Property Records, Denton County, Texas, and being more particularly described as follows:
BEGINNING at a 5/8-inch iron rod with cop stamped "PETITT-RPLS 4087" set for the northeast
comer of said Custer tract, and the southeast corner of a called 53.35 acre tract conveyed to
Lee Weir, Trustee 1991 Weir Family Trust as recorded in Volume 4240. Page 1365 and in County
Clerk's Document No. 98-RO114389 of said Real Property Records and being a point in the west
line of Farm to Market Road No. 2931 (variable width right-of-way);
THENCE South 02'22'00" West, along the west line of said F.M. 2931 a distance of 589.94 feet
to a 5/8-inch iron rod with cap stamped "PETITT-RPLS 4087" set for corner;
THENCE South 13*40*36" West, along the west line of said F.M. 2931 a distance of 101.98 feet
to a 5/8-inch iron rod with cap stamped "PETITT-RPLS 4087" set for corner;
THENCE South 02'22'00" West, along the west line of said F.M. 2931 a distance of 200.00 feet
to a wooden TxDOT monument found for corner;
THENCE South 08'56'36" East, along the west line of said F.M. 2931 a distance of 3.11 feet to
a 5/8-inch iron rod with cap stamped "PETITT-RPLS 4087" set for corner,
THENCE North 87'3WOO" West, leaving the west line of said F.M. 2931 a distance of 230.61 feet
to a 5/8-inch iron rod with cap stamped "PETITT-RPLS 4087" set for corner,
THENCE North 02'22'00" East, a distance of 889.93 feet to a 5/8-inch iron rod with cop
stamped "PETITT-RPLS 4087" set for corner at a point on the north line of said Custer tract
and the south line of Weir tract;
THENCE South 88'20'08" East, along the common line of said Marriot and Weir tracts a distance
of 250.02 feet to the POINT OF BEGINNING and containing 217,804 square feet or 5.00 acres of
land, more or less.
DEDICATION STATEMENT
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
THAT CUSTER ROAD PARTNERS, LP., ACTING HEREIN BY AND THROUGH ITS DULY AUTHORIZED
AGENTS DOES HEREBY ADOPT THIS PLAT DESIGNATING THE HEREIN ABOVE DESCRIBED PROPERTY
AS THE MARRIOT ESTATES, AN ADDITION TO THE COUNTY OF DENTON. TEXAS, AND DO
HEREBY DEDICATE THE EASEMENTS SHOWN ON THE PLAT FOR THE PURPOSES INDICATED TO THE
COUNTY EXCLUSIVE USE FOREVER, AND SAID DEDICATIONS BEING FREE AND CLEAR OF ALL LIENS
AND ENCUMBRANCES EXCEPT AS SHOWN HEREIN. NO BUILDINGS, FENCES, TREES, SHRUBS OR
OTHER IMPROVEMENTS SHALL BE CONSTRUCTED OR PLACED UPON, OVER OR ACROSS THE
EASEMENTS OF SAID PLAT. AT THE DISCRETION OF THE COUNTY AND SUBJECT TO ITS WRITTEN
APPROVAL, UTILITY EASEMENTS MAY ALSO BE USED FOR THE MUTUAL USE AND ACCOMMODATION
OF ALL PUBLIC UTILITIES DESIRING TO USE THE SAME UNLESS THE EASEMENT LIMITS THE USE TO
A PATICULAR UTILITY OR UTILITIES, SAID USE BY PUBLIC UTILITIES BEING SUBORDINATE TO THE
COUNTY USE THEREOF, ANY PUBLIC UTILITY GIVEN THE RIGHT BY THE COUNTY TO USE SAID
EASEMENTS SHALL HAVE THE RIGHT TO REMOVE AND KEEP REMOVED ALL OR PART OF ANY
BUILDINGS, FENCES, TREES, SHRUBS OR OTHER IMPROVEMENTS OR GROWTHS WHICH IN ANY WAY
ENDANGER OR INTERFERE WITH THE CONSTRUCTION, MAINTENANCE, OR EFFICIENCY OF ITS
RESPECTIVE SYSTEM ON ANY OF THESE EASEMENTS; AND ANY PUBLIC UTILITY SHALL AT ALL
TIMES HAVE THE RIGHT OF INGRESS AND EGRESS TO AND FROM AND UPON ANY SAID EASEMENTS
FOR THE PURPOSE OF CONSTRUCTING, RECONSTRUCTING, INSPECTING, PATROLLING, MAINTAINING
AND ADDING TO OR REMOVING ALL OR PART OF ITS RESPECTIVE SYSTEM WITHOUT THE NECESSITY
