Pending Council Requests Work Session Topics — Pursuant to Ordinance No. 21- 1837,the following items will be discussed during the July 19 Council Work Session. Each week,the topics included on the next week's agenda will be in the Friday Report with more information, including the specific request language and staff information, available in the posted agenda for that meeting. OUR CORE VALUES Integrity • Fiscal Responsibility • Inclusion • Transparency • Outstanding Customer Service 1) A Council vote to amend the Mobility Plan, reflecting a direct connection between Windsor Road and Masch Branch Road, north of but separate from Hampton Road. (Davis) Staff contact: Monica Benavides, City Manager's Office B. Request for Donations — Due to excessive heat, the Community Services staff are working to help many households repair or replace their HVAC systems through the Minor Repair Program. Many households are experiencing long wait times and are in need of temporary cooling solutions. Hearts for Homes is a local non-profit which assists with no-cost home repairs for very low-income seniors in Denton County, ages 60 and older. Hearts for Homes helped some Minor Repair clients with temporary window units while they await the repair or replacement of their HVAC. Due to the extreme heat, the agency is experiencing increased calls for assistance and is running low on available window units. Since room for storage of window units is limited, Hearts for Homes is asking for monetary donations to help purchase window units for seniors. Donations can be made online. Recycling Center at the City of Denton Landfill Relocated— The recycling drop-off site in the landfill has moved and will be managed by staff at the Home Chemicals Collections (HCC) Center. The HCC is located on landfill property at the same address 1527 S Mayhill Rd, Building 300. The relocation of the recycling center will ensure recycling patrons will no longer need to wait in line at the scale house,Monday through Friday. Recycling patrons will be diverted back past the scale house and into the landfill for recycling on Saturdays and recognized City holidays. Patrons can bring their recycling to the HCC drive-thru and will be screened and directed to proper recycling receptacles. The drive-thru will be open from 7 a.m. to 4 p.m., Monday through Friday. Status of Construction on Archer Trail&Foxcroft—On July 8,staff received a request from the CMO Office regarding a resident asking about the status of construction at Archer Trail and Foxcroft. This area is being reconstructed as part of the Denton Street Rehabilitation Project. The project experienced a delay due to the current cement shortages the industry is experiencing. The current estimated completion for Foxcroft Circle from Archer Trail to Old North is August 5,pending no major weather events. The project does not include any water infrastructure included within the scope and, after staff spoke with the Water Department, it is confirmed the fire hydrant at Archer Trail and Foxcroft will remain in its current location. Staff contact: Dusty Draper, Capital Projects/Engineering E. Denton Animal Services' Shelter Update—Starting Monday, July 18, Denton Animal Services will resume accepting cats into the shelter. To promote the adoption of cats, Denton Animal Services will waive all adoption fees until Saturday, July 16. Our sincere thanks and appreciation to the Denton community for their continued support. In the Loop from Denton Municipal Electric — Flip the pages of"In the Loop", the quarterly newsletter from Denton Municipal Electric (DME). Filled with news, tips, and community visits,"In the Loop"features DME staff hard at work keeping Denton cool during hot summer months. Staff contact: Bill Shepherd, DME G. City of Denton 2023 Rental Inspection Program Expansion — The City of Denton's Interior/Rental Inspection Program handles rental property maintenance complaints and performs interior inspections of rental units by request at no cost to tenants. The program has been performed by only one Code Officer since September 2014. In order to ensure better housing quality standards throughout the City,the program will be strengthened. Effective October 1, each of the six Community Improvement Services Officers will perform rental inspections within their assigned districts. This will help balance staff workload and decrease response time. Staff contact: Norman Barbosa, Community Services III. Responses to Council Member Requests for Information A. Update on Report of a Potential Supervised Living Home on Ridgecrest Circle — In the July 1 Friday Report, staff provided limited information relating to a report of a supervised living home being discussed on Ridgecrest Circle. On Friday, July 8, staff were able to contact the property owner of 115 Ridgecrest Circle via phone. The property owner shared his intent to provide a home for, by his description, a 6- bedroom home for 6 individuals. The property owner further stated his intent is to operate under the licensure of the State