Recall Petition Received by the City — On May 12, staff received a petition for the recall of the Place 4 Council Member, Alison Maguire. For a recall petition to be certified it must, by charter, be signed by at least twenty-five percent (25%) of the number of votes cast for that district at the last preceding regular municipal election. For a petition received on May 12, 2022, it must have 673 qualified voters sign the petition for it to be certified as sufficient. From the day of the filing of the petition with the City, the City Secretary will have seven(7)days to examine the petition to ensure it has the required number of qualified voters and meets all other requirements to be certified. Staff is currently coordinating with the Denton County Elections Department to assist in the verification process using registered voter records. If the petition is certified, the City Secretary will present it to the City Council at the June 7 Regular Meeting and immediately notify the council member whose removal is sought of such action. If the Council member does not resign within seven(7) days after such notice, the Council shall order an election for the recall of the Council member. Mayor Pro Tem Election Process at the May 17 Special Called Meeting—Following each election, the Denton City Charter requires an election of the Mayor Pro Tem. The election of the 2022-2023 Mayor Pro Tem is scheduled as part of the May 17 Special Called Meeting. As part of that agenda packet, the process is included with the agenda item. To better inform all involved, the process is also attached to this report. Staff contact: Rosa Rios, City Secretary's Office C. Pump Failure at Existing Hickory Creek Lift Station — On Saturday, May 7th, at approximately 10:30 p.m., the primary pump at the Hickory Creek Lift Station (HCLS) suffered a catastrophic failure and is currently operating on a backup pump. The backup pump is currently working,but not reliable as a long-term solution. Staff is preparing for bypass pumping operations and coordinating with the contractor to install the bypass connection that was part of the original design. Staff pulled the primary pump and transported it to Xylem,one of the City's contracted vendors for equipment repair, to determine the cause of the failure. The inspection revealed that the lower seal had failed, allowing wastewater to flood the pump stator and motor windings. In addition, the shaft also dropped damaging the impeller. Initial time estimates for the pump to be repaired and returned to service is 15-20 weeks. Staff attempted to find a replacement pump; however, there are none available in the United States. The new HCLS is in the final stages of construction but has not reached substantial completion to be accepted for use by the City. Staff are monitoring the HCLS, as options are reviewed, and construction of the new station nears completion. Staff contact: Stephen Gay, Water Utilities D. Main Street Association Historic Properties Tour — On Saturday, May 21, 2022, the Denton Main Street Association, in cooperation with several local entities including 2 the City of Denton, will host a Historic Properties Tour as part of an event titled Imagine the Possibilities. The event, lasting from 9 a.m. to noon,will showcase some of downtown Denton's available properties, upcoming rehab and renovation projects, placemaking ideas on public spaces, and completed renovation properties. This tour is for investors, entrepreneurs, business owners looking to relocate, or the public interested in upcoming rehabilitations,recent building renovations, and available real estate downtown. Staff contact: Christina Davis, Economic Development E. 2022 Realtor Day at Cites—On May 18,the Greater Denton/Wise County Realtors Association will be holding its annual Realtor Day event at City Hall. This is an insightful event that allows members of the Realtors Association to learn about city projects and initiatives. City staff will present information on their respective departments and will be available to answer any. Staff contact: Monica Benavides, City Manager's Office F. TPWD Accepts Parks Master Plan—On May 9, the Parks and Recreation Department received a communication from the Texas Parks & Wildlife Department (TPWD) indicating its official acceptance of the 2022 Parks, Recreation, and Trails System Master Plan. The plan, as adopted, meets all requirements set by TPWD for future grant applications and planning efforts. The plan is valid until March 1, 2027, when a five-year update is required for grant eligibility. A full re-write is required by March 1, 2032. Staff contact: Gary Packan, Parks and Recreation G. Tree City USA Re-Certification—The City of Denton has been re-certified as a Tree City USA by the National Arbor Day Foundation and received a Growth Award for 2021. This marks Denton's 3 1" year to be named a Tree City USA and 12th year to receive the Growth Award. Since it has received more than 10 Growth Awards, Denton has also earned recognition as a Sterling Tree City USA. Sterling communities are viewed as leaders in community forestry and are looked upon as innovators. Tree City USA recognizes communities that meet four core standards of sound urban forestry: maintaining a tree board or