General Information & Status Updates
A. Small Business Relief Grant Program Update – The Small Business Relief Grant
program provided funding to eligible small businesses to support recovery from the economic impacts of the COVID-19 Pandemic. The grant program was funded at $2,000,000 through the City’s allocation of American Rescue Plan Act (ARPA) funding. Thirty-seven businesses were awarded grants totaling $913,700. The
remaining ARPA funds were reallocated to support Negative Economic Impact
programs, as outlined via ISR 2023-003 (attached) on January 6, 2023. The grant program and reporting were completed on July 31, 2023. All businesses were able to remain open throughout the grant program period. Thirty-five businesses reported they were able to support and maintain long-term business operations and two businesses
reported that their grant helped them to return to pre-pandemic revenues and staffing.
The allowable uses of the grant funds were personnel costs and benefits, payment of rent or mortgage expenses of business space, fees paid for professional services such as vendors, consultants, tax assistance, etc., equipment purchases for long-term use, supplies for short-term use, and construction of health and safety related building

B. City Website Disability and Accessibility Integration Tool – On Tuesday, Feb. 27, the City’s website will incorporate a disability and accessibility feature to make our public-facing platform more digitally inclusive. The seamless integration makes the City’s
online content more accessible without sacrificing design or functionality. New
features include reading aids, multi-language translations, and customizable screen readers. A small icon will be visible on the site and visitors can access the features by using an optional toolbar. Staff contact: Dustin Sternbeck, Chief Communications Officer
Responses to Council Member Requests for Information
A. Neighborhood Association List – On Jan. 29, Mayor Pro Tem Beck requested a list of
neighborhood associations and HOAs. The Community Services Department maintains
the available information on neighborhood organizations, shown on the attached list and this GIS map. The list is updated annually, or as new information is provided. Staff contact: Joshua Ellison, Community Services
B. Online Speaker Sign-Up System – On Feb. 12, Mayor Pro Tem Beck and Council
Member Meltzer forwarded a request from a resident for the city to consider implementing an online speaker request system for public meetings. Staff are currently scoping this project to determine the feasibility of implementation. Staff contact: Jesse Kent, City Manager’s Office
C. Business Interruption Coverage – On Feb. 15, Mayor Hudspeth requested that staff contact a business owner regarding disruption from road construction. D. Property Sale Opportunity – On Feb. 16, Mayor Pro Tem Beck forwarded a resident’s inquiry about City interest in purchasing their family property for City use. The inquiry
was directed to appropriate staff for follow-up. Staff contact: Michael Gange,
Environmental Services and Sustainability E. Business Property Condemnation – On Feb. 20, Council Member Meltzer forwarded a request for assistance from a business owner regarding her land being condemned by
Atmos. Staff reached out to the business owner and to Atmos to better understand the
issue and left contact information after being unable to reach either party. Although the City is always available to help residents understand land use issues, generally the City is not able to restrict the eminent domain rights of other legal entities. F. Contract Rates – On Feb. 20, during the City Council Meeting, Council Member Watts requested information on the rate structure of the City’s professional services agreement related to HR Green. SUBJECT: American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds (SLFRF)
EXECUTIVE SUMMARY: The City of Denton was allocated $23.29 million in federal aid across two years. The first
payment of $11.645 million was received in June 2021 and the second and final payment of $11.645 million was received in June 2022. City staff continues to administer programs created under the first tranche and develop projects approved during the FY 22-23 budget adoption for the second tranche. The reallocation of remaining funds from completed projects and new
allocations from the second tranche will fund and support areas identified as essential for
continued recovery and meeting the objectives outlined by ARPA – SLFRF, as defined below.
DISCUSSION: On March 11, 2021, the American Rescue Plan Act (ARPA) was signed into law and established
the Coronavirus State Fiscal Recovery Fund and Coronavirus Local Fiscal Recovery Fund also
known as the Coronavirus State and Local Fiscal Recovery Funds (SLFRF) program. The purpose of SLFRF is to provide support to State, territorial, local, and Tribal governments in responding to the economic and public health impacts of COVID-19 and in their efforts to contain impacts on their communities, residents, and businesses.
The City of Denton was allocated $23.29 million in federal aid across two years. The funding is delivered in two tranches, or payments, no later than 12 months apart. Half of this funding ($11.645 million) was received by the City in June 2021, and the remaining half became available in June 2022. In the Final Rule, the Treasury Department encourages recipients to
adapt to new developments that arise during the twelve-month period, including changes in the
public health emergency and negative economic impacts. Programs funded under the first round of funding were developed based on staff recommendations, City Council prioritization of funding categories, and citizen input. Approved
projects were included in the Fiscal Year 2021-2022 budget adoption. Highlights include:
• Loop 288 Building – A total of $5 million has been used towards the construction of the Loop 288 building to provide comprehensive services to individuals and families
experiencing homelessness.
• Behavioral Healthcare Services Grant – Four (4) grants totaling $895,000 were awarded to healthcare service providers aimed at increasing access to services for City of Denton residents in at least one of three priority areas: youth mental health services, adult mental health services and substance use treatment services. The focus is to increase access to
services for underinsured and/or uninsured individuals and families.
• Non-profit Capacity Support – Seven (7) grants totaling $550,000 were awarded to non-profits aimed at providing support to non-profits whose services and programming were directly impacted by COVID. Focus is on long-term sustainment of operations.

