General Information & Status Updates
A. Adjusted Start Time for Yard Waste and Brush Collections – Solid Waste and Recycling
previously modified the starting time for yard waste and brush collections due to high temperatures. This slight adjustment allowed SWR crews to begin servicing customers before the weather became as hot. As the Fall season begins, yard waste and brush collections will re-resume the normal 7 a.m. start time, beginning Monday, Sept.11. Staff

B. Commercial Diversion Article Implementation – Solid Waste and Recycling (SWR) started implementation of the Commercial Diversion Article (CDA), which requires all multi-family, business, government, and commercial entities to create a diversion plan that
recycles/diverts materials for reuse, or from ultimate disposal at the Denton Landfill. This
implementation will be completed in five phases affecting Denton’s current 2,800 commercial customers. Customers in each phase will receive a letter outlining diversion options, to include:
• Contract recycling services with the City of Denton for programmatic materials,
• Contract recycling/diversion with a registered third-party hauler to manage either programmatic or non-programmatic materials, or
• Self-haul/manage your divertible material to an appropriate management facility.
Once a business has identified a plan, it is required to report its plan to SWR through SWR’s CDA reporting website. All third-party haulers and self-haulers are required to report metrics of weights on a quarterly basis on the SWR website.
Phase one letters are scheduled to be mailed on Friday, Sept. 8, 2023, and will be given a 6-month window to become compliant with the CDA. Phase 2-5 will begin at the first of each month, over the next 4 months, with full implementation by June 2024. Staff contact: Brandi Neal, Solid Waste and Recycling
C. Clear the Shelter Adoption Campaign - During the month of August, the Linda McNatt Animal Care and Adoption Center participated in the Clear the Shelter Adoption Drive. This nationwide pet adoption and donation campaign helps find loving homes for animals in need. Nationwide, more than 860,000 pets have found their forever homes since the
inception of the event in 2015. As part of the campaign, all animal adoption fees are
waived. A total of 315 animals were adopted from the shelter during the month-long event. Staff contact: Shelly Meeks, Animal Services D. Animal Shelter Temporary Closure - On Tuesday, Sept. 12, 2023, the Linda McNatt
Animal Care and Adoption Center will be closed to the public to allow for an all-staff
training and development day. The public is being notified of the closure via signage at the facility as well as social media posts and information on the shelter website. ACOs will still be available to respond to emergency call-out situations. Staff contact: Shelly Meeks, Animal Services
E. ERCOT Grid Conditions - With high temperatures and high energy usage forecast today, similar to what has been experienced the past three nights, Denton Municipal Electric (DME) is providing an update regarding ERCOT grid conditions and DME’s response.

Conditions this week
• This week, ERCOT issued a “Weather Watch” for September 6-8, meaning that
grid conditions were normal but forecasted higher temperatures, higher electrical
demand could result in the potential for lower reserves.
• On Wednesday and Thursday, ERCOT issued a Conservation Appeal requesting Texas businesses and residents to conserve electricity use, if safe to do so.
• On Wednesday evening ERCOT issued an Energy Emergency Alert 2 (EEA 2)
requesting additional conservation and a plan to stay safe in case outages become
necessary
o There were no rotating outages for this EEA level.
o ERCOT was able to utilize additional reserve resources to protect the reliability of the grid.
• ERCOT moved out of emergency operations at 9 p.m. as grid conditions returned
to normal.
Local Impact and DME
• DME continually monitors grid conditions and takes action as determined by
ERCOT.
• Staff uses the DME Twitter account (@DMEpower) and the City’s Main Facebook page to communicate messages to the Denton community. In the event of rotating outages, other notification methods would be used, including the City’s website, Textpower, and social media.
Current Systems
• Since Winter Storm Uri, DME staff have worked hard to enhance the electrical system throughout the City.
• Increasing the number of circuits available for controlled outage rotations and
reconfiguring the electric grid to group critical facilities have doubled the
megawatts available for rotation.
• If a rotating outage were to occur, the enhancements allow for any outages to be evenly spread across the city and would likely be 30 minutes or less per circuit depending on the severity of the capacity shortage.
• As an example, if DME had to shed 5 MW over a 2-hour period, that would result
in only four circuits experiencing a 30-minute outage over that time period. As conditions are expected to be similar today, staff will provide updates as necessary. Thankfully, the forecast looks much more pleasant next week and beyond, and should offer

F. Library Launches New Tonies® Discovery Kits – Denton Public Library launched new Tonies® Discovery Kits Sept. 8, with a DTV video promoting the launch on social media the same day. Tonies® provide an imagination-building, screen-free digital listening experience that plays stories, songs, and more, using fun, recognizable characters loved by
children. They are designed to foster imagination and active play for ages three and up and provide an exciting introduction to the wonder of storytelling for pre-readers. Each Tonies® Discovery Kit comes with a Toniebox audio player and 5 Tonies® figures. Kits include a variety of themes and characters, such as favorite animal stories, National
Geographic, and bilingual stories. Most kits feature characters from popular children’s
literature such as Clark the Shark, Dr. Seuss, Peter Rabbit, Diary of a Wimpy Kid, Giraffes Can’t Dance, Pete the Cat, and more.

