Letter in Support of the HELPER Act—On Dec. 14, staff issued letters on behalf of Mayor Hudspeth to our congressional delegation in support of the Homes for Every Local Protector, Educator, and Responder (HELPER) Act. The Act This bipartisan bill would establish a Federal Housing Administration(FHA)mortgage assistance program to provide insurance for one-time, low-cost mortgages to law enforcement officers, firefighters, elementary and secondary school teachers, firefighters, and other first responders for the purchase, construction, or repair of the recipient's primary residence. Programs such as the HELPER Act are increasingly important as Denton continues to grow and housing costs increase. A copy of the letter is attached. South Lakes Park Cattail Removal — In partnership with Texas Parks and Wildlife, the Parks and Recreation Department is strategically removing cattails from the pond at South Lakes Park. This process will improve the health of the pond and its wildlife ecosystem as well as improve fishing access for park users who participate in the Neighborhood Fishing Program. This work is expected to take place over the next few months. Staff contact: Russell Koch, Parks and Recreation D. Solar Rebate Funds — As of Dec. 16th, 2022, Denton Municipal Electric's (DME) solar rebate funds for the current fiscal year have been exhausted. Solar rebates are on a first come, first serve basis and cannot be reserved. A total of 96 solar customers, including one commercial customer, will be receiving a rebate from the City. Projects submitted after Dec. 16 will not be eligible for a rebate. DME staff will notify customers via the City's website and as further installations are processed for the remainder of the fiscal year. Proposed/In-Progress Developments in Nette Shultz Attendance Zone—On Dec. 6,Mayor Pro Tem Beck asked staff to provide a list of all proposed or in-progress developments in the Schultz attendance zone, as well as the dwelling unit counts and formula attendance estimates. The information below (and the attached maps) pertains to proposed or in- progress developments in the Nette Shultz attendance boundaries. • 2211 E University: likely approximately 290 multifamily dwellings, currently under review • 1601 S Loop 288: 248 multifamily dwellings under construction • A feasibility application was submitted for a mixed-density project at the east terminus of East Windsor, but thus far, staff has no information as to whether the development of this site will move forward. 2 The development projects map can be viewed on the City's website. Roadwaypact Fees Collected History—On December 6, 2022, Council Member Watts requested information regarding historical roadway impact fee revenue and the associated service units. Sherman Drive and Kings Row Intersection—On Dec.8, Mayor Pro-Tem Beck requested an update on the planned traffic signal on Sherman Drive at Kings Row. Staff submitted the intersection of FM 428 (East Sherman Drive) at Kings Row as a Highway Safety Improvement Program(HSIP)project to the Texas Department of Transportation(TxDOT) as part of the 2021 call for projects. This location was selected and awarded to the City of Denton as an approved project in June 2022. Considering this intersection is located on a TxDOT roadway,the City of Denton is only required to pay for the design costs,which the Council approved at the Oct. 18,2022,City Council meeting.Design is currently underway for this intersection with construction expected in 2025. North Elm Street and West Congress Intersection— On Dec. 9, Mayor Hudspeth received an email from a local business employee regarding several accidents that have happened at the intersection of North Elm Street and West Congress. The Mayor asked staff to investigate the intersection from a safety standpoint. Staff retrieved traffic crash data from the Texas Department of Transportation (TxDOT) Crash Records Information System (CRIS) for the period of 12/1/2019 to 12/13/2022 and confirmed the data with the City of Denton Police Department. Based on the crash data, there were no reported accidents in 2019 and 2020, two reported accidents in 2021, and two reported accidents in 2022. Three of the accidents were classified as "Not Injured" and only one accident was classified as "Suspected Minor Injury". Staff is evaluating the installation of additional signage at the intersection to warn drivers that cross-traffic does not stop. Based on the review of the crash data, no additional action is recommended at this time, however, staff will continue to monitor this location. Connection between Newton Rayzor and US 380 (University Drive) - On Dec. 9, Mayor Hudspeth requested what would be necessary to provide a connection between Newton Rayzor Elementary School property and US 380(University Drive). There is currently new development located on the south side of US 380,just to the east of the Newton Rayzor Elementary school site, which includes the construction of a Starbucks, Brakes Plus, and an AutoZone. The current Newton Rayzor Elementary School is scheduled to be relocated to the old Denton High School site along with Calhoun Middle School in the future.Denton Independent School District previously advised city staff the existing location of Newton Rayzor Elementary will possibly be repurposed but future use is unknown. Additionally, the vacant land located behind the new developments has been identified as a location for possible flood mitigation for the City by creating a regional detention pond to control stormwater flow. Given that a connection from US 380 to that property is not in the 2022 Mobility Plan, extensive research would be required, including an evaluation of the floodplain, prior to any design of a roadway connection at that location. Additionally, substantial coordination with TXDOT would also be required. Staff contact: Brett Bourgeois, Capital Projects/Engineering F. ADA Transition Plan Appendices — On Dec. 11, Council Member Byrd relayed an email from a University of North Texas student indicating that the ADA transition plan appendices were missing from the document on the website. Due to the size of the appendices, they were not initially included in the materials that were made available online. Staff uploaded the appendices to the ADA Transition Plan webpage and notified both the student and Council Member Byrd. Staff contact: Monica Benavides, City Manager's Office G. Service Animal InquirX — On Dec. 13, Mayor Pro