General Information & Status Updates
A. Wastewater System Testing – On Thursday, Sept. 7, Denton Water Utilities will be
performing sanitary sewer system testing to locate potential breaches in the sewer system. Testing will be performed on Chisolm Trail and Driftwood Trail between Stuart Road and Bell Avenue, between 7 a.m. and 5 p.m. This testing, often referred to as “Smoke Testing”, involves sending a visible vapor through the sanitary sewer system. The vapor is blown
through manholes and a visual inspection is completed to see if vapor is escaping anywhere
other than the next downstream manhole. In the event vapor is present in unexpected places, the crews will document the location for follow up repairs on the public portion of the system. The vapor is a non-toxic and non-flammable moisture concentrate that is odorless and safe around humans, plants, animals, food, and fabrics. No evidence of vapor
should be present in any homes, but if residents or businesses do observe the presence of
vapors, it is an indication that there may be internal plumbing issues that need to be addressed with a professional plumber. Residents are responsible for repairs to their internal plumbing systems. Staff contact: Haley Salazar, Water
B. Economic Development Reports – The Economic Development Department has compiled
and submitted the July activity reports (attached) for key economic development partners:
• Economic Development Partnership - The City contracts with the Denton Chamber to drive specific economic development activities. The collaboration of the
partnership is centered around five key focus areas: 1. Relationship building with developers, brokers, local industry, and business 2. Marketing 3. Business Recruitment & Attraction 4. Business to Business Networking
5. Training and Education
• Stoke-Denton - The City contracts with Stoke to bolster entrepreneurship by supporting entrepreneurs, startups, and freelancers in our community. The partnership focuses on:
1. Events 2. Programs 3. Marketing 4. Ecosystem
• Main Street Association - The Main Street Association contracts with the City to
carry out their Local Program work according to the Main Street Approach. This revolves around the following Four Points: 1. Organization 2. Economic Vitality
3. Promotion
4. Design The City is in the process of proposing to bring the Local Program back in-house in FY 24. Additionally, a Downtown Business Survey was conducted over the summer in
collaboration between the Main Street Association and the City’s Economic Development
Department to gather insights and feedback from local businesses.
• Discover Denton - In line with the Council's initiative to foster a closer relationship, the July activity report for Discover Denton has also been included (attached). This

initiative aims to enhance collaboration and streamline efforts between Discover Denton and the Economic Development Department.

C. Staffing for Adequate Fire and Emergency Response (SAFER) Grant – The City received
notice on Sept. 1 of the receipt of the 2022 SAFER grant award in the amount of $2,035,458. The SAFER Grant Program provides Federal funding to assist in increasing the number of firefighters to help communities meet industry minimum standards and fulfill the traditional missions of fire departments. Grants are 100 percent reimbursable
with no match required over a three-year period. The grant will fund six full-time staff
positions , aligning with the Fire Department’s 10-year staffing plan. The submission of the grant application was approved by the City Council on March 21, 2023, by Resolution 23-528. The 2022 submission is the fifth SAFER grant application by the City of Denton Fire Department and is now the fifth awarded to the City. Staff contact: Kenneth Hedges,

D. Texas Travel Industry Recovery Grant Program – Beginning Sept. 1, a new application period will open for the Texas Travel Industry Recovery Grant Program (TTIR) administered by the Texas Economic Development Finance Division. TTIR was
established to provide reimbursement grants for the recovery of Texas businesses in the
tourism, travel, and hospitality industries that were negatively impacted due to COVID-19. The program is funded by the American Rescue Plan Act of 2021. In accordance with Senate Bill 30, signed into law by Governor Greg Abbott following the
88th Legislative Session, this application round will give applicants the opportunity to
apply for a higher threshold of funds. Applicants who received previous awards under the program are now eligible to reapply for funding for up to $250,000 in total awards, including the amount of previous awards. Eligibility criteria, required documentation, and instructions on how to apply can be found on Texas Economic Development’s Texas
Travel Industry Recovery Grant Program page. Applicants must apply and submit
supporting documentation through the State’s portal. The application deadline is Sept. 15, at 5 p.m. Staff contact: Laura Behrens, Finance E. Sewer Overflow and Stormwater Reuse Municipal Grant Program – The U.S.
Environmental Protection Agency (EPA) announced the availability of approximately $50
million in grants through the Sewer Overflow and Stormwater Reuse Municipal Grant Program, also known as the Overflow and Stormwater Grant (OSG). The program was created by America’s Water Infrastructure Act of 2018 and amended by the Infrastructure Investment and Jobs Act, which increased the eligible uses and authorized funding for the program. Approximately $4,526,000 of OSG funding will be available for the Region 6
states of Arkansas, Louisiana, New Mexico, Oklahoma, and Texas to help Region 6 communities address stormwater and sewer infrastructure needs. Texas’ FY 2023 allocation is $2,824,000 per the statutory formula developed by EPA. States must apply for their allocation and submit a work plan for projects to the EPA Regional Office. Financially
distressed communities meeting affordability criteria established by each state are project
priorities, as well as rural areas. In Texas, the project service area must typically have an

