Virtual Ceremony for Mayor Watts and Outgoing Council Members — The December 17 reception planned for Mayor Watts and Outgoing Council Members has been changed from an in-person event at the Civic Center to a virtual ceremony. The virtual ceremony is planned to start at 5:30 p.m. and feature proclamations expressing appreciation for any outgoing Council Member as well as a short video to honor Mayor Watts's service. This will be formatted as a Zoom meeting, like Council meetings, and allow Council Members to express words of appreciation to their colleagues as well. Staff will plan to send a press release out at the end of next week to confirm the event and provide more details, including an opportunity for community members to sign an online card and leave words of appreciation or thanks. The special-called Council meeting will follow and begin at 6:30 p.m.to canvass the results of the run-off election, swear in new members, and consider scheduled business items on the agenda. Final Green Tree Estates Cost—During the declaration of local disaster for Green Tree Estates, staff gave regular updates to the Council regarding the amount of City funds spent toward the disaster response. Council allocated a not to exceed amount of $100,000 as part of the disaster declaration. With the expiration of the disaster declaration, staff accounted for costs in the amount of$64,899.04 toward the City's response to Green Tree Estates. This is inclusive of road repairs, staff costs for water delivery, and materials, though equipment depreciation costs are not included in this number. These costs are slightly less than the estimated amount provided to staff on September 1,2020,and within Council's designated spending limit. Inclement Weather Planning & Capacity Update— The Monsignor King Outreach Center (MKOC) is open Monday through Friday from 6:30 p.m. to 9:00 a.m. until Christmas,when the shelter facility will be open seven(7) days a week. Until then,the shelter will be open Monday through Sunday from 5:30 p.m. to 9:00 a.m., as needed, in the event of extreme weather. Current average bed use at MKOC is estimated around thirty-two (32)beds per night, and it also has been able to safely increase the bed count to forty-seven (47) during inclement weather. Our Daily Bread (ODB) also offers expanded daytime hours of operation during inclement weather from 8:00 a.m. to 4:00 p.m. The MLK Jr. Rec Center will open with extended hours during inclement weather with access to a sitting area, water, and restrooms. Masks are required for everyone who enters the building. Disposable masks and hand sanitizer are available at the door. Per COVID-19 spacing recommendations, the rec center can safely accommodate thirty (30)people in the Ammon's room and approximately sixty(60)people in the gym. The Civic Center may be opened if additional space is needed during inclement weather with the same amenities and requirements as the MLK Jr. Rec Center. FEMA Reimbursement Awarded — In a previous Friday Report, staff outlined the COVID-19 expenses submitted to FEMA for partial reimbursement. Staff submitted 2 three separate projects for eligible Category B expenses, defined as emergency protective measures such as medical, personal protective equipment and disinfectant. Staff received notice this week that the City of Denton was awarded partial FEMA reimbursement for two of the COVID-19 projects submitted. The total amount awarded is $47,422.05. Staff is working with FEMA to officially receive the money and close the project. Staff still awaits hearing about the status of the third and final submitted project, and expects to hear within 4-6 weeks. Staff will update Council on the status of the final project as it progresses, continue to track COVID-19 related expenses not submitted in the three projects, and explore the possibility of utilizing Coronavirus Relief Funds for reimbursement. Staff contact: Cassey Ogden, Finance E. Municipal Court Text Notifications. — The Municipal Court is currently testing a text notification service with a sample group of open cases. This new text service is part of a continued effort to increase efficiency, safety, and convenience through remote case resolution. In the coming weeks, some defendants will receive friendly reminders advising that options are available for resolving their cases without appearing in court. Once testing is complete, the text campaign will be expanded to more defendants and other types of notification messages. Additional services will also be launched in the near future, including a new website to process payments and submit requests to the Court online. Staff Contact: Jamie Lindsay, Municipal Court F. First Responder Sick Leave Policy — On November 20, Council Member Briggs requested information regarding first responders' benefits. In the tragic event that a First Responder or civilian jailer dies from COVID-19, the death would be handled as any other death claim from the benefits perspective. The City provides basic life and Accidental Death and Dismemberment (AD&D) coverage for all full-time and part- time active permanent employees (working at least 20 hours per week). Basic life coverage provides lx base annual earnings up to a maximum of$300,000. For full- time active executives, the City provides 2x base annual earnings up to a maximum of $500,000. For both employee classes, basic AD&D matches the basic life coverage. The employee also has the option to purchase greater levels of Life and AD&D insurance coverage voluntarily. For the purposes of workers' compensation and COVID-19, the City considers jailers to be First Responders. If a First Responder, including a civilian jailer, tests positive for COVID-19,it is presumed to be a workplace exposure and is automatically accepted as a compensable claim under workers' compensation. This means that the employee will receive all benefits due under workers' compensation including reasonable and related medical care, salary continuation, and impairment or death benefits. 