Format for response:Action Item (2) A Work Session regarding the donation of firefighter equipment no longer in use and the installation of signs at city entrances saying "Denton, Friendship City of Muzquiz,Mexico." a. Requestor: Mayor Pro Tern Meltzer b. Council Member Request: "Many Dentonites may not be aware that Denton has an official friendship city, Muzquiz, Coahuila, Mexico. It's not a random relationship. Thousands of Dentonites are from Muzquiz or are descended from Muzquizeno parents who came to Denton. The first Hispanic council member, Dr. Roland Vega, was Muzquizeno. We have two Muzquizeno school principals and many teachers. The tooled leather saddle you pass in the hall at City Hall was a gift from the people of Muzquiz as was the table made of fluorita in the mayor's office. I would like a brief work session so Council can consider giving direction to make a gift of firefighter equipment we will no longer be using to Muzquiz as was done some years ago. They're a county seat and serve five fire stations. And one more thing. When you enter Muzquiz there's a big sign that says "Muzquiz-Denton, Ciudades Amigas"—friend cities. I would like us to consider showing the same pride in our friendship (really our family relationship) by having signs at our city entrances saying "Denton, Friendship City of Muzquiz, Mexico". 2 c. Staff Information: On April 28, 2015, City Council approved the donation of expired safety equipment to the Muzquiz Municipal Police and Fire Departments. Additionally, a Friendship Cities Agreement between the Cities of Muzquiz, Coahuila,Mexico, and the City of Denton,Texas was signed by the Mayors of both cities in May 2015 (Exhibit 4). d. Internal Audit Fiscal Year 2021-22 Second Quarter Report — The Internal Audit Department's Quarterly Reports are intended to provide the City Council and the public with a status update on the Annual Internal Audit Plan.Additional items of note may also be presented and discussed by the Internal Audit Advisory Committee including,but not limited to, the Department's structure or budget, application of and compliance with relevant auditing standards,the annual audit plan, and changes to the auditing process. Bowling Green Park—On April 29, as a safety precaution Parks and Recreation staff will Ell in a large man-made hole located in the wooded area of Bowling Green Park. To complete the work, a backhoe will be utilized, and the work is expected to be completed the same day. Staff Contact: Gary Packan, Parks and Recreation D. Quakertown Park Electrical Upgrades —Park Maintenance began electrical upgrades to Quakertown Park near the Garden Walk and City Hall. There will be minimal impact to the Park and Park users during the next two weeks. The Rotary Fountain within Quakertown Park will not be operational during the electrical upgrades. The fountain will be cleaned and refreshed once electrical upgrades are complete. Staff contact: Drew Huffman, Parks and Recreation E. Summer Camp Update — Last year, summer camp field trip transportation was provided by Denton ISD. This year, the cost to partner with DISD for summer camp transportation has tripled from about $55,000 last summer to $150,000 this summer prompting staff to re-evaluate transportation options. Staff will utilize city vans for Discover,Voyage, Teen, and Preschool Camps. For the two larger camps, Super Kids and Camp Exploration, staff will utilize the existing contract with Cowtown Charters to provide busses. Summer camp registration kicked off on April 1. Many camps filled the first weekend of registration. • Camp Discovery—All weeks are full with a waitlist except Week 6. • Camp Exploration—All weeks are full with a waitlist except Week 6. • Camp Voyage—All weeks are full with a waitlist. • Preschool Camp—All weeks are full with a waitlist except Week 1. • Super Kids Camp—All weeks are full with a waitlist. • Teen Camp—This camp is about half full. CDBG funds awarded each year provide full scholarships to 56 qualifying campers for 10-weeks of summer camp. Registration for these reserved spots begins Monday, May 2 at 8 a.m. Scholarship terms and applications are available on the City of Denton's website and should be emailed to scholarshipskcityofdenton.com. The 3 Denton Parks Foundation also sponsors partial scholarships that can be used for most classes and camps. Staff contact: Sara Farris, Parks and Recreation F. Update on NDO Communications—On March 22, the Denton City Council approved the City's comprehensive non-discrimination ordinance that prohibits discrimination in the City of Denton based on a set of protected classes. In adopting the ordinance, the City delayed the effective date of the ordinance to July 20, 2022, to allow for, among other preparations, communication of the ordinance to the community. The City has launched a webpage with information on the NDO, including a copy of the