Bell Avenue Repairs – As of noon on Friday, Apr. 26, Bell Avenue repairs from Sycamore Street to Eagle Drive are complete, and the road is fully open. Staff contact: Scott Fettig, Capital Projects B. LCR Inventory Project Communications – Water Utilities field crews will begin service line inventory collection on Monday, May 6 in response to the Environmental Protection Agency (EPA) Lead and Copper Rule (LCR). Collection will continue through October. For additional information, view the attached investigation letter and roadmap, visit the City’s website, or view an explanatory video on the City’s YouTube channel. City Council Priorities Update – The City Manager’s Office is pleased to provide an update on Council priorities. The attached report shows progress through the second quarter of the fiscal year. Monthly Mobility Report – Innovative Transportation Solutions (ITS) provides a monthly report which includes the overview of several major regional Texas Department of Transportation (TxDOT) projects. DTV Video Highlights for April – In addition to producing public meetings, DTV released several videos this month that raise awareness, educate, and inform our community. The following are highlighted videos Council is encouraged to share: • Testing Denton’s Waterways YouTube Once a quarter, the Watershed Protection Team conducts its lentic sampling on the ponds and lakes around Denton. • A Father and Son Experience the Eclipse YouTube Facebook The gravitational pull between a father and son during the historic April 8th eclipse. • Pleasant Hill Quilters YouTube Facebook The Pleasant Hill Quilters from Linden, Texas visit students at Tomas Rivera Elementary. New Cricket Grounds Pilot Project – The Parks and Recreation Department will open two cricket grounds at 4340 Country Club Rd. as a pilot project. The Dallas Cricket League (DCL) and the North Texas Cricket Association (NTCA) will share the fields on Saturdays and Sundays starting Saturday, May 4. This project supports a recommendation for two cricket fields from the Parks, Recreation, and Trails System Master Plan. Staff plan to establish instructional cricket clinics Fall 2024. On-Site Septic Facilities (OSSF) – On Apr. 15, Council Member Meltzer forwarded a resident’s concern regarding regulations and requirements and seeking a variance. Staff communicated with the resident directly. On Site-Septic Facilities (OSSF) are regulated by Texas Commission on Environmental Quality (TCEQ). The City of Denton is an authorized agent of TCEQ and issues permits for OSSF. Like other professional trades, persons that perform as an OSSF evaluator, installer, or designer are required by the State to meet the rules and regulations that govern their trade. The City’s role is to confirm that the sanitarian/engineer who submits the plan meets the City and State permit requirements. The licensed professional is responsible for the design or build of an OSSF system that meets the minimum requirements as set forth with the TCEQ Title 30 of the Texas Administrative Code, Chapter 285 and the City of Denton OSSF permitting requirements. Panhandling Policies – On Apr. 23, Mayor Hudspeth forwarded a resident’s concerns regarding panhandling and unhoused population camping in front of local businesses. Staff communicated with the resident to provide an overview of the City’s aggressive solicitation ordinance, homeless and affordable housing initiatives, and how to report issues through the Engage Denton application. Staff contact: Dani Shaw, Community Services C. Status on Narcan Initiative – On Apr. 23, Council Member Meltzer requested a status update on the Narcan initiatives. Narcan is available in the city monitored AED cabinets. Training content for staff is under development. Recovery Resource Council (RRC) collaborating to confirm their engagement for education and distribution of materials at city sponsored events with an estimated attendance in excess of 3,000. King’s Way Construction Outside Work Hours – On Apr. 23, Mayor Pro Tem Beck forwarded a concern from residents regarding the development contractor performing construction outside of permitted working hours in the King’s Way subdivision. The contractor was observed working outside the allowable hours and has been issued a stop work order. Staff contact: Wes McBride, Public Works Inspections E. Sidewalk Repair Request – On Apr. 24, Council Member Holland forwarded a request from a resident regarding the repair of a sidewalk trip hazard in the Ryan Ranch neighborhood. Staff performed a field visit and found that repairs are needed to sidewalk panels and ADA ramps in the area. Staff is working with the City’s concrete contractor to schedule these repairs and expects repair work to begin within the next six weeks. Staff contact: Ethan Cox, Streets F. The Reserve at Creekside Semi-Truck Route – On Apr. 24, Council Member Holland