Public Meetings & Agendas | Denton, TX (civicplus.com) General Information & Status Updates A.Rayzor Ranch Overlay District Ordinance Consolidation Update – At the April 24, 2024, Planning and Zoning Commission work session (viewable here:https://dentontx.new.swagit.com/videos/303645), Staff presented information regardingthe history and purpose of the Rayzor Ranch Overlay District (RROD), which was firstcreated in 2007 (Ordinance No. 2007-067). The RROD includes 406 acres of land on both the north and south sides of US Highway 380 between I-35 and Bonnie Brae Street. The RROD provides design criteria and development standards for the entire mixed-usedevelopment area using the City’s former 2002 Denton Development Code (2002 DDC)for its base zoning regulations. Most of the current overlay standards for the RROD have been in place since 2010. Still, many areas, particularly within the southern portion of the overlay, did not have design standards adopted until 2016 or later. The RROD has been amended over twenty timessince its adoption in 2007. In addition, the City adopted a new Denton Development Codein 2019, replacing the 2002 DDC, except concerning the RROD. The large number ofamendments to the original RROD and the adoption of the new 2019 Denton Development Code (2019 DDC) have made the RROD challenging to interpret and implement. This challenge was anticipated at the time of the 2019 DDC adoption, and a placeholder(Appendix A) was created within the DDC for the RROD standards to consolidate andadopt them into the DDC at a future date. In addition to desiring and intending to make theRROD less challenging for staff to administer by formally adopting the RROD into the DDC rather than being multiple individual ordinances, the staff’s goal is to make the standards easier for landowners, developers, and residents to locate and use. Since early2023, Staff has been working with a consultant to formally create Appendix A to add theRROD into the DDC. A public hearing was held to consider making a recommendation regarding the consolidated Appendix A text with the Planning and Zoning Commission on June 26, 2024, when the project received a favorable recommendation from the Commission. Staff intendsto present this item to the Council on July 16, 2024. Staff has contacted the affectedproperty owners to solicit feedback on the consolidated amendments; questions andcomments were submitted by owners of the land on the South Campus, which have been discussed and incorporated into the consolidated draft. Staff coordinated with the developer and relocated the fuel tank to a location away from existing homes. Staff contact: Scott McDonald, Development Services B.Noise from Bitcoin Mining Facility – On July 10, Mayor Hudspeth received an inquiry from a resident regarding the noise levels at the Bitcoin mining facility. DCA22-OO03a, AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE DENTONDEVELOPMENT CODE, SPECIFICALLY AMENDMENTS RELATED TO TWO NEW USES: DATA CENTER, MODULAR AND DATA CENTER, WAREHOUSE; PROVIDINGFOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONSTHEREOF; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE(DCA22-0003 a) WHEREAS, pursuant to Ordinance No. DCA18-0009q, the City Council of the City ofDenton adopted the newly revised 2019 Denton Development Code, the (“DDC”); and WHEREAS, the City desires to amend the Denton Development Code to include two new uses; Data Center, Modular and Data Center, Warehouse and associated use-specific standards and minimum development requirements; and WHEREAS, the amendments include the following: 1. 2. 3. 4. Amend Subchapter 9.2 (Definitions) to include definitions for Modular Data Center and Warehouse Data Center, and to update the definition of Electric Substation; and WHEREAS, on August 10, 2022, the Planning and Zoning Commission, in compliance with the laws of the State of Texas, gave the requisite notices by publication, held due hearings and recommended approval [5 - 0] of the amendment to the Denton Development Code; and WHEREAS, on September 20, 2022, the City Council likewise conducted a public hearing in accordance with local and state law and the City Council hereby finds that the Code amendments related to a new use: Data Center are consistent with the City’s comprehensive plan, and federal,state, and local law are in best interests of the City of Denton; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference and found to be true. SECTION 2. Subchapter 2 – Administration and Procedures of the DDC is amended as set forth “Exhibit A” which is attached and fully incorporated herein by reference. SECTION 3. Any person, firm, partnership or corporation violating any provision of this ordinance shall, upon conviction, be deemed guilty of a misdemeanor and shall be punished by Page 1 of 3 4 fine in sum not exceeding $2,000.00 for each offense. Each day that a provision of this ordinance is violated, shall constitute a separate and distinct offense. SECTION 4. If any provision of this ordinance or the application thereof to any person orcircumstance is held invalid by any court, such invalidity shall not affect the validity of the provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 5. That an offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Denton Development Code, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 6. In compliance with Section 2.09(c) of the Denton Charter, this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage. An environmental noise and vibration assessment is required with the initial application, prepared by a professional qualified in the area of noise mitigation, detailing how the proposed use complies with the maximum permissible noise levels described in number 5 below. The environmental noise and vibration assessment must: i. Identify operation noise impacts; i. Provide documentation establishing the ambient noise level prior to installing any modular structures and on-site electrical equipment; 7 111.Detail how the impacts will be mitigated. In determining noise mitigation, specific site characteristics shall be considered, including but not limited to the following: a. Nature and proximity of adjacent development, location and type; b. Seasonal and prevailing weather patterns, including wind directions; c. Vegetative cover on or adjacent to the site; and d. Topography. iv. The applicant shall be responsible for verifying compliance with the environmental noise and vibration assessment noise mitigation measures after the installation. 