WHEREAS Carlos A. Morales is the owner of all that certain tract or parcel of land
lying and being situated in the WILLIAM LUMPKIN SURVEY, ABSTRACT NO. 730, and
being out of and a part of that tract of land conveyed in a deed from James .Mack
Dear to Gary Lynn Dear and Romeono K. Dear recorded under Clerk's Document No.
2017-19103, said tract or parcel of land more particularly being that Lot 1, Block A,
of ROMEANA ADDITION (per the Minor Plat thereof recorded in Document No.
2017-458, Plat Records of Denton County) as described in a deed to Carlos A.
Morales recorded in Document No. 2019-10404 of the Real Property Records of
Denton County and is herein described as follows; to wit:
BEGINNING at an one—half inch capped iron rod set on the North line of said 35.98
acre tract at the Northeast corner of a Plot of land conveyed to David Coffey Exempt
Trust DTD (by Deed recorded under Clerk s Document No. 2016-128132) for the
Northwest corner hereof;
THENCE along the North line of said 35.98 acre tract, South 89 degrees 18 minutes
13 seconds East 234.11 feet to an one—half inch capped iron rod set for the
northeast corner hereof, a re—entrant corner of sold 35.98 acre tract bears South 89
degrees 18 minutes 15 seconds East 35.8 feet;
THENCE South 24 degrees 49 minutes 02 seconds East 176.54 feet to on one—half
inch capped iron rod set on the North line of an Ingress Egress and Utility Easement
(described in a deed recorded under Clerk's Document No. 2016-129959) for the
Southeast corner hereof;
THENCE along the North line of said Ingress Egress and Utility Easement, the following
calls:

Construction not complete within two years of the commissioner's court approval
shall be subject to current county subdivision rules and regulations.
No construction, without written approval from Denton County, shall be allowed
within an identified FIRM floodplain area, and then only after a detailed floodplain
development permit including engineering plans and studies to show that no rise
in the base flood elevation (BFE) will result, that no flooding will result, that no
obstruction to the natural flow of water will result; and subject to all owners of
the property affected by such construction becoming a party to the request.
Where construction is permitted, all finished floor elevations shall be a minimum
of two feet above the 100—year flood elevation.
Denton County shall not be responsible for maintenance of private streets, drives,
emergency access easements, recreation areas and open spaces, and the owners
shall be responsible for the maintenance of private streets, drives, emergency
access easements, recreation areas and open spaces, and said owners agree to
indemnify and hold harmless Denton County, from all claims, damages and
losses arising out of or resulting from performance of the obligations of said
