Council Member Request: Discussion on the electronic "blue card" agenda item comment form to be revised to request people's email addresses. c. Staff Information: The potential additional field requesting a commenter's email address on the comment form would need to be an optional portion of the form. If the Council wishes to include email addresses, an amendment to the Rules of Procedure will need to be considered. Email addresses on blue cards would become part of a governmental record and subject to the Public Information Act. The Act requires that email addresses collected from members of the public in this context must be withheld in response to a public information request. B. January 4 City Council Luncheon — The start time for the January 4 City Council Luncheon has been changed to 12:00 p.m. Staff contact: Rachel Balthrop Mendoza, City Manager's Office C. Third-Party Bill Payment Websites — Staff received several inquiries regarding customers who have used third-party payment sites to make a utility payment. The City of Denton is currently only affiliated with our own billing payment portal that can be accessed from the City of Denton website and has no relationships with any third party bill payment providers. Third-party payment sites typically market some measured usefulness to customers, such as consolidating all of a customer's bills onto one platform;however,using their service usually results in high transaction fees and delayed payment to the City (e.g. payments are typically in the form of a check received by mail). Often, these platforms use paid online advertising to drive customers to their site and rank higher in search engine results. The site that drove the recent inquiries, DOXO.com, at several locations reiterates its non-affiliation with the City and redirects to the City for questions and to pay the City directly. The City encourages its customers to make payments directly to the City to ensure payments are applied as quickly as possible and with no additional cost that might be applied by a third party service. Staff will include information regarding these services, common scams, and the benefits of making payments directly to the City in an upcoming Citizen Connection newsletter and through social media. State of Texas Assistance Request — On December 21, Council Member Meltzer requested information about what the City's role might be in assisting with any nursing shortage the County may face. Fire Department staff reached out to Dr. Richardson, Denton County Health Director, who confirmed hospitals can request staffing through a State of Texas Assistance Request (STAR). He stated the County does not play a role in these requests, with the exception of the Denton County Emergency Management division forwarding a STAR request locally up to the Texas Division of Emergency Management for a decision on whether to fulfill or deny the request. Dr. Richardson said, at this point, the local hospitals have not requested any additional assistance from the County. Staff contact: Kenneth Hedges, Fire 2 E. Hotel Rooms for Emergency Shelter — Past the expiration of the CRF funds on December 31, staff s recommendation was to continue with only one hotel with a smaller block of 40 rooms using CDBG funds. Grace Like Rain was notified by City staff that we would not be recommending continuing with the block of 10 rooms past December 31. Staff recommended only having one location for a block of hotel rooms based upon funds and based upon experience in order to have a sustainable operation and provide on-site supportive services to clients, on-site agency support day-to-day that can coordinate with hotel owner and staff, provide closer oversight, and provide security. This was documented in the AIS for the items that Council approved regarding continuation of hotel rooms for alternative emergency shelter(ID 20-2466, ID 20-2367). There have been reported problems at the second hotel site where the 10 hotel rooms were, and the second hotel has presented a number of damage claims to their property and inside their rooms. Staff has been in contact with Grace Like Rain and will provide for an extension of no more than 2 weeks due to any confusion or miscommunication. This will allow the City to remain within our expenditure authority and it will provide some time for the agency to work on rapidly rehousing the families, for which dollars are available, or potentially moving to rooms at the continued hotel location being managed by The Junction, or to another hotel location using alternate sources. Staff contact: Dani Shaw, Community Services F. CatDenton 35 Proposed Rezoning Case — On December 21, Mayor Hudspeth requested information regarding the proposed rezoning case for CatDenton 35. Planning staff are currently finalizing their analysis and recommendation on the CatDenton 35 case and provide the below information. Hirschbach approached the City in the fall of 2019 to discuss the feasibility of constructing a private trucking terminal for their drivers on 38 acres north of Highway 77, at the nexus of two arterial roadways and 0.5 mile from IH-35. The proposal included a variety of uses, specifically the following: • Administration and Support Building with