General Information & Status Update
A. Organizational Chart Update—To continue the support of growth and development within
the City of Denton, a few organizational changes will take place beginning September 3.
The attached memo was provided to staff earlier this week announcing the division of the
Airport and Facilities department into two separate departments and the hiring of a Chief
Strategic Officer. Additionally, the organization chart included with the memo reflects
these changes and the addition of Doug Shoemaker as Chief of Police, pending

During this time, residents are encouraged to take their recyclables to the drop-off center
of the City of Denton Landfill, located at 1527 S. Mayhill Rd. Landfill hours are Monday

C. NBC Clear the Shelter- On Saturday, August 27, Denton Animal Services held its annual
Clear the Shelter event.This event drew a large crowd and was very successful.All Animal
Services staff were on hand to assist adopters. In total, 45 animals were adopted; 18 cats,
25 dogs, and 2 guinea pigs. As one of the participating shelters in NBC's Clear the Shelter
Event, Denton Animal Services reports the number of animals adopted out each week to
NBC Universal. With 306 animals adopted from the Lind McNatt Animal Care and
Adoption Center/Denton Animal Shelter during the month of August, Denton is currently
ranked fourth out of 61 shelters in the DFW Metroplex. During the Clear the Shelter event,
Denton Animal Services premiered their new dog mascot, who greeted customers and
posed for pictures. Animal Services sought the input of our young customers to help name
the mascot via the use of a suggestion box. The suggestions will be narrowed down, and a

Facebook poll will be used for the community to cast their vote for the final Denton Animal

D. Community Pet Food Drive -Denton Animal Support Foundation(DASF)is conducting a
Community Pet Food Drive for the entire month of September. Pet food received from this
drive will go to organizations such as the Linda McNatt Care & Adoptions Center/City of
Denton Animal Shelter, Lake Dallas Animal Shelter, Denton County Veterans Service
Center, Our Daily Bread Denton, Denton Community Food Center, and SPAN Meals on
Wheels Denton County - Senior Paws. Pet food can be dropped off at the Linda McNatt
Care&Adoptions Center/City of Denton Animal Shelter,located at 3717 North Elm Street.

E. Installation of Street Sign Toppers—During the April 5 City Council meeting, staff briefed
the Council on plans to proceed with a Street Sign Topper pilot program for the Southeast
Denton neighborhood. Following Council approval, the Southeast Denton Street Sign
Topper Design Committee collaborated and shared final designs with the Southeast Denton
Neighborhood Association on July 25. Staff then initiated sign fabrication and began
installation on August 26. All 71 sign toppers are expected to be installed by September 1
for the following Southeast Denton neighborhoods:
• Freedmen Town— 14
• Solomon Hill— 17
• New Quaker— 10
• Fred Moore High School— 15
• Lincoln Park—7
• Willow Creek- 8
The total cost of the pilot program is $8,745. An additional $26,250 has been proposed as
part of the FY 23-24 budget for future neighborhood sign topper projects. Staff wishes to

thank the Southeast Denton Neighborhood Association and the members of the Street Sign
Topper Design Committee for their collaboration in making this program possible.

F. Emulsion Spill on Northcrest St. - On the evening of August 27, Environmental Services
was notified of a truck leaking an unknown oily fluid, later confirmed as an
emulsion. Environmental Services staff relayed the information to Fire Rescue Dispatch.
The Fire Department HAZMAT team has resources and contractors in the event of a large
release. Fire Rescue Dispatch sent out Engine 4 to the scene and reached out to Streets,
Streets confirmed it was a capital project. Dustin Draper, the City's Project Manager,
reached out to the vendor Reliable Paving, Inc. who sent personnel to the scene that
evening. Reliable inspected the valve on the truck to stop any further release and confirmed
that controls were in place. Buckets were placed under the drip area,kitty litter dams along
the curb, and sorbent boom at the curb inlet to the storm drain.
Environmental Services staff went by the site on Saturday, August 27 to assess the
situation. Staff observed buckets under the truck valve/release area, cat litter along the
curb, and a trail of emulsion that led to the curb inlet. In addition, staff went to the
downstream outfall for the storm drain into the channel and confirmed the emulsion did
not reach that far. Staff visited the site again on Sunday, August 28, to confirm the
status. On Monday, August 29, staff visited the site and found the controls (i.e., buckets,
cat litter, and sorbent boom) had been removed. Environmental Services staff then
confirmed with Reliable their methods for addressing the residual asphalt from the curb
and base of the curb inlet. Reliable plans to use mechanical means to address this cosmetic
issue and collect the waste material generated. Staff contact: Michael Gange,

