Discrimination Ordinance in 2021,the City has received one complaint that was investigated by the EEOC,and it was not related to hiring practices. 8/3/2025 Gerard Hudspeth Public Hearing ID 25-1140 Water Utilities Re:Report Why are MUD's included in the growth projections, they are not in the city of 1.The Water Utility Certificate of Convenience and Necessity extends beyond the corporate limits and into the Denton. Please note I read in the report that..."Service Area can be defined for both water ETJ.Impact Fees follow the infrastructure requirements outlined in the Master Plans. Therefore, the master and wastewater facilities that consists of the City Limits and extends throughout the plans were developed to incorporate growth within both the corporate limits and the ETJ.If we do not identify Extraterritorial Jurisdiction(ETJ)."I am asking why it is being considered, because it is not infrastructure impacting our system during the study,we do not have the ability to change or modify the mandatory. Also those developments are not paying municipal taxes, and have an identified infrastructure until a future Impact fee study is done. In addition to the costs of an updated study, new advantage as a result. state law will require a minimum of 3 years before the study can be updated. 2.Local Government Code allows for cities to factor in growth beyond the corporate limits to include growth in the ETJ.3.Many MUDS in the city's ETJ approach the city for utility connections;therefore,we need to identify impact fee eligible projects to recover costs when the city is approached for utility service,as happens often.4.Historical precedent shows that if development in the ETJ is not considered for city services, the services installed may be inadequate and eventually may require effort from the city to resolve if they fail. The most recent examples of this occurring are Greentree Estates and the Old Alton community. 8/3/2025 Gerard Hudspeth Public Hearing ID 25-1140 Water Utilities Please provide the source that stipulates the growth must be based on 10 years.I see this Using the growth window maximum of 10 years is a typical industry standard because it represents a requirement...Chapter 395 mandates that Impact Fees be reviewed and updated at least reasonable planning window and provides flexibility with the number of projects that are impact fee eligible. The every five(5)years.Yet we used the maximum of 10 years..."(6)the projected demand for total infrastructure build over the 10-year window is calculated and divided by the estimated service units added 3 capital improvements or facility expansions required by new service units projected over a in the same timeframe. Then, with the next study, whatever amount that isn't either built or collected is reasonable period of time, not to exceed 10 years".Will the next impact fee evaluation be recalculated into the recoverable cost for the next 5 years. scheduled in 5 years? "CIAC is tasked with advising the City Council of the need to update the Land Use Assumptions or the Impact Fee Capital Improvements Plan at any time within five years of adoption." 8/3/2025 Gerard Hudspeth Public Hearing ID 25-1140 Water Utilities Please add a slide that list all impact fees charged residential&commercial. Impact fees are charged based on the meter size required to serve the facility. That meter size is determined by 4 the fixture count and required fire flows.Property type(i.e.,residential,commercial,industrial,etc.)are not factored in the determination of meter size.A Single Family Equivalency chart has been attached with the proposed rates included to demonstrate the proposed rates per meter size. 8/3/2025 Gerard Hudspeth Public Hearing ID 25-1140 Water Utilities Re:Population estimates Last 10 years saw just under 30,000 added.Projection for next Population growth is one basis on which impact fees are examined, but the more important number is Service 5 10 years is over 90,000 added. Please share the detailed calculations/assumptions in the Unit Growth.Service Units account for both residential and commercial growth. For example,if a business city vs.ETJ/MUD.Please break out MUD/ETJ into its own area. How does that affect the requires an 8"meter,that is equivalent to 90 single-family homes. The assumed population growth per service impact fee projections in the city limits(show in chart)? unit is 2.07 people per unit. 8/3/2025 Gerard Hudspeth Public Hearing ID 25-1140 Water Utilities Stipulation requests:Please stipulate that those projects not started/or online within this 5 City officials will have authority to decide which projects are included when future impact fee studies are yr window, will NOT be rolled over into the next study.I am sorry if I missed it what page in conducted. Projects not started in the 5-year window could be included in the next study. the report captures this required information?"(A)a credit for the portion of ad valorem tax and utility service revenues generated by new service units during the program period that is used for the payment of improvements, including the payment of debt, that are included in the capital improvements plan;or(B)in the alternative,a credit equal to 50 percent of the total project cost of implementing the capital improvements plan." 7 8/3/2025 Gerard Hudspeth Public Hearing ID 25-1140 Water Utilities Provide percentage growth year over year from 2014 in this chart"Table 2.4 Water Please find attached. Impact fees are utilized for any capital improvement project within the service area, and seeing in item 6(C)? decisions on utilization of actual fund are considered for each project in association with available revenue and 9 debt funding options. If a project is delayed beyond the 10-year time-frame,it could get incorporated into future studies.Debt issued for actual construction cost could also be impact fee eligible and incorporated into a future study. In the next impact fee study, which is a maximum of 5-years from the implementation of this study,a financial analysis will be completed on the rate of impact fees collected vs.the projected rates. If a deficiency or surplus is noted,a change will be calculated into the new proposed rates. 8/4/2025 Suzi Rumohr Individual Consideration ID 25-1343 Water Utilities Slide 6:What is a resident project representative?
