Director of Water & Wastewater— Frank Pugsley recently notified us of his decision to separate from the City and return to the private sector. Please join us in thanking Frank for his two years of service and wishing him well in his future endeavors. Staff is currently working with Strategic Government Resources regarding an executive recruitment for Frank's replacement. In an effort to maintain continuity and spread the workload, Terry Naulty has agreed to serve as the Interim Director until a permanent replacement is in place. Terry's duties at Denton Municipal Electric, except for the Energy Management Organization,will be spread to other managers in the department. November 3, 2020 Elections — Construction & Voting Locations — Council requested information regarding clear and easy ways for voters to get around road construction at or near voting sites. Traffic Engineering is identifying any roadway construction that might hinder the ability of residents traveling to listed voting locations in Denton on November 3. Staff will then coordinate voting detour routes, produce detour "vote here" directional signs and, then place the signs at the potential areas of conflict. City of Denton Landfill Expansion Update—On September 15, the Executive Director of the Texas Commission on Environmental Quality (TCEQ) filed the response to comment (RTC) for Permit No. 1590B with the Office of the Chief Clerk. The staff of the TCEQ provided 47 responses to comments made by approximately 400 individuals on the draft permit. The TCEQ did not make any changes to the draft permit in response to comments. Notice of the Executive Director's (ED) decisions was mailed to commenters on September 23. Commenters wishing to request a reconsideration of the ED's decision or affected persons wishing to file for a contested case hearing have until October 23 to make application with the agency. Upgrades to City-owned EV Charging Stations—On June 9, City Council approved the upgrade of outdated city-owned electric vehicle (EV) charging stations with modern platforms at the North Branch Library, North Lakes Recreation Center, South Branch Library, and South Lakes Park. The upgrade was completed on August 7, 2020. The charging stations' upgrade is the first phase of Denton Municipal Electric's(DME) EV strategy to address short- and long-term service and infrastructure needs that will arise as EV adoption increases. The strategy consists of upgrading existing chargers, establishing a public charger rebate program, expanding the public-owned charging network, and encouraging beneficial home charging behaviors. Additionally, the EV strategy is in line with the Sustainability Plan Transportation Strategy: "Develop Electric Vehicle Strategy to address short and long term infrastructure and charging needs as electric vehicle ownership expands." Recently, the Texas Commission on Environmental Quality (TCEQ) approved DME's Alternative Fueling Facilities Program(AFFP) grant applications. The grants are a reimbursement to help offset the costs of the upgrades. The upgrade replaces ten outdated single-port Blink chargers with four state-of-the-art Level 2 dual-port ChargePoint Chargers. The new chargers have more customer- friendly features and will provide DME with additional services currently not available with existing chargers. The most important benefit from the new charging platform is the availability of customer usage data. The platform will provide DME customer data from the vehicles that elect to utilize the chargers. This data is a critical component of DME's EV infrastructure plan. 2 Members of the public who may have electric vehicles are invited to check out the city's new charging stations and join in celebrating National Drive Electric Week 2020. National Drive Electric Week is a nationwide celebration to raise awareness of the many benefits of all-electric and plug-in hybrid cars. This year is celebrated from September 26 to October 4. Library Begins Phase 3 ReopeningPlans lans—On Monday, October 5,2020,North Branch Library will expand services to include Phase 3 reopening services, including walk-in grab and go browsing and checkout and first-come, first-served computer access. South Branch Library will move to Phase 3 services on Monday, October 19. Emily Fowler Central Library will move to Phase 3 services in early November. Currently, Emily Fowler Central Library is rearranging shelving units and computers. A specific date for walk-in service will be announced once the moving project is complete. Once open for walk-in service, curbside hold pickup service will become unavailable at South Branch Library and Emily Fowler Central Library. For patrons who would still prefer to use contactless service,the North Branch drive-thru window will continue to operate as a pick-up and drop-off location. Library Phase 3 services include: • Temporary hours: Monday-Saturday 10 a.m. to 5 p.m. • 30-minute Grab & Go browsing and checkout of library materials • First-come, first-serve computer access, up to two 1-hour sessions per day • First-come, first-serve internet workstations for patrons bringing in their own devices, up to two 1-hour sessions per day 3 • North Branch contactless drive-up hold pickup • Limited in-person quick answer reference and computer assistance with social distancing • Phone and e-mail reference, reader's advisory, and account assistance is available Monday-Saturday 9 a.m.