G. The 2022 Fall ITE Meeting — The Texas Institute of Transportation Engineers (ITE) Fall
Meeting will be held at the Embassy Suites by Hilton Denton Convention Center from
September 7-9. Pritam Deshmukh, Professional Engineer, is one of the Co-Chairs of the
Local Arrangement Committee. On September 8, Cameron Robertson, Tina Firgens, and
Scott McDonald from Development Services will be presenting on the Impact of Land Use
Planning on Transportation. Senior Planner Nathan George will be guiding a group on a
bike tour throughout the City of Denton on September 7. Additional event information can

H. Parks and Recreation Athletics Division Update — The Fall sports season is upon us, and
the Athletics division has several recreational sports leagues for both youth and adults. The
youth soccer season started on August 27 with 150 youth registered to play soccer on
Saturdays at the G. Roland Vela Athletic Complex, located at 3801 N Elm St. The youth
volleyball league begins on September 10, and staff is excited to have 69 teams registered
with over 650 athletes competing. This is the largest group since the beginning of the
COVID-19 pandemic. Youth flag football is scheduled to begin on September 17 and
currently has 95 players ages 5-12 registered this season.
Adult volleyball and basketball leagues also began this week.Volleyball has 11 teams, and
basketball has 6 teams registered for play this Fall. Adult soccer (women over 40) will
begin on Wednesday, September 7, with four teams. Registration continues for adult

I. 2022 Community. Shy Deep Dive-The City of Denton conducted the 2022 Community
Benchmark Survey using the National Community Survey (NCS) tool to assess residents'
opinions on different aspects of the quality of life in Denton. Staff completed a review of
the full survey results, seeking topics in which to perform a "deeper dive" to see if
additional information and insights can be obtained. These topics were selected as they
may have shown an unexpected result,were lower than comparative cities,or have changed
to a greater extent than other topics. To gain a greater understanding of the community's
feelings on these topics, staff created a Discuss Denton engagement project to gather
additional community input. On a monthly basis, surveys and forums relating to these
topics will be shared on www.discussdenton.com/survey-deep-dive for public feedback.
Residents are encouraged to share their voice via the Discuss Denton page and share the
page with friends and neighbors, as feedback collected will assist staff further

Responses to Council Member Requests for Information
A. Bonnie Brae Street and Windsor Drive Intersection Inquiry — On August 16, Council
Member Davis requested information regarding a potential roundabout on Bonnie Brae
Street and Windsor Drive. The improvements at this intersection are part of the Bonnie
Brae Phase 6 Project which has a completed design and is anticipated to be advertised for
bid within the next two months. The current plan includes the creation of dedicated turn
lanes on Bonnie Brae Street and the installation of a traffic signal. The project does not
include the installation of a roundabout at the intersection of Bonnie Brae and Windsor

B. Roadway Microseal Update - On August 20, Mayor Pro Tem Beck expressed concerns
regarding the microseal roadway maintenance recently performed on Victoria Dr. Viking
Construction completed the roadways required for this year's maintenance program and
is in the process of performing quality evaluations and correcting defects on treated
roadways. Staff evaluated Victoria Drive to address concerns and ensure the contractor
will fill gaps in the microseal, as well as sweep the roadway to remove loose fragments.
The completion date for Victoria Drive is September 6, weather permitting.
In addition to the specific state of Victoria Dr., concerns were shared regarding the overall
rough surface of microsealed roadways. The rough surface texture is characteristic of a
microseal treatment upon initial application. Microsealing the surface prevents roadway
degradation and is also intended to improve surface friction and skid resistance. Over the
next few weeks, the surface of recently microsealed roadways will become smoother as
traffic is applied. Staff are evaluating alternative products for future roadway microsealing
programs providing the same level of protection for the roadway, but with smaller
aggregate to provide a smoother surface for residential roadways. Prior to implementing
an alternative method, Streets staff will coordinate with Engineering and Public Works
Inspections to ensure the appropriate traction is provided based on roadway classification