ordinance itself, background information, past presentations, FAQs, and a form to submit questions. This webpage can be accessed at www.cityofdenton.com/ndo. The City has also developed a letter (attached) that will be delivered to local businesses explaining the ordinance and directing them to available resources. Both the Denton Chamber of Commerce and the Denton Black Chamber of Commerce were provided with an advanced copy of this letter. Denton Solid Waste Operators are the Best in the State — On April 23, the Lone Star Chapter of the Solid Waste Association of North America (TxSWANA) hosted its annual Equipment Road-E-O. This year's host was the City of Lubbock, TX. A Road- E-O is an event that fosters a spirit of competition and goodwill among and between participants while allowing cities to showcase their employee's skills and talents in operating machinery, driving trucks, and repairing all manner of equipment all while also promoting professionalism and safety among participants. The City of Denton Solid Waste and Recycling Department sent six employees to participate and test their skills among the best of the best in the State of Texas: Oliver Brazier,Omar Rodriguez, Franqui Vargas, Jose Angel, Robert Feagins, and Steven Sparks. Oliver Brazier placed first in the Automated Side Load competition and Omar Rodriguez placed second in the Off-Road Dump Truck competition. These wins qualify them to participate in the National Road-E-O being held in El Paso, October 14-15, 2022. Payment Processor Implementation Complete—On September 28,2021,City Council approved a contract to replace the City's online bill payment processor. Customer Service implemented the new solution on February 17, 2022. Implementation of new solutions always presents surprises, but Customer Service staff worked diligently to identify and mitigate unexpected challenges in addition to educating and training customers on the new system. Implementation of Invoice Cloud is now substantially complete,and customers are using the online bill pay portal. Customers are responsive to the new platform as shown by the increased enrollment of paperless billing and recurring payments below. If for any reason streaming is not available through the City's webpage,this additional streaming source will still allow the public to view DTV content, including City Council meetings. As a reminder, DTV is the City's government channel and is also available on Frontier channel 38, Charter channel 194, and Grande channel 12. Sandy Creek Resident Concern — On April 21, the City Manager received an email from a resident requesting the status pertaining to the construction schedule for Sandy Creek Drive. The Denton Street Rehabilitation project includes 47 street segments throughout the City. It is a part of the City's focus on rebuilding existing streets that have reached the end of their useful life. The Denton Street Rehabilitation Project is funded through the 2012 and 2014 Street Reconstruction Bond. Staff reached out to the resident on Friday afternoon, April 22 to address the concerns and provide an update to the resident. Staff explained that the segment of roadway was estimated to be constructed in Q4 of 2022 and that the area would be inspected to see if any temporary measures could be taken to address concerns until the project could be constructed. DTV Video Highlights for April - In addition to producing public meetings, staff continues to collaborate on videos this month that raise awareness, educate, inform, and inspire our community.We would like to highlight a few in the Friday Report and encourage Council to share them. • Preserve Denton: City Hall West (A Very Odd Building): YouTube, Facebook Join our Historic Preservation Officer, Cameron Robertson, as she tours City Hall West with restorative architect Alexis McKinney of Architexas. • Denton Fire Station 3 Sculpture: YouTube, Facebook The Denton Fire Department commissioned 23 Design Co. to create a sculpture honoring the history of Fire Station No. 3. • Water Utilities Update - Solids Handling Phase 1A: YouTube, Facebook David Brown,Water Utilities Construction Project Manager,briefs Dentonites on the Pecan Creek Reclamation Plant: Solids Handling Project Phase IA. Update on Hinkle Roundabout—Traffic Operations staff completed the sidewalk and Americans with Disabilities Act(ADA)accessibility accommodations on the east side of the Hinkle Drive and Mimosa roundabout (see photos below). The bicycle/pedestrian paths are now connected to existing ramps and additional striping has been added. Traffic Operations will be working with a striping contractor to refresh all markings on Hinkle from University to Windsor and will install flexible bollards on the North/South bicycle paths. Motorcycle Parking on the Downtown Square—On April 16,Mayor Hudspeth sent to staff a resident question regarding whether existing spaces