Visit the online library catalog to view the available Tonies® Discovery Kits. Each branch
has four Tonies® Discovery Kits, with 12 kits system-wide, to start this pilot program.

Responses to Council Member Requests for Information
A. Bleach Odors near N. Elm and Orr St. – On Aug. 21, Mayor Pro Tem Beck shared a resident’s inquiry on reports of noxious bleach odors and its impact on residents and vegetation near the corner of N. Elm St. and Orr St. Staff received calls and Engage Denton
requests regarding the same concern and address location. Staff continue to investigate and
respond to residents’ reports of concerns regarding odors from this business, but as of now, no violations regarding the odors have been found. A site visit was conducted by the Fire Department, where there were no observed Fire Code violations. Site visits were also conducted by the Environmental Services Department and no stormwater or wastewater
pretreatment violations were found. In the past year, Community Improvement Services
has responded to eight complaints for various property upkeep-related concerns, but no violations were found for odors. Where violations were observed over the past year for grass/weeds, trash/debris, and/or parking on an unimproved surface, the owner corrected the violation within the seven-day verbal compliance period.
The Denton Fire Department has and continues to respond to complaints at the location. They have not transported anyone in reference to having been exposed to anything related to the business in question. As recent as this weekend, the department’s Hazardous Materials Team responded to a call for service. While there, staff tested the air quality for
hazardous substances, which returned with a negative reading.
Residents filed complaints with Texas Commission on Environmental Quality (TCEQ) and staff have spoken with TCEQ in follow up. As the State’s environmental agency, TCEQ can conduct their own, independent investigation. Should residents have additional
concerns, they are encouraged to contact TCEQ’s regional office at 817-588-5800 and/or
report on Engage Denton. Staff will continue to respond to resident concerns and, if any violations of city ordinances are found, will work with the business to resolve them. Staff contacts: Michael Gange, Environmental Services, and Kenneth Hedges, Fire

B. Environmental Concerns on Shady Oaks - On Aug. 25, Council Member Byrd shared a resident’s concerns regarding the business located on Shady Oaks Dr. The concern was
focused on dust being generated by granite cutting at the business. On Aug. 29, Community
Improvement Services visited the site and found the business to be operating within normal procedures. The site reportedly uses wet methods to perform granite cuts within the warehouse. Previously, on Sep. 12, 2022, the Watershed Protection Division responded to the address regarding reports of a slurry discharge to the storm drain channel. As a result
of that previous visit, the site owner corrected and cleaned up the slurry impacts, and the
investigation was closed on Sep. 26, 2022. Staff contacts: Joshua Ellison, Community Services, and JoEtta Dailey, Environmental Services and Sustainability C. CIAC Origins – On Sept. 4, Council Member Meltzer inquired into the origin of the Capital
Improvement Advisory Board (CIAC). The CIAC was established in 2015, via ordinance
2015-109 (attached), and extended in 2018 via ordinance 18-411 (attached) and the supporting agenda information sheet (attached). Staff advised it is common for the Planning and Zoning Commission to serve in the CIAC board capacity, particularly given their involvement in the Comprehensive Plan adoption and in providing recommendations
to Council regarding land assumptions. Furthermore, Texas state statute Chapter 395.058
supports the Planning and Zoning Commission serving in this capacity. Staff advised one person representing the extraterritorial jurisdiction (ETJ) area is included due to any authorized impact fees being applied it the ETJ. Staff contact: Tina Firgens, Development Services
D. Political Signage Regulations – On Sept. 4, Council Member Byrd inquired if the placing of political signage on City property, such as during voting, was regulated by the charter. There are state election laws as well as City of Denton ordinances that govern the time and placement of political signs. For instance, Texas Election Code Section 85.036 (b)
provides: (b) The entity that owns or controls a public building being used as an early
voting polling place may not, at any time during the early voting period, prohibit electioneering on the building's premises outside of the [100-foot zone], but may enact reasonable regulations concerning the time, place, and manner of electioneering. The City of Denton Land Development Code, Chapter 33, Section 33-16 sets forth when temporary
signage containing political advertising can be placed at public polling places which is
during early voting periods and election periods. A charter amendment would not be needed to change the Land Development Code and any changes to state law would have to be put forth in the legislature.
In general, City resources (property that the city owns and uses as a polling location) cannot
be used for election purposes unless specifically permitted under state law. State law allows the use of the city-owned polling places during early voting and election periods, with certain restrictions. We are not aware of any other cities that allow candidates additional time (beyond the period required by state law) to place signs at their polling locations, and a significant amount of additional research would be needed to determine whether this
would violate the general prohibition on candidates using city facilities for campaign purposes. Additionally, some of the polling locations are not owned by the City and would not be subject to city regulation of city-owned polling locations. Staff contact: Ryan Adams, City Manager’s Office
E. GoZone EMS/Fire Data – On Sept. 5, Council Member Watts inquired the number of trips that Fire and EMS responders provide to individuals who are unable to source a ride from