3 Additionally,under the attached Sick Leave policy addendum(no. 111.01),Police and Fire employees and civilian jailers are eligible for COVID-19 Sick Leave which provides 80 hours of paid sick leave (in addition to the employee's accrued sick leave) in the event that they have an exposure to a close contact who is confirmed to be COVID-19 positive that requires the employee to self-quarantine, but the employee does not have a positive test requiring a workers' compensation claim. Development Services Fiscal Impact Solicitation - Development-Services solicited services via Request for Proposal (RFP) that will include a current analysis and forecasting tools for future development. The City's goal is to complete RFP solicitations in 90 to 120 days. During the solicitation, additional time was added for the evaluation team to conduct interviews with the top five (5) firms and request best and final offers from the top three (3). Council consideration is scheduled for December 17, 2020 which will close out the process within 125 days. Staff contact: Christine Taylor, Procurement and Compliance H. Human Rights Campaign Municipal Equality Index Scorecard - The City of Denton (City) is one of 506 cities nation-wide that are rated by the Human Rights Campaign (HRC), a civil rights organization founded in 1980 representing the LGBTQ community, with over three million members and supporters nation-wide. The HRC developed a Municipal Equality Index (MEI) scorecard to annually examine and rate how inclusive municipal laws, policies, and services are to the LGBTQ people who live and work in the community. Cities are rated based on 5 sections: (1) non- discrimination laws, (2) the municipality as an employer, (3) municipal services, (4) law enforcement, and(5)the city leadership's public position on equality. For the 2020 MEI,the City scored a 63, a 6-point increase over 2019. The full scorecard is attached for reference. Staff contact: Sarah Kuechler, City Manager's Office I. Update on Windsor Drive-On Friday,December 4,Council Member Briggs requested a status update on current construction efforts on Windsor Drive associated with the 2019 Street Reconstruction Project. Below are the specific items that Council Member Briggs requested a schedule on along with staff responses to each request: • Schedule for Stuart to Sherman: Paving on Windsor Drive from Stuart to Sherman is scheduled to begin the week of December 7. This will be the final wearing course of asphalt. It should be complete by the week of the December 14, weather permitting. • Schedule from Sherman to Longfellow (near Wilson Elementary): Paving for the westbound lane from Sherman to Longfellow is scheduled to be applied starting the week of December 7, weather permitting. Traffic patterns will then be shifted and work to prepare the subgrade for the eastbound lane will begin. The subgrade is currently scheduled to be completed by January 2021 and then paving will be scheduled. • Project Completion Date: The 2019 Street Reconstruction Project is currently projected to be complete by Summer 2022. American Legion Hall Update—On November 23, Council Member Briggs requested an update on the construction of American Legion Hall. The contractor began interior work on Wednesday, November 18, and is still on target for completion on April 8, 2021. Staff contact: Scott Gray, Facilities K. Holiday Comfort Food Care Packages for Texas Youth and Families — On November 24, Council Member Armintor forwarded along information regarding care packages for Texas families. Senior Center Outreach and Programming — The following details new outreach programs from the Senior Center: New outreach programs • A new program called "Senior Talk" is beginning December 7. This program is a new dedicated conversation hotline for seniors who want to chat. Senior volunteers will be available, Monday 9:30 a.m. - 12:30 p.m. and Thursdays 2 p.m. - 5 p.m. by calling (940) 349-8728. Want to talk weather, sports, crafts or just chat. Give us a call we are here to help. • If you don't want to talk, you can email as well. A dedicated email, DSC&)cityofdenton.com, has been created to allow senior residents to contact all Senior Center staff for questions and needs at the click of a button. • If you know someone that maybe feeling sad, call the hotline and give us the appropriate contact information and we can reach out and help cheer up someone's day. United Way of Denton County CoMprehensive Holiday Resource — On December 3, Council Member Armintor requested information regarding any resources for families in need this holiday season. Sanitization of Downtown Pedestrian Structures—On November 24, Council Member Briggs asked staff if the benches and traffic light buttons downtown were sanitized regularly. Parks and Recreation does not have the appropriate level of staffing to be dedicated sanitization of benches, traffic light buttons or related infrastructure in the Downtown Square area and throughout other areas of the City. During the onset of the pandemic, benches, picnic tables and playgrounds were closed for a period of time to reduce transmission of COVID-19. The Centers for Disease Control, CDC, and Texas Department of