could be converted to smaller motorcycle parking spaces to accommodate motorcycles that would otherwise occupy a full-sized car space. This request was reviewed by several departments including Public Works and Capital Projects/Engineering.Currently,the City does not have standards for motorcycle parking;however, Capital Projects/Engineering will be evaluating its criteria manuals for motorcycle parking in the future. Request for Memorial alongCooper Creek Trail — On April 26, Council Member Armintor sent staff an inquiry from a resident as to whether they could have a memorial installed near a bench located along Cooper Creek Trail in Cooper Creek Park.Memorials can be placed on City parkland,typically as part of a memorial bench, tree and/or brick that can be purchased. Staff has reached out to the resident and has provided the information for making this request. Staff contact: Gary Packan, Parks and Recreation C. Food Sales from Vehicle at Fred Moore Park — On April 26, Mayor Hudspeth communicated to staff reports of a person was selling food out of a vehicle at Fred Moore Park. Health inspectors visited the area and contacted a single individual who was on site but did not witness any sales of food. Staff will continue to monitor the park and speak to anyone distributing food. Staff contact: Ryan Adams, City Manager's Office D. Webpage for City Proclamations — On April 23, Council Member Beck inquired if there was a webpage that listed, promoted, announced, or celebrated our Citywide proclamations. He also inquired if the photos taken of some proclamation recipients are stored. There is not currently a webpage for proclamations,but creating one is part of staffs work plan for the early summer. The webpage would provide more information about the process to request proclamations and a request submittal form. Additionally, photos taken of proclamation recipients are provided directly to the recipients and to the Mayor. Staff contact: Ryan Adams, City Manager's Office E. North Texas Fair and Rodeo Permit Application and Noise Exception—On April 27, Mayor Hudspeth reached out to staff on behalf of Glenn Carlton with the North Texas Fair and Rodeo to inquire about his concern with the timeline for approval of a Noise Exception and Special Event Permit Master Application,which includes the"In-Kind" request. The permit application was received by staff on April 18, and it will take approximately 30-45 days for staff to review the application and obtain the required documents for Council consideration in June, which will provide an approval two months ahead of the scheduled event. Staff does not anticipate any issues regarding the approval of the"In-Kind"or noise exception requests. Staff contact: Gary Packan, Parks and Recreation F. Donations to Offset Lawsuit Expenditures—On April 26, Mayor Hudspeth requested staff report if any donations have been received by the City for the purpose of offsetting expenditures from the mask-related lawsuit against the Office of the Attorney General of Texas. To date,no donations for this purpose have been received by the City. Staff contact: Ryan Adams, City Manager's Office G. Public Parking for the Denton Community Market — On April 22, Council Member Beck inquired with staff regarding a social media post by the Denton Community Market. In the post,the Market notified its followers that the parking lots on Sycamore St.,known as the DATCU lots,were no longer City of Denton public parking. Market vendors and customers have been using the open parking lots for several years on Saturdays during the Market season. Development Services previously leased the property referenced (the former DATCU building). While leasing the building and parking lots,the City made the parking lots available for public use after-hours and on weekends. Once the City vacated the buildings to move to the new Development Services Center, the City terminated its lease and the parking lots returned to the property owner,who now has new tenants. When the Market began its 2022 season,the public parking and Development Service signs were still in place at the former DATCU lots, which led vendors and customers to continue using the lots without knowing the lots were no longer public. The new building tenants require the use of the lots for their customers and have expressed that Saturday is their busiest day. This high traffic day has brought forward the issue of multiple users of the parking lot and the need to provide clear guides on its use. City staff met with one of the new partner-owners of the property and discussed a potential solution to the Market's parking issue. An option to use part of the lots while retaining private spaces for the building's new tenants was shared with the Market's Board. Once the Board has an opportunity to review and respond, City staff will be available to assist both parties in the next steps, if