A. Community Reception for Electric General Manager Candidates — Ralph
Andersen and Associates was contracted with to conduct a nation-wide search for
Electric General Manager candidates. They launched the search in August, and a
total of 111 applicants responded. A press release announcing the finalists for the
position will be distributed on Monday, October 16, and interviews will be
conducted on October 19 and 20.
As part of the interview process, we are hosting a community reception on
Thursday, October 19 from 5:45 to 7:30 p.m. at the Civic Center (note: the
Patterson-Appleton Arts Center is unavailable on the 19th). The information about
the community reception will also be published this weekend in the Denton Record
Chronicle and on the City's social media platforms and website. Staff contact:

B. Assistant Fire Chief/ Fire Marshal — Battalion Fire Chief Brad Lahart has been
appointed to the leadership position of Assistant Fire Chief / Fire Marshal on
Thursday following the review of five strong internal candidates for the position.
Chief Lahart has a proven track record of leadership effectiveness in progressive
operational and administrative assignments. Among other section assignments,
Chief Lahart will have the ordinance and code defined responsibilities as our
City's Fire Marshal, and he will serve as a Leadership Team member guiding the
Fire Department, along with Chief Robin Paulsgrove, Assistant Chief Kenneth
Hedges, and Administrative Manager Christine Taylor. Please join us in
congratulating Assistant Chief Lahart. Staff contact: Robin Paulsgrove
C. Denton Development Code Update — Development Services is in the process of
adjusting the public outreach strategy for the Denton Development Code project
(DDC 2030) in order to solicit additional public feedback and identify additional
stakeholder groups. The revised approach will demonstrate the City's commitment
to be more inclusive, transparent, and to effectively communicate with the public
on DDC 2030 matters. This method will allow Clarion and staff to take a fresh
look at best practices based on the most recent public feedback and new City
direction as they relate to development services.
Adjusting the public outreach strategy for the DDC 2030 project will allow the
City to build support for the update on a foundation of transparency and trust. Due
to the apparent concerns raised at recent public meetings about the project not
adequately providing two-way feedback, staff is focusing on stakeholder
engagement as part of the project "restart." This action will deliver an updated
Assessment Report and will provide greater feedback on all parts of the updated
code,with a focus on the development review processes. Staff expects the outreach
to be completed and the updated Assessment Report to be delivered by November
30. Simultaneously, staff will be working to implement the process improvements
required to complete the Administration and Procedures module. The project is
expected to be finalized and presented to Council in spring 2018. Staff contact:

D. Small Area Plan—The consultants preparing the Small Area Plan are wrapping up
their work associated with Phase 1: Inventory and Database Development, which
includes two series of stakeholder interviews and a public outreach plan. The next
phase of the project is Phase 2: Community Assessment/Analysis, which will
include a public workshop and an open house. Before the next phase, a steering
committee needs to be established. Staff will establish the committee utilizing
nominations from Council. After the steering committee is formally established,
staff will hold the first committee meeting, which is tentatively scheduled for

E. Public Open House for Mockingbird Reconstruction—There will be a Public Open
House on Wednesday, October 18 regarding the construction on Mockingbird
Lane scheduled to begin October 23. Staff from the City and Lane Construction,
the contractor completing the work,will be available from 6 to 8 p.m. at the Civic
Center to answer questions about the project. Crews will be reconstructing
Mockingbird Lane between McKinney and Paisley streets, and between Audra
Lane and Newport Avenue. Please see the attached notice that was mailed. Staff