State Health Services encourages residents to carry and use hand sanitizer frequently when out in the public. The City continues to promote preventative practices, such as use of hand sanitizer while shopping, going out to dinner or visiting a park. Connection Wellness Volunteer Opportunities — On November 25, a member of the Connection Wellness Group, a counseling clinic in the City, reached out to the City Manager's Office requesting volunteer opportunities to help spread mental health awareness. Staff contacted Connection Wellness Group on November 30, following up on the group's inquiry about tree and flower plantings and the painting of park benches as volunteer opportunities.A virtual meeting has been scheduled for Friday,December 4 to discuss available projects and learn more about the group's Champions of Radical Change committee and their initiatives. Projects identified by Parks and Recreation staff include collection and transplanting of young Post Oaks and Blackjack Oaks from a development site and painting the gate and fence at Clear Creek Natural Heritage Center. Open Excavation Sites on Windsor Drive — On December 1, Council Member Briggs requested staff investigate concerns about open excavation sites located at two residential properties on E. Windsor Drive. Staff performed a site visit on December 2 to review the work being performed. The two open areas were excavated by the City's construction contractor as part of the 2019 Street Reconstruction Project between August 25 and September 8 in order to tie into the new waterline. The tie-ins are awaiting the results of the water sample tests. Unless testing indicates additional work is needed, the open areas will be filled within the next 7-10 days. In the interim, the contactor has agreed to backfill the cavities up to where the meter will be placed. Staff contact: Trevor Crain, Capital Projects 6 Q. Sound Walls on Interstate 35 Corridor— On December 1, Council Member Armintor forwarded a resident's concern about the noise levels in their neighborhood near the interstate. Staff contacted TxDOT regarding the installation process for sound walls. Staff was informed that TxDOT's standard process is to add/include sound walls when a facility is widened rather than when the adjacent land is developed. Since there are several upcoming improvement projects along IH 35 in the upcoming years,there may be an opportunity to pursue sound walls with these construction projects. Staff is working to schedule a meeting with TxDOT to discuss these opportunities. Staff contact: Brian Jahn, Capital Projects R. Mingo Road and TWU Area Project Updates — On September 23, Council Member Briggs requested an update on planned projects on Mingo Road including a proposed side path. A Texas Woman's University (TWU) Area Traffic Study was completed in September 2020. Since that time, the City of Denton Capital Projects Team has been actively collaborating with other City departments to identify planned and potential capital improvement projects within the TWU area. To-date, approximately 15 meetings have taken place with internal and external stakeholders, including the TWU Facilities Management and Construction Team. The internal departments have included Parks, Traffic, Streets, Drainage, Water, Wastewater, Denton Municipal Electric, and Development Services. As the scope development of individual projects progresses, Real Estate,Finance and public safety departments will also be engaged in the TWU Area Program. Staff most recently met with TWU representatives on Wednesday, December 2 to review the list of potential projects in the area. Due to the amount of coordination required to address the various improvements, staff is in the process of creating a TWU Area Capital Improvement "Program,"which will include several different projects stemming from needs identified by different City departments. Examples of projects include road widening, new sidewalks, drainage studies, and a quiet zone study. The widening of Mingo Road, along with the addition of an 8'-12' side path is one of the proposed projects in the TWU Area Program. Capital Projects has engaged a consultant engineer to prepare a scope of services and summary of each of the proposed projects in the TWU Area Program. The summary will include graphics; preliminary identification of constraints such as right-of-way, easements, utilities, railroad, and floodplain; preliminary cost estimates; a design schedule to get to 100% design documents; and a preliminary construction schedule. Development of the conceptual design for all proposed projects is currently scheduled to be complete in spring 2021,with 30%design plans completed in summer 2021.After 30% design documents are complete, the City Council will receive a presentation and be asked to provide staff direction regarding which projects in the TWU Area Program should be continued to 100% design. Capital Projects will continue to coordinate with TWU and all internal stakeholders as program development proceeds. Capital Projects Staff is currently working with Finance and the City's new Grant Administrator to identify external funding to support completion of the proposed projects in the TWU Area Program. Thunderbird Drive Speed Study—On November 16,Council Member Briggs requested staff perform a speed study on Thunderbird Drive to determine if traffic calming 7 measures are necessary. Staff will work to collect speed and volume data for this roadway. When data collection is complete, staff will determine the need to traffic calming measures and will prepare a list of options in it is deemed