of Texas and the State would refer all occupants, additionally, he indicated the state program requires for every 4 individuals, a full-time caregiver at the property. Staff are currently conferring with the State to understand the nature and status of the property owner's proposed operation and, when confirmed, will evaluate it against our zoning ordinance to determine what uses are allowable if any. In the meantime, the property is currently in an incomplete state of construction and, until the construction work can be inspected and approved by the City,the property may only be used as a single-family home. Staff will provide further updates as more information becomes available. Staff contact: Scott McDonald, Development Services B. Shiloh Lane Neighborhood Issues — On June 16, Council Member Byrd requested staff assistance in addressing Shiloh Road neighborhood concerns. Due to Non- Annexation Agreements in this area, Shiloh Road has a mix of parcels with some adjacent parcels in the Extraterritorial Jurisdiction(ETJ) and some parcels in the City of Denton.The City can only enforce the City of Denton code of ordinances on parcels paying taxes to the City. Community Improvement Services (CIS) and Building Inspections(BI)visited the neighborhood to inspect the concerns and identify parcels where the City could enforce City codes. CIS and BI are working with those property owners to address violations enforceable under the City codes. Staff also meet with a few residents on July 7 to establish a more direct line of communication with residents in the Shiloh Road neighborhood. Staff contact: Norman Barbosa, Community Services 3 C. Animal Services Website Updates—On July 8, Mayor Pro Tem Beck requested staff add links to information on steps the public should take when finding baby birds and mammals on the Animal Services website. Staff reviewed the information and are in the process of updating the website to reflect and reiterate this information. Rooftop Solar and Transmission Cost of Service—On July 10, Mayor Pro Tem Beck inquired regarding rooftop solar expenses and Transmission Cost of Service (TCOS). Staff advised that only qualified transmission infrastructure investments reported to the PUCT (Public Utility Commission of Texas) by transmission owners are eligible for cost recovery via TCOS rates approved by the PUCT. The cost of the ERCOT transmission system is paid for by the loads in ERCOT, not the Generation. With the exception of Non-Opt-In Entities (NOIEs - Coops and MOUs), generators are prohibited from owning transmission systems. Distributed Energy Resources (DERs), including rooftop solar, are connected to the distribution system and not the transmission system, the interconnection investments made by the distribution provider are not eligible for recovery via TCOS. Thus, in DME's case,these costs are born by customers and DME attempts to recover the cost via the base rate. For distribution system owners in the competitive market,the PUCT regulates the recovery and allowed rate of return on these distribution investments and allows the distribution system owner (wires company) to recover costs via the regulated distribution component of the PUCT adjudicated Transmission & Distribution Service Provider (TDSP) rate that is paid by all customers in the competitive market regardless of their energy supplier. Transportation Between Shelters and Agencies — On July 11, Mayor Pro Tem Beck requested information on transportation between Salvation Army and Monsignor King Outreach Center (MKOC). Staff advised the city does not provide transportation directly, but individual agencies provide transportation based on individual client needs and the location of their move. There is not a City policy regarding nor City resources allocated to provide transportation to the public at this time. Public transportation is provided through DCTA for individuals who do not have personal transportation and many agencies provide access to public transportation through their agency's programs and services. There is also a fixed DCTA bus route from MKOC to ODB (MK101) in the morning Monday-Friday, which was initiated in 2019 and has remained in operation since. Outside Displays at Businesses — On July 12, Mayor Hudspeth asked if staff could clarify the regulations regarding outside displays at businesses such as retail stores or service providers. The Denton property maintenance code Sec. 17-61 governs outside displays and generally states outside displays of merchandise are allowed when it is presented in an orderly manner, is part of the merchandise of an authorized retail business, and do not cause or contribute to any safety hazards or nuisances. Additionally, outside merchandise displays must be relocated indoors when the business is closed. If that does not occur,the merchandise is then considered outdoor storage and must be appropriately screened. Staff contact: Dani Shaw, Community Services 4 G. US Marshal Task Force—On July 12,Council Member McGee requested information on reimbursements