Pending Council Requests Work Session Topics—Pursuant to Ordinance No. 19-2026, the following items will be discussed during the August 25 City Council work session. Installing a "Wall of Fame" at the American Legion Hall a. Requestor: Mayor Pro Tern Hudspeth b. Council Member Request: Outline: Wall of Fame at American Legion Hall. Format for response: Draft budget for implementation.Desired outcome:Using the medallion or QR technology for history of key Southeast Denton Residents. It is one of the most rented buildings in the city and renters can learn about the community. I would advocate,we interview the key residents now and they can record a message for visitors (Ms. Cole, Ms. Minter, Ms. Kimball, Ms. Clark, etc.). I would like to include the data captured on the rail trail. Also, the city should connect with the UNT Professor that has the footage from Freedman Town 2.0 (Carla Carter-professor of media arts at UNT). c. Staff Information: There are currently two historical art projects being considered for the ALH. Staff will seek community input as the projects move forward. The first project is a public art piece honoring the Denton Women's Interracial Fellowship (DWIF). The group was formed in 1964 at the height of the Civil Rights Movement, consisting of African-American and Anglo-American women in Denton concerned about their children's adjustment to school integration and working together to ease the process. The monument is currently being considered to be placed on the north side of ALH within Fred Moore Park. The project budget is $80,000 and will be complete by August 2021. The second project,as proposed by Mayor Pro Tern Hudspeth,provides a vision for a Wall of Fame in the ALH highlighting the history of key Southeast Denton 2 residents. Based on initial research, some resources are already available including the history along the DCTA Rail Trail and UNT Oral History Collection with members of the DWIF including Ms. Betty Kimble and Ms. Catherine Bell. DTV estimates 5 to 6 hours of staff time per interview for the production and editing of additional oral histories. The project is anticipated to take 45 hours of staff time and cost $15,000 in display equipment. The ALH construction is scheduled for completion at the end of February 2021 and the Wall of Fame could be placed in the loggia. d. Date Requested: August 25, 2020 e. Requested Format for Response: Work Session B. Public Works Organizational Updates — With the recent departure of Todd Estes to pursue an opportunity in the private sector,Becky Diviney has been appointed Director of Capital Projects and City Engineer. Becky,who served as the Deputy City Engineer since May 2020,has over 15 years of service to the City of Denton and recently served as the Deputy Director of Water and Wastewater. Becky's former role as the Deputy City Engineer, along with a few other structural changes to the Capital Projects Team, will be filled in the upcoming weeks. Rachel Wood,who is now serving as Deputy Director of Business Services over Public Works, will move to the role of Deputy Director of Capital Projects. The Business Services role provides a unique opportunity to get involved with the Public Works Team under the direction of Ethan Cox. Additionally, the Capital Projects and Engineering Department in Public Works will be re-organized under Becky to three distinct divisions, including: • Engineering: Led by the Deputy City Engineer(Vacant) • Capital Project Delivery: Led by the Deputy Director of Capital Projects (Rachel Wood) • Public Works Inspection: Led by the Public Works Inspection Supervisor(Rob Plato) To consolidate strategic operations under the same leadership, the Traffic Operations Division will be moved under the direction of Daniel Kremer, Deputy Director of Operations. This move is intended to improve coordination and project efficiency between Streets, Drainage, and Traffic Operations. The Public Works Team is excited about the new opportunities and wishes everyone well in their new endeavors. Please welcome Becky and Rachel to their new roles. Staff contact: Ethan Cox, Public Works C. New Grants Administrator — Laura Behrens has been promoted to the new Grants Administrator for the City of Denton. As Laura has completed for the Parks and Recreation Department in helping build new processes and policies, she will create a group to oversee grant management for the entire City. This new role will work collaboratively with Departments to analyze grant opportunities, write grant applications, ensure compliance, and complete appropriate reports on outstanding grants. The need for this role was identified through an internal audit that recognized some weaknesses in the City's grants management operations. Laura will continue to help during the transition, however, her last official day with Parks and Recreation will be September 11. Staff is currently working with Ralph 3 Andersen & Associates to facilitate the recruitment and interview process for the Assistant Director position. Staff contact: David Gaines, City Managers Office D. Chief Technology Officer Update — Melissa Kraft has been selected as the Chief Information Officer for Dallas