necessary. Based on the current backlog of the speed study equipment, we estimate at least 10 to 12 weeks before the information will be available. Staff contact: Brian Jahn III. Sick leave accruals accumulate to provide the employee coverage for severe or catastrophic illnesses. Although the City provides sick leave accrual at the rate of fifteen days per year, excessive absences on the part of the employee may signal a performance problem to the supervisor. Continued use of sick leave at higher than average rates as defined by a department director may create situations within a work group which hamper accomplishment of the tasks. A supervisor may take remedial action by setting attendance goals or enforcing the appropriate disciplinary action. Employees who die while in service of the City or while on authorized military leave of absence shall be paid for all unused sick leave not to exceed 90 working days. Payment shall be made to the estate of the employee or beneficiary of the sick leave benefit, whichever the employee has designated. Employees who leave the service of the City, except as provided for in this paragraph, shall not be paid for unused accrued sick leave. Civil Service employees are an exception to this rule;please see Section V of this policy for full details. ADMINISTRATIVE PROCEDURES: I. SICK LEAVE ACCRUAL(NON-CIVIL SERVICE) A. Sick Leave Pay No cash payments will be made for unused accrued sick leave. B. Accrual 1. Sick leave is accrued at the rate of ten hours (10) for regular full-time employees and prorated for regular part-time employees (seven and one-half(7.5) hours for three-quarter time employees and five (5) hours for half-time employees) for each month of continuous service. Sick leave hours are accrued o n t h e I s t a n d 15 t h of each month in halved amounts. Sick Leave(111.01) 10/1/17 Revisions approved by City Council through Resolution 2017-033; Addendum Approved by City Manager Todd Hileman 11/13/20 for COVID-19 10 For example, a full-t i m e employee accrues five (5) hours of sick leave on the 1 s t and 15t'of the month, while a half-time employee accrues two and one-half(2.5) hours of sick leave on the 1 st and 15t' of the month. Sick leave can be used during the pay period in which it is accrued. Sick leave may not be used before it is accrued. 2. Sick leave may be accumulated up to a maximum of 90 days (720 hours for full time employees; 540 hours for three-quarter time employees; and 360 hours for half time employees). All employees with accrual in excess of 90 days (720 hours)prior to October 1, 1981, may retain all accruals until such accrual is down to 720 hours at which time the accrual can never exceed 720 hours (See Section V for Civil Service Accrual). 3. Sick leave will not accrue during any unpaid leave of absence (see Family & Medical Leave policy no. 107.04; Non-FMLA Medical Leave policy 111.07; and Personal Leave Without Pay policy no. 111.08). II. NOTIFICATION A. To receive paid sick leave, an employee shall notify the supervisor or authorized representative at least 30 minutes before the time set for beginning of work. Employees must also comply with departmental policies, if applicable. B. Employees are required to contact their supervisor daily if absent for more than one day, unless otherwise approved by the supervisor. Exceptions would be hospitalization, a prolonged or catastrophic illness, or a determination by the City that the absences qualify as family and medical leave (see Family& Medical Leave policy no. 107.04). C. Employees who become ill during the period of their vacation may request that their vacation be temporarily terminated and that their time be charged to sick leave. A physician's statement will normally be required in such instances. III. CONDITIONS FOR USE A. Sick leave may be used in 15 minute intervals. Official holidays and regular days off shall not count against sick leave. B. Sick leave may be allowed in cases of personal illness, doctor's or dentist's visits, or physical incapacity of the employee. Additionally, sick leave may be used when an employee is required to attend to their spouse, child, parent,or dependent who is ill, incapacitated,or incapable of self- care; or, to attend a bona fide counseling session by a qualified counselor. hi the case of critical illness or emergency medical situations,sick leave may also be used for immediate family(spouse, father, mother, children, brother, sister, grandchildren,grandparents, father-in-law, mother-in-law, brother-in-law, sister-in-law, son-in-law, daughter- in-law, and grandparent-in-law). For purposes of this policy, a critical illness will be defined as a life-threatening condition. An emergency medical situation will be a medical condition requiring immediate treatment. Supervisors may require satisfactory proof of illness/injury or of the need for attending to a family member and may deny, upon consultation with Human Resources, any sick leave in the absence of such documentation. D. After accumulated sick leave has been exhausted, employees may use authorized a cc r u e d vacation time. Upon the exhaustion of all paid leave, the employee may be eligible for unpaid leave until returning to work unless additional leave has been approved through the Catastrophic Leave Donation directive (no. I11.05). It is the employee's responsibility to provide a doctor's prognosis and an estimated return date to Human Resources so they can consult with the supervisor to determine whether the position can be left open or filled temporarily based on the following criteria: -length of leave requested -workload requirements -employee's past work record -employee's ability to perform in same position upon return E. After 90 consecutive days of disability, the long-term disability plan will go into effect for all eligible employees who make application. Accrued sick leave may be used in conjunction with long-term disability. F. Accrued sick leave may be used in conjunction with the workers' compensation plan to meet but not exceed an employee's regular pay(see Policy no. 409.01). G. Sick leave benefits will not be paid for the same time an employee receives holiday pay, death in the family leave pay,vacationibonus time pay or any other paid leave benefit. H. Sick leave is not considered "time worked" for overtime purposes and will be paid at straight time unless the hours worked exceed the sick leave used. I. An exempt employee is not subject to salary reductions for absences of less than eight (8) hours unless they have exhausted all accrued leave (reference 29 CFR 541.710). The exempt employee is required to first use accumulated sick and vacation hours. If the employee has no sick or vacation accruals, the employee may be granted discretionary time or may be granted leave without pay. IV. MISUSE OF SICK LEAVE Misuse of sick leave by an employee may affect the service provided to our customers and/or the productivity of other employees in the workgroup, especially those who seek assistance, advice, or guidance from an absent employee. "Misuse" is considered the use of sick leave for that which it was not intended or provided and may constitute a violation of this policy. If a supervisor suspects that an employee is misusing sick leave, the supervisor, upon consultation with Human Resources,may require a suitable explanation or documentation to determine whether the sick leave was used according to this policy. V. SICK LEAVE PAY AND ACCRUAL(CIVIL SERVICE) A. Sick Leave Pay Civil Service employees may be paid for accrued sick leave up to a maximum of 90 working days pursuant to Chapter 143 of the Texas Local Government Code. B. Accrual Sick leave is accrued at the following rate for each month of continuous service: 1. In accordance with the Families First Coronavirus Response Act ("FFCRA"), an Administrative Directive Addendum ("Addendum") has been created to address COVID-19 (novel coronavirus). Toward that end, and effective immediately,this Addendum shall apply during the term of the declared local emergency originally dated March 13,2020,and as extended or terminated by action of the City Council. This leave is only available for use until this Addendum terminates, and at no time will be paid out at employee's separation from the City and will not carry over to the next year. Employees may use this leave only when the City has work for the employee to perform. Emergency Paid Sick leave is not available to employees who are furloughed, laid off, or terminated. This Addendum applies to all City employees,including City temporary staff,and is subject to change at the sole discretion of the City Manager or designee at any time. This Addendum also does not apply to independent contractors or temporary staff working through temporary staffing agencies.This Addendum does not change the terms and conditions of employment. Effective November 1, 2020, this Addendum shall apply to Emergency Responders. Additionally, effective April 1, 2020, in accordance with the Emergency Paid Sick Leave Act ("EPSLA"), employee SICK-COVID19HR-660 Paid Leave amounts will be reset to the full amount according to the employee's pay category (i.e., regular full-time, three-quarter time, or part-time) as defined under the section below titled AMOUNT OF SICK-COVIDI9HR-660 PAID LEAVE. The employee has been advised by a health care provider to self-quarantine due to concerns related to COVID-19; or 3. The employee has been directed to self-quarantine by their supervisor, their department director or their designee, or by the Human Resources Director or their designee. 4. The employee is exhibiting symptoms of COVID-19 and is seeking a medical diagnosis; or 5. The employee is caring for an individual with whom the employee has a close personal relationship who is the subject of a quarantine order or has been advised to self-quarantine due to COVID-19; or 6. The employee is caring for their minor son or daughter if the child's school (elementary or secondary) or place of care has been closed,or the child care provider is unavailable due to COVID-19,and there is no other suitable person available to care for the child; or 7. The employee is experiencing any other substantially similar condition as specified by the Secretary of Health and Human Services. The construction specifications and standard details are nearing completion with a planned effective date of January 1, 2021. BACKGROUND: Construction specifications are the foundation of constructing public infrastructure. These specifications describe in detail the work to be performed,accepted construction methods,how the quality of construction is determined, how the work will be measured, and how the City's contractors will be paid. The more clearly and plainly these items are described, the better the understanding a contractor bidding a project will have of the expectations and ground rules required by the City during the bidding process. Clearly defined specifications minimize change orders which,by extension,reduce potential risks incurred by the City with respect to increases in scope, schedule, and budget. The City of Denton currently uses multiple sets of specifications to construct public infrastructure, which often leads to