GoZone. Staff advised the patient care reports do not have a data field that would allow a report to be ran on this scenario. This would be reliant on the caller/patient sharing this

F. Traffic Near Denton High – On Sept. 5, Council Member Holland shared a concern regarding traffic congestion around Denton High School. There are three planned projects to address traffic congestion for this area. The Westgate temporary connector project will
connect from East/West Westgate to Bronco Way, providing additional ingress and egress
to the school. This project has been awarded to a contractor, and construction will begin pending the resolution of a property issue, with an estimated construction timeline of 3 months. The second project, for the Westgate Roadway, will widen North/South Westgate, install sidewalk connectivity, widen East/West Westgate, and connect both portions of
Westgate. This project is currently at 60% design, and staff anticipates construction to
begin in Q2 of 2024. Finally, Bonnie Brae Phase 6 will widen Bonnie Brae from US 380 to US 77, providing pedestrian connectivity and a signalized intersection at Windsor Drive and Riney Road. This project is in the final design stages and is anticipated to begin construction in Q1 of 2024. Staff Contact: Trevor Crain, Capital Projects
G. UNT Discovery Park Entrance Traffic Controls – On Sept. 6, staff received an email from a resident, including their Council Member, requesting installation of a traffic signal at the intersection of US 77 (N. Elm Street) and Discovery Boulevard. An intersection improvement project was submitted as a Highway Safety Improvement Program (HSIP)
project with the Texas Department of Transportation (TxDOT), and approval was received
in 2022. The project has been awarded to a contractor, and construction is expected to begin in the Fall/Winter of 2023. Staff has responded to the resident directly and shared the above information. Staff contact: Brett Bourgeois, Engineering
Upcoming Community Events and Public Meetings
A. Citizen Scientists: An Overview – Learn how to become a citizen scientist and help researchers gather data on a variety of projects. Dan Friedman from Sustainable Denton will share information about various citizen scientist platforms available for anyone who
wants to join in scientific research. This event is for all ages, free to attend, and registration
is not required. Saturday, Sept. 9, 11 a.m. to 12 p.m. at North Branch Library (3020 N. Locust St.). Staff contact: Jennifer Bekker, Library B. Author Tracy Lawson at South Branch Library – Author Tracy Lawson writes books for
children, teens, and adults including historical novels, dystopian thrillers, non-fiction titles.
Her latest book, Answering Liberty’s Call, is based on her own ancestor who rode to Valley Forge with an urgent warning for General Washington. Tracy Lawson will speak about her writing process, how she chooses what to write about, and how she discovers engaging characters and stories that connect to readers. Copies of her books will be available for purchase and signing at the South Branch Library (3228 Teasley Ln.) on Saturday, Sept.

about the unexpected physical and mental challenges of working remotely and offer

D. Dementia-Friendly Nature Walk – Join Dementia Friendly Denton County as an Elm Fork Chapter Master Naturalist guides a tour of the Civic Center Garden (321 E. McKinney St.) to provide exercise, education, and sensory stimulation for people living with dementia and
their caretakers. The next walk will take place Sept. 13 at 10 a.m. with participants meeting

G. The Public Library: A Treasure Trove for Genealogy Research – The Denton County Genealogical Society’s (DCGS) September presentation is all about the best and most overlooked resources for genealogical research: the Public Library. Denton Public Library’s (DPL) Laura Douglas shares how and where to find unexpected treasures hidden
in local history and genealogy collections, both in your own community and those where
your ancestors lived. After the presentation, participants will hunt for their own genealogical treasures in the DPL Special Collections research area. Join us as DCGS kicks off the 2023-24 programming year on Thursday, Sept. 14, at the Emily Fowler Central Library (502 Oakland). Social time begins at 6:30 p.m., with the presentation following at

National Hispanic Heritage Month runs from Sept. 15 through Oct. 15. This event will celebrate the vibrant history of our Hispanic community, discuss its heritage, and the contributions made by Denton residents from Mexico, Spain, the Caribbean, and South and Central America. Featuring keynote speaker Dr. Rudy Rodriguez, trustee of Denton ISD
since 2008, the event will also feature entertainment and activities for children. The event

J. National Dance Day Party – Celebrate National Dance Day on Sept. 16 at North Lakes
Recreation Center (2001 W. Windsor Dr.). The festivities begin at 1 p.m. with BollyX,
followed by Zumba at 1:40 p.m., Les Mills BODYJAM at 2:30 p.m., and a Freestyle Dance Party beginning at 3:15 p.m. This is the perfect opportunity to see how dance can feature in an active lifestyle. K. Kayaking, Ages 8+ – Join American Canoe Association assessed instructors and American Red Cross lifeguard certified staff on a kayak adventure that tours a beautiful local waterway. Our next kayaking event will explore Pecan Creek and takes place on Saturday,
Sept. 16, and includes both Single and Tandem kayaking options. The excursion begins at
9:00 a.m. and ends at 3:00 p.m. Participants are asked to bring a sack lunch and a bottle of
water and meet at the Denton Civic Center (321 E. McKinney St.) lobby in the morning to begin their adventure. The cost for a single kayak is $25 and the cost of a shared, tandem one is $50. L. Veterans Kayaking –Parks and Recreation is offering a kayaking program specifically oriented toward veterans. Join American Canoe Association assessed instructors and American Red Cross lifeguard staff for a kayaking trip in a local waterway. Make connections with other veterans and enjoy connecting with nature. The trip begins on
Saturday, Sept. 19, at 10 a.m. at the Denton Senior Center (509 N. Bell). The cost is $25