5. Data center operations, including on-site electrical equipment, shall not cause any noise measuring more than sixty (60) dba on the A-weighting utilizing properly calibrated sound measuring instrumentation measured at the property line, or shall not cause anincrease in the ambient noise level in the area more than 3 dba. 6. On-site Electric Substations shall comply with Section 7.13.7 Electric Substation Design of the Denton Development Code. In the MR and SC Zoning Districts, the use shall be limited to a maximum of 55,000 square feet of gross floor area per lot. 2. Accessory uses may include office and/or electrical equipment for localized distribution. This definition excludes accessory storage of computer systems and hardware within or outside of an existing building, where the primary use is residential, commercial, or institutional in nature. Data Center. Warehouse As a principal use, a building or buildings intended for large-scale storage of specialized computing systems and hardware that are used for the sole purpose of remote storing, gathering, processing, and/or analyzing large amounts of data information. Accessory uses may include office and/or electrical equipment for localized distribution on-site. Electric Substation An enclosed assemblage of equipment, e.g. switches, circuit breakers, busses, and transformers, under the control of qualified persons, through which electric energy is converted from a transmission voltage level (60 kV or higher) to a lower, distributionlevel (below 60 kV). 10 July 12, 2024 Report No. 2024-25 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: City Council Member Committee Appointment Process EXECUTIVE SUMMARY: The appointment of City Council members to internal and external committees and boards occurs during the summer after each municipal election. Internal City Council committees consist only of Denton City Council members. Council members could also serve on other internal committees and boards that include the participation of citizens and/or business professionals from the community. Finally, council Members may be appointed to external boards that operate on a regional level, generally incorporating members from the county, surrounding cities, and towns, as well as members of the relevant business community and the citizenry for which the board was formed to serve. Council committee appointments are expected to be considered on August 6, 2024. Appointments to other internal and external committees are scheduled to be discussed on July 23, 2024, and considered on August 6, 2023. The only exception to this timing is the Regional Transportation Council appointment, which will be discussed at the July 23, 2024, Work Session and considered at the City Council meeting that night. It's important to note that Council member preferences for committee or board appointments must be submitted by Friday, July 19, 2024, to the City Secretary. BACKGROUND: Participation by council members in City Council committees is not just about attendance, it's about shaping the future of our city. It supports the development of City policy and provides an opportunity for issues to be evaluated before consideration by the full Council. Additionally, council member representation on other standing, ad-hoc, and/or external bodies ensures external organizations hear the voice of the City of Denton. Committee membership assignments are updated annually by the Mayor and City Council to allow for participation by new council members and to adjust participation if required. DISCUSSION: The summer after each municipal election is used to appoint council members to internal City Council committees and to the committees and boards of external organizations. City Council Committees The City Council maintains three City Council committees (see attached descriptions). The Agenda Committee membership is not appointed but consists of the Mayor, Mayor Pro-Tem, and the City Manager. The remaining committees include the Committee on the Environment and the Community Partnership Committee. The Mayor is vested with the authority to nominate Council members to the Committee on the Environment, with the full City Council confirming those nominations by vote. For the 11 July 12, 2024 Report No. 2024-25 Community Partnership Committee, any council member may provide a nomination that may then be voted on by the full Council. Consideration of City Council committee nominations is scheduled for the August 6, 2024, City Council meeting. Other Committee Appointments: The Council also appoints members to over a dozen other standing, ad hoc, and/or external committees. Attached is a listing of committees with seats that will be available for appointment, the appointing authority, and other relevant information. Staff requests that Council Members review the current assignments and notify the City Secretary by Friday, July 19, 2024, which bodies they are interested in serving on. At the July 23, 2024, Work Session, staff will seek Council direction on which nominations to bring forward for a formal appointment at the August 6, 2024, City Council meeting, except for the Regional Transportation Council appointment, which will be considered at the July 23, 2024, City Council meeting. Appointing authority is the City Council per Council Ordinance. 