Tem Beck asked what the standard practice for public safety staff is when dealing with service animals. Standard practice is that service animals ride with the patient if they are being transported by ambulance.Non- service animals stay on the scene until Animal Services arrives, and engine crews do remain with the service animal until a handoff happens unless police officers offer to stay. Wreaths Across America—Denton Parks and Recreation will host its first National Wreaths Across America Day event on Saturday, Dec. 17 at Oakwood Cemetery (747 East Prairie Street) beginning at 11 a.m. Wreaths at each of the 253 veteran gravesites at Oakwood Cemetery were sponsored by donation. The event features a wreath-laying ceremony, an address by Rev. Reginald Logan, and a performance by the Denton Fire Department's Pipes and Drums,with light refreshments following. The mortgages would not require a down payment or monthly mortgage insurance premiums. Applicants would have to have at least four consecutive years of service and would certify in good faith that they intend to continue in their occupation for at least one more year. If enacted,this legislation would help the first responders afford to live in the community they serve. Programs such as the HELPER Act are even more important as Denton continues to grow and housing costs increase. I recognize that with the end of the 117'Congress just a few weeks away, it may be difficult for Congress to act on this legislation this year. Cordially, G Gerard Hudspeth Mayor 6 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Pedestrian and pedalcyclist crash statistics and review BACKGROUND: On November 25, 2022, Mayor Pro Tern Beck requested staff to review and provide pedestrian related crash statistics throughout the City of Denton. This request was subsequent to a recent hit- and-run pedestrian fatality collision along US 380,located in the vicinity of Bell Avenue and Texas Woman's University on November 24, 2022. This request is related to several other City-led initiatives to improve vehicle-related safety throughout the City of Denton, including • the adoption of the 2022 Mobility Plan which highlights Multimodal means of transportation, • the Vision Zero initiative with the goal of achieving zero vehicle-related fatalities, and • the 2022 Citywide Speed Study which studied and recommended adjustments to speeds on city streets. DISCUSSION: In March of 2022, City Council adopted the 2022 Mobility Plan for the City of Denton,prioritizing safety for all road users. Shortly after the adoption of the 2022 Mobility Plan, staff-initiated Phase 1 of the Vision Zero initiative,which is an approach to traffic safety that seeks to"eliminate traffic fatalities and severe injuries among all road users, and to ensure safe, healthy, equitable mobility for all." At the same time, staff initiated the 2022 Citywide Speed Study with the goal to collect speed-related data on the major streets throughout the city, and compile crash data to help adjust speed limits to reduce crashes and improve mobility. Staff pulled crash data from the Texas Department of Transportation Crash Records Information System (C.R.I.S.), which compiles all crash-related data across the State of Texas into an online database. The tables below show the number of pedestrian and pedalcyclist crash statistics citywide, as well as the statistics specifically located along US 380. Table 1. Of the 339 total reported Pedestrian/Pedalcyclist crashes,22 involved a fatality, and 65 involved a suspected serious injury. For crashes specifically associated with US 380, the total number of Pedestrian/Pedalcyclist- related crashes from the years of 2019 through 2022 was 34 reported instances. Of the 34 total reported Pedestrian/Pedalcyclist crashes along US 380, 4 involved a fatality, and 10 involved a suspected serious injury. For context, Table 3 below shows the total number of vehicle crashes citywide and specifically along US 380 for the same period of Jan. 2019 through Nov. 2022. The values reported in Table 3 represent the number of instances, not the number of persons involved in each instance. Table 3.Vehicle Crashes Jan. 2019 through Nov.2022 Crash Severity Citywide US 380 Fatal Injury 55 6 All Crashes 13,456 2,737 s As mentioned above, the City has initiated Phase 1 of the Vision Zero initiative in the Spring of 2022, with an anticipated completion date of January 2023. The outcome of Phase 1 is an initial assessment of current actions, including recommendations for immediate, short-term, and long- term actions focused on moving the City closer to zero fatalities. Examples of the potential actions include, but are not limited to, improving coordination on TxDOT-owned facilities, increasing safety audits via a third party (i.e., NCTCOG, TxDOT), prioritization of safety projects near incident hot spots, and the creation of a traffic calming toolkit. The next step after the completion of Phase 1 will be the issuance of a Request for Qualifications to create a Vision Zero Action Plan that is intended to expand upon the City's existing efforts and outline the implementation of the Vision Zero framework developed in Phase 1 in a manner that works for the City. As part of the 2019 Street Bond program,the City has funding allocations to improve street lighting along the US 380 corridor, with design funding allocated in the fiscal years 2023/2024 and construction funding in the fiscal years 2024/2025, with construction estimated to be complete by early 2026. Additionally, the City participates in the Highway Safety Improvement Program, which is a federal-aid program, administered by TxDOT, with the purpose to achieve a significant reduction in traffic fatalities and serious injuries on all public roads. Each year TxDOT issues a call for projects to be submitted for re-design and construction to improve intersection safety for both vehicles and pedestrian/pedalcyclists. For the 2018 call for projects, the City was awarded three intersections for design and construction. For the 2020 call for projects,the City was awarded two projects scheduled for construction in FY 2023. For the 2021 call for projects, the City was awarded five intersections for redesign and construction in FY 2023,FY 2024, and FY 2025. The City has submitted four additional projects as part of the 2022 call for projects and is expecting to hear a response back from TxDOT in the summer of 2023 on if the projects were selected and awarded.