N. Joe Skiles Park Improvement Project Meeting –Parks and Recreation will host a virtual
meeting on Thursday, Sept. 21 at 6:30 p.m. to provide residents with an update for the planned renovations to Joe Skiles Park. Planned improvements include the addition of a loop trail, landscaping, shade, and typical park amenities. Staff are asking for feedback on these elements and the plan in general. Staff will also provide residents with a proposed
project implementation schedule. Residents interested in attending the virtual meeting must

Hiking boots, long pants, drinking water, sunscreen are all recommended. Registration for the hike is $5 per person and available at this link. P. Clear Creek Night Hike – Join Parks and Recreation’s outdoor recreation staff on a night hike at Clear Creak Natural Heritage Center (3310 Collins Rd.) on Sept. 22 from 6 to 8
p.m. Cost for the hike is $5 per person, and it is open to ages 5 and up. Children aged 12

Sky Theatre! The program is open to those 16 and up with developmental disabilities and

S. Yappy Hour at North Lakes Park – Grab your four-legged companions and join Denton
Parks and Recreation at North Lakes Park (808 W. Windsor Dr.) on Friday, Sept. 22, from 5:00 p.m. to 8:00 p.m. There will be an array of food and pet treat vendors who will be offering a variety of yummy goodies for sale. T. Bike Safety Course – Learn the basics of bicycle safety with an expert-led class at Denia Recreation Center (1001 Parvin St.) on Saturday, Sept. 23 from 9 a.m. to 4 p.m. The class will cover topics such as helmet fit and how to respect the rules of the road in your bicycle, and will also involve practicing in a safe place before venturing onto neighborhood roads
for further practice. The class is taught by a Denton Police Department Bicycle Patrol
Officer. The class is open to individuals ages 8 and up, and costs $40 for residents and $45 for non-residents. Participants are asked to wear appropriate clothing including close-toed shoes and to bring their bicycle, helmet, water, and something for lunch. Registration is available at this link. U. Fall Block Party – Mark your calendars for an exciting, family-friendly event, the City Block Party, bringing the community together for a night of fun and engagement with City officials. This event combines the National Night Out Kick Off Party with State of the City in one central location where all can attend. Join us on Sept. 28, from 6 to 8 p.m. at the
Denton Civic Center and Quakertown Park (321 E. McKinney St.), where numerous
departments will host booths, “touch-a-truck” exhibits, and various fun activities with free giveaways for attendees. Food trucks will also be in attendance with food for purchase. referred to as the "Advisory Committee" shall consist of seven members of the City of Denton
Planning and Zoning Commission. All seven (7) members of the Advisory Committee shall be
voting members thereof. The terms of the members shall parallel those terms of the City of
Denton Planning and Zoning Commission.
SECTION 4, The duties of the Advisory Committee shall consist of the requirements
listed in Texas Local Government Code §395.058(c) and (d) as currently written, and any other

BACKGROUND Denton collects impact fees on all new water and wastewater connections to help offset a portion of the cost of new infrastructure to accommodate new demand. Under Chapter 395 of the Local Government Code, Denton must update the land use assumptions and capital improvements plans used to calculate its impact fees every five years. Denton completed its last impact fee study and update in 2013.
As part of the update process, Chapter 395 requires appointment of a Capital Improvements Advisory
Committee to review and comment on land use assumptions, capital improvements plans, and proposed impact fees. The next step in the update process required by Chapter 395 is to appoint the Capital Improvements Advisory Committee which is charged with advising and assisting in adopting land use assumptions, reviewing the proposed capital improvements plans for water and wastewater, monitor the
implementation of the capital improvements plan, and advise on the need to update impact fees.
Section 395.058 of the Local Government Code allows for the Planning & Zoning Commission (P&Z) plus a representative of the ETJ (Extra Territorial Jurisdiction) to serve as the Capital Improvements Advisory Committee. Since the first implementation of the water/wastewater impact fees in 1998 and the
subsequent 5-year mandated updates in 2003, 2008 and 2013, the P&Z plus one member from the ETJ has
been appointed by the City Council to serve as the Capital Improvements Advisory Committee. Staff is recommending that the Council appoint the Planning and Zoning Commission plus one additional member to represent the City of Denton ETJ interests.
Staff further recommends that Robin Harris, P.E. be appointed to serve as the ETJ member on the Advisory Committee. Robin is a licensed Professional Engineer in Texas and an Associate in the
consulting firm Teague Nall & Perkins in the Denton office. Robin has been involved in several water and
wastewater design projects for Denton over the years, with the most recent one being the Fort Worth Drive Utility Relocation project. Robin will bring the technical expertise to the Capital Improvements Advisory Committee in evaluating the impact fee study results. His knowledge of the city and ETJ area as well as his understanding of the issues facing Denton will bring valuable insight to the impact fee process.