forwarded a request from a resident regarding semi-trucks driving through The Reserve at Creekside neighborhood. . A stop work order for the site has been issued. A Notice to Proceed may be issued once the contractor is in compliance with the City’s Ordinances. Water Pressure Concerns for Business– On Apr. 24, Mayor Hudspeth forwarded a request from a business owner regarding a business not receiving sufficient water pressure. Staff 3 investigated and determined that the water pressure at the site exceeds TCEQs minimum threshold of 35 pounds per square inch (psi). The site is presently at 56 psi. Staff contact: Stephen Gay, Water Utilities Intergovernmental News State: The Texas House Select Committee on Artificial Intelligence & Emerging Technologies (AI/ET) will meet on Monday, Apr. 29 at 10:00 a.m. to hear invited and public testimony on the following subjects: • Examining the current state of artificial intelligence and emerging technologies and its uses by private actors in a modern society. • Determining the impact of the application of artificial intelligence and emerging technologies on various sectors of society. • Identifying policy considerations necessary to ensure the responsible deployment of artificial intelligence and emerging technologies. In our initial investigation which included construction records and previous service line repair records, we were not able to identify your service line material. This work will require the following steps: 1. Hand digging small holes around the meter to view and identify the material type on both the utility’s and public’s side of the meter. Excavation using water may also be used. The holes will then be back filled. 2. Viewing and testing service line materials to update our inventory. 3. Any vegetation removed during the investigation will be restored as it was found. Their work should not interrupt service. The only actions we ask you to take are:  Keep all dogs and animals inside when field crews are on site.  Remove any obstructions to the meter or service lines.  Allow uniformed field crew members, with proper IDs, to access your property when necessary. Why is Denton Water Utilities doing this? As part of the United States Environmental Protection Agency’s (EPA) requirements to reduce sources of lead in drinking water (www.epa.gov/ground-water-and-drinking-water/revised-lead-and-copper-rule), Denton Water Utilities is inventorying the types of service lines (plastic, copper, galvanized, or lead) used to deliver water from water mains to your home or business. The City of Denton has always been committed to providing our community with high-quality drinking water. The water that leaves our facilities is clean and lead-free – and it always has been! Learn more about your water service lines, pipe materials and more here: www.denton-water.com If Denton Water Utilities determines there are lead service lines on either side of your property, you will be contacted by Denton Water Utilities to inform you of the next steps. Facts About Lead: Having a water service line that contains lead doesn’t necessarily mean you have elevated levels of lead in your water, but there are steps you can take to reduce your exposure if you do have a lead service line:  Use only cold water for drinking, cooking, and making baby formula, etc. Remember that boiling water does not remove lead.  Regularly clean your faucet’s screen (also known as an aerator).  Consider using a water filter certified to remove lead and know when it’s time to replace the filter.  Before drinking, flush your pipes by running your tap, taking a shower, doing laundry or a load of dishes. However, due to the default of Delilah Solar coupled with 6.28% higher load served during the year, we did have to purchase Renewable Energy Credits (RECs) to ensure 100% renewable energy power supply. BACKGROUND: DME previously received approval from City Council to recognize the use of RECs to meet its 100% renewable energy goal as mandated by the Denton Renewable Resource Plan. Compliance with the renewable energy supply mandate has been achieved for 2021, 2022, and now 2023. This compliance report documents the sources of Renewable Energy Credits (RECs) used to demonstrate compliance. For the purposes of this discussion, RECs are synonymous with MWhs because each REC is associated with a MWh of renewable energy production as verified by the Electric Reliability Council of Texas (ERCOT). DISCUSSION: Compliance with the requirements of the Denton Renewable Energy Plan (DRRP) is measured on a calendar year basis. This compliance period is a direct result of the accounting and crediting of RECs by ERCOT which provides a third-party independent verification of renewable energy credits for all market participants. Consequently, when DME forecasts the number of MWhs of renewable energy required to demonstrate compliance with the DRRP, it