County. Please join the City of Denton in congratulating her on her new appointment. Staff are currently working with Ralph Anderson and Associates regarding a national recruitment for Melissa's replacement. Ad Hoc Use-of-Force Committee Update — The ad-hoc Use-of-Force Committee has met several times through the last few weeks to receive information and discuss areas related to use-of-force in the Denton Police Department, including policy, training, accreditation and compliance,transparency and reporting,internal affairs,and potential civilian oversight options. The Committee has two additional meetings scheduled, September 17 and September 24, to discuss and finalize recommendations and conclude its work with a final report to City Council. A presentation is scheduled to be delivered to City Council during the October 5 luncheon. Staff contact: Sarah Kuechler, City Manager's Office F. Auto-Draft Issue Affecting Online Bill Pam —Customer Service has identified and corrected an issue affecting online bill pay users with scheduled payments between the dates of August 15 and September 11. Payments that were scheduled in the online bill pay portal to be deducted during the noted timeframe may not have drafted from customer accounts. This has resulted in a large number of customers with scheduled payments receiving a call as the balance has become past due. The problem has been corrected and all registered users of the online bill pay system will receive notification via email today. This issue is estimated to affect less than 3,000 customers. Completion of Green Tree Estates Connections —Prior to and during the September 1 City Council meeting, Green Tree Estates residents and advocates requested a two- week extension to the declaration of disaster in order to allow for the remaining six households that paid connection fees to facilitate their connection to the City of Denton water system. As of September 9,2020,all seven(7)Green Tree Estates properties that paid tap, meter, and impact fees have been connected to the City water system. Additionally, all connections have been inspected and customers may create standard residential water accounts with the City and begin service on a permanent basis. The addresses that have connected are listed below: • 4055 Ash • 6509 Willow • 4008 Hickory • 4010 Hilltop • 4011 Hilltop • 4119 Ridge • 4002 Hickory 4 The remaining eight(8)properties have not indicated to the City a plan or intent to pay the tap, meter, and impact fees that would allow connection to the City system. Temporary water provision will continue to these 8 properties until the expiration of the current declaration of local disaster on September 15. After that time, temporary water provision will cease. Properties may connect to the City at any future time provided tap, meter, and impact fees are paid and all applicable code requirements are met. Properties that have connected will be provided solid waste and recycling services including solid waste and recycling carts. Since the roads of Green Tree Estates are private property, the City will lose its authority to access private property to provide services once the current declaration of disaster has expired. As a result, City cannot then enter the neighborhood and drive on its private roads to provide solid waste and recycling services at each individual property.Additionally,the roads are not improved to the extent that they could withstand the weight of solid waste vehicles without suffering damage over time and could become impassable during inclement weather. After a staff review, the nearest accessible right of way for collection was determined to be located at the northeast corner of the intersection of Rolling Green Road and Swisher Road. This location would not require the solid waste truck to drive in reverse in a residential neighborhood (a safety hazard) and is closer to more of the properties that connected.Residents will be notified of solid waste and recycling collection details when their carts are dropped off by City staff. The City will also begin to address any substandard structures within the Green Tree Estates neighborhood. This includes structures that are not inhabited,but pose a risk to the health, safety, or welfare of the public. Additionally, any structures that are occupied, but not connected to an approved water source, are required to come into compliance with state and local regulations. If a building is determined to be substandard as a result of the absence of an approved water source, the City will issue a notification that includes a timeframe to come into compliance. If no compliance is achieved (i.e. the residence continues to be occupied without a connection to an approved water source) a public hearing with the Health and Buildings Standards Commission (HABSCO) will be scheduled. Ultimately, the Commission will make a final determination on the structure. The full enforcement process, including HABSCO hearings and subsequent steps to achieve compliance, could last from six to nine months or longer. A final report of total expenditures regarding the declaration of local disaster for Green Tree Estates will be provided in future