income level at or below 75 percent of the state income level and have higher total proposed water and service costs per household to be eligible as a distressed community.
The Texas Water Development Board is expected to manage the program since the Board administers other federal Clean Water Act grants, including the Clean Water State Revolving Loan Fund. F. NATOA Award Finalists – The City of Denton and DTV are finalists in four categories and honorable mention in two others for the National Association of Telecommunications Officers and Advisors (NATOA) Government Programming Awards. These annual awards
recognize excellence in broadcast, cable, multimedia, and electronic programming
produced by local government agencies from across the United States. The four categories in which the City of Denton is nominated are Public Affairs - Denton: State of the City, Library - Summer Reading Challenge, Animal Services – Animal Shelter Thanksgiving, and Profile of a City/County Dept. or Employee – Employee Spotlight – Jeremiah Tillman-
David. The two Award of Honor recognitions are for Instruction/Training - We Otter Talk

Spring and Fall peak bird migration periods. The proclamation formalized efforts to
encourage all citizens and businesses to turn off non-essential lighting during critical bird migration periods. Fall peak migration is estimated from Sept. 6 through Oct. 29, 2023. As an added benefit this year, Denton Municipal Electric will be dimming residential streetlights to provide reduced disruption to migration, while ensuring that adequate
lighting levels are maintained to promote the health and safety of the Denton public. As we

I. Climate Action and Adaptation Plan Update – The City is currently working with Sustainability Solutions Group (SSG) to finalize the Climate Action and Adaptation Plan
(CAAP). SSG provided the City with the first draft of the CAAP on Aug. 11, and City staff
provided comments on the draft back on Aug. 25. Staff anticipates providing the proposed final content to the Sustainability Framework Advisory Committee (SFAC) in September with subsequent final documents and presentation to the full Council in October. J. Carl Young Splash Pad Closure – The Carl Young Splash Pad will close for the season on Tuesday, Sept. 5 to accommodate construction to expand the size of the splash pad. The expansion will include several new water features, a shaded pavilion, and additional site improvements. For more information on the project, visit Discuss Denton. Staff contact:

K. Afterschool Action Site – Afterschool Action Site started on Aug. 10, 2023. The program is currently operating from Denia, Martin Luther King, Jr., and North Lakes Recreation Centers. Students are picked up from 13 elementary schools in Denton ISD as well as
Denton Classical Academy. The program’s total enrollment across all three sites is
currently 112 students. On early release days, including Friday, Sept. 1, staff will transport kids to the Denton Civic Center where they will have the opportunity to enjoy bounce houses, video games, the party store, and much more. Staff contact: Grace Mulkey, Parks and Recreation
L. Denton Senior Center Facility Maintenance – The Denton Senior Center will be closed to the public from Saturday, Sept. 2 through Monday, Sept. 4, for facility maintenance and the Labor Day holiday. During the closure, vinyl flooring will be installed throughout, replacing the old tiles and mismatched flooring. In addition, the partitions in the
Multipurpose Room (MPR) will be removed, allowing storage in the room. Additionally,
walls will be repainted. Staff contact: Nicole Brasher, Parks and Recreation M. Denia Recreation Center Facility Updates – Denia Recreation Center will undergo cabinet and gym floor replacements beginning Monday, Sept. 11. The center will remain open,
with limited programming. All programs will be cancelled the week of Sept. 11-15, except
for the fitness room, game room and esports room, which will be available for drop-in activities during this time. Programs held in the multipurpose rooms will resume on Sept. 16. The gym will remain closed through Sept. 24 to allow for installation and manufacturer recommended curing time. All programs utilizing the gym during this time have been

Responses to Council Member Requests for Information
A. Back-in Parking on E. Hickory Street - On Aug. 22, Council Member Holland inquired about enforcement and usage of the back-in parking and potential speeding along East
Hickory Street. Staff evaluated the existing street configuration and signage and confirmed the posted 25 mph speed limit signs align with the roadway design. The City of Denton Police Department has issued citations along East Hickory Street and will continue to enforce, as staffing allows. Staff contact: Chandra Muruganandham, Engineering and

