Page 372, Deed Records, Denton County, Texas, grants to the United States of America a perpetual 'flowage easement ("the Easement") with respect to a 20.6 acre
tract of land out of the Francis Pearce Survey, Abst. No. 1016 and the William P. Pearce Survey, Abst. No. 1015, Denton County, Texas, described as "Tract No. D-366E"
in the Judgment, which grant reads as follows:
"A perpetual right and easement to occasionally overflow, flood and submerge the land hereinafter described, subject to existing easements for public
roads and highways, public utilities, railroads and pipelines, as may be required in connection with the operation and maintenance of the Garza -Little
Elm Dom and Reservoir Project as authorized by the Act of Congress; reserving, however, to the owners of the described lands all such rights and
privileges as may be used and enjoyed without interfering with or abridging the rights and easements hereby taken; provided that no structure for
human habitation shall be constructed or maintained on the hereinafter described lands below an elevation of 537 feet; and, provided further, that
with respect to said described lands the written consent of the representative of the United States in charge shall be obtained for the type and