Friday Report. Online Billing Portal Issue — Approximately two weeks ago, Customer Service discovered that customers logging into the online billing portal can see their current balance,but do not have access copies of their bills. Staff are actively engaged with the vendors in attempts to correct the problem. We believe the issue to be corrected as of this afternoon, but are in the process of confirming that fact. 5 Customers may contact Customer Service at (940) 349-8700 to obtain a copy of their bill or they may email customerservicekcityofdenton.com from their registered email address. The outage impacts approximately 16,000 customers who do not receive paper bills. Although these customers can see their balance due, we understand they may hesitate to make payment without having seen the itemized billing statement. For this reason, all customers who do not receive a mailed statement have been exempted from receipt of fees or interruption due to charges accumulated during the outage. Once the issue is resolved, all registered users of the online billing portal will be notified via email that statements are available. The billing portal message has been updated to alert customers to the known outage with information for requesting bill copies. Customer Service is continually dedicated to protecting our customers and providing exceptional service despite the unexpected. Staff contact: Christa Foster, Customer Service and Public Affairs I. Fair and Impartial Policing Course — On September 10 and September 11, several residents from the Denton community sat side by side with the Denton Police Department (DPD) Command and Executive Staff to attend a Fair and Impartial Policing course. This class is one of many implicit bias trainings mandated for all DPD officers and is tailored explicitly to address the needs of both police and the community. The training covers the science of bias, its implications for policing, and the elements of a comprehensive agency program to promote fair and impartial policing. DPD is grateful to the many community members who took the time to attend this course and offer their feedback. Representatives from the following community groups attended: • NAACP • LULAC • Local clergy • Community advocates • TWU Department of Public Safety • UNTPD • Homeless advocates • CACDC Members from other organizations were unable to attend, but we are looking to have this training on an annual basis to work together in making Denton better. Arts and Auto Waiver— On August 28, the Denton Main Street Association (DMSA) submitted a request for Mayoral approval to hold series of modified Arts and Autos events over four weekends in September and October. These events would consist primarily of an auto caravan, limits to participation, social distancing protocols, and no closures of City Streets. Additionally, the DMSA included precautionary measures in light of the COVID-19 pandemic. The Mayor's letter of approval is attached to this report as is the request from DMSA and the Texas Department of State Health Services minimum health protocols for outdoor events. Currently, there are 108 residential, multi- family, and business accounts which are past due and eligible for interruption. Service restoration is being made with partial payment, pay arrangements, and agency referrals as appropriate for the individual customer's situation. No deposits are being assessed due to interruption of service. Upon speaking to customers, referrals for agency assistance are being submitted and the account exempted from interruption during processing. From the month of August to date we have received a total of 778 pledges totaling $149,795.15 in vital assistance for customers. Staff contact: Christa Foster, Customer Service and Public Affairs L. Milam Road—On September 1, Council Member Meltzer requested information about future road work for Milam Road. Milam Road, which is split by Interstate 35, is not owned by the City of Denton. The section that runs east of I-35 is FM 3163 and is the responsibility of TXDOT. The section to the west of I-35 is owned and maintained by Denton County. Currently the city is not aware of any plans from either TXDOT or the County to perform any major work on these roadways. Staff contact: Daniel Kremer, Public Works M. Road Construction Inquiries — On September 1, Council Member Meltzer inquired about the future work plan for several City streets. Staff prepared the table below to summarize the status of the streets included in Council Member Meltzer's request. The majority of the streets are included in the 2019 Bond program,which is currently in the planning stages and does not have a definitive construction timeline. As the 2019 Bond schedule is finalized, staff will communicate the timelines for these projects through the Friday Report, Street Construction Report, on the City website, and through monthly capital project work session presentations where staff will provide the City Council with status updates on key infrastructure projects across the City. Construction is anticipated to be completed by October 2022. Another segment of Crawford Rd., from Texas St. to E. Sycamore St. is included in the 