-6 p.m. • Interlibrary Loan services • 3D printer requests and pickup • Summer Reading Challenge prize book pickup • Virtual Book-A-Librarian appointments • Some areas and services remain unavailable: study rooms, meeting rooms, quiet rooms, The Forge MakerSpace, lounge chairs and open seating, study tables, youth and teen interactive play activities, etc. • 50% capacity limit in facility and posted capacity limits in certain areas of buildings Once all three library locations are in Phase 3 services,the Library will begin expanding operating hours and services as COVID safety recommendations allow. Staff contact: Jennifer Bekker, Library F. Food Truck Residential Regulations—The intent of the food truck regulation is to allow food trucks to park on commercially zoned properties. There are exceptions in our ordinance for food trucks to be allowed within the City of Denton parks, ROW, and neighborhoods under certain conditions. Mobile food trucks would be allowed in residential zoning districts with permission from a HOA or Neighborhood Association. Food trucks are not permitted in zoning districts which do not allow food establishments for greater than 1 hour or in neighborhoods where an HOA or Neighborhood does not exist. Alternatively, food trucks are permitted on City property or parks with an approved permit. Licenses holders would only need to submit an itinerary to the Health and Food Safety Department for approval. These food trucks would still be required to meet the following standards when providing food in these areas: • Provide verification that the food trucks shall move the mobile unit at the end of each day and go to their commissary for cleaning and storing their unit. • Provide itinerary for all parked locations, including dates and times. • Provide statement that the food truck will only hook up to electricity and nothing else. • Provide documentation for food truck personnel's access to a restroom within 500 feet with hot and cold running water. Examples of where a food truck would be allowed include an HOA or Neighborhood Association with prior permission from the association. It also allows for a food truck to be in a City park with prior permission from the City. Additionally, food trucks are allowed on construction sites in any location in the City for less than one hour. Staff contact: Scott McDonald, Development Services 4 G. Juno Street—On September 15,Mayor Pro Tem Hudspeth requested information about a tripping hazard at a driveway entrance on Juno street. Staff investigated the request and found that the curb line begun to sink in this area. Staff placed asphalt at the curb line and drive approach on September 24 to temporarily eliminate the hazard until the full reconstruction, which is currently in the design phase, can be completed as part of the 2019 Bond program. Use of 5%Construction Contingency for Capital Improvement Projects—Construction contingencies are predesignated amounts set aside to cover unanticipated costs that may arise during a project. In the City of Denton, construction contingencies are calculated as 5% of the total contract bid amount. Contingencies are included in the contract bid award to be used in the sole discretion of the City and are intended to help address necessary changes in the field without having to bring minor change orders to the Public Utilities Board (PUB) and/or City Council for consideration, which take an average of 45 days to work through the Procurement, Legal, and PUB/City Council approval process. To ensure transparency in the use of contingency funds, Procurement tracks all change orders in the same manner that amendments and change orders are documented when going to PUB and/or Council. By including the contingency in the contract bid award, City Council authorizes staff to spend the approved funds designated in the 5% contingency and an additional $50,000 allowable under procurement law and the Procurement Policy prior to bringing any additional change orders before the City Council for approval. All future change orders brought to City Council for consideration will include a detailed history of previous change orders, including those approved by staff and those previously approved by the City Council. This process has been vetted by the City Attorney's Office, Procurement, and Internal Audit to ensure compliance with statutes, local policies, and industry best practices. Additional details on the process will be provided during the October 27 City Council Capital Projects Update work session presentation. Hole in Mulberry Street Roadway-- On September 22, Mayor Pro Tern Hudspeth requested information on a hole that was in the roadway on E. Mulberry Street,near its intersection with Elm Street. Staff investigated the area and determined the hole was created during fiber optic work in the area. The city has contacted the provider and repairs are scheduled to be completed on September 29, weather permitting. Staff contact: Rachel Wood, Capital Projects J. Community Engagement for Construction on Elm and Locust — On September 1, Council Member