Once complete, the updated study and proposed impact fees will be also be presented to the Public
Utilities Board for review and an impact fee adoption recommendation to the City Council.
ESTIMATED SCHEDULE OF PROJECT Based on the proposed schedule, the impact fee adoption public hearing is slated for the September 18, 2018 City Council meeting.
PRIOR ACTION/REVIEW (Council, Boards, Commissions) September 25, 2017- PUB approved the contract with Kimley Horn Associates for update of the impact fees.
FISCAL INFORMATION The Kimley Horn contract was approved for $91,400 and funded from the revenue funds allocated for the study in the water and wastewater budgets.

2022 City of Denton Economic Development property tax (ad valorem) incentive agreements
including tax abatements and rebates
EXECUTIVE SUMMARY:
In tax year 2022, the City of Denton had six active property tax incentive agreements. This includes
four Chapter 380 property tax rebate agreements and two property tax abatement agreements. In
total, the value of the rebates and abatements for tax year 2022 is $655,408. The associated
properties have a total valuation of $297,733,412 and generated $1,251,951 in net property tax
revenue for the City.
BACKGROUND:
The City of Denton provides economic development incentives in accordance with the City’s Tax
Abatement and Chapter 380 Policies to stimulate private development and redevelopment, expand
the tax base, generate jobs, and enhance the local economy. The City currently has two active
property tax abatement agreements and four active Chapter 380 property tax rebate agreements.
The property tax rebates are paid annually based on the terms in the individual grants.
The City is authorized under various regulations and through its adopted policies to offer property
tax abatements and property tax rebates.
Tax Abatements allow local governments to exempt all or a portion of the valuation
increase of real and personal property taxes from a new or expanded business development
for a period of up to 10 years. The statutes regulating tax abatements can be found in
Chapter 312 of the Texas Property Tax Code.
Tax Increment Reinvestment Zones (TIRZ) allow local governments to finance
improvements and infrastructure within a defined area in order to stimulate private
development and redevelopment. A property tax valuation base is established in the first
(base) year, and the revenue from the increased valuation from subsequent years is
allocated to development within the TIRZ. The statutes that regulate tax increment
financing and the related zones are in Chapter 311 of the Texas Property Tax Code, also
known as the Tax Increment Financing Act.
Chapter 380 of the Texas Local Government Code states that a municipality may
establish and provide for the administration of one or more programs for making loans and
grants of public money and providing personnel and services of the municipality, to
promote state or local economic development and to stimulate business and commercial
activity in the municipality.
Freeport Exemptions are an exemption from property tax on goods that have been held
in the state for 175 days or less for the purpose of assembly, storage, manufacturing,
processing or fabrication. The exemption applies throughout the entire taxing jurisdiction.

A triple freeport exemption means that the three taxing jurisdictions, city, county and
school district, participate.
The City uses these tools to facilitate performance-based property tax incentives, taking the form
of either a property tax abatement (reduction in property tax payment) or property tax rebate
(reimbursement of a portion of property taxes paid). Chapter 380 agreements may also include an
expansion or relocation cash grant, TIRZ grant, or job-based grant that incentivizes high-wage or
knowledge-based jobs.
Each year, once values are received and property tax payments are due, calculations are performed
by the Denton Central Appraisal District (DCAD) and Economic Development staff. For
abatements, DCAD determines the amount of an abatement for active agreements by applying the
terms of the approved abatement. The corresponding company will then see a reduction in their
tax bill. For property tax rebate agreements, Economic Development staff review property tax
values and payments made, then calculate the amount of the rebate by applying the terms of the
approved agreement. The corresponding company then receives a rebate directly from the City.
For all agreements, specific valuation, job, and wage threshold requirements in the agreements are
verified using a certificate of compliance, third party verification from the DCAD, and IRS
documentation. The valuation, revenue, job, and incentive information is captured in the annual
Net Revenue Report and tracked over time to determine the net benefits to Denton.
Summary memos of the 2022 active property tax abatement agreements and property tax Chapter
380 agreements are attached. The memos include breakdowns of property valuation, including
taxable values that may be ineligible under the specific terms of the applicable agreement. Because
the terms vary by agreement, each payment/abatement is calculated and reviewed individually.

This is the fifth year of the twenty-five-year agreement for O’Reilly Hotel Partners Denton (OHPD).
Under the Chapter 380 Agreement, OHPD will pay 100% of the property taxes owed to the City and will
receive a grant equal to 100% of the building and equipment valuation of the hotel and convention center
(excluding inventory, vehicles and supplies).
OHPD will receive 100% of the ad valorem tax, hotel occupancy tax, and sales tax generated by the
project for a maximum of 25 years or until the combined principal amount of $28 million and interest
payment of $26 million, for a total aggregate amount of $54 million, is reached, whichever comes first.
The incentive is capped at $54 million.

through 2022. The total abatement over the period was supposed to be $132,920. Actual abatements
amounted to $150,546 The difference amounted to $17,637 over what should have been abated for the
period. Both parties are working on the best method to correct this error.