offices, conference and training rooms, exercise space, laundry facilities, day rooms, and changing rooms • Inspection and Truck Wash • Truck Repair Shop • Fenced Long Term Car Storage and Tractor Storage Originally, staff considered applying the Travel Plaza use to the proposal; however, Travel Plazas are typically intended as a place for the general motoring public, suggesting a high-intensity use that attracts a high volume of visitors (including passenger vehicles and large freight trucks) who stop for a brief period for fuel and other services while traveling along the interstate. For the Hirschbach proposal, given the private nature of the facility and proposed activities,Travel Plaza didn't quite capture the intensity and activities associated with the use. Staff again referred to the permitted use table to find a comparable use, but the proposal was so specific that nothing accurately captured the all of the components of the proposed development. 3 Therefore, the applicant submitted a Planned Development application to rezone the property and define the use and development standards. Public notification was initially mailed on December 19, and the item was published in the newspaper on December 20. The Future Land Use designation for the subject property is Business Innovation, which is intended for large tracts of land that are appropriate for well-planned, larger scale office and employment parks with supporting uses such as retail, hotels, and residential. Typically,the Business Innovation Future Land Use designation supports the General Office (GO) and Light Industrial (LI) Districts. As with all arterials, staff is concerned about the quality of design, encouraging increased development standards for tree canopy, landscaping, and site design. Ordinarily, DDC Section 7.10.5A.2 exempts industrial uses in the LI District from site and building design standards. Therefore,in order to address staff s concerns,the applicant is proposing to blend the LI and GO Districts, using the LI permitted uses with the increased GO development standards. Attached is the overall proposed landscape plan submitted as part of the PD application. While the plan meets the GO requirements, staff would like to see additional buffers on the west, north, and east property lines to address adjacent property owner's concerns. Currently, staff is deliberating the following buffer elements, but has not yet finalized the recommendation: 1. Three ornamental trees planted every 25 linear feet of buffer for a total of 474 additional ornamental trees 2. One large canopy tree planted for every 30 linear feet of buffer (minimum 4" caliper) for a total of 132 additional large canopy trees Planning staff subsequently met with the applicant to discuss staffs analysis and public hearing schedule. Based upon this meeting, below is further information on the proposal: • Staff provided the applicant with the proposed draft recommendation regarding the additional buffers, and she requested to postpone the public hearing at the Planning and Zoning Commission to give the engineer an opportunity to review the recommendation and revise the site plan. • Additionally, in response to staff s concerns for the LI District, since the proposed PD primarily followed GO District standards, they are now considering using GO as a base-district only, including the permitted uses and development standards. In summary, the applicant requested to postpone consideration of the item to the January 20 Planning and Zoning Commission meeting to review staffs recommended buffers and modify the site plan accordingly. Staff will reach out to the representative of the adjacent property owner to ensure she is aware of all meeting changes and answer any questions. Staff contact: Julie Wyatt, Planning G. Apartment Natural Gas Leak— On December 12, the City received an inquiry from Council Member Armintor regarding an apartment complex experiencing concerns 4 with a potential natural gas leak. The Denton Fire Department received a call regarding Carbon Monoxide detector going off at the same location where, upon arrival, gas was detected in the apartment. The leak was detected from a supply line coming into a specific apartment unit. All adjoining apartments were checked, and all found to have gas in them. DFD had all tenants evacuate their apartments and the properties were ventilated until no gas remained detectable. Apartment maintenance staff were contacted along with Atmos who all arrived at the scene. Denton Fire Engine 3 was called out to assist with ventilation and monitoring efforts. Once all apartments were cleared,residents were allowed back in,but the gas was left off until apartment maintenance coordinated necessary repairs with a licensed plumber. City staff contacted Atmos and to ensure timely restoration of service. Atmos coordinated a plan to restore gas service to the facility with apartment maintenance staff. On December 15, City staff performed a final inspection after all repairs were made. Gas was restored to the facility on December 15 following the final inspection. North Lakes Park Recycling Drop-off Site Improvements—In an October 9 Informal Staff Report, Solid Waste and Recycling staff reported that, until a program