2019 Bond and is still in the planning phase. Rockwood Ln is currently under construction with an estimated completion of October 2020, weather dependent. Atlas Dr. is schedule to start construction in May 2021 and be completed in October 2021. Farris Road Sewer Line North Extension — On September 10, Council Member Armintor forwarded a citizen's concern about the sewer line extension near Farris Road, and requested information about the arrangements made with the developer for the City to inherit this sewer line that are being constructed by the developer. The developer of the proposed "Hartlee Field Ranch" development has been working with the Utilities Department to provide options for access to adequate water and wastewater utility service. The Texas Administrative Code Title 16,Part 2,Chapter 24, Subchapter F, Section 24.161 states "...every retail public utility shall serve each qualified service applicant within its certificated area as soon as is practical after receiving a completed application. A qualified service applicant is an applicant who has met all of the retail public utility's requirements contained in its tariff, schedule of rates, or service policies and regulations for extension of service including the delivery to the retail public utility of any service connection inspection certificates required by law." As long as the Developer meets all conditions of the Code and other governing regulations of the City, we have a requirement to provide service. No agreements or approvals have been made. When public utility infrastructure is constructed by a developer, it is dedicated to the City upon acceptance so that we can carry on operations and maintenance. This is consistent with the process for all development within the City. For the infrastructure to remain private, the developer would need to create a Municipal Utility District(MUD) and, apply for and be granted a Certificate of Convenience and Necessity (CCN/Service Area) within the City's CCN. In accordance with the Denton Development Code, and Water and Wastewater Design Criteria Manual, the City will not construct any extensions for the developer. If the development is approved, the wastewater infrastructure for this would be completely paid for and constructed by the Developer and dedicated to the City upon final inspection and acceptance. The City has design review and inspection authority over any such infrastructure and must inform the County that the City shall assume operations and maintenance of any developer constructed infrastructure,once inspected and accepted by the City. 9 In regard to the permanence and obtrusiveness of the wastewater system, the contemplated wastewater line will be constructed below grade, and upon completion of construction and re-vegetation, will be largely out of view with the exception of manholes. The gravity portion of the wastewater collection system along Farris Road will be available to serve all residents fronting the line, providing them an alternative to septic in the future. Staff provided the attached Informal Staff Report in the September 4 Friday Report with additional information including the three (3) alternatives that were considered, with the only viable alternative pursued by the developer. Private Landscaping Damaged During Scripture Street Reconstruction—On August 30, Council Member Davis requested that staff investigate a request from a citizen who had their landscaping damaged during the Scripture Street reconstruction project. The City's Project Manager assigned to the Scripture Street project has been in contact with the contractor responsible for the road reconstruction and notified them of the damaged private landscaping. The contractor has been in contact with the citizen and will be replacing the damaged landscaping. Earlier this week, the citizen provided the contractor with the specific plant varieties that need to be replaced so the contractor can purchase the correct replacement plants. The Project Manager will remain in contact with the contractor to ensure the necessary landscaping repairs are made. Staff contact: Rebecca Diviney, Capital Projects P. Kings Row Sidewalk Repair— On September 5, Council Member Briggs forwarded a resident's concern about cracked concrete and missing sod from a recent sidewalk repair on Kings Row between Nottingham Drive and Dunes Street. Staff assessed the issue Tuesday, September 8, and contacted the contractor to replace the cracked sidewalk section which is under warranty. The sidewalk repair is scheduled to be complete within the next two weeks, weather dependent. Any grass that is damaged will be replaced after the repair is complete. Striping on Kerley Street — On September 1, Council Member Meltzer requested information about the striping plan for Kerley St. which completed reconstruction on July 31. Prior to construction, Kerley was not striped, and therefore it was not in the scope of the reconstruction. Traffic Engineering has reviewed this request, identified a striping plan,and is currently working to identify funding for the project. Staff Contact: Brian Jahn, Public Works R. Colorado Boulevard and South Mayhill Road Intersection—On