7. Upkeep and maintenance of the private drainage easement is the responsibility of the property owner's association.
8. Upkeep and maintenance shall include but not limited to the following items:
a. Grass and ground cover shall be kept at a height required by the town ordinance.
b, the detention facility shall be kept free of debris and litter, with particular attention given to
keeping the outlet structure clear at all times.
c. Accumulated sediment shall be removed from the facility as required to ensure that there is no reduction in function or detention capacity.
9. No dumping of any type is permitted within this easement area.
10. Retention Ponds:
i. the pond will maintain the normal pool elevation level specified on the civil plans.
ii. The pond will be kept clear of all noxious plant material including cottonwood trees, willow trees,
and cattails specifically.
iii. To achieve the above specification, the BOA may heed to secure a pond maintenance company for weekly or monthly treatment
of the noxious plant material. *Water depths less than 6 feet may require additional treatment.
iv. Aeration will be provided to the pond and be in good repair and operational year-round.
v. Permanent vegetation shall be established and maintained along the exposed banks to prevent erosion issues.
11. Subject to PD #186.
12. The purpose of the WIVE on Lot 3, Block A, is to allow maintenance of the masonry screening wall per VCA Development Agreement.
13. The purpose of this project is to subdivide 6.805 acres of land into 5 lots to allow for a non-residential project per the approved pd.