evaluation is completed and subsequent direction is received as part of the development of the Comprehensive Solid Waste Management Strategy,the City will continue to operate the North Lakes Park Recycling Drop-off Site at its current locations with identified improvements. Since October 1, the City of Denton has increased the recycling capacity within the containers on-site by 52%(62 cubic yards of capacity.) Additional signage has been placed on the new containers directing the public on proper materials/methods of management. It is anticipated that the gate to the site will be installed and the mobile video trailer will be received and deployed by the end of January 2021. In the interim, SWR continues to regularly service the site Mondays, Wednesdays, and Fridays; inspecting and addressing illegal dumping and site conditions multiple times daily and servicing full dumpsters off schedule should the need arise. Over the Christmas Holiday,specifically the evening of December 27,to the morning of December 28, a significant amount of illegal dumping occurred at the site (Figure 1.) This site condition is atypical of operations we have seen over the past 3 months (Figures 2 and 3). While much of the illegal use will be abated following the installation of the gate and video system, staff will continue to monitor and clean the area as needed. Hickory Creek Trail Connectivity_ — On December 21, Mayor Pro Tern Davis requested information on how the Boy Scout Camp and Roselawn Cemetery factor into the planning for the Hickory Creek Trail. Staff will work on coordinating with the Boy Scout group to understand if the organization is interested in linking to the trail in the future and how the new Bonnie Brae St. and future Bonnie Brae Trail could provide that connectivity. Located on the north side of Hickory Creek,the new Bonnie Brae St.will traverse the western side of the Boy Scout property on Roselawn Dr. At this time, the trail is planned to be located on the southern side of the creek. Staff will continue to work with property owners and special interest groups as planning for the future trails continues. Staff contact: Gary Packan, Parks and Recreation J. Future Center for People Experiencing Homelessness Bike and Pedestrian Facilities On December 16, Council Member Johnson requested information on bike and pedestrian facility plans for the Center for People Experiencing Homelessness on Loop 288, as well as the Center's anticipated opening date. Sidewalk connectivity is planned for the Loop 288 facility. Staff is coordinating with the mobility plan and Development Services to determine how to connect the different existing sections, along with the planned development expected south of the building, for sidewalk access to McKinney Street. Staff will also coordinate with TxDOT,DCTA,and Serve Denton for ongoing transportation and mobility resources. Additionally, the 2019 Intersection Improvements Project includes an at-grade crosswalk for the intersection of McKinney St. and Loop 288, with construction scheduled for completion in Summer 2021. Currently, there is not an anticipated opening date for this facility. The project is in its design phase and is determining the construction timeline. Once the design phase is complete, Staff will provide City Council with specific details on the project's completion date. Denton Holiday Festival HOT Contract — On December 21, Mayor Hudspeth requested information regarding Zera Coffee's mural progression and HOT funds usage. The scope of Denton Holiday Festival Association's (DHFA) PY20 HOT contract is to support the execution of the 2020 Denton Holiday Lighting festival. This event was held December 4 with a revised schedule to support COVID-19 restrictions. While planning in the early fall, the event realized a large portion of its HOT Art budget could not be used as intended due to the necessary changes.DHFA's Director, Warren Dane, reached out to Finance staff to discuss using their HOT Art 6 funds for another purpose, as well as adapting their HOT Advertising funds to meet the needs of the new style of the event. Finance staff was able to quickly approve their HOT Advertising budget request as it maintained the scope and amount of the approved HOT application and contract. DHFA was looking to use $11,500 of their $15,000 HOT Art budget on the original mural location. Their PY2020 full budget is attached. Below is the timeline of events: • September 11:DHFA requested advertising change and mural idea.No location.No rendering. • September 25:DHFA presented 227 W Oak(A Creative Art Studio)as potential location.No owner approval. • September 29:DHFA provided rendering. • October 9:Development Services(DS)advised Finance staff the Oak St location is not in any district thus would not require a review by any board.City staff agreed that the potential project needed to be reported to PAC. Advised DHFA about DS findings,PAC presentation and need for project to also be presented to Council for HOT contract scope and budget change prior to the end of the program year. Program year deadline for expenditures is December 31,2020. • December 22:PAC was advised. • November 10: More Q&A with DHFA about the timing of the mural and expensing it