Litter Cleanup Programming and Opportunities
BACKGROUND:
On August 30, City Council Member Holland shared a resident’s concern over the amount of litter
in the City of Denton and encouraging the City to create service focused on improving the
appearance of the city.
DISCUSSION:
The City of Denton has several departments and programs that work to reducing litter throughout
the city and thus improve its appearance, as highlighted below:
PARKS AND RECREATION / KEEP DENTON BEAUTIFUL
Parks and Recreation deploys volunteers through the following Keep Denton Beautiful (KDB)
programs to address litter prevention and cleanup:
Community Appearance Index – Each year our Keep Denton Beautiful staff deploy a group of
volunteers throughout the community to conduct a windshield survey scoring methodology to
measure the litter and appearance of the city. Using Keep America Beautiful’s nationally
recognized litter assessment scale, a team of staff and community volunteers will score litter
prevalence along 96 different roadway “zones” in Denton. Results from this annual citywide litter
scan allow KDB to pinpoint and monitor highly littered areas of Denton, and then subsequently
target these areas for increased litter cleanup and education efforts year-round - primarily through
volunteer-driven programs like Meetup Cleanups, Adopt-A-Spot, and the Great American
Cleanup. See the chart below for scoring results. No scoring was conducted in 2019-2020, 2020-
2021, or 2021-2022 due to COVID-19.

Great American Cleanup – Denton’s largest and longest-running litter cleanup event is hosted
each March and coincides with the universities’ Big Event volunteer service day. This event is part
of a nationwide beautification campaign led by Keep America Beautiful. In Denton, an average of
2,000 volunteers assist with this one-day citywide effort. In 2023, KDB volunteers removed 6.35
tons of litter from Denton roadways, parks, and waterways. For more information on this
nationwide effort, visit kab.org.
Meetup Cleanups – As an ongoing effort to remove litter from the community, cleanup supplies
(trash bags, recycling bags, disposable gloves, safety vests, and pickup sticks) are provided to
volunteers at no charge. Anyone can sign up on a one-time or recurring basis. Staff receives an
annual average of 100-150 “Meetup Cleanup” requests.
Adopt-A-Spot – For volunteers committed to long-term roadway cleanups, KDB offers the Adopt-
A-Spot program. There are 98 Adopt-A-Spot locations, which are currently all adopted.
“Adopters” must sign an agreement to conduct quarterly cleanups and submit reports to staff. The
1-2-mile roadway selections are City-owned, non-TxDOT roads and are determined through the
annual litter assessment. Denton City Council maintains an Adopt-A-Spot location along Bell
Avenue from Prairie Street to Eagle Drive.
Adopt-A-Spot Locations
Cigarette Litter Prevention Program – Through grants from Keep America Beautiful, staff have
been able to place 26 cigarette litter receptacles around the Downtown Square and mews streets,
the Fry Street area near the UNT campus, and within Quakertown Park. Staff lead quarterly
volunteer opportunities to empty the receptacles and conduct litter assessments to gauge the
effectiveness of the receptacles. KDB recently received 20 additional receptacles to place in

cigarette litter hotspot areas. Volunteers and staff collect an average of 15,000 cigarette butts
annually. The cigarette butts are mailed and recycled through an outside company.
Cigarette Litter Receptacles
While thousands of KDB volunteers make a huge impact in our community, due to safety, we are
not able to send volunteers to all littered locations. Litter hotspots like high-speed roadways such
as I-35 (45+ mph), illegal dumping sites, encampments, and along railroads (UPRR and KCRR)
and sections of the Rail Trail (Non-City trail / DCTA tracks) are not considered safe locations to
send volunteers. One consideration is to expand upon the existing illegal dumping and mowing
contract to include these high-risk littered areas.
Illegal Dumping Crew - A few years ago, Parks and Recreation created an “Illegal Dumping
Crew”. This crew consists of two dedicated staff members that pick-up litter across the city. This
was the first phase of dedicated staff to focus on the cleanliness of the community. Phase 2 which
consists of an additional two staff has not been implemented due to department priorities and
funding availability.