Meltzer forwarded a resident's concerns about the timing of construction on Locust north of the Square. Locust and Elm are both in the early stages of design for major utility upgrades performed by the City, which will be followed by TxDOT performing a full reconstruction of the roadways. Currently, the utility upgrades are in the early stages of design. Redrawing Council Districts — On September 22, Council Member Briggs requested information about the timing and requirements of redrawing City Council Districts. The Charter addresses the redrawing of Council districts in two places (below), and states that"...districts shall be created so that each will contain, as nearly as possible, a population equivalent to the others, according to the latest available census data. " [Sec. 2.01(d)] The current districts, which were drawn in 2011 and have been updated as new property is annexed into the City,will need to be updated in 2021 after the 2020 Census data is published. Once that data is available, staff will schedule a work session to begin this process, and recommends having outside attorney Bob Heath,who guided the City through redistricting in 2011, lead the discussion with City Council. (d) The council shall from time to time create and describe by ordinance election districts known as districts one (1), two (2), three (3) and four (4). Such districts shall be created so that each will contain, as nearly as possible, a population equivalent to the others, according to the latest available census data. Sec. 2.08. -Powers of the council. Except as otherwise provided by this charter all powers of the city and the determination of all matters of policy shall be vested in the council. Without limitation 6 of the powers granted or delegated to the city by the Constitution, statutes, or this Charter, the council shall have power to: (s) Perform the districting and redistricting function. L. Request for Emergency Signal on Vintage Boulevard — Staff from the Planning department reached out to Engineering staff and the Fire Department regarding the potential need for an emergency signal on Vintage Boulevard near the fire station and future charter school. Engineering responded that conflicts are not anticipated at this time; however, as more development occurs in the area (thus increasing traffic), an emergency signal may be needed in the future. The Fire Department replied that with the expansion of Vintage Boulevard to four lanes (scheduled completion of April 2021), the roadway will be sufficient to handle to the school traffic and emergency response. Fire Marshall David Becker also indicated that since the nearby fire station also includes a training facility (which requires frequent fires),they would like to begin a conversation with the Charter School leadership to establish lines of communication regarding potential impacts of the training activities on the school site. Staff contact: David Becker, Fire M. Ray Roberts Plant Update —On September 17, Council Member Meltzer requested an update for the Ray Roberts Water Treatment Plant. Due to growth in the City, including Hunter and Cole Ranch, the production capacity of the Water treatment plant at Ray Roberts will need to be increased. Depending on growth and risk tolerance, this capacity will be needed around 2025, but not later than the spring of 2026, and would cost around $100,000,000 to complete a 30 Million Gallons per Day(MGD) increase in capacity. This would be accomplished by a physical expansion of treatment processes. As an interim solution, staff proposed an"uprating project". Uprating takes advantage of the existing capacity in the treatment processes combined with treatment and pumping modifications to produce more water from the existing plant processes. This approach should be able to produce at least 5 MGD of water, and may be able to produce substantially more. This would push the need for a physical expansion out to approximately 2029 or longer. However,one of the main benefits of the capacity uprate is that the originally planned future 30 MGD expansion will become 37.5 — 45 MGD at approximately the same $100,000,000 cost. This greatly reduces the dollars per gallon cost of the expansion, and prolongs any future upgrade needs. Staff contact: Kenneth Banks, Utilities N. Pecan Creek Water Reclamation Facility — The Pecan Creek Water Reclamation Plant(PCWRP) is currently permitted for a maximum average daily flow of 21 MGD. The current average daily flow is approximately 14.75 MGD or 70% of the permitted flow. TCEQ rules require the Utility to begin planning for an expansion when the flow reaches 75%of permitted capacity(15.75 MGD). The small Robson Ranch wastewater treatment plant has a permitted average daily flow of 0.375 MGD, and will be decommissioned in or before FY 2022. The flow from this plant will directed to the PCWRP. 