• Small Business Rent and Mortgage Relief Grant - Awards to 37 small businesses totaling $913,700 were made to provide relief to small businesses who demonstrated an economic
loss associated with COVID. The focus is on long-term sustainment of operations.
• Street Outreach Expansion – A Caseworker and Paramedic have been added and dedicated to Street Outreach operations providing direct assistance to individuals experiencing homelessness. Additionally, a vehicle has been purchased for the Police
Department to be used in responses.
• Facility Modifications – Modifications and improvements to City facilities that promote public health by mitigating the spread of COVID have been made totaling approximately $395,500.
• Emergency Management Program Manager – The position within the Fire Department’s Emergency Management Division has been reinstated with expanded duties related to public health initiatives.
• Administrative Costs – The City has acquired and implemented a grant management
system that is currently being used to manage the three grant programs created using SLFRF. In preparation of the second payment, staff assessed the current phase of the pandemic recovery to determine new and on-going needs. The following areas were identified as essential for
continued recovery and meeting the objectives outlined by ARPA – SLFRF:
• Temporary Alternative Housing
• Non-profit Capacity Support
• Public Safety Equipment
• Park and Recreation Projects
The reallocation of remaining funds from completed projects, such as the Small Business Relief
Grant program and Public Communication Software and addressed needs like COVID Vaccination Support will help fund these areas. Additionally, new allocations from the second tranche will provide support.
An update on ARPA was presented to City Council during budget discussions and projects under
the second tranche were approved with the FY 22-23 budget. All programs and allocated budgets funded by SLFRF are outlined in Exhibit 1. All costs must be incurred or obligated by December 31, 2024. The period of performance will run until December 31, 2026, at which time all projects must be completed.
CONCLUSION: Staff will continue to administer and monitor SLFRF programs with updates provided to City Council quarterly.

City’s Debt Summary Report (FY End 2023 Outstanding Debt)
BACKGROUND:
Attached is the Debt Summary Report with principal and interest outstanding as of September
30, 2023. This report is prepared on an annual basis to provide residents with a comprehensive
and easy to understand summary of the City’s debt profile. Additionally, this report includes
required information in accordance with Texas Local Government Code 140.008 (House Bill
1378).
The report provides a high-level introduction to the types and uses of debt issued by the City as
well as the most recent bond ratings. Staff has differentiated between tax-supported and revenue-
supported debt to give the public a better understanding of which debt is paid for by property
taxes versus rate revenues. Furthermore, the report details the principal and interest for each
major service area of the City and provides two visual representations by dollar amount and
percentages.
This Debt Summary Report is provided annually to City Council for feedback.
CONCLUSION:
If no feedback is received within a week, staff will post this report on the City’s website for the
public the week of March 4, 2024. The report is intended to be updated annually in conjunction
with the City’s fiscal year end.

INTRODUCTION
This report is divided into two sections. The first section (City Debt) presents the City’s outstanding debt by the manner in which the City intends to pay for such debt (tax-supported versus revenue-supported). Additionally, this section provides a breakdown of the City’s outstanding debt by purpose (General Government, Electric, Water, Wastewater, Solid Waste and Airport). The second section (House Bill 1378) is intended to comply with reporting requirements pursuant to Texas Local Government Code 140.008. The City of Denton utilizes long-term debt to finance non-operating expenses, which may include equipment, facilities, and the acquisition of land. The City generally issues debt for the purchase or construction of capital assets and infrastructure improvements and cannot issue debt to fund operating expenses or deficit spending. All debt issued by the City must be approved by the Texas Attorney General’s Office prior to the final sale of the debt. Additional information on the City’s outstanding debt including statistical comparisons and ratios can be found in the City’s Annual Financial Report, which is located on the City’s website under the Finance Department. The City issues two types of long-term debt: General Obligation Debt and Revenue Bond Debt. The City also differentiates between tax-supported and revenue-supported debt to provide the public with a clear
understanding of which debt will be paid by property taxes versus rate revenues. The following table shows the latest bond ratings for each type of debt for which ratings are given:

GENERAL OBLIGATION DEBT: The largest category of debt is General Obligation Debt. It consists of two categories of bonds:
General Obligation Bonds (GOs) and Certificates of Obligation (COs).
GOs are backed by the full faith and credit of the City (property tax pledge) and must be approved at an election. Voter approval may be granted during one of two general election dates each year. GOs which are
issued to refund outstanding debt do not require voter approval. Under the City’s debt policy, GOs strive to have a final maturity of twenty (20) years or less. COs do not require voter approval and generally have a dual pledge of a specific City revenue source as well as the full faith and credit of the City. Some examples of pledged City revenues are electric, water, wastewater, and drainage revenues. Under the City’s debt policy, COs will strive to have a final maturity of thirty (30) years or less. In 2010, the City began issuing COs not only for general government purposes which are repaid by property taxes, but also for utility related projects of the City. The COs issued for utility purposes are repaid from the specific utility fund for which the debt was issued. COs have a lower interest rate than revenue bonds, due to the pledge of full faith and credit of the City. A portion of the interest savings to the City’s utilities through issuing COs (instead of revenue bonds) is being applied to the Street Improvement Fund.

REVENUE BOND DEBT:
The second category of debt is Revenue Bond Debt. This debt is secured by only a pledge of the operating revenues of the City’s Electric, Water and Wastewater Funds (collectively known as the “Utility System”) and not the full faith and credit of the City. Under the City’s debt policy, revenue bonds will strive to have a final maturity of thirty (30) years or less. As of September 30, 2023, the City has the Utility System Revenue Bonds, Series 2017 and 2021’s outstanding.

Glossary of Terms
The HB 1378 Section of the Annual Debt Report contains terminology provided by the Texas Comptroller’s Office. To assist the reader of this document in understanding these terms, a glossary of terms has been included in the document as provided by the Texas Comptroller’s Office.
Political Subdivision. Political subdivisions are counties, municipalities, school districts, junior college districts, other special districts, or other subdivisions of state government.
Total Authorized Debt Obligations. Debt obligations are defined in the bill as issued public securities
which are instruments, including bonds, certificates, notes, or other types of obligations authorized to be issued by an issuer under a statute, a municipal home-rule charter, or the constitution of this state.
Issuance is the process of authorizing, selling, and delivering public debt. Public security authorization means a resolution, order or ordinance that is approved or adopted, or any other action taken in a
proceeding, by the governing body of an issuer in authorizing the issuance of a public security.
Total Principal of all Outstanding Debt Obligations. Total amount borrowed (par) of all obligations that
have yet to be repaid.
Combined Principal and Interest required to pay all Outstanding Debt Obligations on time and in
full. Total amount borrowed (par) that has yet to be repaid plus the cost of interest.
Total Authorized Debt Obligations Secured by Ad Valorem Taxation. Total debt obligations secured by a pledge of property taxes.
Total Principal of all Outstanding Debt Obligations secured by Ad Valorem Taxation. Total amount borrowed (par) of obligations secured by a pledge of property taxes that have yet to be repaid.
Combined Principal and Interest required to pay all Outstanding Debt Obligations secured by Ad
Valorem Taxation on time and in full. Total amount borrowed (par) of all property tax-secured obligations plus the cost of interest.
Total Authorized Debt Obligations secured by Ad Valorem Taxation expressed as a Per Capita
Amount. Total authorized debt obligations secured by a pledge of property taxes divided by the population of the political subdivision.
Total Principal of Outstanding Debt Obligations secured by Ad Valorem Taxation as a Per Capita
Amount. Total amount borrowed (par) secured by a pledge of property taxes divided by the population
of the political subdivision.
Combined Principal and Interest required to pay all Outstanding Debt Obligations secured by Ad
Valorem Taxation on time and in full as a Per Capita Amount. Total debt obligations secured by
a pledge of property taxes plus the cost of debt service on these obligations divided by the population of the political subdivision.