confusion and complication between the City and its general contractors during construction. This typically comes in the form of referencing the North Central Texas Council of Governments' (NCTCOG) Public Works Specifications with addendums specifically required by the City of Denton that either modify, add to, or completely change certain portions of the NCTCOG specifications. In addition to these specifications, references are also made to other specifications, such as those from the Texas Department of Transportation, or Manual on Uniform Traffic Control Devices, and special specifications that pertain only to a specific project. The complication of having multiple specification references causes potential misunderstanding between the contractor and the City from the beginning of the project through inspection to final acceptance. On October 23, 2018, the City entered into a professional services agreement with Kimley-Horn and Associates, Inc. for the preparation of standard construction specifications. Following approval of the agreement, staff began working with Kimley-Horn to prepare a unified set of technical specifications and standard details for public infrastructure construction in Denton. Standard details are detailed drawings that visually represent the technical requirements of the construction specifications. The draft construction specifications were substantially complete in spring of 2019. The public inspection period for the standard construction specifications lasted from December 23,2019,to January 24,2020. Since that time, staff has incorporated the feedback received from the public, conducted additional internal review, and the Engineering Design team prepared the standard details in accordance with the latest draft of the specifications. The project 22 Date: December 4,2020 Report No. 2020-097 schedule, which was originally projected to be completed by December 2019, was impacted in part by staff work to prepare for the 2019 bond program and by the City's COVID-19 response. Development of the construction specifications also included an overhaul of the City's construction contract documents. The revised contract documents were developed in collaboration with the Procurement & Compliance Department and City Attorney's Office. Once finalized, the new contract documents will be used by every City of Denton department for public works construction projects. The new construction specifications will also be used by the private development community when private developers are required to construct public infrastructure with their projects. The development community recently received updates on the draft construction specifications and standard details through a Developer Town Hall presentation on November 11, followed by a presentation to the Texas Society of Professional Engineers on November 13. Feedback received to-date from the development community has generally been very positive, as the new specifications will alleviate confusion and provide consistency from project to project. The draft standard construction specifications and standard details are also available on the City's Land Development webpage at: www.cityofdenton.com/landdevelopment. Standard details and construction specifications are reviewed and approved administratively. Staff is currently conducting a final review of the draft specification and standard details with a goal of finalizing the documents by December 18, 2020. The effective date of the new standard construction specifications and standard details will be January 1, 2021. Staff will conduct comprehensive internal training in early calendar year 2021 to ensure all technical staff, including the inspectors and project managers, fully understand the City's new technical requirements. Staff plans to update the standard construction specifications and standard details annually,with a public inspection and feedback period each summer. Due to the growth of the City's southwestern sector and increased traffic, staff is experiencing increased issues in its ability to provide service and complete routes in a timely manner. Additionally, the anticipated growth in this area suggests that, without relief, the workload will only increase. During the August 6, 2020 Council meeting staff was asked to review additional refunding opportunities due to favorable market conditions obtained in the prior bond sale. In response to Council's request, Informal Staff Report (ISR) No. 2020-81 outlined tax-exempt refunding opportunities for the City's Certificates of Obligation, Series 2011 and General Obligation Refunding and Improvement Bonds, Series 2011. The principal amount of these outstanding obligations to be refunded by the Series 2020A Refunding Bonds was $15,185,000 for the Certificates of Obligations and $1,355,000 for the General Obligation Refunding and Improvement Bonds, for a total of$16,540,000. DISCUSSION: On November 17, 2020, the City along with its financial advisor, Hilltop Securities, conducted a competitive sale for the General Obligation Refunding Bonds, Series 2020A. The City expects to close on the Series 2020A Bonds on December 17, 2020. The preliminary numbers presented to Council on October 27, 2020 estimated the net present value savings of the refunding to be about $2,873,861. Based on the winning bid from Raymond James & Associates, Inc., the final net present value savings achieved was $3,444,385. The increased savings is due to improvement in the market as well some conservatism in the assumptions used within the preliminary numbers. DISCUSSION: Based on mosquito trap results from the