F. 24-Hour Medical Facility Status —Please see the attached memo from the Legal
Department regarding the status of 3111 Teasley Ln. Staff contact: Aaron Leal
G. Upcoming Public Hearings—Public Hearings are scheduled for Tuesday, October
24 for City Council to receive comments and consider adoption of amendments to
the proposed Perimeter Street Paving Guidelines and amendments to the Water
and Wastewater Design Criteria Manual. The Public Hearings were advertised in
the Denton Record Chronicle on October 9 and will be posted on the City's
website. An email will also be sent to the eTRAKit database and the Denton
Community Development Alliance (DCDA) membership, advising them of the
Public Hearings and how to access the proposed documents.
The proposed Perimeter Street Paving Guidelines,which will be an amendment to
the Transportation Design Criteria Manual, were presented to Council in a work
session on September 12, 2017. At the end of that discussion, Mayor Watts asked
for the Perimeter Street Paving Guidelines to be presented at a Council Public
Hearing in lieu of the normal process for amending the City's Design Criteria
Manuals. Staff has met with key members of the DCDA on at least four occasions
to discuss and revise the proposed Perimeter Street Paving Guidelines based on
their input. The guidelines are being developed in accordance with the Roadway
Impact Fee Ordinance (Ord. No. 2016-189) to provide City staff direction on
administering Perimeter Street Paving requirements and allocating credits for
required Perimeter Street improvements toward the Roadway Impact Fees due
from the development.
The proposed amendments to the Water and Wastewater Design Criteria Manuals
have followed the Denton Development Code (DDC) process for amendments to
Criteria Manuals, which involves a presentation to the Planning and Zoning
Commission in a work session for suggestions and recommendations; posting the
proposed amendments on the City's website and at City Hall for a 30-day public
comment period; and resolving all protests or requests for review and considering
all comments. In addition to the DDC requirements,notices of the public comment
period were emailed to the development community members who have applied
for permits with the City through its online system; a comment meeting was held
with the development community; the revised amendments, resulting from
comments received, were posted for an additional seven-day public comment
period,with notices emailed to the development community; and the amendments
were finalized based on the comments received from that second comment period.
In lieu of adopting the proposed amendments administratively, as allowed by the
DDC, the proposed amendments are being presented to Council at a Public
Hearing for public input and adoption by the Council. The amendments have been
developed to update the current manual, which is dated February 20, 2002.
The City's Construction Criteria Manual is currently being updated, having been
presented to the Planning and Zoning Commission and posted for 30-day public
comment. Revisions are being made to the original proposed amendments, based
on numerous comments received. After those revisions are made, the revised
amendments will be posted for a seven-day public comment period and then
presented to the Council at a future Public Hearing and adoption.
The City is just beginning to develop amendments to its Drainage and
Transportation Design Criteria Manuals. Staff contact: Galen Gillum/John Davis
H. City Staff Supporting Unique International Student Exchange Program — On
October 17 and 18, students from Universidade Estadual de Ponta Grossa,Parana,
Brazil will tour the City's water and wastewater treatment plants to learn about the
environmental impacts of ammonia in water supply sources, its effects on the
water treatment process, and the availability of water for human consumption. The
tours are part of a unique graduate study-abroad program through a partnership
between Universidade Estadual de Ponta Grossa and Texas Woman's University.
The grant supporting this program is provided by the 100,000 Strong in the
Americas Innovation Fund, a public-private sector collaboration between the U.S.
Department of State, Partners of the Americas, and NAFSA: Association of
International Educators. The group, which will be joined by students from Texas
Woman's University, will also tour ECO-W.E.R.C.S. Resource Recovery Park
and other local plants.
Following the visit,Kathy Gault,the City's water treatment regulatory supervisor,
will travel to Brazil to give an educational presentation to graduate students in the
Environmental and Sanitary Engineering program at Universidade Estadual de
Ponta Grossa. The grant will cover all costs associated with staff's travel. Staff

I. Parks and Recreation Updates—Please see below a couple updates:
• Downtown Square — Due to the replacement of traffic signals on the
Square, as mentioned in last week's Friday report, the Park Maintenance
crews will be required to shut off water to the flower pots, therefore,
preventing the planting of new flowers.
• Water Works Park- In response to information requested on the number
of promotions marketed and the number of discounts redeemed associated
with the promotions after the opening of the wave pool at Water Works
Park, the following is provided:

The Library's Summer Reading Challenge, formerly the Summer Reading
Club, rewarded 1,596 participants with an invitation to their Water Park
Party as an incentive for submitting reading logs. Approximately 1,477

J. Citizen's Police Academy — The current Citizen's Police Academy Class began
on September 25 with 20 citizens enrolled. The Citizen's Police Academy(CPA)
is a long-standing program with the first class graduating back in September 1992.
Approximately 450 citizens have attended and graduated from the CPA.
It is a 12-week program designed to open the lines of communication between the
Denton Police Department and the community. It is the sincere desire of the
Denton Police Department to develop a style of policing that reflects a
collaborative effort between the community and police. This process requires an
informed citizenry, and it is the goal of the CPA to increase "Understanding
through Education."
The curriculum is intended to provide a comprehensive overview of the
operational dynamics of the Denton Police Department and the critical role
citizens play in our community crime control efforts. Each class is given by police
officers who actually work every day in the job area they are presenting. For
example, school resource officers (SRO) will discuss the SRO program and its
effects on our children. Traffic officers will discuss their role in enforcing the
traffic laws and reducing the number of accidents in the city. Detectives will
discuss the types of offenses that occur in Denton and their role in investigating
those crimes.