B. Crosswalk Inquiry on Oak and Hickory Streets - On Aug. 22, Council Member Holland shared a resident’s request to evaluate lighted crosswalks on Oak and East Hickory Street.
Staff evaluated the existing crosswalks and recommended the installation of LED
pedestrian crossing signs at the Austin and Industrial Street crosswalks for added visibility and safety. This item will be considered in the future CIP process. Staff contact: Chandra Muruganandham, Engineering
C. Safety of Intersections on North Carroll Boulevard (Eagle, Hickory, Oak) - On Aug. 22,
Council Member Holland shared a resident’s concerns regarding reckless driving and pedestrian and bicycle safety crossings on North Carroll Boulevard at Eagle Drive, Hickory, and Oak Streets. Staff requested the City of Denton Police Department add this to the high visibility enforcement list. Staff contact: Chandra Muruganandham,

D. ADA Issue at Locust Street and Windsor Drive - On Aug. 26, Mayor Pro Tem Beck submitted a resident’s concern regarding ADA accessibility and safety on the northwest corner of Locust Street and Windsor Drive intersection. Staff evaluated the safety issue
and is installing a temporary fix on the ADA ramps. A permit with the Texas Department
of Transportation (TxDOT) was approved and construction of permanent improvements, including the replacement of ADA ramps and sidewalk landings, will be completed in the upcoming months. Upon construction completion, an update will be provided in the Friday Report. Staff contact: Chandra Muruganandham, Engineering
E. Condition of Hill Alley Street – On Aug. 28, Mayor Hudspeth inquired about cracking on the newly constructed Hill Alley Street. Staff identified three segments (Hill Alley Street, Wye Street, Industrial Street), within the active construction project of Southeast Denton Package A, with settling issues caused by subcontractor utility installation. The contractor
will be required to repair the settling and resurface a portion of the roadway before final
acceptance. The contractor is anticipated to perform a temporary repair on the roadway within the next few weeks to avoid further damage to the road's new subgrade. Staff contact: Seth Garcia, Capital Projects
F. Stop Sign at Linden Drive and Bryan Street - On Aug. 28, Council Member Meltzer
forwarded a resident’s concern about a recent crash and overall safety at the Linden Drive/Bryan Street intersection. On Aug. 31, a field visit and evaluation of the intersection was conducted. A detailed review of the findings and recommendations will be provided in a future Friday Report. Staff contact: Chandra Muruganandham, Engineering
G. Utility Balance Checks for Board and Commission Appointments – On Aug. 29, Mayor Pro Tem Beck asked staff about the process regarding the review of utility accounts for past due balances for board and commission appointments. Specific questions were related to the process for when a person with an account sells a property and the notifications they may receive. Utilities are billed to the customer who requests service at a location, but not
always the property owner. When a customer is no longer responsible for the services, they contact the City to terminate the account, so they are no longer responsible for the bills. If a customer fails to contact the City, the services are terminated either for non-payment or when a new customer assumes responsibility for the utilities. Customer Service
communicates regularly to customers regarding their account balances. The customer
receives a bill each month notifying them of charges accrued. When an account becomes past due, the customer will receive two separate courtesy calls alerting them to the

delinquency. If an account closes with an unpaid balance, the account holder is called 2 weeks after the due date of the final bill. If the account remains unpaid, a letter is mailed
to the customer’s address on file on week later.
City policy states that board and commission appointees not be in arrears with respect to City utility accounts. The vetting process for appointees was recently updated to include not just the current account, but all accounts or properties associated with the appointee.

H. Neighborhood 4 Construction at Pickwick Lane – On Aug. 31, Mayor Pro Tem Beck emailed staff regarding a resident’s concern about emergency services response and trash placed around a construction site located at Pickwick Lane. Ongoing construction is part
of the 2019 Bond project for Neighborhood 4. Staff contacted the contractor to ensure the
appropriate trash receptacle is utilized and access for emergency vehicles is maintained. Staff contact: Taylor Holt, Capital Projects
Upcoming Community Events and Public Meetings
A. Kayaking for Active Adults – Join an American Canoe Association assessed instructor and American Red Cross-certified lifeguard staff on a kayak adventure for adults over the age of 50 on Saturday, Sept. 8. The activity will begin at Denia Recreation Center (1001 Parvin St.) at 10 a.m. and will return at 2 p.m. The kayak adventure will tour a beautiful local
waterway and is open to all skill levels. Paddling experience is not required. Participants
should bring a sack lunch and a bottle of water for an adventure picnic. The fee ($25 for Denton residents and $30 for non-residents) includes transportation, instructors, guides, the use of sit-on-top kayaks, paddles, life jackets, and kayak instruction. B. Food N Fun Friday – Join Parks and Recreation staff at the North Lakes Driving Range (2009 W. Windsor Dr.) on Sept. 8 from 5 to 9 p.m. for $20 unlimited golf balls, a free-to-join closest to the pin challenge, and food for sale from food trucks including King & Queen New Orleans Sneauxballs. Stuart, Parks and Recreation C. Adapted Recreation Dance – Get your groove on with friends at the North Lakes Recreation Center (2001 W. Windsor Dr.) on Friday, Sept. 8, from 7 to 9 p.m. and enjoy
music, a dance floor, a photo booth, and fellowship. This month’s theme is “A’Hoy
Matey!” The event is $5 per person, and open to individuals 16 and up with disabilities. Registration is available at this link. Staff contact: Mia Macy, Parks and Recreation D. Kids Rock, Parent’s Night Out – Kids Rock, Parent’s Night Out returns for another school year! Each month, Kids Rock provides unique and entertaining fun for kids, while
providing their parents or guardians a chance to enjoy a night out. The next Kids Rock event will be Friday, Sept. 8 from 7 to 11 p.m. at the Denton Civic Center (321 E. McKinney St.). Experienced staff plan each month around a unique theme, then create play stations that include games and activities, mini-sports tournaments, unique inflatable fun,
ping-pong, video games on a large screen, and a DJ with dance contests! Two slices of
pizza and a drink are included for attendees. Preregistration is required and can be

