A. Pending Council Requests Work Session Topics – Pursuant to Ordinance No. 23-1431, the
following items will be discussed during the Nov. 7 Council Work Session: 1) Request for a medium priority work session to discuss and develop a process to enhance the efficiency of the nomination process for city boards and commissions via timeframe window for nominations.

B. Friday Report Distribution for Veteran’s Day – In observance of Veteran’s Day, all City of Denton offices will be closed on Friday, Nov. 10. As a result, the weekly Friday Report will be distributed to Council and posted on the City’s website on Thursday, Nov. 9. Staff

D. CapitalEdge Updates – Federal legislative consultants, CapitalEdge, provided the following updates on their work for the City of Denton: CapitalEdge staff visited Denton in October and had productive meetings with directors and city management. Follow up items include research on Inflation Reduction Act tax
incentives and the use of the Environmental Protection Agency (EPA) Water Infrastructure
Finance and Innovation Act (WIFIA) loan program for City drinking water, wastewater, and stormwater investments. As Congress negotiates FY 2024 spending and other items on its agenda, priorities for the
City will be:
• Protecting FY 2024 funding for Community Development Block Grant (CDBG), HOME Investment Partnership Program, and other core local government grant programs,
• Opposing unfunded mandates and unworkable mandates on general aviation airports
in the Federal Aviation Administration (FAA) reauthorization bill,

• Opposing a massive federal preemption of local authority in telecommunications
legislation (HR 3557),
• Addressing supply chain issues impacting Denton Municipal Electric, and
• Ongoing Implementation of the Infrastructure Investment & Jobs Act and the Inflation Reduction Act.
CapitalEdge also shared FEMA’s revised scoring criteria for the Building Resilient Infrastructure & Communities (BRIC) hazard mitigation grant program, providing points to applications from cities that have adopted the latest building codes even if the state has not done so. FEMA also issued the FY 2023 BRIC funding notice in October. Staff contact:

Parks and Recreation Receives TxDOT Grant – The City of Denton was selected to receive a grant of $10,971,904 from the Texas Department of Transportation (TXDOT) to support the construction of select phases of the Pecan Creek Trail. This grant will provide 80% of
the proposed construction costs with the other 20% matched by the City, sourced from the
City’s American Rescue Plan Act (ARPA) allocation and Parks Dedication and Development fees. The TXDOT Transportation Alternatives Set-Aside (TA) Program supports a variety of bicycle and pedestrian planning and infrastructure projects throughout the state. A total of $345,110,072 in federal funds are being awarded across Texas.
Parks and Recreation strategically plans projects to be “shovel ready” to improve the marketability of the projects in grant applications. This is the third consecutive project awarded a grant to support park development within the city. The other two projects are the development of Villages of Carmel Park and improvements to Bowling Green Park.
More information on the project will be released regarding contractual processes and
timelines when received. Staff contact: Chris Escoto, Parks and Recreation F. 2023 STAR Environmental Leadership Award – On Oct. 9, the City of Denton was awarded The Cis Myers Sustainability Leadership Award by the State of Texas Alliance
for Recycling (STAR). This award is open to individuals, communities, organizations, and
businesses across the state of Texas. The award honors recipients with a dedication to advancing recycling, composting, sustainable materials management, public education, outreach, and other sustainable practices. Denton’s submission spotlights the efforts undertaken to decrease recycling contamination through a multifaceted approach. An
enhanced cart tagging program was piloted which provided a business case to hire a full-
time auditor. A market strategy was implemented at the beginning of FY2023 using targeted mailers, and high impact advertising such as billboards, movie ads, audio, and video ads. The
submission also calls attention to the
Denton Sustainable Schools program which combines recycling education with comprehensive sustainability at Denton Independent School District

G. TATOA Awards – On Nov. 2, the City of Denton won six programming awards at the Texas Association of Telecommunications Officers and Advisors (TATOA) Annual
Programming Ceremony. These annual awards recognize excellence in video
programming produced by local government agencies from across Texas. The City competes at the highest level against cities such as Dallas, Houston, Austin, and San Antonio. The City distinguished itself in video production by winning one 1st place award, two 2nd place awards, and three 3rd place awards.
All videos aired on DTV, were shared via social media channels, and are available on

Public comments can be given for any item considered by the Council, EXCEPT work session reports or

styled, “City of Camden, et. al., v. 3M Company,” pending in the United States District
Court for the District of South Carolina; where public discussion of these legal matters
would conflict with the duty of the City’s attorneys to the City of Denton and the Denton
City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar
of Texas, or otherwise compromise the City’s legal position.

these legal matters would conflict with the duty of the City’s attorneys to the City of
Denton and the Denton City Council under Texas Disciplinary Rules of Professional
Conduct of State Bar of Texas, or would jeopardize the City’s legal position in any
administrative proceeding or potential litigation.

Any final action, decision, or vote on a matter deliberated in a Closed Meeting will only be taken in an Open
Meeting that is held in compliance with Texas Government Code, Chapter 551, except to the extent such final
decision, or vote is taken in the Closed Meeting in accordance with the provisions of Section 551.086 of the
Texas Government Code (the ‘Public Power Exception’). The City Council reserves the right to adjourn into a
Closed Meeting or Executive Session as authorized by Texas Government Code, Section 551.001, et seq.
(The Texas Open Meetings Act) on any item on its open meeting agenda or to reconvene in a continuation of
the Closed Meeting on the Closed Meeting items noted above, in accordance with the Texas Open Meetings

B. Reports from members of the public shall be received through the following two (2) methods. A total
of up to seven (7) speakers are permitted to provide public comment and may include any combination of
prior registration and open microphone speakers.
1) Pre-registration. This section of the agenda permits any person who has registered in advance to
make a citizen report regarding a public business item he or she wishes to be considered by the City
Council. Each speaker is allowed a maximum of four (4) minutes to present their report. At the conclusion
of each report, the City Council may pose questions to the speaker or may engage in discussion. If the
City Council believes that a speaker's report requires a more detailed review, the City Council will give the
City Manager or City Staff direction to place the item on a future work session or regular meeting agenda
and advise staff as to the background materials to be desired at such meeting.
2) Open Microphone. This section of the agenda permits any person who has not registered in
advance for a citizen report to make comments about public business items not listed on the agenda. Such
person(s) shall have registered using the “Virtual White Card” or “By Phone” process outlined by the City
on its website or meeting notice.
During open microphone reports under this section of the agenda, the Council may listen to citizens speak.
However, because notice of the subject of the open microphone report has not been provided to the public