Classes meet one evening per week for 12 weeks at the Police Department training
facility and are conducted at no cost to the participants. Any citizen who lives,
works, or is a student in Denton and is 18 years of age or older is eligible to sign

III. Community Events
A. Stream Clean 2017 — Stream Clean, Denton's fall cleanup event, targets specific
waterways in and around Denton to improve the appearance of our city and impact
our quality of life. The event will be held this Saturday, October 14 from 9 to 11
a.m. with the event headquarters located at City Hall. About 500 volunteers have
pre-registered for the event, including local scout troops and groups from Denton
ISD, the University of North Texas, and Texas Women's University. Volunteers
may also register the day of the event between 8 and 8:45 a.m. Staff contact:

B. 2017 Neighborhood Empowerment Summit—On Saturday, October 14, between
9 a.m. and 1 p.m. at the MLK, Jr. Recreational Center, the City will host the 2017
Neighborhood Empowerment Summit. A total of 52 participants have registered.
The Summit will feature presentations and tables with lots of information on how
to improve the quality of life in neighborhoods. This year's Summit includes
presentations on sustainability, increasing tree canopy, successful grant projects
presented by past applicants, and a workshop on how to apply for a Neighborhood

C. Denton County Landlord Forum—On Wednesday, October 18, a Denton County
Landlord Forum will be held from 9 a.m.to noon at CoSery for landlords,property
managers, real estate professionals, housing providers, and community members
to learn about current efforts to address homelessness and housing insecurity in
Denton County. Attendees will hear from local service providers and the various
assistance programs throughout the community.
A partnership opportunity will also be launched to increase access to housing
throughout the county. "Doors for Denton County" is a collaborative initiative of
the Denton County Homelessness Leadership Team, which seeks to connect the
nonprofit and low-income housing community with landlords and property
managers to increase access to housing for Denton County citizens.
This event is free and open to the public. If you plan to attend, please register for

NOTICE OF PUBLIC MEETING
Dear Resident or Property Owner:
The City of Denton will hold a Public Open House on Wednesday, October 18 regarding the
construction on Mockingbird Ln. between McKinney St. and Paisley St., and between Audra Ln.
and Newport Ave. (see attached map).
The Open House will be held from 6:00 p.m. to 8:00 p.m. at the Civic Center at 321 E.
McKinney St., Denton, Texas 76201. Information will be displayed, and staff will be available
to discuss the project and answer questions. No formal presentation will be made, and you are
welcome to come and go at your convenience.
Construction is scheduled to begin on October 23. Weather conditions and contractor scheduling
may impact the plans, but we hope to have the project completed by February 20, 2018.
This project is a reconstruction of Mockingbird Ln. The work is being completed by Lane
Construction for the City of Denton. It will include damaged curb replacement, valley gutter
installation, nine (9) inch milling of the asphalt, subgrade treatment, and placement of new nine
(9) inch asphalt surface. The reason for this project is due to deteriorating condition of the
asphalt and subgrade.

SUBJECT: Status Report on 3111 Teasley Lane (24 Hour Medical Facility)
Background:
During 2006,the property at 3111 Teasley was rezoned from Neighborhood Residential 2
to Neighborhood Residential Mixed Use with an overlay district. Ten years later,July 2016, a pre-
development meeting request was submitted to discuss development of medical offices. In January
2016, the developer submitted its Amending Final Plat Checklist. On April 6th, Development
Services approved the Amending Final Plat and a May 19t' Pre-Construction Meeting with the
developer was scheduled. Leading up to the spring of 2017, the project, as presented by the
developer, remained"medical offices."
On May 23`d, Mr. Coleman submitted a letter raising issues with the Code 3 ER
development, including that it was a hospital that planned to operate on a 24-hour basis. After
receiving the City's Development Services Director response, Mr. Coleman shared their
disagreement with the City's position and that they would consider their options.
On July 15th, Charlie Parker sent staff an email sharing, "It's my hope that we can resolve
this informally and avoid the effort of filing a formal appeal. I have attached a draft of the appeal
we have prepared as a reference." In the days that followed, staff met with Mr. Parker to discuss
the concerns he raised which were similar to Mr. Coleman.
The Development Services Director drafted an official response to the concerns raised by
Mr. Parker on July 19th. On July 24th,Mr. Parker acknowledged in an email, "Thanks for passing
this along to me. I'm out of town at the moment, but I'll get with my neighbors to see how we'll
proceed on this."
In a letter dated September 5, 2017 by Mr. Parker and the members of Concerned
Neighbors in Hunter Ridge,the group filed their official appeal to the City's Board of Adjustment.

