Pending Council Requests Work Session Topics – Pursuant to Ordinance No. 21-1837, the following items will be discussed during the Feb. 6 Council Work Session: 1. Request for a medium priority work session to discuss the feasibility of an opt-in Community Benefits Ordinance that would provide a fast-track approval process for developers with signed Community Benefits Agreements. Controlled Burn at North Lakes Wildflower Trail – On Jan. 31, the Fire and Parks and Recreation Department conducted a strategic burn within a 22-acre section of North Lakes Park near the Wildflower Trail open space. Staff was able to burn approximately 75% of the 22-acres. There were no injuries, complaints, or calls to Dispatch. The burn was deemed a success with the help of National Weather Service Ft. Worth, Denton Police Department, Dispatch, Animal Services, Sustainability, Marketing and Communications/DTV, and Chief Officers. City Auditor’s Office Fiscal Year 2023-24 First Quarter Report – The City Auditor’s Office’s Quarterly Reports are intended to provide the City Council and the public with a status update on the Annual Internal Audit Plan and Recommendation Follow-Up Status. Additional items of note this quarter include the annual Auditing Standards Continuing Professional Education Compliance Report. The full First Quarter Report can be seen on the Internal Audit Website. The full Fiscal Year 2022-23 Fourth Quarter Report can also be seen on the Internal Audit Website and includes the Annual Auditing Standard Compliance Report and the annual City Auditor’s Office Strategic Plan Performance Report. Department Performance Scorecards – To bolster transparency and inform the community about work being done across the organization, Strategic Services is pleased to release the Denton Enterprise Airport’s performance scorecard, which can be found on the City’s Strategic Plan Dashboard under “Other Plans and Data”. These scorecards are developed as part of performance workshops aimed at helping departments create a purpose statement, identify core services, and develop a family of measures to effectively evaluate defined services. Data visualizations are then created to tell the department's story, shine a light on needs, share achievements, and serve as an asset in the decision-making process. The Airport’s scorecard highlights metrics related to core services including providing a safe and secure airport and managing airport facilities and infrastructure. Additional data is shared to demonstrate the Airport’s support for the local economy and position amongst the top 10 busiest airports in Texas. Staff contact: Aimée Kaslik, City Manager’s Office 2 E. Monthly Mobility Report – Innovative Transportation Solutions (ITS) provided a monthly report which includes an overview of several major regional Texas Department of Transportation (TxDOT) projects. Department of Solid Waste and Recycling Electric Truck Pilot – Over the next three weeks, the Solid Waste and Recycling Department (SWR) will test the viability of an electric truck. If proven effective, the City will explore integrating additional electric collection vehicles into the SWR fleet. Peterbilt’s electric truck is designed to handle residential refuse collection, accommodating 1,000 carts worth of contents with the ability to travel approximately 120 miles. During the pilot period, SWR will gather data on the truck’s performance to assess its efficiencies and ability to meet SR’s service needs. Parvin Street Excess Vehicles Speeds – On Jan. 17, Council Member Watts forwarded a resident’s concern regarding drivers exceeding speed limits near Azalea and Parvin Street. Staff visited the site and analyzed the overall traffic flow. Factors affecting traffic flow include road closures for work zones, absence of sidewalks, lack of ADA compliance, and missing striping and signage. Staff recommends adding sidewalks to both sides of Parvin Street, treatments for ADA compliance, and improving roadway striping and signage. Staff is coordinating an effort to implement these recommendations. Staff contact: Scott McDonald, Development Services B. Community Benefits Ordinance Response – On Jan. 22, Council Member Meltzer submitted a two-minute pitch request for a work session to discuss the feasibility of an opt-in Community Benefits Ordinance that would provide a fast-track approval process for developers. The attached memo provides additional background information regarding development review processes, which was not included in the Informal Staff Report provided on Jan. 12, 2024. Bell/Mingo Intersection – On Jan. 29, Council Member Byrd asked for an update regarding the construction occurring at the Bell/Mingo intersection. and its relation to the improvements included in the 2023 Bond. The work at this location is currently being completed by Atmos Energy. The Mingo Bell Improvements included in the 2023 Bond are anticipated to begin design in Q2 of 2024. Staff contacts: Trevor Crain and Wesley McBride, Capital Projects 3 D. Railroad Quiet Zones – On Jan. 29, Council Member Byrd forwarded a resident’s email regarding the need for railroad quiet zones. The City currently has two Quiet Zone Projects: • The Downtown Union Pacific Railroad (UPRR) Quiet Zone Project, initiated by the City in 2019, is in its final design stage. The project will provide the required improvements to the at-grade UPRR crossings at McKinney, Hickory, Sycamore, and Prairie Streets, as well as the Denton County Transportation Authority (DCTA) at-grade crossings at Sycamore and Shady Oaks Streets. These improvements will bring each