C. Tow Trucks Blocking the Road—On August 22,Mayor Hudspeth shared with staff photos
and a video of a tow truck blocking both lanes of Bell Avenue as they unloaded a vehicle

at a local maintenance shop. The concern was that the road would be impassable to
emergency vehicles, given the proximity to the Fire station. Officers from the Police
Department spoke with the towing company and discovered that vehicles are towed to that
location a few times per week. If the towed vehicle is drivable, the tow truck driver can
drop it without blocking all lanes of traffic. In the case documented, the vehicle was not
drivable and there was no other possible way to drop the vehicle. The towing business has
agreed to drop only drivable vehicles for the time being. Additionally, the business
receiving the towed vehicles has found a new location and will be fully moved by the end
of the month. Residents are encouraged to call the Police in similar instances. Staff

D. Robertson Street Visibility Concerns — On August 27, Mayor Pro-Tem Beck contacted
staff with concerns about the roadway visibility on Robertson Street. Staff reached out to
the contractor working on the Southeast Denton Package A(SED-A). SED-A is the first of
two projects underway associated with the 2019 Street Reconstruction Bond in the
Southeast Denton Neighborhood. Construction began in June 2022 and is estimated to be
completed in July 2023. In preparation for the utility work,the contractor received multiple
material deliveries in a short period of time. Staff worked with the contractor to add
additional advance warning traffic signs and cones to protect the materials and the traveling
public. Public Works Inspections will continue to monitor material deliveries to ensure the
traveling public has a safe passageway. Staff contact: Seth Garcia, Capital

E. Concerns With Lack of Lighting Near Local Business—On August 28, Council Member
McGee shared concerns about the lack of lighting near a local business on Lillian Miller
Parkway after receiving a report of a vehicle break-in. Staff determined that the lighting
surrounding the business is on private property. Additionally, Council Member McGee
indicated that the wooded area behind the business is a gathering place for kids and
individuals experiencing homelessness, citing possible safety concerns. In February 2022,
the Homeless Outreach Team(HOT)was dispatched to this location and found that while
there is a small path in the trees, there were no encampments or individuals in the area.
Staff will ask the HOT team to confirm that no encampments have been established in this

F. Fairman Adams Project—On September 1, Council Member McGee expressed interest in
partnering with the Fairman-Adams Project, a non-profit organization committed to
providing no-cost breast cancer screenings. A service agreement was established by the
City's Risk Management department and a mobile mammogram unit will be set up at the
Martin Luther King Recreation Center on October 1. Staff contact: Sarah Kuechler,

Upcoming Community Events and Meetings
A. Senior Center Volunteer Appreciation-On Thursday, September 15 at 6 p.m. senior center
staff will honor senior center volunteers from both American Legion Hall Senior Center
and Denton Senior Center for their hard work and dedication to the programs and activities
at each location. This year's event is superhero-themed, as all our volunteers are
superheroes for the community. Dinner will be catered by Cotton Patch Caf6 and each
volunteer will receive a token of appreciation. Staff will also do a special recognition for

B. Know What to Throw? —Whether you're new to the city or just need a refresher,join the
staff at the Emily Fowler Library for a workshop on how to correctly dispose of tricky
items and determine whether an item goes in the trash, recycling, yard waste, or home
chemical collection. The event will be held on Thursday, September 15, from 6 p.m. to 7