last several weeks, low temperature ranges, and results of the West Nile virus(WNV) screening by the Texas Department of State Health Services (TDSHS) and the University of North Texas (UNT), Denton staff members consider the 2020 mosquito season complete. In accordance with the City of Denton's Mosquito Surveillance and Response Plan (MSRP), the West Nile Virus risk level will be reset to Risk Level Two and will remain at that level until the start of the 2021 mosquito season. The following information is provided as a brief summary of the 2020 season: • Trapping began on June 6 and ended on November 23. • Approximately 229 traps deployed for routine monitoring (samples sent to the TDSHS for WNV testing and mosquito species identification) • Approximately 206 traps deployed for local testing for WNV (conducted by UNT) • Approximately 1,600 larvicide applications by the Drainage and Parks and Recreation departments • Seventeen larvicide treatments distributed to citizens • Thirty-four mosquito traps tested positive for WNV. The earliest detection was on June 15, and the latest detection was October 29. • Three reported positive human cases within the City of Denton, all were neuroinvasive WNV • Three ground-based neighborhood sprayings,using for the first time the organic pesticide Merus 3.0, were conducted on September 9, September 11, and September 21 • Two deaths reported within the City of Denton The 2020 season was a very active season with onset in mid-June and a high number of positive mosquito traps, unlike the pattern observed in 2019. The sampling of mosquitoes occurred for a longer period of time due to the last WNV positive mosquito trapping occurring in late October. Mosquito trapping started at the beginning of June and was extended until late November. The first hard freeze, the typical weather indicator used as the ending of the WNV mosquito season, was recorded on November 30. There are many staff members across the organization involved in the City of Denton's Mosquito Surveillance and Response activities. These staff members include the Drainage Department, Public Communication Office,Technology Services,Parks and Recreation,the Water Department, and Watershed Protection. The Mosquito Surveillance and Response Program would not be possible without the dedication and hard work of these staff members. EXECUTIVE SUMMARY DME Engineering was tasked with researching the effects of 5G cell service on humans. In particular, the concern is whether the radio frequencies used pose a danger to human tissue in the form of Radio Frequency Radiation (RFR). Neither DME nor its staff are subject matter experts in 5G communications systems. This ISR is a compilation of expert opinions and does not reflect the opinion of DME. DISCUSSION What is 5G? 5G stands for 5th generation. 1st and 2nd generation cell phone service began in the 1980s and 1990s and were mainly for carrying voice and SMS messages. Yd and 4th generation services, starting in the 2000s and 2010s, added web browsing and increased data speeds to handle a wide range of mobile services. 5th generation allows much higher data transfer speeds with much lower latency (delays) enabling a wide range of technologies that extend beyond communications. One article summarized the improvements as follows: "The last major network upgrade was 4G, which debuted in 2009... with a peak speed of about 10 Mbps. In comparison, 5G is poised to deliver peak speeds between 10 and 20 Gbps. And network latency will drop from 30ms to about 1 ms,ideal for video game streaming,online video,and the Internet of Things,which is anticipating 5G to connect sensors, computers, and other devices with ultra-low latency."' For comparison purposes, 10 Mbps is equivalent to 0.01 Gbps which means 5G is 1,000-2,000 times faster than 4G. Network latency is defined as the amount of time it takes for a packet of data to be captured, transmitted,processed through multiple devices, then received at its destination and decoded. 5G technology is similar to the previous cell service technologies in that it uses radio frequencies to transmit data between networked towers and individual devices. 1G through 4G service use frequency bands ranging from 850 MHz up to 2.5 GHz. There are also specifications that would allow 5G to make use of several more bands all the way to 125 GHz. One key difference between 5G and previous generations of cell service is that the power output of each of the antenna is much lower than that of 1 G through 4G. There are two main reasons for this: 1)the higher frequency signals used by 5G do not travel as far as lower frequency signals and 2) the system is designed to interact more closely with client devices using beam shaping techniques (think directional instead of omni-directional signals) and functions better with more antennae on a smaller scale. Health Risks of 5G and RFR Because 5G cell service is fundamentally radio frequency signals, the health concerns will be similar to those of existing cell service. In fact, some researchers estimate a net decrease in RFR as 5G is implemented because there will be less wasted energy being broadcast in all directions from the larger, older cell towers. Radio Frequency Radiation is classified as non-ionizing radiation and falls into the same class as microwaves, infrared waves, and visible light. Its energy is easily absorbed by water molecules and human tissue(which is mostly water)but is not powerful enough to make atomic changes as would high energy x-rays and gamma rays.As RFR is absorbed by water or tissue molecules the atoms are excited and begin to