department, having a community tree ordinance, spending at least $2 per capita on urban forestry, and celebrating Arbor Day. It also gives communities an avenue to celebrate their work, showing residents, visitors, and the entire country that they are committed to the mission of environmental change. Keep Denton Beautiful Receives State Recognition as Gold Star Affiliate — Keep Texas Beautiful (KTB), a statewide grassroots environmental and community improvement non-profit organization, recently named Keep Denton Beautiful (KDB) a Gold Star Affiliate, a designation granted to only 86 affiliates out of KTB's nearly 300 total affiliates. Gold Star recognition is the highest recognition status any community affiliate can achieve. In 2004, KTB introduced the concept of Gold Star recognition to reward those communities who sought to go above and beyond its established requirements. To achieve Gold Star status, affiliates must share information on their mission and goals, answer questions about their economic development and diversity and inclusion 3 practices, participate in the Beautify Texas Awards or Governor's Community Achievement Awards programs,and provide a letter of support from their community. KTB will formally recognize Gold Star communities during its 55th Annual Conference in June. Keep Denton Beautiful is managed and operated by the Denton Parks and Recreation Department and successfully implements programs to clean up litter, plant and distribute trees, educate residents, and beautify and enhance the community. Urban Forester in City Trees Magazine Feature — Haywood Morgan, the City Urban Forester, collaborated on an article for City Trees Magazine that discussed the merits of the Monterrey Oak tree. Haywood is quoted in the article speaking to the tree's hardiness, especially during cold snaps and dry weather. In his position, Haywood is responsible for maintaining and enhancing the City's urban forest. The urban forest— those trees that grow within built-up areas throughout the City — bestows many benefits to Denton residents including providing natural beauty and shade, reducing energy costs, and improving soil, air and water quality. City Trees Magazine is the official journal of the Society of Municipal Arborists. Staff contact, Gary Packan, Parks and Recreation J. Update on Council Contingency Funds Process — Staff recently initiated a review of the process for distributing City Council Contingency Funds. Under the current contingency fund process, outlined in the attached Ordinance 21-2193, the city budget includes contingency funds for the members of the Council to make contributions to organizations that serve a public purpose. The ordinance states that the funding may be provided when: • The organization is a nonprofit entity; • The organization serves a public purpose; and • The funding of the organization by the City is in the public interest. Council members are each allotted$1,700 on a fiscal year basis for this purpose.Under the ordinance, the Council delegates the authority to review the contributions and execute related agreements to the City Manager.Notably,the Council delegates to the City Manager the authority to determine if funding the organization serves a public purpose and is in the public interest. Determinations of whether an expenditure has a public purpose should be made by City Council since courts are not likely to defer to a governing body's determination if the funding is judicially reviewed. Subsequent to our review, staff will schedule a work session discussion during the summer regarding contingency funds to receive additional Council direction on not only what authority is delegated to the City Manager, but also to consider adding more precise guidelines and procedures to ensure an efficient process and further confirm the use of the funds as intended. Additionally, during our recent review of the process, staff received a Council contingency funding request that may or may not serve a public purpose. As a result, staff will be requesting the City Council directly affirm the public purpose of the requested funding and approve the associated agreement. This will be our practice for all contingency fund requests until the aforementioned work session discussion is held. Staff contact: Ryan Adams, City Manager's Office 4 K. Tabletop Exercise — On May 11, Denton's Office of Emergency Management conducted a tabletop (discussion-based) exercise to allow City and County staff to discuss and review emergency plans for a HAZMAT incident at the Ray Roberts water production plant.A total of twenty staff members from the City of Denton and Denton County reviewed emergency plans for response and notification of a HAZMAT incident, Emergency Operations Center (EOC) activation, public information, evacuation, and recovery. Having multiple city departments in one room discussing capabilities and emergency plans improves communication and emergency preparedness for the City of Denton. Staff contact: Bob Martinez, Fire III. Responses to Council Member Requests for Information A. Park vs. Pla ryg ound—On May 5, Council Member Byrd requested staff provide a definition of a park versus a playground as it relates to the discussion on park fees. A park is a property that includes various