crossing in compliance with the railroads’ quiet zone criteria, allow for the removal of existing wayside horns, and prohibit Train Engineers from routinely sounding their train horn in advance of each crossing. However, should an engineer observe a conflict near the tracks, they are required to sound their horn to provide proper warning. Currently, the City anticipates beginning the construction solicitation in Q2 2024, construction in Q3 2024, and construction completion by Q3 2025. • The Mingo-Ruddell Quiet Zone Project includes the widening of Ruddell/Mingo between Bell Ave and US 380-University Drive, including required improvements to the existing at-grade rail crossings at Mockingbird Lane, Nottingham Drive, a private crossing, and Frame Street. This project is estimated to begin in Q2 2024, with construction anticipated to be completed by Q4 2027, dependent upon submittal review and approval by UPRR. Jannie Street Construction – On Jan. 29, Council Member Byrd forwarded a resident's email inquiring about an estimated start date for construction on Jannie Street. The Oakland Drainage / Neighborhood 5B Project, which includes Jannie Street is part of the 2019 Bond Program. The project is currently in the design phase and construction is expected to start in Q1 of 2025. Staff contact: Trevor Crain, Capital Projects F. Graffiti at Lake Forest Park – On Jan. 29, Mayor Hudspeth forwarded a resident's concern to inspect potential vandalism at Lake Forest Park. Staff conducted an inspection and found 40 rocks of different sizes with random paint graffiti along the trail. The rocks, ranging in size, were either removed from the trail or had the paint removed by staff. Staff contact: Russell Koch, Parks and Recreation G. Pending Multifamily Developments in Denton – On Jan. 30, Mayor Hudspeth requested a list of multifamily developments in the city, both pending and in construction phase. There are currently 2,236 units (11 projects) in review with Building Safety and 4,314 units (20 projects) under construction. Connection will be an at-grade, signalized intersection. • The Loop 288 alignment from Kings Row to I-35 is being modified to provide a direct connection to both sides of Loop 288. Westwood met with City of Denton to review proposed alignment and to elicit feedback. City of Denton was favorable to Windsor Road extension and agreed to provide capital funding to construct extension. • Anticipate meeting with Southwire Development to discuss proposed improvements impacting site. • Project to be terminated at Geesling Road to minimize US 380 impacts per Denton County direction. • Noise wall locations are being added to schematic. • Second public meeting to be held in second quarter of 2024, possibly April 2024. Past Experience: During 2019, the City of Denton offered a “fast pass” option for expedited review of development applications. Applicants were allowed to pay a higher fee in order to have their application review expedited; this process was available for administrative-approved applications only (i.e. civil engineering plans, zoning compliance plans, and certain plats). This process was discontinued shortly thereafter in 2020 due to vesting concerns and the process not working effectively. Staffing levels were not able to support the expedited process, developers provided feedback they did not want to pay 1.5 times the amount of the normal application fee, and there was inequity amongst projects being reviewed due to this “pay to play” option. Four projects were processed during that time when the expedited review option was available. Current Experience: The Texas Local Government Code dictates performance time obligations that cities must adhere to when reviewing development plans (i.e. civil engineering plans and plats). Staff continuously works to refine the City’s development review processes so that customers receive an efficient experience, and that projects are being reviewed following state statutes while satisfying the City’s development requirements. The timelines in which cities must perform currently provide a fast turnaround, such as 15-day review following denial, thereby not offering incentives to developers to participate in a presumably shorter process. One consideration is benefits gained from the City’s review may not off-set the amount of time spent negotiating with community organizations and neighborhood groups. Additionally, shortening review times beyond those already dictated by state law, could have an unintended consequence of potentially compromising the quality of staff’s review for compliance with the City’s development requirements particularly for more complex development projects. 28 Page 2 of 2 The following 2023 data below illustrates the total number of civil engineering plans, final and preliminary plats, and zoning compliance plans processed by the City, and the average number of days for processing these application types from initial application submission to approval including the number of days spent with staff in review. It is important to understand that state statutes can only regulate the number of days in which the City must respond; there are no time obligations assessed on applicants. For preliminary and final plats, the amount of time spent with staff is approximately one-fourth of the overall application timeline (26% and 27% respectively). Based on current conditions, staff does not recommend a “fast-track” option for developers who choose to opt-in to a community benefits agreement based on past experience with a similar process coupled with current regulatory statutes.