move. This atomic vibration is manifest as heat. According to Nature Research, "We believe the main biological effect of the electromagnetic radiation from mobile phones is a rise in temperature."3 So then, how damaging is the energy emitted by modern cell towers? According to the Federal Communications Commission, "At a cell site, the total radio frequency (RF) power that can be transmitted from each transmitting antenna depends on the number of radio channels (or transmitters)that have been authorized by the Federal Communications Commission and the power of each transmitter. Although the FCC permits an effective radiated power (ERP) of up to 500 watts per channel (depending on the tower height), the majority of cellular or Personal Communication Service (PCS) cell sites in urban and suburban areas operate at an ERP of 100 watts per channel or less. An ERP of 100 watts corresponds to an actual radiated power of 5-10 watts, depending on the type of antenna used. In urban areas, cell sites commonly emit an ERP of 10 watts per channel or less. For PCS cell sites, even lower ERPs are typical. As with all forms of electromagnetic energy,the power density from a cellular or PCS transmitter rapidly decreases as distance from the antenna increases. In the case of cellular and PCS cell site transmitters, the FCC's RF exposure guidelines recommend a maximum permissible exposure level to the general public of approximately 580 microwatts per square centimeter [.000580 W/m2]. This limit is many times greater than RF levels typically found near the base of cellular or PCS cell site towers or in the vicinity of other, lower-powered cell site transmitters. Calculations corresponding to a "worst-case" situation (all transmitters operating simultaneously and continuously at the maximum licensed power) show that, in order to be exposed to RF levels near the FCC's guidelines, an individual would essentially have to remain in the main transmitting beam and within a few feet of the antenna for several minutes or longer. Thus,the possibility that a member of the general public could be exposed to RF levels in excess of the FCC guidelines is extremely remote. ,4 The FCC limit for RFR exposure due to portable communication devices is 1.6 watts per kilogram (W/kg), as averaged over one gram of tissue.5 For comparison, the magnetron (microwave generator) in most home microwave ovens will generate approximately 500 — 1000W of microwave power. It is also important to note that the heating of tissues takes place at a very superficial level in the tissue (less than 1 cm and decreasing in depth as the frequency increases). Thus, the higher frequency radiation of 5G cell service is less likely to affect tissues beyond the skin and the eyes. The following is the FCC statement on links between wireless device use and cancer or other illness: "Some health and safety interest groups have interpreted certain reports to suggest that wireless device use may be linked to cancer and other illnesses,posing potentially greater risks for children than adults. While these assertions have gained increased public attention, currently no scientific evidence establishes a causal link between wireless device use and cancer or other illnesses. Those evaluating the potential risks of using wireless devices agree that more and longer- term studies should explore whether there is a better basis for RF safety standards than is currently used. The FCC closely monitors all of these study results. However, at this time, there is no basis on which to establish a different safety threshold than our current requirements."' Not all groups agree that little or no harm is done by RFR. Effects include increased cancer risk, cellular stress, increase in harmful free radicals, genetic damages, structural and functional changes of the reproductive system, learning and memory deficits, neurological disorders, and negative impacts on general well-being in humans. All installations of 5G equipment on DME assets require the communication company to install a disconnect switch. The switch's purpose will allow field personnel, who may have close contact to a 5G antenna or node,to turn off the node—without prior notice to the communication company —prior to field personnel coming in close contact. DME communicated with Professor Shengli Fu (Department Chair—Electric Engineering), from the University of North Texas (UNT), who informed us that 5G is one of his research interests. Dr. Fu stated he is willing to provide a presentation to the Council. If Council would like Dr. Fu to provide a presentation,DME will be happy to coordinate dates. Additionally, if Council prefers that staff issue a formal solicitation to obtain expert advice on this matter, staff will proceed as directed. Legal and Financial Considerations of 5G Texas Senate Bill 1004 restricts the powers of municipalities with respect to telecommunication nodes within public right-of-way(ROW). Exclusive use arrangements and discriminatory fees are prohibited; permitting time limits are set forth; and ROW usage fees are capped to ensure that municipalities provide fair access to ROW facilities to telecommunications providers.8 CONCLUSION: The information provided in this report is a summation of external sources and the City does not have experts in this field on staff. As such, if Council is interested in expert advice on this matter, staff recommends that a one-minute request to the full Council be made to direct staff to identify an expert(s) to present further information to the Council or for staff to issue a formal solicitation for those services.