needed. City staff continues to work with the Market to identify additional parking opportunities at adjacent banks and vacant businesses that do not use their parking lots on Saturdays. Scott Brown Commercial has offered the Wells Fargo paid parking as free parking for Market patrons, though the details of this option are still in the works. Additionally, Denton 8 Main Street Association's website offers parking information and they are updating their online information to mirror the changes of the former DATCU lots. Spraygound Budget — On April 26, Mayor Hudspeth requested the budget and costs related to the construction of the sprayground located in Carl Gene Young Sr. Park. The original intent of this project was to fund the construction of a small/medium splash park. The park would contain spray jets and water features such as water cannons and dumping buckets. The original cost for this project was $200,000 but was revised to $395,515. The funding gap was bridged with Park Development funds in the amount of$195,515. The project has been completed and was dedicated on May 12, 2018. The final cost of the project was $381,488. Mayor Hudspeth also asked if there was a link on the City's website with the 2014 committee members. The webpage dedicated to the 2014 program includes the propositions, voters' guide, and ordinance,however,the specific committee member information is not currently listed Staff Contact: David Gaines, City Manager's Office I. 2022 HOT Fund Recipients—On April 26, Council Member Armintor requested a list of the 2022 HOT Fund recipients, including the amounts requested and received. Additionally, it was asked that the information be linked annually to the HOT Funds Committee website. Pecan Creek Drainage Project Phases 1 - 4 — On April 22, Mayor Pro-Tem Meltzer reached out to staff regarding the latest update on the Pecan Creek Drainage Project. Pecan Creek Drainage Project Phases 1 & 2 (Wainwright to Prairie & Elm) began construction in July 2019 and was substantially completed in December 2021. City staff is currently working through project closeout and a Letter of Map Revision to FEMA along with TxDOT coordination on the pavement repair in the area of this project. A table has been provided below showing the final construction costs per division. Pecan Creek Drainage Project Phases 3 & 4 (Prairie Street & Elm Street to Mulberry Street&Bernard Street)is currently at 90%design and on hold for the right of way and construction funding. A table has been provided below showing the funding needed and available to complete the project. Staff will be presenting funding options for Pecan Creek Drainage Project Phases 3 & 4 during the CIP budget discussion process. Once construction is complete, the second Letter of Map Revision will be submitted for Phases 3 & 4. Staff anticipates the project schedule to take 4-5 years from funding identification to project completion. Ryan Road Construction Timeline — On April 22, Mayor Pro-Tem Meltzer reached out to staff regarding the timeline for construction on Ryan Road and where information could be found on the website. The project can be found on Discuss Denton, and the page is located here: https://www.discussdenton.comLryan-road- construction-project The Ryan Road Reconstruction Project Page that has the latest 10 information regarding the project's schedule, scope and contact information. The design of the Ryan Road project is at the 30% milestone and is now placed on temporarily on hold until 2023. The decision was made to place this project for two primary reasons: (1) Hickory Creek Road Phase 3 project was moving forward and Staff did not want to have two main East — West Corridors both under construction simultaneously. (2)Additional funding will be allocated to this project as a part of the CIP process in order to complete the entire scope. Once the Hickory Creek Road Phase 3 project begins construction the schedule will indicate a timeline for the Ryan Road Widening Project design to be completed. Staff intends to have the project completely designed and ready for construction as the Hickory Creek Road Phase 3 Project nears completion. The project design is tentatively scheduled to be completed in 2024, and construction is tentatively scheduled to be completed in 2025. This plan was first outlined and communicated in the May 18, 2021, Friday Report. Staff contact: Kyle Pedigo, Capital Projects L. Windsor Sewer Capacity Project—On April 22, Council Member Beck inquired about the Windsor Capacity Upgrade Project. This project is an upsize in the wastewater line along Windsor Drive between Bonnie Brae Street and Fireside Lane to accommodate the current and future wastewater capacity needs. The development of the new Denton High School, The Mark Apartments, and Lennar at Kings Ridge subdivision, along with future plans for development in the area, required an