7 The combined flows ofPCWRP and Robson represent about 72%ofPCRWP capacity. Because projected flows from City and Hunter/Cole Ranch growth will exceed 75%of capacity in the near future, the Utility has begun planning for a plant expansion. This will be a"capacity expansion"using a chemically enhanced primary treatment process (CEPT) using existing plant basins. The first phase of this project involves solids handling,and is expected to increase the treatment capacity to a permitted average daily flow of 26 MGD for a cost of approximately $15,000,000. This phase should be completed in FY 2023. Depending on growth rates, this additional capacity could postpone the need for a physical expansion well into the 2030s. The next phases,which have not yet been designed include increasing the capacity of the filter system and adding an additional anaerobic digester. Staff contact: Kenneth Banks, Utilities O. Grease Spillage on Walnut Street—Environmental Services was notified about a grease spill at Walnut St. on Sunday morning, September 20. The information about the spillage was first released on social media. The grease spill resulted from bar staff hand carrying buckets of grease from Dusty's Bar at 119 S Elm St. to the shared grease receptacle located behind the building on Walnut St. The grease receptacle is shared between Sweetwater and Dusty's. Personnel from the Wastewater Collections division responded to the spill by vacuuming the spill and power washing the general area. Environmental Services staff was on site and collected information about the incident and reached out to the bar staff. City staff made bar manager aware of the violation of city codes and asked for preventive measures to be implemented and staff bar be educated on correct ways to transport and dispose the used grease. Since the incident, Dusty's bar acquired a new grease receptacle and placed it on Mulberry Street reducing the distance bar staff travels for disposing grease and reducing the chances for future spillage. Various Streetlight Outage Updates— On September 22, Mayor Pro Tern Hudspeth forwarded a request regarding various streetlight outages across the city. Below are updates for those that have been repaired: • I-35 Service Rd in front of Golden Triangle Mall: 5 lights were reported out. o This entire circuit is direct buried and the cable has multiple bad spots causing the circuit to short. Staff set up locates and will install conduit, cable, and new poles with LEDs. This will be a new installation project to go with the new streetlight circuit and poles on San Jacinto. • I-35 Service Rd in front of Callaway's Nursery and access to Dallas Drive: 4 lights were reported out and are now burning. • Dallas Drive from Race Track all the way to Prairie St: 6 lights were reported out and are now burning. Staff contact: Tony Puente, Utilities Q. Street Construction Report—On September 24,Council Member Briggs relayed citizen comments about access to construction information on the City website. All of the City's current and upcoming construction information can be found on the Street Construction Report, which is located on the homepage of the Improving Denton site and distributed weekly through the Friday Report (see screenshot below). To increase access to this comprehensive document, Public Works is coordinating with Public Affairs to also post the Street Construction Report on the City's Facebook page every- 8 other Friday to update citizens on the projects. Missing Water Meter Cover—On September 22, Mayor Pro Tem Hudspeth requested the repair of a water meter cover on Eagle Drive. The issue was addressed the next day. City Property Maintenance — On September 22, Mayor Pro Tem Hudspeth requested staff assess the maintenance needs on City property located on Bernard St. The area requested belongs to DME, and staff responded by repairing a leaning fence, clearing the sidewalks, and hauling off the brush pile and trash. The site now looks substantially better after the maintenance. Staff contact: Tony Puente, Utilities T. Baseball Tournaments—This weekend, Denton Boys Baseball, Inc. (DBBI)will host a youth baseball tournament, using fields at Evers and Mack Park. This will be the first baseball tournament hosted in City of Denton parks this year. Below are the planned upcoming tournament dates: • Saturday and Sunday, September 26-27 at Evers and Mack Park • Saturday and Sunday, October 17-18 at Evers and Mack Park DBBI created a detailed plan that follows COVID-19 Risk Mitigation Guidelines, state's minimum standard health protocols, and the City of Denton protocols. Details of the plans include: • Face coverings are required for participating athletes, spectators, staff, and volunteers where social distancing is not possible. • All attendees must maintain six feet of social distancing. • There will be additional time between games to allow adequate time for teams/spectators to vacate the field. 