before end of program year. • November 13: Confirmed with Legal that contract would have to be presented and approved due to changing purpose of funds from event operations and orchestra to new project. • December 5:DHFA advised having issues with mural wall surface. DHFA requested to instead use unused HOT Art money to buy outdoor bulbs for Visual Art Center.Finance staff denied request. • December 15: DHFA advised a new location for another mural was in being considered: backside of Zera Coffee.No owner approval yet.New rendering in works. • December 16: DS advised location is in DTIP which encourages local art and would not need any review. Staff advised DHFA of DS comments on new location. Staff also referred DHFA back to October 9 email stating the steps needed to take to gain approval from Council.With no owner approval or final rendering in hand,Finance staff would not be able to present to Council for approval before the end of the HOT program year (December 31,2020). DHFA replied with its understanding of the time constraints and expressed appreciation of City's effort in assisting them in trying to reallocate the unused HOT art budget for their event. Staff contact: Randee Klingele, Finance L. Demolition of Houses on W. Hickory and North Texas — On December 21, Council Member Armintor requested information about the houses being demolished on the corner of W. Hickory and North Texas. Development Services staff checked the records on this site and found it had demolition permits approved the week of December 7. The site will be developed as a 27-unit apartment complex. They are currently working through building permits and plan to be open for the next school year. Developers were not required to go through the rezoning process because they were permitted by right. The apartments are planned to be regular apartments, and staff are not aware of the developer intending to market them exclusively to students. They will be market-rate units to be rented by the unit as there was no indication by the applicant during the review process that they were to be rented by the room. Further,the buildings were not tested for asbestos before being demolished. The City follows the Texas Department of Health and Safety standards for when a demolition 7 requires asbestos testing or abatement, and the demolition of these properties did not meet the State's standards for testing. Headstones Found by Demolition Crew— On December 22, Mayor Pro Tern Davis informed staff that three headstones were discovered on December 21 on the adjacent properties on West Hickory Street and North State Boulevard while clearing land for the construction of a 27-unit student housing apartment building. Construction was halted after the discovery due to concerns of possible buried bodies. Two of the headstones found were for Shelby Howard Williams (1882-1931) and Lora Elisabeth Lindsey Whitwell (1864-1911). The third headstone was unidentifiable. The Parks and Recreation Department (PARR) maintains Oakwood Cemetery and I.O.O.F. Cemetery, along with a database of records of names, plot locations,and burial dates dating back to the late 1800s.Using this,PARD confirmed that Williams was buried in Oakwood Cemetery. While the database did not contain Elisabeth Lindsey Whitwell's records, further investigation located her grave at Medlin Cemetery in Trophy Club. She has a new headstone that is a double with her husband, William Amos Whitwell, who passed away four years later in 1915. It appears that after new headstones were created, relatives or others removed the old ones. PARD currently has the headstones and staff are attempting to contact the remaining family members for further instruction. Staff contact: Drew Huffman, Parks and Recreation N. Southeast Denton Programs and Projects— To continue improving communication with the community, the Parks and Recreation Department (PARD) is gathering members from the American Legion Hall Senior Center Council and MLK Jr. Recreation Center Council for a series of regular meetings over the next few months to provide updates on several projects that are taking place in Southeast Denton. These projects include,but are not limited to,MLK Jr. Rec Center improvements and sculptures, partnering with the Denton Police Department to office a Community Resource Officer in MLK,ALH Senior Center construction,programming,historical interpretation, Foundations of Our History mural, Denton Women's Interracial Fellowship sculpture, and future plans for Fred Moore Park and Carl Young, Sr. Park. PARD has several projects underway that are in the planning stage,construction, and renovation. By bringing these groups together, PARD can continually provide updates that can be shared throughout the neighborhood and community as they progress and gain critical feedback during the various stages of development. Lake Forest Park Nearby Construction Concerns — On December 18, Council Members received an email from a resident regarding construction activities near Lake Forest Park and Wiggly Field Dog Park. The resident's primary concerns were 8 the removal of the natural habitat by the housing development and the disturbed soils polluting the waterway. Environmentally Sensitive Areas Habitats