16 Development Code Review The Development Code Review Committee is a standing City Committee established to review proposed Denton Development Code amendments and make recommendations to the Planning and Zoning Commission and the City Council regarding proposed Denton Development Code amendments. Economic Development Partnership Board The Economic Development Partnership Board (the “Board”) was created to provide economic development policy guidance for the City. The DCTA Board of Directors is governed by a five voting member board appointed by respective entities from Denton County and the cities of Denton, Highland Village, and Lewisville serving two-year terms. Dallas Regional Mobility Coalition The primary mission of the Dallas Regional Mobility Coalition is to advance critical infrastructure projects in North Texas by working with local, state, and federal policymakers. •This appointee must be the Mayor 18 Discover Denton Advisory Board The Discover Denton Advisory Board (initially established as the Convention and Visitors Bureau Advisory Board) was initiated in 1976 by the Denton Chamber of Commerce to promote events and attractions, provide hospitality education, and ensure a positive experience to Denton visitors. It operates via an agreement between the City of Denton and the Denton Chamber of Commerce. Lake Ray Roberts P&Z Commission The purpose of the Lake Ray Roberts P&Z Commission is to promote the following of Lake Ray Roberts Zone in Denton County: general welfare, health, morals, recreation, and safety. The ordinance governs any structures and land located within the area bounded by the shoreline of Lake Ray Roberts at its take elevation line of 645 fee mean sea level and a line 5,000 feet from and following said take line except any land lying within a city’s corporate limits. •This appointee must be the Mayor North Texas Commission The purpose of the North Texas Commission is to convene and educate public and private sector leaders to ensure that state and federal policies promote strong local governments, support excellence in public schools, increase the skilled workforce pipeline, and safeguard a thriving business environment. •The current appointee is Mayor Hudspeth serving a term ending September 30, 2025 Regional Transportation Council The Regional Transportation Council is the independent transportation policy body of the Metropolitan Planning Organization. RTC's 45 members are local elected or appointed officials from the metropolitan area and representatives from each of the area's transportation providers. The RTC oversees the metropolitan transportation planning process. This Agency board appointments are processed and presented by Tony Peunte, General Manager of Denton Municipal Electric. 19 July 12, 2024 Report No. 2024-26 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: Final Report for the Commercial Organics Diversion Pilot Program BACKGROUND: In July 2023, Denton Solid Waste and Recycling (SWR) collaborated with the Wastewater Department to launch a Commercial Organics Diversion Pilot Program focused on food waste at restaurants that utilize the premium valet waste services downtown and in the Fry Street vicinity. Previous studies highlighted food waste accounts for over 32% of Denton's waste stream, so the Commercial Diversion Pilot Program was initiated to help reach a goal of 30% waste diversion from the landfill by 2030 – a deliverable of the City’s Comprehensive Solid Waste Management Strategy. While SWR currently collects pre-consumer food waste from a few commercial businesses and curbside yard waste bins, post-consumer food waste, such as fats, oils, meats, and bones, is not included in the program. DISCUSSION: The North Texas Council of Governments provided a grant to support the Commercial Organics Diversion Pilot Program, which initially targeted 30 customers in the downtown area, primarily focused on restaurants. Each participating business was provided with indoor kitchen bins to store food waste during the day. The organic waste was transferred to SWR outdoor carts equipped with locks to prevent scavenging or spills. To ensure effective participation, SWR discussed the program's parameters with each participating business one-on-one and provided them with outreach materials, including posters and guidelines for kitchen and outdoor carts, to reinforce proper waste separation practices. The pilot began on July 7, 2023, and continued for six months. Monthly check-ins were conducted during the first three months, which transitioned to bi-monthly check-ins during the final months. Contamination levels remained low throughout the pilot, and businesses were promptly contacted if issues were detected. The food waste collected during the program was delivered to the wastewater reclamation plant for processing. A grinder and pump were purchased through the grant to support the existing infrastructure. The grinder reduced the size of the collected organics into quarter-inch particles, 20 July 12, 2024 Report No. 2024-26 while the pump facilitated feeding material into the digester. The wastewater reclamation plant reported no adverse impacts from the material received. CONCLUSION: Throughout the six-month pilot, SWR collected 420 tons of waste (trash, recycling, and organics). The organics collected equated to 7% of the total volume set for disposal. Based on these results, the Texas Commission on Environmental Quality has approved the continuation of this program. The program's future involves conducting similar pilot initiatives with the Denton Independent School District and local universities. Over the next few years, the goal is to extend program offerings to all commercial businesses, followed by a residential drop-off service.
