WHEREAS, Kurt Crawford and Wanda Crawford are the owners of the following:
All that certain tract or parcel of land lying and being situated in Denton County,
Texas, a part of the G.W. Daniel Survey, Abstract No. 331, and being and including
all of Lots 22R and 21R, Block C, yacht club estates, an addition to the City of Oak
Point, Denton County, Texas, according 'to the instrument recorded Volume 1162, Page
265 and 266, Deed Records of Denton County, said tract or parcel of land is herein
described as follows; to wit.
BEGINNING at a 318 inch iron rod found at the northeast comer of said yacht club
estates and the northeast comer of sold Lot 22R for the northeast comer of the
premises herein described,
THENCE along the east line of said Lot 22R, south 08 degrees 03 minutes 47
seconds west 106.21 feet to a 518 inch iron rod found for comer;
THENCE south 34 degrees 38 minutes 32 seconds west at 10.25 feet passing an 112
inch iron rod found at the southeast corner of said Lot 22R, said comer being the
northeast corner of said Lot 21R, and in all a total distance of 55.47 feet to a
point for comer;
THENCE south 16 degrees 23 minutes 57 seconds west 59.57 feet to an 112 inch
iron rod found (with cap marked 'Arthur Surveying) for comer,
THENCE south 72 degrees 03 minutes 17 seconds west 42.91 feet to an 112 inch

132.61 feet), an arc length of 134.03 feet to an 112 inch iron rod found on the
north line of sold yacht club estates for the northwest comer of Lot 22R and the
northwest comer hereof,

BEGINNING and containing 0,879 acres of land.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS
THAT WE, KURT CRAWFORD and WANDA CRAWFORD do hereby adopt this plot designating the
herein above described property as LOT 22A, Block Q, YACHT CLUB ESTATES, being an
Amending Plot of Lot 21R and Lot 22R, Block C, of yacht club estates, an addition to the
City of Oak Point, Denton County, Texas, and do hereby dedicate to the public use forever
the fight -of -ways and easements shown hereon. The easements shown hereon are hereby
reserved for the purposes as indicated. The utility easement shall be open for all City or
franchised public utilities for each particular use, The maintenance of paving on the
easements is the responsibility of the property owner. No buildings or ,auxiliary structures
shall be constructed, reconstructed or placed upon, over, or across the easements as
shown. Sold easements being hereby reserved for the mutual use and accommodation of
all public utilities using, or desiring to use some, Any City or franchised utility shall have
the full right to remove and keep removed all or parts of any fences, trees, shrubs, or
other improvements or growths which in any way endanger or interfere with the
construction, maintenance, or efficiency of its respective system on the easements and all
City or franchised utilities shall at all times have the full right of ingress and egress to
and from and upon said easements for the purpose of constructing, reconstructing,
inspecting, patrolling, maintaining, and adding to or removing all or parts of its respective
system without the necessity at any time of procuring the permission of anyone.
This plot is hereby adopted by the Owners and approved by the City of Oak Point (called
"City") subject to the following conditions which shall be binding upon the Owners, their heirs,
grantees, successors and assigns:
The portion of Lot 224, Block C as shown on the plat called the 'Drainage and Floodway
Easement" and is the natural drainage channel crossing each lot. The existing creek or
creeks traversing along the Drainage and Floodway Easement within the limits of this addition,
will remain as an open channel at all times and will be maintained by the owners of the lot
or lots that are traversed by or adjacent to the drainage courses in the Drainage and
Floodway Easement. The City will not be responsible for the maintenance and operation of
sold creek or creeks or any damage to private property or person that results from the flow
of water along sold creek, or for the control of erosion. No obstruction to the natural flow
of storm water run-off shall be permitted by construction of any type of building, fence or
any other structure within the Drainage and Floodway Easement or the natural drainage
channels, as herein above defined. Provided however it is understood that in the event it
becomes necessary for the City to erect or consider erecting any type of drainage structure
in order to improve the storm drainage that may be occasioned by streets and alleys in or
adjacent to the subdivision, then in such event, the City shall hove the right to enter upon
the Drainage and Floodway Easement at any point, or points, to investigate, survey or to
erect, construct and maintain any
drainage facility deemed necessary for drainage purposes.
Each property owner shalt keep the natural drainage channels traversing or adjacent to his
property clean and free of debris, silt, and any substance which would result in unsanitary
conditions or obstruct the flow of water, and the City shall have the right of ingress and
egress for the purpose of inspection and supervision of maintenance work by the property
owner to alleviate any undesirable conditions which may occur. The natural drainage through
the Drainage and Floodway Easement, as in the case of all natural channels, is subject to
storm water overflow and natural bank erosion to an extent which cannot be definitely
defined. The City shall not be held liable for any damages of any nature resulting from the
occurrence of these natural phenomena, or resulting from the failure of any structure or
structures, within the natural drainage channels. Building areas outside the drainage and