The Parkvue Development site contains Environmentally Sensitive Areas (ESA) including Riparian Buffers and Cross Timbers Upland Habitat. An alternative environmentally sensitive areas (AESA) plan was approved on March 5, 2019 allowing Parkvue to encroach into riparian buffers ESAs for the purpose of constructing roadway improvements for crossing Fletcher's Branch Tributary No. 4 and associated utilities, the approved AESA is shown below. The removal of vegetation of the protected area would not exceed 10,000 sf. The applicant proposed multiple mitigation strategies in exchange for the removal of protected area,including the removal of Chinese Privet and Callery Pear, invasive plant species; the planting of native species throughout the riparian stream buffer to replace the invasive understory; and preserve an additional 1.25 acres of Cross Timbers upland habitat and an additional 5.5 acres of tree canopy cover beyond the minimum City of Denton requirements for preservation. The latest communication with the construction site operator about the implementation of the AESA occurred on November 30,indicating invasive species have been grubbed and the planting of native vegetation is scheduled to start in Spring 2021. The site operator is to maintain temporary controls along streambank where necessary to prevent off-site discharge from disturbed areas. - - W. -- - - --'RYAN ROAD (GOOD SAMARITAN EAST TRACT U ■��1 KI.Iev-HOI. Construction Stormwater The developer is constructing single family housing and infrastructure and is required to comply with stormwater regulations and address erosion and sediment control deficiencies. Constructions sites are required to comply with both the Texas Commission on Environmental Quality (TCEQ) and the City of Denton stormwater regulations. These include obtaining a construction general permit, developing a stormwater pollution prevention plan (SWPPP), maintaining stormwater controls identified on the SWPPP throughout the construction stages until sites develop permanent vegetative cover, and passing regular construction site inspections 9 generally performed every three weeks by city staff. Developers are given time for making necessary corrections to any deficiencies identified during site inspections. Failure to address identified deficiencies set construction sites into enforcement escalation plans that could result in issuing stop work orders until all deficiencies are addressed.Parkvue Phase 1 and 2 was last inspected on December 28. During the last site inspections some needed minor corrections were identified and a report with the findings was sent to the site operator. The site would be inspected in three weeks when the status of corrections would be verified. Staff Contacts: Deborah Viera, Environmental Services and Michael Smith, Engineering P. Township II Park Pla rX o�und - On December 15, Mayor Hudspeth requested staff research the opportunity to place a playground in Township II Park. Staff did look into the possibility of installing a playground in this park. Staff determined that, due to its linear form and location of the creek, space is limited. The best location for a properly sized playground would be at the southern end of the park land near San Gabriel Drive and Angelina Bend Drive.Based on the Playground Replacement Plan, a number of playgrounds are scheduled to be replaced in the upcoming years that still do not have dedicated funding. Staff has tentatively placed the Township II Park playground to be installed in 2025. However, if funding can be secured sooner or if another play structure is rescheduled to another year, the playground could be installed prior to that date. Sediment Cleanup on Longfellow Lane — On Monday, December 28, Council Member Meltzer requested that staff investigate and remediate dirt and other sediment on Longfellow Lane resulting from nearby construction on Windsor Drive. Quality Excavation is the contractor for the 2019 Street Reconstruction Project, which includes Windsor Drive. After receiving the request from staff, Quality had crews sweep the stretch of Longfellow Lane containing sediment on Tuesday, December 29. Below are before and after photos of the sediment remediation work that took place earlier this week on Longfellow Lane. Staff contact: Trevor Crain, Capital Projects Before Aftor l 10 R. American Legion Hall Update—Details of staff s efforts to overcome issues with the original architect's design are available in previous Friday Reports. Staff will continue to work with the current contractor and architect to address those issues in an effort to keep the project on schedule. In November,minimal construction activity took place, however, the project's current architect and the contractor worked diligently through numerous design questions and clarifications. The contractor was able to begin interior construction activities in December as the exterior/structural issue collaboration efforts were underway. Most of the issues were resolved in early December, resulting in the contractor being able to order the needed structural supplies. These supplies are now onsite and the contractor is making visible progress. There was some further delay as a result of subcontractor COVID-19 