Glossary of Terms - continued
Population total used to calculate per capita figures. The denominator used to calculate per capita
figures. This is a population total for the political subdivision.
Source and Year of population figure used to calculate Per Capita figures. The source of population data comprising the denominator of per capita figures.
Outstanding Debt Obligation. An issued public security that has yet to be repaid.
Conduit or Component Debt. Debt that is not a legal liability of the political subdivision but is secured by
another entity.
Principal Issued. Total amount borrowed (par).
Principal Outstanding. Total amount borrowed (par) of obligation that has yet to be repaid.
Combined principal and interest required to pay each Outstanding Debt Obligation on time and in
full. The total amount borrowed (par) plus the cost of interest for each individual debt obligation or bond
series.
Final Maturity Date. The final payment date of individual debt obligation at which point all principal and interest will be paid off.
Secured in any way by Ad Valorem Taxes. Indicates which individual debt obligations are in part or whole pledged with property taxes.
Total Proceeds Received. Total assets received from the sale of a new issue of public securities.
Proceeds Spent. The portion of total proceeds received that have been spent.
Proceeds Unspent. The portion of total proceeds received that are remaining to be spent.
Official stated purpose for which the debt obligation was authorized. The reason for the debt issuance as defined in ballot language, if applicable, or the Official Statement.
Current Credit Rating. Existing rating given by any nationally recognized credit rating organization to debt obligations.

INFORMAL STAFF REPORT
TO MAYOR AND CITY COUNCIL
SUBJECT: Fleet Purchase Under Delegation of Authority
EXECUTIVE SUMMARY: In February 2024, the City utilized delegation authority approved by Ordinance 22-1269 to
purchase a total of two chassis for the Fire and Electric Department. These chassis replacements
were funded in the FY 22-23 Budget, and Fleet Services had been unable to locate replacements
through existing contracts due to market conditions. Fleet Services identified an opportunity to
purchase the two chassis at Ron Carter Chrysler Dodge Jeep Ram in Alvin, Texas, and was able
to act quickly, since the replacements aligned with the delegation authority requirements.
BACKGROUND:
In late 2019, the City began experiencing challenges in securing materials and supplies due to supply chain issues. Conditions worsened and began to affect several operational areas including Fleet Services. Vehicle lead times grew close to a year under the organization’s normal acquisition process. At times, vehicles and equipment become available through other avenues such as dealer
inventory, lease-to-own opportunities, and unclaimed allocations from non-contract Original
Equipment Manufacturer (OEM). Staff requested a Delegation of Authority for Fleet Services allowing the City to move quickly when opportunities present to procure vehicles or equipment outside the organization’s normal
acquisition process. On June 28, 2022, City Council approved Ordinance 22-1269 providing for
the delegation under the following conditions: 1) City Manager, or their designee, will be allowed to sign contracts or other required documentation with OEM suppliers to purchase a vehicle for a city utility or public safety
department (which cost that has been approved through the budget process) through the
following means: a) Fleet Services will review any available procured contracts (i.e., City of Denton contracts, cooperative contracts, and other City contracts with piggyback options). Fleet Services will
use such a contract if available. Once a contract is located, the City Manager, or their
designee, will be able to execute the appropriate documentation to purchase under the contract. b) In the event there is not a procured contract that can be used for the purchase, and the purchase is required to protect the health and safety of City of Denton residents, Fleet Services will work with the relevant utility or public safety department to prepare a declaration of emergency that
will detail why the purchase had to go outside of the normal process and how health and safety are at issue to be reviewed and approved by Purchasing and Legal.

c) In the event there is not a procured contract that can be used for the purchase, and the purchase is required to protect the health and safety of City of Denton residents, Fleet Services will work
with the relevant utility or public safety department to prepare a declaration of emergency that will detail why the purchase had to go outside of the normal process and how health and safety are at issue to be reviewed and approved by Purchasing and Legal. d) Fleet Services will provide a report to City Council in the Friday Report, or other appropriate method, regarding any vehicles purchased with this authority, the cost, any markup, or
discounts received, and a running total of each department’s vehicle budget as the funds are used. 2) This delegation of authority is time limited to the earlier of three years or when market conditions
return to normal.
DISCUSSION:
Chapter 791 of the Texas Government Code authorizes respective participating governments to
enter into agreements for the purchase of goods and services. The Agreement allows both entities to utilize contracts for goods and services competitively solicited by the other party to the contract. The solicitation process followed by both entities meets all statutory procurement requirements per Local Government Code 271.102.