September 1, Council Member Meltzer submitted a request for staff assess the turn lanes on South Mayhill Rd. turning left onto Colorado Blvd. Previously, both lanes of traffic were allowed to turn left onto Colorado Blvd, which caused traffic in the right lane to become backed up. To address this issue, traffic signs were added on Wednesday, September 2 to indicate one left turn only lane and one right turn only lane. In addition, advanced lane designation signs were added both on the right lane and the left lane on Thursday, September 10. Staff Contact: Brian Jahn, Public Works 10 S. Striping on FM 428 Update—On July 30,Council Member Briggs forwarded a resident concern regarding the need for striping on FM 428 to improve visibility for motorists at the intersection of Warschun Road and FM 428. The intersection is part of both City and TxDOT right-of-way. Initial feedback on the development of a striping plan was provided in the July 31 Friday Report. The preliminary paint portion of the striping was performed at the intersection by City crews on August 25 to address safety concerns. The City is currently scheduling the thermal striping portion of the project with a contractor and expects the work to be completed in the next two weeks. Due to the roadway's width constraints, the restriping has caused the rumble strips, which are typically located on a roadway shoulder, to now be in an active traffic lane. The City is looking into options for removing or smoothing the rumble strips to address noise concerns. In the coming weeks, staff will present long-term options to resolve safety concerns at this intersection to the City Manager's Office. After the best path forward has been identified, staff will meet with area residents to review the plan prior to implementation. Staff is also coordinating with Denton County and TxDOT to identify funding for the long-term intersection improvement options. Long Range Development Fiscal Plan—On July 21,Council Member Briggs requested information about whether the City had a long-range development fiscal policy or plan. There is a Request for Proposal regarding a Development Fiscal Impact Analysis and Tool that just closed on September 1. Staff anticipates having a recommendation for awarding the contract to Council in October. Staff contact: Christine Taylor, Procurement U. Hartlee Field Road — Recently, City Council received several emails about potential widening plans for Hartlee Field Road, and whether there will be the opportunity for public input on the future of the road. DEC Purchases—On September 5,Council Member Briggs asked how many contracts, parts, and supplies have been purchased for the Denton Energy Center that were not included in the original pro forma. Staff made three purchases (listed below) that were not in the original proforma and two purchases that are planned: 1. Overhaul parts ("swing sets")—Contract#7246 Onetime expenditure ($2,028,967.43) to Wartsila North America for parts needed to drastically reduce down time during unexpected failures and outages. In addition to, reduction in downtime, the materials were purchased now to reduce cost of purchase in future years when needed during planned maintenance intervals. 2. The cruise will be in place of the traditional car show held annually in September in downtown, and the streets will not be closed. This promotion will have limited participation and a social distanced cruise on four Saturdays this Fall with the dates below. *September 12. 2020 •September 26. 2020 .October 10, 2020 October 24, 2020 This cruise will have no more than 30 cars reserving a spot in the parking lot per Saturday. They will be leaving the downtown area and going out to area nursing homes and assisted living centers to drive by and bring some visual interaction to their residents. We will offer a VIP package to participants in the cruise that will include some reserved seating at a downtown restaurant to ensure social distancing dining options are available. They will get a reserve parking pass for a private downtown lot. Currently. the paid lot at Wells Fargo will be the place to meet and park while downtown. Car spaces will be marked off at least 1-2 spaces between cars and staggered so that there is plenty of space between parked cars. Cruise participants will come and go from the lot between 7:30 a.m. and 3 p.m. on the four Saturdays listed above. There will be 1-2 volunteers in the lot to help monitor activity, and signage in place for social distancing. CDC guidelines and reminding participants of any mask mandates that may be in place during that time. Volunteers will wear masks while giving out VIP Goody- Bags available for pick-up from the Wells I-argo parking lot or outside of Norman Roscoe and Discover Denton Welcome Center, located at 111 W. Hickory St.. Businesses around downtown participate by offering a themed scavenger hunt and art installations/exhibits to be viewed. Limits on occupancy allowed in buildings will be applied. and some activities will require a previous sign up to allow for spaced-out intervals and social distancing. The county judge or the mayor, as appropriate,in coordination with the local public health