KDB / Volunteer Supervisor - Since March 2022, the KDB/Volunteer Supervisor position, who
leads the efforts mentioned above, has been vacant for 12 months (non-consecutive). The
responsibilities of the position have also expanded to encompass all beautification efforts within
Denton Parks and Recreation. This vacancy has impacted beautification and volunteer efforts as
an organization. If the City wishes to expand efforts, additional resources (staffing and
materials/supplies) would be necessary to accommodate this need.
ENVIRONMENTAL SERVICES AND SUSTAINBILITY
Stream Clean - Stream Clean is the City's long running annual waterway clean up event focusing
on public access streams, ponds and Lewisville Lake northern shore. In 2022 over 500 volunteers
collected more than 500 bags of trash, 30 bags of clean recycling and 100’s of large or heavy loose
items including over 30 tires. Volunteers pick up litter and debris from five to eight miles of
drainage channels and shoreline and average at least a ton per cleanup.
COMMUNITY SERVICES
Community Improvement Services (CIS) works with Private Property owners to address trash and
debris (litter) on private property to ensure trash and debris are properly collected.
Downtown Ambassadors –The City of Denton is starting a new program in 2024 that will provide
a greater focus on downtown Denton. One aspect of this program will be increased staff and
cleaning efforts in the downtown core, in hopes to reduce litter, debris, and graffiti.
SOLID WASTE AND RECYCLING
Pursuant to its state permit to operate the City of Denton Landfill, (MSW1590B), the City is
responsible for litter cleanup daily, each day the landfill is open (six days a week), on all roadways
that are used as access routes, within two miles of the site entrance (Mayhill and Spencer). This
task is completed using 4- Field Service Workers II and contract employees supplied through the
City’s Temporary Services Contract and its agreement with Our Daily Bread.
In addition to offsite litter collection, which lasts four to six hours per day, staff also collects litter
on the landfill proper as well as completing additional tasks (landfill spotter and minor site
maintenance). The annual cost for this effort is approximately $300,000.
Staff is on track to collect over 6,000 bags of litter, and other assorted large, bulk-type items, in
CY2023. In addition, to help further mitigate litter resulting from unsecured material blowing out
of vehicles traveling to the Denton Landfill, the City on Denton, in support of State law (30 Texas
Administrative Code 145 and the Texas Transportation Code, Title 7, Chapter 725, Sec.725.021
(c)), requires that all loads be contained, secured, or tarped. Persons arriving at the landfill with
unsecured loads are assessed an additional fee.

TEXAS DEPARTMENT OF TRANSPORTATION
Adopt-A-Highway – Texas Department of Transportation (TxDOT) offers a state-wide program,
Adopt-A-Highway, which targets litter cleanups along TxDOT highways. Staff are in contact with
TxDOT AAH Coordinators to disseminate litter prevention educational material through their
Don’t Mess with Texas campaign. For more information on this program, visit txdot.gov. Staff,
residents, and community members are encouraged to report litter and debris on or surrounding
highways on TxDOT’s website.
CONCLUSION:
Multiple resources, programs, and opportunities exist currently for cleaning up litter throughout
the City. Community members are encouraged to report litter on Engage Denton for cleanup, as
well as participate in the volunteer opportunities and events hosted throughout Denton. If an
increase in service levels are desired, additional discussion and direction will need to be provided
by the City Manager’s Office and City Council.

SUBJECT: Wildlife Corridors and Mapping
BACKGROUND:
The Denton 2040 Comprehensive Plan as approved on March 22, 2022, established Key Action
#127 - Identify and map wildlife corridors throughout the City to be addressed within three years
of Plan adoption.
Work Plan Timeline Summary
March 2022-In advance of the Denton 2024 Comprehensive Plan a Habitat Connectivity Map was
provided in the March 18, 2022, Friday Report (II.C. and Attachment A). This map took a different
look at the Preferred Land Preservation Map (Figure 2.3 of the 2040 Comp Plan).
June 2022– Staff provided ISR 2022-038, which staff recommended definition for wildlife
corridors as “greenspace and manmade structures/improvements that allow wildlife to move
between larger areas of existing habitat.” The term wildlife corridor was not previously defined
within the Denton 2040 Comprehensive Plan, but was recommended within this ISR. Additionally,
the ISR outlined a two-pronged approach to identify and map the wildlife corridors. The first step
was to generate an overall greenspace map that pulls information from existing City of Denton
resources.
December 2022 – Staff provided ISR 2022-077, which included an update on the greenspace map
in support of identifying and mapping wildlife corridors. That update included graphic images of
the greenspace map and its components as well as outlined the next step of working with a wildlife
working group to finalize a wildlife corridor map.
May 2023- Formation of the Wildlife Working Group which met five times and concluded work
on July 26, 2023. The University of North Texas and the City of Denton worked through the final
model description and graphics throughout August 2023.
DISCUSSION:
Staff have used geographic information system (GIS) layers as well as non-GIS data to augment
GIS layers to better identify potential wildlife areas. This effort refined the greenspace map and
provided a visual of lands within the City that the City controls, have existing conservation
restrictions, and/or are covered under the Environmentally Sensitive Areas (ESA) requirements of
the Denton Development Code (DDC).