of City of Denton officers on the US Marshal Task Force. Currently, five officers are on the Task Force and the City receives reimbursement for expenses incurred by staff related to task force activities. Staff contact: Shanika Mayo, Police H. Solar Rebate Calculations — On July 13, Council Member Davis requested information on solar rebate calculations following the receipt of a communication from a local business. Staff are reviewing all Green Sense programs, including solar rebates, and will bring recommendations forward via presentation to Council. Staff contact: Tony Puente, DME I. Westgate Improvement Project — On July 13, Council Member Davis requested an update on the Westgate Improvement Project. Staff advised Capital Projects is securing a contract for a design firm to begin the design of the Westgate Project. Community meetings are not yet planned;however,Capital Projects staff are working closely with the school district, other departments, and the ADA/bicycle/pedestrian coordinator to ensure the public has a safe route to access the school campus. This plan will be communicated publicly once completed. Staff contact: Trevor Crain, Capital Projects/Engineering J. ERCOT Conditions - On July 13, Mayor Pro Tern Beck requested clarification on ERCOT conditions, load shedding, and self-curtailment in light of ERCOT's public updates and dashboard projections. Staff advised there is not a "typical" load shed event expectation. However, should that occur due to heat, staff estimated individual customers would experience a few hours of rotating outages lasting no more than 30 minutes in duration. This load shed estimate, however, would depend on the underlying reason for a load shed event (loss of dispatchable generation facility, loss of renewable resources, transmission-related failure, etc.). Self-curtailment from users, such as Core and other large loads, generally shut down well in advance of a load shed event. If ERCOT were to go into mandatory load shedding, curtailment will be based on the load currently available. Staff contact: Tony Puente, DME K. Providence Village Gate Removal — On July 14, Mayor Hudspeth shared a resident request to investigate if codes were broken by removing gates at Providence Village. Staff visited and were unable to find violations of City codes but encouraged the resident to share their concerns with their landlord. Staff contact: Emily Loiselle, Development Services L. Tree Clearing on Duncan St — On July 14, Mayor Hudspeth requested information tree clearing occurring on Duncan St. Community Improvement Services (CIS) staff visited the area of concern,took photos of the tree removal, and advised removal was not a violation for CIS, unless the trees are left as trash/debris. Staff advised work appeared to being done on two lots, one of which had significant tree clearing, and the other in which trees were trimmed as they were encroaching on the former lot. Building Inspection staff were unable to locate an application for tree removal and scheduled a visit from building inspection to investigate. Permitting for Well for Hartlee Field Rd Neighborhood — On July 13, Mayor Hudspeth requested information on a well permit delay for Aqua Texas which would service the Hartlee Field Road neighborhood. Staff reviewed permits for this area and for Aqua Texas,but no Aqua Texas permits were found in the City of Denton system in areas near Hartlee Field Road. It is possible Aqua Texas may be awaiting a notice to proceed from the North Texas Groundwater Conservation District or a permit from the Texas Department of Licensing and Registration, however the City of Denton does not have any pending well applications for this area. Yard Concerns on Hercules and Huntington Dr — On July 14, Council Member McGee requested staff address a resident's concerns with grass dying at Hercules and Huntington after construction was complete. Staff investigated this issue and noted while the grass was technically out of warranty as it was planted two years ago, it will be replaced. The project manager is instructed to speak with the resident and let him know about the replacement,but as it is currently too hot to plant grass,they will also advise it will be planted once it is cooler. Staff will remain in contact with the resident until the grass is placed to ensure the best chance of its survival. Staff contact: Trevor Crain, Capital Projects/Engineering IV. Upcoming Community Events and Meetings A. Weekend Family — On July 16, Denton Public Libraries is hosting multiple family-friendly events for the youngest residents of Denton and their families to attend. At 10 p.m., children ages 1-5 and their families can join in Family StoryTime at the South Branch Library. Shortly following, at I I p.m., students in kindergarten through fifth grade and their families can join in Sign Language StoryTime at the South Branch Library. Then, at 2 p.m. at the North Branch Library, children ages 5- 10 and their families can join in Read to Rover. Staff contact: Jennifer Bekker,Library B.