E. Dementia Friendly Nature Walk – Join Dementia Friendly Denton County as an Elm Fork Chapter Master Naturalist guides a tour of the Civic Center Garden (321 E. McKinney St) to provide exercise, education, and sensory stimulation for people living with dementia and their caretakers. The next walk will take place Sept. 13 at 10 a.m. with participants meeting
at the South Side of the Civic Center. The event is free to attend, and registration is

H. Hispanic Heritage Month Celebration – Celebrate Cultural Diversity in Denton at the MLK
Jr., Recreation Center (1300 Wilson St.) on Saturday, Sept. 16 from 10 a.m. to noon! National Hispanic Heritage Month runs from the middle of September through the middle of October. This event will celebrate the vibrant history of our Hispanic community, discuss its heritage, and the contributions made by Denton residents from Mexico, Spain,
the Caribbean, and South and Central America. Featuring keynote speaker Dr. Rudy

I. National Dance Day Party – Celebrate National Dance Day on Sept. 16 at North Lakes
Recreation Center (2001 W. Windsor Dr.). The festivities begin at 1 p.m. with BollyX, followed by Zumba at 1:40 p.m., Les Mills BODYJAM at 2:30 p.m., and a Freestyle Dance Party beginning at 3:15 p.m. This is the perfect opportunity to see how dance can feature in an active lifestyle. Sept. 16, and includes both Single and Tandem kayaking options. The excursion begins at
9:00 a.m. and ends at 3:00 p.m. Participants are asked to bring a sack lunch and a bottle of water and meet at the Denton Civic Center (321 E. McKinney St.) lobby in the morning to begin their adventure. The cost for a single kayak is $25 and the cost of a shared, tandem one is $50. Children under age 11 must share a Kayak with an adult. K. Joe Skiles Park Improvement Project Meeting –Parks and Recreation will host a virtual meeting on Thursday, Sept. 21 to provide residents with an update for the planned
renovations to Joe Skiles Park. Planned improvements include the addition of a loop trail,
landscaping, shade, and typical park amenities. Staff are asking for feedback on these elements and the plan in general. Staff will also provide residents with a proposed project implementation schedule. Residents interested in attending the virtual meeting must register with their name, contact number, and email address 24 hours before the meeting

contact: Chris Escoto, Parks and Recreation L. Ages 50+, Active Adult Hike – Discover beautiful fall colors at Clear Creek Natural Heritage Center with outdoor recreation staff on Sept. 22 from 10 a.m. until 12:30 p.m.
Meet old friends and make new ones on this leisurely 3-mile jaunt. Hiking boots, long

M. Clear Creek Night Hike – Join Parks and Recreation’s outdoor recreation staff on a night hike at Clear Creak Natural Heritage Center (3310 Collins Rd.) on Sept. 22 from 6 to 8:00 p.m. Cost for the hike is $5 per person, and it is open to ages 5 and up. Children aged 12 may attend without a guardian if they provide a signed waiver. Registration is available at

TWU - We vetted applicatns for AccelerateHER and conducted
interviews with the top 13 candidates. We made the selection of 8 that

• Cameron Robertson, HPO attended the ‘Monuments of the Future: Planning for a more Equitable Public Space’ lecture in April
via the APA Arts & Planning group. In addition, Cameron attended the CNU Conference in Charlotte, NC in early June and the CLG
Regional Training in Grapevine, TX on June 14, 2023.
• Davis, Weeden, Robertson, Pulido, Molly Carter, and four-DMSA Board Members all attended a Master Class training on
Employee Hiring and Retention with Workforce Solutions of N. TX.