The working group was assembled after informal communication with such entities as the Texas
Parks and Wildlife Department, University of North Texas, Texas Women’s University, master
naturalists and others. Staff spent time with the working group reviewing the data used to create
the greenspace map (attached) as well as providing information on the ESA requirements.
Through the review of the City data (i.e., greenspace map), the group was able to discuss wildlife
movement in general. UNT representatives offered to perform a flow analysis using Linkage
Mapper.
Flow analysis offers a dynamic framework to model intricate connections and pathways among
focal regions on diverse landscapes. By combining geographic, environmental, and ecological data
researchers can visualize overall connectivity of a landscape and model the effects that different
human land uses have on landscape connectivity (Balbi et al. 2021). The use of flow analysis can
provide insights useful for landscape planning, conservation efforts, and sustainable resource
management, and contribute to a more comprehensive understanding of the complex interplay
between nature and human activities (Balbi et al. 2021). The Linkage Mapper Toolbox is a
commonly used statistical model used to implement flow analysis (McRae et al. 2023).
Linkage Mapper is an open-source software built upon Circuitscape and specialized for wildlife-
centric flow analysis within Esri software, like ArcPro (Anantharaman et al. 2020, McRae et al.
2023). Both Linkage Mapper and Circuitscape are free to use and available to download online
(Anantharaman et al. 2020, McRae et al. 2023). Linkage Mapper uses a user-provided cost image
to calculate the most likely paths between areas of interest, mapping all potential wildlife corridors
and highlighting the Least Cost Path (LCP) between areas. The LCP was the route with the least
difficulty for wildlife movement.
The two main requirements of the tool are a feature layer with points indicating areas of interest
and a cost image. Ten greenspaces were chosen to be areas of interest based on their size, location,
and local knowledge of habitat. For this analysis, the main assumption was that these greenspaces
provide adequate wildlife habitat, and that wildlife will want to connect from greenspace to
greenspace.
Three datasets were used to create a cost image (i.e., difficulty or ease of wildlife movement
through the area) for the analysis. The Normalized Difference Vegetation Index (NDVI) was used,
otherwise known as a greenness index, to account for spatial differences in vegetation structure
and cover. Land cover data from the National Land Cover Database was used to account for land
use and its effects on wildlife movement. Finally, City of Denton specific data to include areas
with some sort of government oversight, such as Environmentally Sensitive Areas and
Conservation Easements. These three datasets were combined into a single cost image depicting
the relative integrity of the landscape.

Once the datasets were ready, UNT ran the “Build Networks and Map Linkages” tool. The outputs
shared included potential corridors (attached) and Least Cost Paths (attached).
The final Wildlife Corridor Map (attached) will now be integrated into the City’s online
interactive mapping tool. Similar to the Future Land Use Map, the Wildlife Corridor Map will be
used as a planning tool when reviewing and recommending future land uses.

Individuals may speak during a Council meeting under one of the following categories:
Open Microphone:
At regular meetings only, individuals can speak on any topic that is not on the agenda for no longer than
four (4) minutes per individual. This portion of the meeting occurs immediately after the start of the regular
meeting session. Please note, Council members cannot engage in a discussion on topics presented during
this portion and there are limited slots available for this portion of the meeting.
Comments on Agenda Items:
Public comments can be given for any item considered by the Council, EXCEPT work session reports or
closed meetings. Individuals are only able to comment one time per agenda item and cannot use more than
one method to comment on a single agenda item. Public comments are limited to three (3) minutes per
citizen.
Public Hearing Items:
Individuals are limited to four (4) minutes per public hearing item.

to make virtual comments using the eComment module will be made available next to the meeting listing on
the Upcoming Events Calendar. Using eComment, Individuals may indicate support or opposition and
submit a brief comment about a specific agenda item. eComments may be submitted up until the start of
the meeting at which time the ability to make an eComment will be closed. eComments will be sent directly
to members of the City Council immediately upon submission and recorded by the City Secretary into the
Minutes of the Meeting.
4. By Phone:
Individuals may register to provide comments by phone. Instructions and a link to register to comment by
phone will be available at www.cityofdenton.com/publicmeetings until noon of the meeting date. Residents

After determining that a quorum is present, the City Council of the City of Denton, Texas will convene in a
Work Session on Tuesday, September 19, 2023 at 2:00 p.m. in the Council Work Session Room at City Hall,

B. Reports from members of the public shall be received through the following two (2) methods. A total
of up to seven (7) speakers are permitted to provide public comment and may include any combination of
prior registration and open microphone speakers.
1) Pre-registration. This section of the agenda permits any person who has registered in advance to
make a citizen report regarding a public business item he or she wishes to be considered by the City
Council. Each speaker is allowed a maximum of four (4) minutes to present their report. At the conclusion
of each report, the City Council may pose questions to the speaker or may engage in discussion. If the
City Council believes that a speaker's report requires a more detailed review, the City Council will give the
City Manager or City Staff direction to place the item on a future work session or regular meeting agenda
and advise staff as to the background materials to be desired at such meeting.
2) Open Microphone. This section of the agenda permits any person who has not registered in
advance for a citizen report to make comments about public business items not listed on the agenda. Such
person(s) shall have registered using the “Virtual White Card” or “By Phone” process outlined by the City
on its website or meeting notice.
During open microphone reports under this section of the agenda, the Council may listen to citizens speak.
However, because notice of the subject of the open microphone report has not been provided to the public
in advance, the Texas Open Meetings Act limits any deliberation or decision by the Council to: a proposal
to place the item on a future agenda; a statement of factual information; or a recitation of existing policy.