exposures resulting in a workforce shortage for two weeks. Previous reports show that the original project schedule substantial completion date of February 18, 2021 was modified several times as a result of the numerous delays. The lengthy collaboration efforts between the contractor, architect, and staff, along with supply deliveries, resulted in an updated substantial completion date of April 8, 2021. While there are no current construction budget issues, Parks staff is working on addressing a potential budget shortfall for some unexpected FF&E(furniture,fixtures and equipment),however,this is not holding up the current construction efforts. Interstate 35 and US 380 Interchange Safety Enhancements Update — On December 27, Mayor Hudspeth forwarded a resident's concerns about the safety of the of the northbound 1-35 and US 380 interchange. As stated in the November 13, 2020 Friday Report, while both Interstate 35 and US 380 are both state-owned facilities,City staff is working with TxDOT to identify and evaluate potential interim solutions to improve the overall safety of the intersection prior to the long-term solution being implemented by TxDOT. Multiple solutions will be evaluated, including but not limited to: • Reversing the entrance ramp from Oak St. &the exit ramp to US 380 • Eliminating the entrance ramp from Oak St. • Adding an additional left turn northbound at US 380 • Adding an extension of the existing right turn lane to US 380 from the NB 1-35 frontage road • Creating/signing a second exit from NB I-35W to the NB frontage road prior to the 1-35E/1-35W merge • Signalization of W. Oak St. and the NB 1-35W frontage road • Potential revisions to the existing lane markings on US 380 east of I-35 • Evaluating the traffic signals to ensure timing is at optimal efficiency After the initial meeting with TxDOT on November 18, the City performed a traffic count study that concluded on December 11. Staff is now in the process of analyzing the data to determine which of the proposed interim solutions are viable. This analysis will not only tell which alternatives are feasible, but also how effective each option would be in reducing the congestion in the study corridor. The study is scheduled to 11 be complete by mid-January, after which the City will share the results with TxDOT for their review and approval. The City and TxDOT will then develop plans for the implementation, including public outreach, construction, scheduling and funding, of the selected improvements. Additionally, the resident requested a contact at TxDOT to voice his concerns to as well as information public hearings from TxDOT. Staff contact: Rebecca Diviney, Capital Projects T. Operation Rudolph — On Tuesday, December 29, the Denton Fire Department completed Operation Rudolph for the 2020 holiday season. Operation Rudolph consisted of two fire trucks (Rudolph 1 and 2) adorned with Christmas decorations and lights that drove through every community in Denton in a show of holiday spirit. For 16 nights, the two trucks covered over 500 miles across Denton. The idea for Operation Rudolph was formulated from fire departments in other cities performing similar acts in years past. Due to this year's pandemic and the inability to socialize in groups,the Denton Fire Department developed a plan to bring the holiday spirit to each citizen. Two nights were set aside for Santa to make a special appearance and citizens were able to drive by and say hello. The Fire Department would like to thank its employees for over 100 hours of volunteered personal time to pilot Rudolph 1 and 2 around the city. BACKGROUND: Attached are the July, August and September 2020 (Q4) Dashboards for the Denton Energy Center. The dashboards are usually provided to City Council in a Friday Report at the end of each month. The unseasonably cooler weather during the summer months resulted in lower usage than previously forecast. Staff delayed providing the FY 2019-20 July, August, and September dashboards due to year-end projections changing as a result of the summer weather and usage. Staff is preparing to provide October,November, and December 2020 dashboards to Council in January 2021. The dashboards are intended to give a snapshot of relevant DEC metrics. The dashboards highlight the following: • The Emission Charts (based on calendar year) display the July, August and September engine runtime hours, starts, stops, monthly and annual emissions totals and limits. • DEC MWh Generation and Gross Revenue for FY 2019-20. o The DEC ran 55,258 MWh less in FY 2019-20 compared to FY 2018-19. This resulted in $24.7 Million less in DEC Revenue. • A DEC financial summary showing FY 2018-19 Actuals, FY 2019-20 Budget, the FY 2019-20 Estimate as of June 30, and the FY2019-20 Preliminary Actuals. • The Plant Monthly Run Hour Comparison Graph illustrates the monthly plant run times. • The Key Trends section explains variances in revenues and expenses. o Due to running fewer hours in FY 2019-20, fuel cost was approximately $3.35 Million lower than in FY 2018-19. o The DEC Net Income for FY 2019-20 was ($11.98) which is $26.2 Million less than in FY 2018-19. o The DEC Gross Margin for FY 2019-20 was $9.0 Million which is $21.3 Million less than in FY 2018-19.