A. Analysis
1. Section 35.3.7 (A)(4) of the DDC states that staff may"make determinations regarding the
appropriate designation for new and unlisted uses based on similar uses that are described." After
reviewing emails, documents and interviewing various employees at the Development Services
Department, it was apparent that Munal Mauladad,Development Services Director,was asked and
did make a determination regarding a designation for a new and unlisted use based on similar uses
that were identified in the DDC at the time. There was no indication that the Director acted outside
of her authority as it relates to 3111 Teasley Lane.
2. Residents that disagree with these determinations have the right to submit an appeal to the
Zoning Board of Adjustment. The procedure for such appeals are governed by Sec. 35.4.2.1(D)
the DDC, which requires that each appeal "shall be submitted to the Planning and Development
Department within fifteen (15) days after the decision has been rendered."
In this case, even if the City considered the Director's letter dated July 19th (and received
by Mr. Parker on July 24th) as the triggering date of determination (and not some previous
correspondence), Mr. Parker's letter of appeal, dated September 5, 2017, unfortunately still falls
outside of the fifteen (15) day filing period to submit an appeal.
B. Lessons Learned and Actions Taken following Teasley Lane:
In an attempt to ensure that the circumstances surrounding Teasley Lane do not reoccur in
future developments, a DDC amendment was recently enacted that creates a special classification
for 24 hour medical offices.
In addition, staff will be presenting another DDC amendment that will give residents within
200 feet of a development impacted by a 35.3.7 determination a formal written notice of such a
decision. The notice will also advise the recipients of their opportunity to appeal the determination
to the Board of Adjustment.
Although the circumstances and issues raised were properly addressed under the DDC at
the time, going forward, staff believes that these two revisions to the DDC will improve
communication and transparency between city staff and residents and prevent a similar situation
from happening again.

After determining that a quorum is present, the City Council of the City of Denton, Texas will convene in a

Following the completion of the Closed Meeting, the City Council will convene in a Special Called Meeting to
consider the following items:
1. ITEMS FOR INDIVIDUAL CONSIDERATION
A. ID 17-513 Consider adoption of an ordinance authorizing the City Manager, or his designee, to
execute an agreement for Energy Trading Risk Management (ETRM) software with the
vendor selected in accordance with the City's competitive bidding process.
B. ID 17-610 Consider adoption of an ordinance authorizing the City Manager, or his designee, to
execute an amendment to the Energy Trading Risk Management Contract with
ABB/Ventyx.
C. ID 17-1168 Consider recommending approval of an ordinance of the City of Denton, Texas
authorizing the City Manager, or his designee, to execute Mutual Confidentiality
Agreements by and between the City of Denton, Texas and outside organizations; to
ensure Denton Municipal Electric (DME) operates in the public's best interest and
complies with legal obligations;providing an effective date.
2. PUBLIC HEARINGS
A. A17-0005b Hold the second of two public hearings for a voluntary annexation of approximately 73.47
acres of land generally located north of Long Road and west of FM 428 by the City of
Denton,Texas.
B. ID 17-1435 Hold a public hearing and consider adoption of an ordinance of the City of Denton,
Texas, regarding amending the City's Transportation Design Criteria Manual to include
Guidelines for Perimeter Street Paving; providing a severability clause and an effective
date.
C. ID 17-1436 Hold a public hearing and consider adoption of an ordinance of the City of Denton,
Texas, regarding amending the City's Water and Wastewater Design Criteria Manual;
providing a severability clause and an effective date.

A. Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the City Council