authority, must give approval to such an outdoor gathering or event prior to it being held. All individuals must wear a face covering(over the nose and mouth) wherever it is not feasible to maintain six feet of social distancing from another individual not in the same household or,for those engaging in physical activities outdoors, wherever the individual is not able to maintain a safe physical distance from others not in the same household. The following are the minimum recommended health protocols for all outdoor events in Texas. These minimum health protocols are not a limit on the health protocols that individuals may adopt. Individuals are encouraged to adopt additional protocols consistent with their specific needs and circumstances to help protect the health and safety of all Texans. Further, business parity is not an issue at large outdoor events. ❑ In evaluating large gatherings (those with an estimated attendance exceeding 10 individuals), the county judge or the mayor, as applicable, should consider the following factors: ❑ The overall number of projected attendees; ❑ The likelihood of individuals over the age of 65 attending; ❑ The density of the forum and the ability to ensure social distancing of 6 feet between individuals; and ❑ The level of transmission in the county. ❑ Gatherings of less than 10 individuals may proceed consistent with all the health protocols above without approval of the county judge, local health authority, or mayor, as applicable. 19 Date: September 4, 2020 Report No. 2020-080 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: On Sunday August 30, 2020 a resident of unincorporated Denton County and customer of the Oak Bend Homeowners Water Supply Company (OBHWSC) wrote to Council to express their concern regarding a proposed wastewater collection line along Farris Road. The resident noted that the OBHWSC wells are located approximately 100 feet from the proposed wastewater line. The resident requested clarification regarding why the Farris Road alignment was being proposed by the developer, while other alternatives appear to be available. DISCUSSION: It should be noted prior to beginning this discussion that the Utility is in the preliminary design phase for the Clear Creek Wastewater Lift Station,located north of Hartlee Field Road.This lift station will ultimately handle the wastewater from the developments in question, with anticipated completion in 2023. The flow contributions from the development would cease when the lift station is placed into operation. The OBHWSC owns and operates two (2) water wells and a distribution system to provide potable water to their residents. The residents are presumed to have individual septic systems. The resident had a conversation with Mr. Stephen Belknap, P.E., Denton County Development Services Engineer, where the resident understood that the City of Denton was preparing to install a wastewater collection line along Farris Road, from Grant Parkway, north to Hartlee Field Road. The developer of the proposed "Hartlee Field Ranch" development has been working with the Utilities Department to provide options for access to adequate water and wastewater utility service. In accordance with the Denton Development Code and Water and Wastewater Design Criteria Manual, the City will not construct any extensions for the developer. If the development is approved, the wastewater infrastructure in question would be wholly paid for and constructed by the Developer and dedicated to the City upon final inspection and acceptance. The City has design review and inspection authority over any such infrastructure and must inform the County that the City shall assume operations and maintenance of any developer constructed infrastructure, once inspected and accepted by the City. Connection Options The developer approached the City requesting confirmation of their proposed water and wastewater utility connection points, which initially included wastewater discharge to the collection system near Long Road and Sherman Drive/FM 428. This plan would constitute pumping wastewater out of one drainage basin (Clear Creek Basin) to another (Cooper Creek Basin). Sewer basins are generally divided by ground elevation/topography, as wastewater generally flows by gravity to the treatment facility. Because the wastewater collection system is designed and constructed using flow projections for a particular basin, pumping from one to another is sometimes unfeasible due to capacity issues, which is the case with the collection system near Long Road and Sherman Drive/FM 428.The developer went as far as placing a flow metering device in the collection system near this location to verify the city-provided data. 20 Date: September 4, 2020 Report No. 2020-080 The collection system line at the intersection of Grant Parkway and Farris Road currently has adequate capacity to accommodate flow from the initial phases of development along Hardee Field Road. As noted above,when the Clear Creek Lift Station is complete, all sewer flows north of Hardee Field Road are intended to be handled by the Clear Creek Lift Station,pumping the wastewater south to the treatment plant. The Utility and