upgrade to the City's collection system. The project alignment is not in Windsor Drive itself but will be in the Right of Way (ROW) on each side of the street, except for two crossings, one at Parkside Drive and one up near Bonnie Brae Street. These two crossings will be repaired with the correct subgrade and permanent roadway asphalt. When the project was in design, there were many items on the south side of Windsor Drive (between Parkside Drive and the west end of the North Lakes Driving Range) requiring the alignments to be on the north side of the road for a period of time, see map below. There was a Virtual Community Meeting for this project on March 17, 2022. This meeting gave an overview of the project, an update on the project's scope, timeline, expected impacts during construction, and addressed concerns from community members who attended the meeting. Archer Trail Resident Concern—On April 22,Mayor Hudspeth requested information on behalf of a resident pertaining to a construction related concern. The resident was concerned about their decorative stones that were relocated during the Denton Street Rehabilitation Project. Archer Trail from Foxcroft to Emerson Lane is being reconstructed as part of the Denton Street Rehabilitation Project. The Denton Street Rehabilitation project includes 47 street segments throughout the City and is a part of the City's focus on rebuilding existing streets that have reached the end of their useful life. The Denton Street Rehabilitation Project is funded through the 2012 and 2014 Street Reconstruction Bond. Staff reached out to the resident on Friday afternoon to address their concerns and provide an update to the resident on the status of the stones being placed back for final restoration. Staff has addressed the issue with the contractor and added this item to the punch list. Staff contact: Dusty Draper, Capital Projects/Engineering N. Preserves of Pecan Creek—On April 26,Mayor Hudspeth inquired about landscaping replacement that was removed during a wastewater manhole construction.Wastewater staff have been in contact with the HOA for the Preserves of Pecan Creek and currently the Risk Management department is coordinating with the HOA on the replacement of the landscape and working to find a resolution. Rumble Strips—On April 26,Mayor Hudspeth inquired about the cost and criteria for installing "rumble strips" similar to one on Greenwood Street as a traffic calming measure. Staff is unaware of any rumble strips currently in that location but are aware of speed cushions on that street. Speed cushions have been installed in multiple locations around the City of Denton, such as parking lots and on a small number of streets, by developers. Installation costs are approximately $3500 - $5,000 per speed cushion. The speed cushions have not been in service long enough to determine their long-term maintenance costs and the day-to-day impact on our Traffic Operations team. As with speed bumps, speed humps, speed cushions, and other traffic calming devices, they can affect response time and increase the maintenance needs of fire vehicles. Staff is currently evaluating our existing ordinances on this topic and working to create criteria for the design and installation of speed humps, speed cushions, speed bumps, and other traffic calming measures. These may be studies, periodicals,reports,or web resources.My intent is to make the Council aware of broad perspectives and discussions and not to suggest any particular policy or service change. A. The linked article, entitled Waterloo Greenway gets $9M federal grant for second phase of parks system is a short read published by the Austin Monitor that gives background on an innovative project to fund and create a greenway connecting the University of Texas campus with Lady Bird Lake in Austin, TX. I was fortunate to be 12 involved in the launching of this project that,with the help of the Waterloo Greenway Conservatory, created an array of natural and cultural spaces in what once was a downtown floodplain. I hope you find it an enjoyable and stimulating read. Thank you. V. Upcoming Community Events and Meetings A. The Denton Chamber of Commerce Ribbon Cutting Ceremony—The Denton Chamber of Commerce will be holding a Ribbon Cutting Ceremony at 9 a.m. on May 2, 2022, outside the Development Services building at 401 N. Elm St. There will be a proclamation from the Mayor and ribbon cuttings for local small businesses without storefronts. The Fire Department's pipe and drums team will be opening the ceremony and light refreshments will be served. Staff contact: Scott McDonald, Development Services B. Asian/Pacific American Heritage Month Celebration — The Parks and Recreation Department will host an Asian/Pacific Heritage Month Celebration on April 30 starting at 10 a.m. at the MLK Jr. Recreation Center. This year's theme highlights "Advancing Leaders