WHEREAS DSCS INVESTMENTS, LLC, is the owner of that certain tract or parcel of
land lying and being situated in the City of Aubrey ETJ, Denton County, Texas, a
part of the F.H. POLLARD SURVEY, Abstract No. 995, and being comprised of a
2.037 acre tract and a 4.81 acre tract described under the captions Tract 1 and
Tract 2 respectively in a deed to DSCS recorded under Clerk's Document No.
2017-154489 Official Records of Denton County, said tract or parcel of land is
herein described as follows; to wit:
BEGINNING at an one-half inch iron rod found on the south right of way line of
F.M. HIGHWAY No. 428 at the northwest corner of Lot 1, Block A, THREE RRR'S
ADDITTON per the plat thereof recorded under Clerk's Document No. 2019-185 of
the Denton County Plat Records, said corner being the northeast corner of the
premises herein described;
THENCE with a westerly line of said THREE RRR'S ADDITION, south 01 degrees 19
minutes 52 seconds east 311.56 feet to an one-half inch iron rod found with cap
marked "RPLS4857" and south 02 degrees 59 minutes 00 seconds west 535.73
feet to an one-half inch iron rod found on the north line of Lot 2, Block A,
THREE RRR'S ADDITION for the southeast corner hereof;
THENCE north 87 degrees 01 minutes 23 seconds west 554.34 feet to an
one-half inch iron rod found with cap marked "RPLS4857" on the east line of a
3.0 acre tract described in a deed to Darwish Family Trust recorded under Clerk's
Document No. 2022-77065, Official Records of Denton County for the southwest
corner hereof;
THENCE with said line, north 01 degrees 55 minutes 22 seconds east 89.65 feet
to an one-half inch iron rod found at the southwest corner of a 3.98 acre tract
described in aforecited deed to Darwish Femiliy Trust for the most southerly
northwest corner hereof;
THENCE north 89 degrees 18 minutes 34 seconds east 228.93 feet to an
one-half inch capped iron rod set at the southeast corner of said 3.98 acre tract
for a re-entrant on or hereof;
THENCE along the east line of said 3.98 acre tract, north 02 degrees 37 minutes
12 seconds east 743.30 feet to an one-half inch iron rod found on the south
right of way line of said F.M. HIGHWAY No. 428 for the northwest corner hereof;
THENCE south 86 degrees 48 minutes 32 seconds east a distance of 308.81 feet
to the Place of BEGINNING and containing 6.832 acres of land.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENT:
THAT DSCS INVESTMENTS, LLC, acting herein by and through its duly authorized officers,
does hereby adopt this plat designating the hereinabove described property as DSCS
INVESTMENTS ADDITION, an addition to the City of Aubrey, Texas, and does hereby
dedicate, in fee simple, to the public use forever, the streets and alleys shown thereon.
The streets and alleys are dedicated for street purposes. The easements and public
use areas, as shown, are dedicated for the public use forever, for the purposes
indicated on this plat. In addition, utility easements may also be used for the mutual
use and accommodation of all public utilities desiring to use or using the some unless
the easement limits the use to particular utilities, said use by public utilities being
subordinate to the public and City of Aubrey's use thereof. The City of Aubrey and
public utility entities shall have the right to remove and keep removed all or parts of
any buildings, fences, trees, shrubs, or other improvements or growths, which may in
any way endanger or interfere with the construction, maintenance, or efficiency of their
respective systems in said easements. The City of Aubrey and public utility entities
shall at all times have the full right of ingress and egress to or from their respective
easements for the purpose of constructing, reconstructing, inspecting, patrolling,
maintaining, reading meters, and adding to or removing all our parts of their respective
systems without the necessity at any time of procuring permission from anyone.

GENERAL NOTES.
1) All lot corners set are marked with 1/2 inch diameter rebar
with yellow plastic caps inscribed "J.E. SMITH 3700".
2) Selling a portion of this addition metes and bounds is a violation
of City Ordinance and state law and is subject to fines and withholding
of utilities and building permits.
3) All surface drainage easements shall be kept clear of fences, buildings,
foundations, plantings, and other obstructions to the operation and
maintenance of the drainage facility.
4) Blocking the flow of water or constructing improvements in surface drainage
easements, and filling or obstructing the floodway is prohibited.
5) The City of Aubrey ETJ will not be responsible for any damage, personal injury or loss
of life or property occasioned by flooding or flooding conditions.
6) The existing creeks are drainage channels traversing along or across the
addition will remain as open channels and will be maintained by the individual
property owners of the lot or lots that are traversed by or adjacent to the
drainage courses along or across the lots.
7) Construction not completed within two years of the Commissioners' Court
approval shall be subject to current County Subdivision Rules and Regulations.
8) No construction without written approval from the City of Aubrey ETJ shall be allowed
within an identified FIRM floodplain area, and then only after a detailed
floodplain development permit including engineering plans and studies to show
that no rise in the base flood elevation (BFE) will result, that no flooding will
result, that no obstruction to the natural flow of water will result; and subject
to all owners of the property affected by such construction becoming a party
to the request. Where construction is permitted, all finished floor elevations
shall be a minimum of two feet above the 100-year flood elevation.
9) The City of Aubrey ETJ shall not be responsible for maintenance of private streets,
drives, emergency access easements, recreation areas and open spaces, and
the owners shall be responsible for the maintenance of private streets, drives,
emergency access easements, recreation areas and open spaces, and said
owners agree to indemnify and hold harmless The City of Aubrey ETJ, from all claims,
damages and losses arising out of or resulting from performance of the
obligations of said owners set forth in this pagagroph.
10) FLOOD INFORMATION: The property shown hereon is situated within the "non -shaded
zone X" defined as "areas determined to be outside the 0.2% annual chance floodplain"
per FEMA map no. 48121CO270G, dated 04/18/2011. This; flood information does not
imply that the property and/or structure thereon will be free from flooding or flood
damage, on rare occasions greater floods can and will occur, and flood heights may be
increased by manmade or natural causes.
11) A driveway culvert permit must be obtained from road and bridge departments
by the owner of each lot prior to the construction, installation or placement
of any driveway access improvements within the dedicated right-of-way.
12) Sanitary sewer to be handled by facilities approved by the Denton County
Health Department.