amenities such as, but not limited to, parking, restrooms, trails, sculptures,ponds, landscaping,utilities, pavilions, recreation centers, athletic fields, etc. Amenities vary by the type of park and a playground is an amenity that is within a park. A nonprofit development can receive credit for park amenities within their development per the parkland dedication and development ordinance. In addition,pending Council direction, the development could receive the development fees waived as part of a development agreement. Staff contact: Gary Packan, Parks and. Staff contact: Gary Packan, Parks and Recreation B. Wildwood Inn Update—On May 6, Mayor Pro Tem Meltzer requested a status update on the Wildwood Inn operating as an event venue. Staff previously provided background on this property in the Dec. 10, 2021, Friday Report. To date, there have been no formal applications received by Development Services, nor has staff received any additional complaints. Staff contact: Scott McDonald, Development Services C. Possible Narcotics Activity at Local Business - On May 10, Council Member Beck contacted staff regarding a report of perceived narcotic activity at a local business on a near-daily basis. The citizen reported to Council Member Beck that they communicated their concerns to police during an investigation of separate break-ins at their property; however,they have not filed a separate report. Information has been provided to the police department for follow-up. Staff contact: Frank Dixon, City Manager's Office D. Conservation Easements — On April 27, Council Member Beck asked Development Services staff to point out any restrictions in the Denton Development Code (DDC) related to conservation easements. According to staff,the City's regulations regarding conservation easements are limited and have primarily been utilized in the context of preserving Environmentally Sensitive Areas. Although this is not the only context in which they can be utilized, it is the one with which the City has the most experience to date. Related to tree preservation, there is not a specific tree count that must be contained in the easement, but there is a minimum land area requirement, and the easement must contain the minimum diameter at breast height (dbh) inches of trees 5 necessary to satisfy the minimum preservation requirements for the property being developed. The definition of a conservation easement in the DDC is intended to be consistent with Chapter 183 of the Natural Resources Code in terms of who can hold a conservation easement. Staff is not aware of any restrictions specific to the application of conservation easements within Chapter 183. Staff contact: Hayley Zagurski, Development Services E. Housing Funds Information—On May 12,Council Member Beck asked if,with regard to funding for unhoused individuals, if there is a"table of funds vs. need/demand vs. outflow as a function of municipality/location" and how the City might know when its contributions the Barrier Fund are over or underperforming for our local needs. Unfortunately, the City does not yet have this level of detail available, though we are working toward attaining it. The Homeless Management Information System(HMIS) is built on the data the Department of Housing and Urban Development requires so it does create some challenges for extrapolating local-level data.Additionally,the HMIS system does not have a concise data point for location in the Coordinated Entry workflow which is our most important data tool. We are currently working with the Texas Homeless Network to improve the HMIS system to help us better extract location data. While United Way of Denton County also works with our local organizations to improve data collection efforts, there will always be a challenge working with this specific population since it is hard to track inflow locations for people who do not have a fixed permanent address. The City utilizes the data available in the data dashboard extensively as our benchmark for understanding demand (need). We also have all the existing grant performance data to analyze. The Community Services Advisory Committee will be reviewing the City's current Homelessness Initiative funding to evaluate the funding amount ($703,850) and the activities funded that were first allocated in 2018. This may result in recommendations for City Council in the future. The Barriers Fund is within this Homelessness Initiative funding and is set at$40,000 annually. The City of Denton and the City of Lewisville are the primary funders. The fund is now county-wide, but the funds are separated by grantee to serve residents in the respective cities. The City of Denton funds have been expended as of last week and the Barriers Fund to residents in Denton is closed. Staff contact: Dani Shaw, Community Services IV. South Lakes Multi-Purpose Courts Grand Opening — The Parks and Recreation Department will celebrate the opening of new, lighted, multi-purpose courts at South Lakes Park with a grand opening ceremony on, Tuesday, May 14, from 11 a.m. to 1 p.m. The new courts are designed to be used by tennis and pickleball players. WHEREAS, the City of Denton budget includes contingency funds for the members of the City Council to make contributions to organizations that serve a