Denton Main Street Association works with the Denton Parks & Recreation Department to identify private property that may need to
have art improvements or enhancements; the association utilizes fundraisers to get funds donated to the Denton Main Street
Foundation and the foundation is able to offer a grant cost-share to private property owners to make an art improvement.
The Denton Main Street Association works with large festivals taking place in downtown Denton that are not produced by DMSA and
offers support to those other non-profits for logistics advice, volunteer needs, or sponsorship.
The Denton Main Street Association board president and other board members and downtown business owners serve on the Downtown
Economic Development Committee, which is the committee that review building grant applications from the City of Denton TIRZ funds.
The downtown TIRZ Committee has downtown business owners and DMSA board members serving on the committee to approve the
building grant applications for funding.
The Denton Main Street Association serves as a network for business owners and downtown residents and is a liaison for the
downtown community and represents their voice at the City of Denton.
The Denton Main Street Association produces tours and activities, such as the Historic Bar Tour, and other building tours to promote
preservation of downtown.

past three months.
The Denton Main Street Program is part of the planning committee for the Downtown Master Plan Update that kicked-off on July 19. In
the previous quarter, staff assisted in the selection of the consultant that will be doing the Master Plan Update. Denton Main Street
Association Board and members will participate in providing information regarding parking, mobility, housing, open space, historic
preservation, drainage, infrastructure, and other public service needs during the information gathering and planning of the 10-month
project.
Denton Main Street provided data and input for the City’s Ambassador Program. The creation of the program took about 12 months
and will have a two-year trial period in the Downtown. Denton Main Street will be an integral part of the program.
We have also updated the Downtown Reinvestment Grant Application process to include project review by the Historic Preservation
Officer to reinforce our dedication to preservation as outlined by the Secretary of the Interior.

The Downtown All-Way Crossing project on the face of the square is in its final stages of completion. The project provides safe
pedestrian crossing of the four-intersections of the Square and includes specific ADA compliant features to provide equal access to all
visitors to Downtown.
DMSA members worked with the City (for Right of Way), a local artist, and a downtown property owner on a penny-tile mosaic project
that helped to beautify a corner of Downtown. It created a pedestrian rest area that included creating two benches on a low brick wall.

In April, the Denton Main Street Program held its annual Spring Open House which included a shopping and dining event to promote
the start of Spring, a fashion show featuring 10-Downtown District businesses, a Mimosa Hop (22 participating businesses, 252
participants), a Story Walk in partnership with the Denton Public Library, and highlighted specials and discounts offered by Downtown
businesses.
The Thin Line Film Festival was held in Downtown Denton and the Denton Main Street Association provided 50 gift bags to the
filmmakers with local goods from Downtown Businesses. Additionally, Denton Main Street Association volunteers provided downtown
parking information for the festival goers and artists.
Denton Main Street Association participated in First Friday (April, May, June) Downtown Businesses offer special events and
discounts including live music, live screen-printing, free wine/beer, gallery openings, and photography events.
In May, the Twilight Tunes concerts on the Historic Courthouse Square Lawn kicked-off. The free concert series averaged 560 people
at each Thursday evening concert. A Historic Bar Crawl in coordination with Preservation Month, Downtown businesses with historical
designations offered food and drinks and heard the history of the buildings (5 participating businesses, 83 participants & 6 scheduled
tours).
In June, Twilight Tunes concluded on the last Thursday of the month, but also planned an additional family focused concert for Make
Music Day.

Our Main Street Program is established, but we have been experiencing some vacancies on our Square along with our Main Street
Manager leaving our program. On a positive note we have two new part-time employees and new Assistant Manager that are bringing
new life and energy to our program. We will also see the completion of the All-Way Crossing Project in Qtr. 3 along with the kick-off of
the Downtown Master Plan and Downtown Parking Study. Lots of great things heading our way!

•The annual 4th of July parade brought a large crowd to
the square. We opened early for the parade, and had
176 visitors before noon, 299 all day.
•We installed our latest GDAC featured art installation.
Local artist, Sofia Hayes, art will be on display through
September.
•DMSA’s Margarita Mosey was a huge success! We
partnered with Denton County Brewing Co to sample a
Mango Habanero Margarita Seltzer. We had 393
visitors in total that day, with 300 during the Mosey.
Our best sales day for the month, by far!
•We placed a large order for new merchandise in July.
Items started arriving in the later half of the month.
DCBC candles, t-shirts, dog toys, dog bowls, coasters,
tumblers, stickers, and more!