Through Collaboration" and will feature a panel led by Dr. Ling Hwey Jeng, Professor and Director of Texas Woman's University School of Library and Information Studies. Mother's Day Brunch— On Monday, May 9, the Denton Senior Center will host the annual Mother's Day Brunch from 9 a.m. to 10:30 a.m. There will be waffles and plenty of fixins for participants to enjoy as we honor and celebrate all the mother figures in our lives. South Lakes Multi-Purpose Courts Grand Opening — On May 14, from 11 a.m. to 1 p.m., the Parks and Recreation Athletics Department will host a grand opening community event at South Lakes Park to celebrate the opening of two new, lighted multi-purpose courts. These new courts will accommodate both tennis and pickleball players. The grand opening event is open to residents of all ages and all skill levels! McKinney St., Denton, TX 76201 April 29, 2022 RE: City of Denton Non-Discrimination Ordinance Dear Business Owner or Manager: We are reaching out to inform you that on March 22, 2022, the Denton City Council adopted a Non-Discrimination Ordinance (NDO) for the City of Denton to enhance the public welfare and quality of life for residents, visitors, and businesses. The ordinance will become effective on July 20, 2022, and, as a member of our business community, it is important for you to be familiar with its provisions. The following provides a brief overview of the NDO. A full copy of the ordinance and additional details can be found at www.citvofdenton.com/ndo. What does the NDO prohibit? The NDO prohibits discrimination in the City of Denton in the areas of employment,housing, and public accommodations based upon race,color,national origin,age,religion,disability,sex,sexual orientation, and gender identity. The NDO also prohibits discrimination in housing based on a veteran's source of income. Are there any exclusions? The ordinance does not apply to religious organizations, the United States government (or any of its departments or agencies), or the State of Texas (or any of its departments, agencies, or political subdivisions). There are some additional exclusions that generally mirror the exclusions found in federal and state non-discrimination laws. Are schools included in the NDO? The ordinance does not apply to public schools and religious-affiliated private schools (see above relating to exclusions). Private schools that are not affiliated with a religious organization are included in the employment and housing provisions of the NDO but are exempted from the public accommodation provisions. Does the NDO apply to restrooms or other similar facilities? Yes. Under the NDO, an individual cannot be denied access to restrooms or other similar facilities in an establishment that serves the public on the basis of one of the defined protected classes, including on the basis of a person's gender identity. McKinney St., Denton, TX 76201 How would a discrimination complaint be handled? Under the ordinance, an individual who claims to have been discriminated against in violation of the ordinance may file a complaint, made under oath or affirmation, on a form prescribed by the City within ninety(90) calendar days after an alleged unlawful practice has occurred. If the complaint is within the jurisdiction of a federal or state agency, it will simply be referred to the appropriate federal or state agency. For example, the City will refer employment complaints to the Equal Employment Opportunity Commission(EEOC)or the Texas Workforce Commission (TWC), and refer housing complaints to the US Department of Housing & Urban Development (HUD). For those complaints that are protected under the ordinance and cannot be referred to another jurisdiction,the City has established a process to investigate the complaint, including notifying the respondent(accused), advising them on their procedural rights and obligations, and allowing them to file a response to the complaint. The City plans to use a contracted third parry to conduct the investigation, which may include reviewing statements, conducting interviews, or contacting any witnesses. If during or after the investigation, it is determined that there is reasonable cause to believe discrimination occurred,the City will attempt to resolve the complaint between the parties through a third-party conciliation process. What if the complaint cannot be resolved between the parties? Is there a penalty? If there is reasonable cause to believe discrimination occurred and the complaint cannot be resolved, it may be referred to the City Prosecutor for review. The case may be heard in Municipal Court as a Class C misdemeanor, which carries a maximum $500 fine per violation (per City ordinance). What if there is no reasonable cause found that discrimination occurred? If investigated, and there is not reasonable cause that the reported discrimination occurred, the complaint will be closed.