public purpose; and WHEREAS, the City Council desires to delegate the authority to review such contributions and execute any related agreements to the City Manager,or their designee; and WHEREAS, the City of Denton supports non-profit organizations that strive to make the City a better place by providing services in the public interest; and WHEREAS, the City Council of the City of Denton hereby finds that the procedure and delegation of authority set forth in this Ordinance will provide the City Manager, or their designee, the ability to administer the contingency fund contributions, and that such contributions serve a municipal and public purpose and is in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The members of the City Council may elect to provide such funding to entities that meet the following parameters: (i) the organization is a non-profit entity that meets the City's requirements; and (ii) the organization serves a public purpose;and (iii) the funding of such organization by the City is in the public interest. SECTION 4. The members of the City Council may make an application to the City Manager, or their designee, for a contribution of contingency funds to an entity by providing the following information: 11 (i) the legal name of the organization; and (ii) the amount of funds to be contributed (which shall not be less than $250.00 per application); and (iii) information about the purpose and activities of the organization and its public purpose; and (iv) why funding such organization by the City would be in the public interest. The City Manager, or their designee, will review the provided information and determine if the request meets the parameters laid out in Section 3 of this Ordinance. The City Manager, or their designee, will maintain records as to the amount of funds distributed on behalf of each member of the City Council and ensure that any new request would not exceed a maximum of$1,700.00 per member of the City Council per Fiscal Year. SECTION 5. Upon determining that the proposed contribution meets the parameters laid out in Section 3 of this Ordinance, the City Manager, or their designee, is hereby authorized to execute a Council Contingency Fund Agreement (the "Agreement"), substantially similar to the form attached hereto, to carry out the duties and responsibilities of the City under the Agreement in accordance with the terms of the Agreement and this Ordinance. SECTION 6. Each member of the City Council must make any proposed contributions by September 15 of each Fiscal Year. SECTION 7. The dashboard is intended to give a snapshot of relevant DEC metrics. The dashboard highlights the following: • The Emission Chart displays the December engine runtime hours, starts, stops, monthly and annual emissions totals and limits. • DEC MWh Generation and Gross Revenue for FY 2021-22 through December 2022. o The DEC ran 21,242 MWh more in the 1st Quarter of FY 2021-22 compared to FY 2020-21. This resulted in $3 Million more in DEC Revenue. • A DEC financial summary showing I st Quarter FY 2020-21 Actuals, FY 2021-22 Budget, 1st Quarter Actuals as of December 2021 and the FY 2021-22 end of year projections. o The FY 2021-22 year-end projections are equal to the FY 2021-22 budget. • The Plant Monthly Run Hour Comparison Graph illustrates the monthly plant run times. • The Key Trends section explains variances in revenues and expenses. o Approximately $3.0 million more in revenues which was offset by $3.0 million in higher fuel costs as compared to the prior fiscal year. o The DEC Net Income was ($2.26 Million)which is expected for the 1 st Quarter of the fiscal year. o The DEC Gross Margin was $3.6 Million which is $3.2 Million higher than budgeted due to higher DEC Revenue in October through December. (The Gross Margin=DEC Revenue—Fuel cost—Variable Operating& Maintenance cost.) Gross Margin represents the component of revenue available to pay fixed cost including debt. Committee membership assignments are updated annually by the Mayor and City Council to allow for participation by new Council members and to adjust participation if required. The City Council will hold a Work Session on June 7, 2022, to discuss which Council members will be assigned to city-related or external committees and policy bodies. Prior to holding this discussion, the City is asking each council member to notify the City Secretary of their interest in serving on any of the available committees. Attached to this report is a listing of all Council committees, economic development-related committees, and external committees with the seats that will be available for appointment. Note that the highlighted names are expected vacancies effective immediately following the swearing- in of the Council Members-Elect. Please review the current assignments and notify the City Secretary by Monday,May 23, 2022, which committees are of interest to you. After the proposed appointment list is presented for discussion at the June 7 Work Session,action items providing for formal appointments is expected to occur at the June 18, 2022, City Council meeting (see attached schedule). Your prompt response in identifying preferred assignments will ensure Council Committees can begin meeting immediately following formal appointments.