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT:
Temporary crash gate across Monte Carlo Lane separating the Ridgemont and Teasley Trails
neighborhoods.
BACKGROUND:
On December 17, 2019, the City Council considered a change in the zoning district and use
classification for the development of the Ryan Way/Woodmere residential subdivision (Ordinance
PD19-0003a). During the Public Hearing, the Council considered concerns from residents of the
bordering Ridgemont neighborhood regarding safety and speeding due to Monte Carlo Lane being
extended to the new subdivision. The developer had previously agreed to alter the neighborhood’s
layout to avoid the construction of a straight, downhill connection to Monte Carlo Lane; however,
Ridgemont residents requested that the road remain closed to through traffic. City staff informed
the Council that the connection at Monte Carlo Lane was required by the Denton Development
Code and was needed to provide emergency access to the new and existing neighborhoods. As a
compromise, the City Council discussed and approved the installation of an emergency-access-
only gate to separate the Ridgemont neighborhood from the new subdivision while allowing access
for emergency vehicles. During deliberations, the City Council agreed that the gate may be
removed at the discretion of a future Council, which is why the ordinance also required the full
improvement of Monte Carlo Lane underneath the gate.
DISCUSSION:
Recent Resident Requests
In May, staff and Council Member Holland met onsite with residents from the Ridgemont
neighborhood to discuss their concerns with the crash gate that was installed at the Council’s
direction. Residents expressed concerns that the gate looks flimsy and temporary. The residents
requested that the City take steps necessary to improve the gate to an aesthetically pleasing
permanent structure.
Following the onsite meeting, staff in Capital Projects, Public Works, Fire, Development Services,
and City Attorney’s Office met to review the request and explore options for Council
consideration.
Options for Council Consideration
Leave the Existing Gate in Place – The current gate was installed in accordance with the
development plan approved by the City Council on December 17, 2019. The development plan
did not specify the aesthetics of the gate. To meet access requirements, the gate was required to
have a Knox padlock to allow for emergency access. As currently constructed, the gate meets the
needs of the Fire Department; however, in the event of an emergency, unlocking the gate to access

either neighborhood will negatively impact emergency services response times. No action is
required by the City Council to leave the existing structure in place since the gate was installed in
accordance with the Council’s requirement as part of ordinance PD19-0003a.
Remove the Gate – The removal of the gate would provide the connectivity called for by the
Denton Development Code. The City Council required the original layout of Ryan
Way/Woodmere to be altered by the developer to adequately address the safety and speeding
concerns raised by the Ridgemont neighborhood residents. While the existing crash gate provides
emergency access, the need to remove the lock to access either neighborhood will delay emergency
response times, particularly for homes located at the end of Porizek Place. Because the existing
gate was approved by ordinance, removing the gate will require the Council to approve an
amendment to the Planned Development (PD) ordinance.
Improve the Gate – As stated previously, the current gate was installed in accordance with the
Planned Development ordinance, which did not specify the aesthetics of the gate. Additionally,
the previous City Council agreed that the gate was to remain as a temporary structure that may be
removed at the discretion of a future Council by means of amending the PD ordinance. If the City
were to improve the gate, it could be considered an unconstitutional gift benefiting private parties
without a public purpose. Further, the gate does not comply with connectivity requirements
outlined in the Denton Development Code or the 2022 Mobility Plan. Staff does not recommend
improving the gate for the reasons outlined above.
If the City Council wishes to consider the improvement or removal of the gate or propose
additional options for consideration, staff recommends Council members submit their proposals
as a Two-Minute Pitch for a future Work Session discussion.

TO MAYOR AND CITY COUNCIL
SUBJECT: Seeking Nominations for DCAD Board of Directors
EXECUTIVE SUMMARY: The Denton Central Appraisal District (DCAD) has notified the City that the term for members on
the current DCAD Board of Directors expires on December 31, 2023. Therefore, DCAD is seeking
nominations from the 61 taxing jurisdictions in the district. The City Council can make up to five
nominations for the Board of Directors. The City Council is scheduled to vote on nominations on
September 26, 2023. The purpose of this informal staff report is to notify you of the process and
seek nominations in advance so that you can give adequate consideration before the Council vote.
Once nominations from all taxing jurisdictions are received by DCAD, a ballot will be sent to the
City. The City Council will then cast their vote to elect Board members at the December 5, 2023
City Council meeting.
During the second special session of the 88th Legislature, the passing of Senate Bill 2 changed the
terms and composition of the board. The DCAD Board of Directors will increase from a 5-member
board to a 9-member board. The new board composition will include 5 members appointed by the
taxing jurisdictions, the Tax Assessor/Collector now serving as a voting member, and 3 publicly
elected members. There were no changes made to the nomination and appointment process for
taxing jurisdictions. Board members will now serve staggered 4-year terms, instead of 2-year terms
for all.
The selection process for the Board of Directors is set forth in Section 6.03 of the Property Tax
Code. This process is not an “election” governed by the Texas Election Code. It is an independent
procedure unique to the property tax system. An appraisal district director must reside in the
appraisal district for at least two (2) years immediately preceding the date the member takes office.
Most residents are eligible to serve as a director. An individual who is serving on the governing
body of a city, county, or school district is eligible to serve as an appraisal district’s director. An
employee of a taxing unit served by the appraisal district is not eligible to serve as a director.
However, if the employee is an elected official, he or she is eligible to serve. Additionally, a person
may not serve as a board member if closely related to anyone in the appraisal district if related to
anyone who represents owners in the district, or if the person has an interest in a business that
contracts with the district or taxing jurisdiction.
The number of votes a taxing unit has is determined by their proportional share of the total levy in
the district from the prior tax year. There is a total of 5,000 votes throughout the district. The five
candidates who receive the largest cumulative vote totals are appointed to the board. On October