C. Hispanic Heritage Month Celebration - The Parks and Recreation Department will host a
Hispanic Heritage Month Celebration on September 17, starting at 10 a.m. at the MLK Jr.
Recreation Center. This year's theme highlights "UNIDOS: Inclusivity For A Stronger
Nation" and will feature Keynote Speaker Lilyan Prado-Carillo, who is currently a
bilingual specialist at Alexander Elementary and was awarded the Estrella de Tejas award
from the Hispanic Women's Network of Texas in San Antonio for her leadership and
contributions to the community. The event will also feature various vendors, resources,

D. Composting Workshop—Compost is the single greatest soil amendment you can add to set
your garden and landscape up for success! Learn how to make high-quality compost at
home using materials most folks throw away. We'll give you the dirt on the most effective
composting materials and methods. The event will be held on Thursday, September 22,
from 6 p.m. to 7 p.m. at the Emily Fowler Library, located at 502 Oakland St. There is no

A. Dia De Los Muertos Celebration - The Parks and Recreation Department will host a Dia

SUBJECT: Organizational Chart Update
With the return of cooler weather and children back in school, I want to share my appreciation for
each one of you who braved the heat and worked tirelessly to serve our community.
I am reaching out to the organization to advise of a few organizational changes taking place.
Beginning September 3,Facilities and Airport will be split into two separate teams to provide even
greater service to our community members and businesses in Denton. Going forward,the Airport
will continue to be led by Airport Director Scott Gray,while the Facilities Director role will be led
on an interim basis by Trevor Crain. Trevor currently serves as Deputy Director of Capital Projects.
This change will allow our Airport staff to work more closely with Economic Development as the
City focuses on implementing the Airport Master Plan. It will also allow additional focus on
improving and refining our approach to Facilities capital planning and delivery.
The Police Chief and Strategic Services Officer positions have also been updated to reflect new hires.
Aimee Kaslik will be joining the City of Denton from the City of Irving as the new Chief Strategy
Officer. Aimee will focus on developing and implementing a city-wide process for monitoring City
performance in achieving strategic objectives,partner with departments to identify and implement
performance strategies, and streamline how data is displayed and utilized for decision-making.
Additionally, Chief Shoemaker will join the City on October 3, from the City of Grand Junction
Colorado pending Council confirmation on September 20.
Last, but certainly not least,the Public Affairs Department will be renamed to Marketing and
Communications to better reflect their services and operations and to align with how similar
departments are titled in other organizations.
To assist in the balance of department reporting structures, Facilities will continue to report to
Assistant City Manager Christine Taylor, while Airport will now report to Deputy City Manager
David Gaines to further strengthen the collaboration with Economic Development. Please see the
attached updated organizational chart reflecting these changes.

TO MAYOR AND CITY COUNCIL
SUBJECT:
2021 City of Denton Economic Development property tax (ad valorem) incentive agreements
including tax abatements and rebates
EXECUTIVE SUMMARY:
In tax year 2021, the City of Denton had six active property tax incentive agreements. This
includes four Chapter 380 property tax rebate agreements and two property tax abatement
agreements. In total, the value of the rebates and abatements for tax year 2021 is $768,732. The
associated properties have a total valuation of more than $325,995,831 and generate $1,160,475
in net property tax revenue for the City.
BACKGROUND:
The City of Denton provides economic development incentives in accordance with the City's Tax
Abatement and Incentive Policy to stimulate private development and redevelopment, expand the
tax base,generate jobs,and enhance the local economy. The City currently has two active property
tax abatement agreements and five active Chapter 380 property tax rebate agreements. The
property tax rebates are paid annually based on the terms in the individual grants.
The City is authorized under various regulations and through its adopted policies to offer property
tax abatements and property tax rebates.
• Tax Abatements allow local governments to exempt all or a portion of the valuation
increase of real and personal property taxes from a new or expanded business development
for a period of up to 10 years. The statutes regulating tax abatements can be found in
Chapter 312 of the Texas Property Tax Code.
• Tax Increment Reinvestment Zones (TIRZ) allow local governments to finance
improvements and infrastructure within a defined area in order to stimulate private
development and redevelopment. A property tax valuation base is established in the first
year, and the revenue from the increased valuation from subsequent years is allocated to
development within the TIRZ. The statutes that regulate tax increment financing and the
related zones are in Chapter 311 of the Texas Property Tax Code, also known as the Tax
Increment Financing Act.
• Chapter 380 of the Texas Local Government Code states that a municipality may
establish and provide for the administration of one or more programs for making loans and
grants of public money and providing personnel and services of the municipality, to
promote state or local economic development and to stimulate business and commercial
activity in the municipality.
• Freeport Exemptions are an exemption from property tax on goods that have been held
in the state for 175 days or less for the purpose of assembly, storage, manufacturing,
processing or fabrication. The exemption applies throughout the entire taxing jurisdiction.

