to the park area and for kids to cross walking home from school. On August 26, Council Member Briggs also requested a stop sign at the intersection of Bryan and Linden. Staff will begin the evaluation process for determining the feasibility of installing an ALL-WAY STOP at both of these intersections. In addition, staff will place the Bryan and Linden intersection in the queue and conduct a speed survey of all approaches. These analyses will be delayed,however,until school is back in session on campus (which is currently scheduled to be September 8 at the earliest) so as to give staff the best opportunity to satisfy the necessary warrants. Keep Denton Beautiful— In 2018, with new recommendations following the Parks Foundation audit, the City of Denton began collaborating with the nonprofit partner, Keep Denton Beautiful, Inc. (KDB) on an updated contract. In September 2018, City staff presented at a Denton City Council work session to seek advisement on the new contract. Negotiations continued into 2019, and all parties agreed to reorganize KDB within the Parks and Recreation Department (PARD). KDB's Board of Directors and COD staff have worked closely over the past year to ensure the best outcome for the community beautification programs. On March 2, 2020, PARD staff and KDB jointly presented a new contract during a council work session, which brought up new questions about the sustainability of the hybrid public-private structure. Soon after, KDB considered possible organizational changes to best support programs, and ultimately, the board voted to transition all existing programming to the City and consider dissolving the nonprofit arm. The board has since taken steps to transition KDB initiatives, financial assets, and intellectual property to the City. The KDB, Inc. board members and City staff have been working diligently to execute a transition plan in the Denton community's best interest. PARD staff have the passion for continuing the heritage of KDB and its mission of creating a clean and beautiful Denton. PARD staff will continue to plan and implement programs with funding included in the FY 2020-2021 City of Denton budget. PARD staff will rely on the Parks, Recreation, and Beautification Board to provide community input, as needed. STAR Texas Environmental Leadership Awards — The City of Denton Sustainability and Solid Waste Department were awarded the Outstanding Public Outreach Program award last week for their social media outreach and engagement. They had previous won the award for the North Texas region but recently learned that they had also won at the State level. STAR stands for the State of Texas Alliance for Recycling and is focused on advancing recycling in the State of Texas. Sustainability has been working with the Solid Waste Department to promote messages online that increase awareness around recycling in our community. Since 2019, they have been able to increase their followers by 22 percent on Facebook and 182 percent on Instagram. Staff Contact: Katherine Barnett, Sustainability Q. Clear the Shelter Update—The event officially ends this Saturday, August 29, and the adapted event's support has been incredible. The Denton Animal Shelter quickly began scheduling appointments, and currently have 144 appointments made. As of Monday, 60 animals found their forever homes, and many more are still up for adoption. In 2019 the shelter adopted 98 animals and expects the modified event for 2020 to be just as successful. Staff contact: Randi Weinberg, Animal Services R. Animal Fosters Needed for Hurricane Laura Evacuees—The Denton Animal Shelter is expecting the need for dog and cat fosters to increase as Hurricane Laura evacuees arrive in Denton. While the evacuees are housed in Denton, they are often unable to keep their animals with them. Denton Animal Shelter would temporarily house the animal or place the animal in foster care until the owners could safely return home. Denton Animal Shelter Food Pantry- Due to the COVID-19-19 pandemic and shutdown, Denton Animal Shelter began a dog and cat food pantry for pet owners in need. The pantry is still open for Denton residents who may need help providing food for their pets. Anyone interested should call (940) 349-7549 to set up an appointment to pick up the food. After much reflection and research, a vision began to emerge with compassion at its core. Compassion is feeling deep sympathy for those stricken by misfortune, accompanied by a strong desire to alleviate that suffering. We must strive to have compassion in our interactions with our community, as we most certainly would want for our loved ones. The mission of MHD is "To serve our most vulnerable citizens with compassion and steadfastness by connecting those in a serious mental health crisis or experiencing homelessness with help. The Mental Health Division strives to reduce arrests of people suffering from mental illness while increasing the likelihood they will receive mental health services." Our Crisis Intervention Response Team and Homeless Outreach Team are committed to this endeavor and will meet any challenges with grace, resilience, and creativity. Denton Police Department, a& . - ..-, "The One Mind Campaign seeks to ensure successful interactions between police officers and persons affected by mental illness. The initiative focuses on uniting local communities, public safety organizations, and mental health organizations so that the three become `of one mind'. To join the campaign, law enforcement agencies must pledge to implement four promising practices over a 12-36-month time frame. These practices include: establishing a clearly defined and sustainable partnership with a community mental health organization, developing a model policy to implement police response to persons affected by mental illness, training and certifying sworn officers and selected non-sworn staff in mental health first aid training or other equivalent mental health awareness course, and providing crisis intervention team training." The MHD is already in the process of instituting these practices. We have collaborated on two grant opportunities with MHMR, and an MOU is set to go before Council. General orders on crisis intervention and EDOs are being drafted with the help of our subject matter experts and partners. Training is currently being assessed with a plan for implementation. The One Mind Campaign will L Lring credibility to the MHD and will serve as a stepping stone to other program certifications. 3 . HOMELESS OUTREA H.O.T., in partnership with service providers, has been working relessly to connect people experiencing homelessness with services in the City of Denton. Going into a campsite is not without risks. These are often areas that must be trekked out into where debris and waste has accumulated that presents hazards to the team and people residing there. Our amazing partners in this effort are Carrie Powell with Vision and Wendy Noble with Giving Hope. There are many other considerations and partnerships that have come to the forefront as this process is explored. We have already made great strides in understanding the process and getting stake holders on board. All of this is critical in the creation of our EDO general order. 5 . COLLA ORATION The MHD might reside in the PD, but it has been a collaborative effort from day one. Here are some of our partners in this journey. - • • — This relationship is critical to our success. xecu ive Director Pam Gutierrez and the Administrator of Mental Health & Crisis Services, Brittany Waymack, have provided valuable feedback and information. We have collaborated on two major grant solicitations, one of which has already been awarded. One grant will bring tele-medicine into the hands of patrol officers at crisis scenes, and the other will bring two social workers from MHMR into the MHD. MHMR is developing training for Denton at soMent irst Aid and suicide intervention. Chief Corolla has been working on implementing th cess at his agency for the last three years. He serves on the Judicial Commission on Mental Health and has blazed a trail that has made it significantly easier for us to achieve the same goals. Chief Corolla graciously provided invaluable information and advice to us. • ' • • - M- Chief Executive Officer Loren Fouch has given her support and has offered training for the PD. This is another key relationship that will aid us in development. Training on Mayhill Hospital's procedures and es be forthcoming. • • - - The Honorable Judge Jahn has offered his support and re he MHD.