9 • Game times have been staggered to ensure entrances/exits to the park will not be overcrowded. • Reduced number of fields will be used. • City of Denton COVID-19 liability waivers are required for participating athletes. • There will be no post-game handshakes. • DBBI is asking teams to limit the number of spectators. • People are asked to return to their vehicles during times that their team is not playing. Parks and Recreation staff placed COVID signage throughout the park.As patrons walk into the complex from the parking lots, there are signs on the ground and signs hung on fences and bleachers that encourage social distancing. Additionally, staff marked spots in the dugout that are six feet apart to encourage distancing. This tournament is being operated based on the protocols presented to Council during the COVID-19 return to play update in July. While there is no set occupancy limit for City parks, staff created two separate zones for Evers Park. There will be a north and south zone separated by the middle parking lot, limited to 100 people each. Mack Park also has a north and south zone separated by McKinney Ave.Note that both complexes are situated within public parks and include other amenities open to the public during park hours of 6 a.m. to 10 p.m. The complexes are not gated, and therefore access to the complexes is not controlled. To ensure safety measures and social distancing efforts, PARD staff will check on the tournament sites twice per day. Staff will continue to review and analyze programs and adjust as necessary to improve operational and safety measures. Parks and Recreation will provide a COVID-19 update at an upcoming Council meeting to discuss future programming. Staff contact: Jason Barrow, Parks and Recreation U. American Legion Hall Senior Center Construction Update — Construction of the American Legion Hall began on June 1, by Mart, Inc. The contract time is 270 days with substantial completion set for February 25, 2021, barring any weather delays. The project is currently 30 percent complete. To date, the main slab is in place as well as the main structural steel. Exterior framing is slated to start the week of October 5. Due to correcting design errors, the project is currently 25 days behind schedule. Staff contact: Caroline Seward, Parks and Recreation V. Denton Marathon — The Parks and Recreation Department's (PARD) staff is considering Councilman Davis's inquiry about hosting a marathon in Denton. While staff agrees that offering a half or full marathon is a great way to showcase Denton to non-resident participants, it does pose some challenges. Currently, the City of Denton hosts two races, Liberty Run and the Honey Run, which are annual 5K fun run events held in February and July. Other various organizations host nearly 20 community runs throughout the year. Most of the events range from fun runs to 5Ks, with none hosting half or full marathons within Denton. The two most 10 prominent marathons in the DFW area are the Dallas Marathon, typically hosted in December, and the Cowtown Marathon (Fort Worth) in February. Due to COVID-19, the Cowtown Marathon has been pushed to May 2021. In an effort to draw a large number of participants, a Denton marathon date would be ideal during Fall 2021 or Spring 2022. The Denton Area Running Club (DARC) has been a longtime partner of the City to host the Liberty Run and its annual Turkey Trot. Staff began discussions with DARC to host a potential marathon in Denton. DARC is excited about the idea of partnering with PARD and have a common goal of promoting health and wellness throughout Denton. PARD staff and DARC both recommend that the suggested race route be adjusted to pavement-only to hold a USA Track&Field(USATF)certification.USTAF races have increased participation in previous City races, brings credibility to the race, assures participants of the route's length, and allows them to be a qualifying race based on their race time. Unfortunately, if we were to host the run along natural trails, this would eliminate a USATF certification option. We also run the risk of discouraging road- runners who might not be interested in running on trails due to exposed roots and other terrain issues. If a Denton marathon were successful, the goal would be to have it be a qualifier for other world marathons, requiring paved race routes. PARD staff will continue conversations with DARC and see if such an event could possibly begin with a half marathon. A minimum of 12 months would be necessary to plan, assess budget, promote, and receive the required certifications for a race of this scale. In addition to planning, these events rely heavily on staff and volunteers. Currently, to host our annual 5K runs, an average of 40 PARD staff are required to ensure a smooth operation. In addition to PARD staff, we also rely on numerous volunteers and police to implement these events. We will continue to assess the feasibility of a marathon as a future community event, and look forward to bringing in-person events back to Denton. Tennis Tournaments — The Goldfield Tennis Center hosted the Denton September Universal Tennis Rating (UTR) Tennis Tournament this past weekend on September 19 and had 58 participants in this tournament. Natatorium Modified Reopening—The Natatorium will reopen for modified adult-only hours on Monday, October 5. This is the first public swimming activity at the Natatorium since the facility closed due to COVID-19 concerns in March. The program restart is the second of three phases of the Natatorium reopening plan. Programming is limited to lap swimming, exercise sessions, and physical therapy. Phase Three will include full program resumption and is expected in January 2021, depending on all COVID-19 restrictions. The Natatorium reopened to accommodate DISD swim teams on August 26. Staff prepared the facility according to the department's reopening plan. DISD coaches have enforced social distancing before, during, and after swim practices.