A triple freeport exemption means that the three taxing jurisdictions, city, county, and
school district,participate.
The City uses these tools to facilitate performance-based property tax incentives, taking the form
of either a property tax abatement (reduction in property tax payment) or a property tax rebate
(reimbursement of a portion of property taxes paid). Chapter 380 agreements may also include an
expansion or relocation cash grant, TIRZ grant, or job-based grant that incentivizes high-wage or
knowledge-based jobs.
Each year,once values are received and property tax payments are due,calculations are performed
by the Denton Central Appraisal District (DCAD) and Economic Development staff. For
abatements, DCAD determines the amount of abatement for active agreements by applying the
terms of the approved abatement. The corresponding company will then see a reduction in their
tax bill. For property tax rebate agreements, Economic Development staff review property tax

approved agreement. The corresponding company then receives a rebate directly from the City.
For all agreements, specific valuation,job, and wage threshold requirements in the agreements are
verified using a certificate of compliance, third-party verification from the DCAD, and IRS
documentation. The valuation, revenue,job, and incentive information is captured in the annual
Net Revenue Report and tracked over time to determine the net benefits to Denton.
Summary memos of the 2021 active property tax abatement agreements and property tax Chapter
380 agreements are attached. The memos include breakdowns of property valuation, including
taxable values that may be ineligible under the specific terms of the applicable agreement.Because
the terms vary by agreement, each payment/abatement is calculated and reviewed individually.

This is the fourth year of the twenty-five-year agreement for O'Reilly Hotel Partners Denton (OHPD).
Under the Chapter 380 Agreement, OHPD will pay 100%of the property taxes owed to the City and will
receive a grant equal to 100%of the building and equipment valuation of the hotel and convention center
(excluding inventory,vehicles and supplies).
OHPD will receive 100% of the ad valorem tax, hotel occupancy tax, and sales tax generated by the
project for a maximum of 25 years or until the combined principal amount of$28 million and interest
payment of$26 million, for a total aggregate amount of$54 million, is reached, whichever comes first.
The incentive is capped at$54 million.

This is the fourth year of the agreement for WinCo Foods. Under the Chapter 380 Agreement,WinCo
Foods will pay 100%of the property taxes owed to the City and County and will receive a grant equal
to 40%of the contribution of the City and County into the Tax Increment Fund(land and improvements)
from the distribution center. Both entities participate in Tax Increment Reinvestment Zone(TIRZ)at a
rate of 40%. Business personal property(equipment)is not included in the TIRZ contribution.
WinCo will receive 40% of the ad valorem tax contribution(land and improvements) into the Tax
Increment Fund from the City and County, 60% of the City's portion of the ad valorem by the

Since Peterbilt Motors met the$18.5 million threshold of the grant agreement,they should have received
the full 70% abatement amount of$122,985 Net City ad valorem taxes owed by Peterbilt (total less
abatement)is$585,286. In a meeting with DCAD about Peterbilt, staff found that DCAD has not been
granting an abatement on Business Personal Property(BPP)in 2019 through 2021. Real property has
been abated correctly over the same period. The total abatement over the period was supposed to be
$434,240. Actual abatements amounted to $72,137. The difference amounted to $362,104 over the
period. An adjustment will be made to correct the error.