12, 2021, the City Council voted to nominate Howard Martin and Bryan Webb. However, after
receiving a nomination Bryan Webb indicated he did not want to be reappointed to the board. In
December 2021, the City of Denton cast 85 votes for Howard Martin and 85 votes for Ann
Pomykal to serve on the board. The current Board of Directors is as follows:

DISCUSSION:
To date, the City has not received the number of votes allocated for the year. Last year the City
was allocated 170 votes, DISD had 654 votes and Denton County had 567 votes of the 5,000 total
votes for the district. City Council may elect to cast all of Denton’s votes for one candidate or
votes among multiple candidates.
The following is a summarization of DCAD’s nomination & approval process.
Prior to October 1st - DCAD notifies taxing entities of the number of votes they are entitled to
cast for appointing board members.
Prior to October 15th - Nominations are submitted to DCAD by each jurisdiction. Each
jurisdiction can nominate up to five candidates.
Prior to October 30th - DCAD compiles a comprehensive list of the nominees and forwards to
each taxing unit in the form of a ballot.
Prior to December 15th - The taxing jurisdictions choose by written resolution the candidate (s)
of their choice. The jurisdiction then submits the name (s) and the votes cast to DCAD.
Prior to December 31st - DCAD tabulates the votes and forwards the results back to the
jurisdictions. The five candidates that receive the most votes become the Board of Directors as of
January 1st.
Please send nominations to the City Secretary’s Office by Friday, September 15, 2023.
Nominations will be compiled and prepared for City Council discussion and vote on Tuesday,
September 26, 2023.

Taxing Entities of Denton County:
This communication is to inform you on the timeline for the Appointment and Election of the
Board of Directors for the Denton Central Appraisal District (DCAD). The Texas Property
Tax Code outlines this process in section 6.03.
As I am sure you are aware, during the 2nd special session of the 88th Legislature, SB2
passed and was signed by Governor Abbott. In this bill, there were a few changes to the
composition of the board and the term limits established for each member of the board. The
DCAD Board of Directors is increasing from a 5 member board with the Tax
Assessor/Collector as an ex officio member to a 9 member board, which will be made up of
the 5 members appointed by the taxing entities, the Tax Assessor/Collector, and 3 publicly
elected members. It is our interpretation of the new law that the Tax Assessor/Collector will
now be a voting member of our board in order to avoid a tie in votes.
There are no changes to the nomination and appointment process for the taxing entities;
however, all board members will now serve staggered 4-year terms, instead of 2-year terms
for all.
This year, you will all appoint 5 members to serve a term of 1 year ending on December 31,
2024. Next fall, we will have another round of nominations and appointments for all 5
members to begin a new term on January 1, 2025. For that term, 2 directors will be appointed
to serve a 1-year term and 3 directors will be appointed to serve 3-year terms. This will be
done by random draw. Thereafter, all elected directors will serve 4-year terms. I will assign
each member a “place” on the board of 1 through 8 so that moving forward staggering places
will be easily identified and tied to a specific seat. This will be done at random draw as well.
The 3 members that are publicly elected in the May 2024 election, will take office on July 1,
2024 and serve a term that expires on December 31, 2026. That said, there will be a new
election for those 3 places on the board in the November 2026 election and those elected will
take office January 1, 2027. These three elected members will draw as well to determine
which director will serve a 2- year term and the other 2 directors will serve a 4-year term.

These provisions take effect only if the constitutional amendment proposed by H.J.R 2 is
approved by the voters this November. I think we are all fairly confident this bill will pass,
considering it also contains property tax relief by increasing the ISD homestead exemption
and providing a 20% cap limitation on appraised value of non-residential homestead real
property.
Please see the timeline below for the nomination, voting and appointment process.
ACTION BY CHIEF APPRAISER:
Allocation of votes is to be done before October 1st. We will calculate the number of votes
for each entity and send out that allocation by email to the county, cities and school
districts. Tax Code 6.03 (e) There are 5,000 total votes to be distributed based on tax levy,
and each taxing entity’s vote allocation is based on their tax levy compared to the grand total
levy for all taxing entities for the previous year. Example: If a taxing entity’s tax levy is
calculated to be 5% of the grand total levy for all taxing entities, the taxing entity would be
allocated 250 votes.