Developer discussed three(3)potential options: 1. Discharge to the collection system on Long Road—Insufficient capacity 2. Discharge to the collection system on Farris Road— Sufficient capacity, interim solution pursued by developer 3. Discharge to the collection system on Cooper Creek Road—Insufficient capacity Oak Bend Homeowners Water Supply Wells The Texas Water Development Board database indicates that the OBHWSC owns two water wells, one screened between 616 to 626 feet and 630 to 656 feet below ground surface. The second well is screened between 1067 to 1088 feet and 1115 to 1136 feet below ground surface. From a geologic standpoint, well No. 1 appears to draw water from the Paluxy Formation, based on its depth of 616 to 656 feet, and well No. 2 draws water from the Twin Mountain Formation,based upon notes on the well report,both components of the Trinity Aquifer.The Trinity Aquifer is separated from the surface by the Woodbine Aquifer and several hundred feet of low permeability formations consisting of clay, shale, limestone and marl. Contamination of the Trinity Aquifer form local septic systems, or wastewater collection mains by infiltration is not possible. The Texas Commission on Environmental Quality (TCEQ) rules (30 TAC §290.40(c)) require minimum separation distances between water wells and certain wastewater infrastructure: 50-feet — Tile or concrete sanitary sewer, sewerage appurtenance, septic tank, storm sewer, or cemetery. 150-feet—septic tank perforated drain field, areas irrigated by low-dosage, low angle spray on-site sewage facilities, absorption bed, evapotranspiration bed, improperly constructed water well, or underground petroleum and chemical storage tank or liquid transmission pipeline. The TCEQ also requires minimum separation distances between water distribution lines and wastewater infrastructure (30 TAC §217.53(d)). This minimum distance is 9-feet in all cases, without additional construction methods and materials (Figure: 30 TAC §217.53(d)(3)). In no case would the City permit the construction of wastewater infrastructure in violation of these provisions. The City does not permit the construction of wastewater gravity mains using tile (clay) or concrete pipe. BACKGROUND During the September 1, 2020 City Council meeting staff provided a work session item (20- 1743) and a resolution (20-1742) regarding spraying in proximity to confirmed human cases of West Nile Virus (WNV). During discussions of the resolution, staff was asked to verbally provide information about the insecticide used for spraying, effectiveness / efficacy, and impacts on humans and non-target insects. After providing this information, staff was asked to provide additional details and references supporting the information provided. DISCUSSION: The work session and resolution mentioned above follow the procedures outlined in the City of Denton's Mosquito Surveillance and Response Plan (MSRP) for Risk Level 5. The MSRP is a comprehensive plan that focuses on monitoring mosquito populations for WNV and other viruses of concern. The MSRP outlines management practices for mosquito control that focus on mosquito larva habitat reduction ("source reduction") and control of larval populations through the use of biological control agents ("larviciding"). Control of adult mosquitoes using ultra-low volume spray (ULV) is conducted only in proximity to confirmed human cases of West Nile Virus and is considered only when WNV has become prevalent enough to impact humans as evidenced by human infections. Product used for ULV spraying For this season, staff is proposing to use Merus®, which is a new product formulated with 5% pyrethrin with no petroleum distillates. Merus® meets the United States Department of Agriculture's National Organic Program (NOP) standards for use in and around organic gardens, farms, and crops. Merus® is also Organic Materials Review Institute (OMRI) listed, which means it meets the Organic Materials Review Institute standards for ingredients that can be used in organic production or processing. Merus® does not include piperonyl butoxide or any other synergist. Based on staff s research, this product appears to be effective and safer from an environmental perspective than other options. Merus® will be applied by a licensed applicator using ground-based spraying equipment in ULV formulations. If Merus® works well, staff will update the MSRP at the close of the season to include this product as an option for future applications. Efficacy/Effectiveness During-discussion of the resolution, the question was asked about efficacy of the spray for controlling (killing) mosquitoes. Staff explained that control effectiveness is dependent on application conditions and can be heavily influenced by obstructions and vegetation. Meteorology and time of application also have important roles in application effectiveness, and 25 Date: September 11, 2020 Report No. _2020-082 these variables must be considered when applying the spray. However, in open areas where vegetation is relatively minimal, as is typical in front yards of homes, a high percentage of control is possible. Bonds (2012) quotes a journal article by Andis et