Individuals may speak during a Council meeting under one of the following categories:
Open Microphone:
At regular meetings only, individuals can speak on any topic that is not on the agenda for no longer than
four (4) minutes per individual. This portion of the meeting occurs immediately after the start of the regular
meeting session. Please note, Council members cannot engage in a discussion on topics presented during
this portion and there are limited slots available for this portion of the meeting.
Comments on Agenda Items:
Public comments can be given for any item considered by the Council, EXCEPT work session reports or
closed meetings. Individuals are only able to comment one time per agenda item and cannot use more than

corporation, authorizing the City Manager to execute a contract with Waste Connections
Lone Star, Inc., providing for a guaranteed volume contract for the landfill; and providing
an effective date (File #8005 awarded to Waste Connections Lone Star, Inc. For a term
of two(2)years beginning Octoberl,2022,with no renewals or extensions)
J. ID 22-1606 Consider adoption of an ordinance of the City of Denton, Texas, approving a negotiated
settlement between the Atmos Cities Steering Committee ("ACSC") and Atmos Energy
Corp., Mid-Tex Division regarding the company's 2022 Rate Review Mechanism filing;
declaring existing rates to be unreasonable; adopting tariffs that reflect rate adjustments
consistent with the negotiated settlement; finding the rates to be set by the attached
settlement tariffs to be just and reasonable and in the public interest; approving an
attachment establishing a benchmark for pensions and retiree medical benefits; requiring
the company to reimburse ACSC's reasonable ratemaking expenses; determining that this
ordinance was passed in accordance with the requirements of the Texas Open Meetings
Act; adopting a savings clause; declaring an effective date; and requiring delivery of this
ordinance to the company and the ACSC's legal counsel.

Creek Water Reclamation Plant and those pursuant to Texas Water Code 26.0291;
including paying any amounts required by the protocols and funded in the annual budget;
declaring an effective date. Public Utilities Board recommends approval(5-0).
N. ID 22-1727 Consider adoption of an ordinance of the City of Denton, Texas authorizing the City
Manager or designee to fulfill the responsibilities of the City as a Public Water System
Operator and those pursuant to Texas Water Code 5.103 and Texas Health and Safety
Code Section 341.041 for the annual Water System Fee (Public Health Service Fee);
including paying any amounts required by the TCEQ and funded in the annual budget;

O. ID 22-1728 Consider adoption of an ordinance of the City of Denton, Texas authorizing the City
Manager or designee to fulfill the responsibilities of the City the water storage in Lake
Lewisville and Lake Ray Roberts for the annual major capital repair (MCR) and
operations and maintenance pursuant to 43 U.S.C. 390B for the annual operation,
maintenance, and replacement cost fee (ACOE Fee); including paying any amounts
required by the United States Army Corps of Engineers (ACOE) and funded in the annual
budget; declaring an effective date. Public Utilities Board recommends approval(5-0).
P. ID 22-1809 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a contract with DKJ Concrete
Construction, Inc., as the primary contractor, and JKK Concrete Construction, LLC, as
the secondary contractor, for the utility cut restoration for the Water Utilities Department;
providing for the expenditure of funds therefor; and providing an effective date (RFP
8046- awarded to DKJ Concrete Construction, Inc., the primary contractor, and JKK
Concrete Construction, LLC, the secondary contractor, for one (1) year, with the option
for four (4) additional one (1) year extensions, in the total five (5) year, not-to-exceed
amount of$5,250,000.00). The Public Utilities Board recommends approval(-).
Q. ID 22-1740 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a Professional Services Agreement
with Black & Veatch Corporation, for engineering services related to the LLWTP Sludge
Improvements project for the Water Production Department as set forth in the contract;
providing for the expenditure of funds therefor; and providing an effective date (RFQ
7574-020 - Professional Services Agreement for engineering services awarded to Black
& Veatch Corporation, in the not-to-exceed amount of $282,955.00). The Public Utilities

R. ID 22-174 Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a contract with Johnston Technical
Services, Inc., through the Department of Information Resources (DIR) Cooperative
Purchasing Network Contract No. DIR-CPO-4792, for the purchase of Microwave
Network Equipment and Service for the Water Production Department; providing for the