spans two fiscal years. For calendar year 2023, the number of expected MWhs served for the months of January through September 2023, were forecasted in April of 2022 as part of the fiscal year 2023 budget. The remaining months of October through December 2023 were forecasted in April 2023 as part of the fiscal year 2024 budget. The Energy Management Organization (EMO) uses weather normalized forecasts to predict the amount of energy to be served in the City of Denton and the generation expected from our renewable resources under long-term PPAs. Renewable energy output from our contracted resources are a function of wind speed and duration and hours and intensity of solar irradiation during each day. Forecasting these quantities is based upon proprietary algorithms that use historical correlations of wind and sun to forecast output from each of our contracted resources. Given the volatility of weather, the EMO recognizes that forecasts are likely to be off from actuals but in order to maintain the statistical integrity of the load and generation forecasts, this analytical approach is considered a best practice in the electric utility industry. For calendar year 2023 the EMO projected that the total DME served load would be 1,646,280 MWh. The actual calendar year 2023 load served was 1,749,737 MWh, or 6.28% more than forecasted. Recall that the summer of 2023 was one in which the ERCOT market experienced the second hottest summer on record, and DME also set new records. 47 April 26, 2024 Report No. 2024-015 For the calendar year, the EMO projected that renewable energy supply under contract would be sufficient to meet the forecasted load. However, in June of 2023, the summer forecasts continued to build week after week until it was evident that DME would experience a hotter than normal summer. The Delilah Solar project default contributed to the shortfall, however demand usage in November and December was lower than forecasted which helped reduce the overall shortfall. Renewable Energy Credit Inventory ERCOT, as the market administrator for RECs, issues RECs to each renewable energy generator monthly. However, Retail Energy Providers (REPs) who provide contracted energy in the competitive retail market areas of ERCOT are not required to demonstrate compliance with the renewable energy portfolio standards until May 1 of the year following the compliance year. Because the REC market was developed with this compliance date in mind, renewable energy resources do not generally finalize their REC transactions until mid-April of each year. DME’s contracted renewable energy resources, including the Delilah Replacement Contract, do not post their RECs to DME’s REC account at ERCOT until mid-April. Consequently, DME does not know the actual level of RECs officially allocated by ERCOT to each renewable energy resource and those resources are trueing up their ERCOT accounts into April of each year. In early April 2024, DME’s ERCOT REC account contained 1,742,944 RECs or 98,454 (5.35%) less RECs than the actual load served during calendar year 2023.DME’s load forecast for calendar year 2023 was 1,646,280 MWh and less than the actual load (1,749,737) for the calendar year. Actual Load Served and Actions Taken by EMO As previously stated, DME purchased 1,749,737 MWh from ERCOT for resale to retail (non-Core Scientific) customers in calendar year 2023. With an ERCOT REC inventory of 1,742,944 for the calendar year, DME’s account was 6,793 or 0.39% short of the actual load served. To balance the account DME purchased 6,793 calendar year 2023 RECs from the market to achieve 100% renewable energy supply for the year and to again achieve compliance with the DRRP goal. The 0.39% deficit in RECs at the end of the year was expected based upon the 6.28% more load served by DME than was forecasted. However, because energy can only be purchased prospectively, and the EMO manages the hourly load position in real-time and next day ERCOT markets, REC backed energy is not purchased. There is no real time or day ahead market for REC backed energy in ERCOT, or any other regional transmission market. Unless DME were to purposefully over procure REC backed energy as compared to the EMO’s forecast, the only way to true-up the REC amounts at the end of the year is through the bilateral REC market. This is what was done for the calendar year 2023. DME will continue to function in this manner and this practice will be fully explained in the revised DRRP that will be issued later this year. It should be noted that if DME were in a surplus position relative to REC inventory levels, DME would use the same bilateral REC market to sell the surplus RECs and monetize the excess value for the benefits of DME customers. The EMO believes the actions taken this year to demonstrate compliance with the DRRP are prudent and consistent with electric industry best practices.