ACTION BY ENTITY:
Nomination of candidates is to be done before October 15th. Since October 14th is a
Saturday, the deadline will shift to the next business day, October 16th. This must be done by
submitting a nominating resolution to us no later than the end of the business day on the
16th. Each entity that is entitled to vote may nominate up to one candidate for each position to
be filled on the Board of Directors. All five of the board positions are included in this
appointment, therefore each taxing entity can nominate a maximum of five candidates. Tax
Code 6.03 (g) The Resolution must include the name and address of each candidate
nominated. To be eligible to serve on the board, an individual must be a resident of the
district (Denton County) and must have resided in the district for at least two years
immediately preceding the date they take office. Remember that this is the nominations
part of the process and the written resolution associated with this phase of the election
should only include nominations of candidates.

Delivery of ballots is to be done before October 30th. Since October 29th is a Sunday, the
deadline will shift to the next business day, October 30th. I will do my best to prepare and
deliver a ballot listing the candidates whose names were timely submitted to each entity as
soon as possible (my goal will be the week of October 23rd). The ballot will list each
candidate, alphabetically sorted by surname. Tax Code 6.03 (j)

Entities cast their votes before December 15th. To be clear, the deadline is for voting
resolutions to be received by the chief appraiser by the end-of-day December 14th. This must
be done by resolution. If a ballot is returned marked, it must be accompanied by a resolution
adopted in a public meeting.
Tax Code 6.03 (g), 6.03 (k and k-1 effective 1-1-2022)
Please remember that taxing entities with 5% or more of the total votes MUST
determine its votes by resolution adopted at the FIRST or SECOND OPEN meeting of
the governing body held after the chief appraiser delivers the ballot, and the resolution
must be submitted to the chief appraiser no later than the THIRD day following the date
the resolution was adopted. This applies to taxing entities with 250 or more votes.

Director appointment results will be sent out before December 31st. We will count the votes
and declare the five candidates who received the largest cumulative vote totals to begin

Individuals may speak during a Council meeting under one of the following categories:
Open Microphone:
At regular meetings only, individuals can speak on any topic that is not on the agenda for no longer
than four (4) minutes per individual. This portion of the meeting occurs immediately after the start
of the regular meeting session. Please note, Council members cannot engage in a discussion on
topics presented during this portion and there are limited slots available for this portion of the
meeting.
Comments on Agenda Items:
Public comments can be given for any item considered by the Council, EXCEPT work session
reports or closed meetings. Individuals are only able to comment one time per agenda item and
cannot use more than one method to comment on a single agenda item. Public comments are limited
to three (3) minutes per citizen.

A. Review of procedures for addressing the City Council.
B. Reports from members of the public shall be received through the following two (2) methods.
A total of up to seven (7) speakers are permitted to provide public comment and may include any
combination of prior registration and open microphone speakers.
1) Pre-registration. This section of the agenda permits any person who has registered in advance
to make a citizen report regarding a public business item he or she wishes to be considered by the
City Council. Each speaker is allowed a maximum of four (4) minutes to present their report. At
the conclusion of each report, the City Council may pose questions to the speaker or may engage in
discussion. If the City Council believes that a speaker's report requires a more detailed review, the
City Council will give the City Manager or City Staff direction to place the item on a future work
session or regular meeting agenda and advise staff as to the background materials to be desired at
such meeting.
2) Open Microphone. This section of the agenda permits any person who has not registered in
advance for a citizen report to make comments about public business items not listed on the agenda.
Such person(s) shall have registered using the “Virtual White Card” or “By Phone” process outlined
by the City on its website or meeting notice.
During open microphone reports under this section of the agenda, the Council may listen to citizens
speak. However, because notice of the subject of the open microphone report has not been provided
to the public in advance, the Texas Open Meetings Act limits any deliberation or decision by the
Council to: a proposal to place the item on a future agenda; a statement of factual information; or a
recitation of existing policy. Council Members may not ask the open microphone speakers
questions or discuss the items presented during open microphone reports.

the City Secretary 24 hours prior to the meeting.

4. CONSENT AGENDA
Each of these items is recommended by Staff or a board, commission, and committee. Approval
thereof will be strictly on the basis of the those recommendations. Approval of the Consent Agenda
authorizes the City Manager or their designee to implement each item in accordance with the Staff
recommendations. The City Council has received background information and has had an
opportunity to raise questions regarding these items prior to consideration.
For those items recommended by a specific board, commission, or committee, the agenda item will