al. (1987) that state average mortality of Aedes aegypti caged in open areas to assess the effectiveness of ULV applications was approximately 95.5%, but in cases where there were obstructions / vegetation and more "sequestered" areas this percentage dropped to 49%. Bonds (2012) also quotes research by Mount (1998) using ULV applications of malathion to provide greater than 90% average control rates in an open field, but rates dropped to 34% to 67% percent in vegetation. Farajollahi et al. (2012) demonstrated an overall reduction of 72.7f5.4% for Aedes albopictus (a notoriously difficult mosquito to control) using ground based ULV applications of DUET adulticide at the full label rate in a highly urbanized area in New Jersey. In both studies, multiple applications achieved greater control, which can be important in situations where mosquitoes can transmit disease to offspring as is the case with diseases like Dengue fever. While research has demonstrated that it is possible for WNV to be transmitted from adult mosquitoes to offspring, the process is very inefficient and is not thought by itself to be a cause of persistence and reappearance of West Nile outbreaks. Product testing for Merus® includes field trials that assess mosquito mortality following a spray event. Because assessments of spray efficacy on wild populations have a number of uncontrollable variables (multiple species of mosquitoes, possibilities of new adult populations emerging from pupae stages soon after applications, etc.), these field trials used laboratory reared mosquitoes that are placed in cages and deployed in the field in defined experimental plots. Control mosquitoes that are treated the same as test mosquitoes except for being exposed to the spray event are used to ensure mortality of test mosquitoes can be attributed to the pesticide application. These trials used lab reared Aedes, Anopheles and Culex mosquitoes and were conducted using United States Environmental Protection Agency Good Lab Practices (GLP). GLP is a system that ensures uniformity, consistency, reliability, reproducibility, quality, and integrity of testing. The trials also specify that equipment such as weather stations, stop watches, thermometers, etc. need to be National Institute of Standards and Technology certified. The application of Merus® was completed using a Clarke "Cougar" ULV sprayer equipped with a SmartFlow System, which is the same type of sprayer used by the City of Denton. Caged trials were conducted at distances of 100, 200, and 300 feet from the point of application. Under these conditions, Merus® achieved 100% knockdown in 1 hour and 100% mortality in 24 hours for Culex quinquefasciatus (the main target mosquito for WNV in Denton) at all distances. Merus® also achieved 100% knockdown in 1 hour and 100% mortality in 24 hours for Aedes aegypti (a minor target for WNV in Denton) in all replicates and distances except one location at 300 feet (which had approximately 98% mortality). It is important to note that caged trials are generally expected to have higher mortalities than wild mosquito applications, due to the variables mentioned earlier in this report. Human and Non-target insect effects Bonds (2012) describes a two-dimensional probabilistic risk assessment conducted by Schleier et al. (2009) to evaluate three pyrethroid insecticides, pyrethrins, two organophosphate insecticides, and piperonyl butoxide applied by a truck mounted ULV sprayer. As stated by Bonds, results 26 Date: September 11, 2020 Report No._2020-082 support the findings of previous studies that risk to humans from adult mosquito management are most probably negligible, and that the human health deterministic risk assessment is most likely sufficiently conservative. In the same article, Bonds states that the current weight of scientific evidence indicates that human health risks from residential exposures to mosquito insecticides are low and unlikely to exceed levels of concern. Other flying insects do not appear to be affected by mosquitocidal sprays if the insect's body mass is larger than that of a mosquito (Boyce et al. 2007). Field trials conducted in an aerial ULV application in California found there to be no effect on larger non-target species including dragonflies, spiders, butterflies, and honeybees. However, some small bodied arthropods that are closer in size to mosquitoes were impacted. Conclusions Staff has provided this informal staff report for informational purposes. Excerpts from the concluding sections of the two main journal articles used in this ISR are as follows. Bonds (2012) states that evidence shows correctly applied ULV spraying can be effective at controlling mosquito populations, that non-target impacts do not exceed levels of concern, and that disease transmission can be interrupted. Farajollahi et al. (2012) conclude that nighttime application of a synthetic pyrethroid is efficacious in reducing the abundance of Aedes albopictus in urban environments, and recommend that nighttime applications of ULV adulticides in areas with large populations of Aedes albopictus be considered as part of an integrated mosquito management approach for public health protection.
