II. General Information & Status Updates
A. ThanksgivingH oliday—Please see attached press release that was distributed this
week regarding holiday closures for the Thanksgiving holiday. Please also be
informed that there will be no Friday report next week.
B. Organizational Updates—Please see below a few organizational updates:
• Director of Development Services—Scott McDonald has been named the new
Director of Development Services/Chief Building Official effective
immediately. City Manager Hileman stated that he has been impressed with
Scott's customer service approach, sense of urgency, and ability to organize
and work through complex procedural issues. Please join us in congratulating

• Keep Denton Beautiful — Over the last few months, the Utilities departments
have actively focused on improving organizational support for employees
directly involved in community outreach and education programs. To help us
achieve those goals, a reorganization has been implemented to shift the
management of our community programs to the Utilities' Sustainability office.
As part of this change, KDB personnel will report to Katherine Barnett in her
new role as the Sustainability and Customer Initiatives Manager. Katherine is

a former KDB board member and has helped support Solid Waste and KDB
staff following Lauren Barker's recent departure. Please join me in

KDB's mission and program of services is a vital component of Solid Waste's
efforts to maintain a clean and vibrant community. To that end,the Solid Waste
department will continue to provide funding for KDB personnel and
operations. All of us in Utilities are excited to improve support for KDB and

• DME Divisions—In an effort to streamline and provide the most effective and
efficient utilization of city resources and capabilities, DME GIS and DME
Communications Team will begin reporting to Technology Services effective
December 1, 2017. This will enable us to focus on the provision of services
and respond more flexibly to needs and innovations. The combination of these
enhancements will ultimately provide improved service to other city
departments and in turn, our residents. Additionally, in an effort to support the
continued growing demands and needed improvements to the Radio system,
staff will perform a comprehensive technical assessment of the radio system
to validate the current value or identify alternatives for the current solution.
In addition, the DME Warehouse function will begin reporting to Materials
Management department effective December 1, 2017. Staff contact: Bryan

C. ERCOT and Air Permit Emissions Limitations —At the City Council meeting on
Tuesday, November 14, Council Members inquired as to whether ERCOT could
ask the City to run the Denton Energy Center (DEC) even if it has reached the
emissions limit granted by the air permit. Under normal grid conditions, ERCOT
will not force a unit to operate beyond its operating parameters, such as its
emissions limits, unless an emergency is declared (e.g. life and/or safety risks,
such as the peak of summer and need for air conditioning, or a major unit(s)
tripping offline causing infrastructure instability). This would be a very rare
situation, but if such an emergency were to be declared by ERCOT, the DEC
would request and need to receive approval from TCEQ for an exception to exceed
emission limits. In these cases, it is likely that the request would be approved and
any associated penalties for exceeding the permit would not be applicable. Staff

D. DEC Air Permit and Emissions—During the November 14 City Council meeting,
Black and Veatch presented information related to the permitted emissions for
both DEC and Red Gate in pounds per million British thermal units (lb/mmBtu),
while in the draft report and in air permit, values are presented as pounds per hour
(lb/h). Black and Veatch converted the lb/h rates into lb/mmBtu rates to provide
an equal basis to compare the emission rates of the DEC and Red Gate. The plants
have different fuel input rates, therefore the emission rates were standardized to 1
mmBtu for direct comparison. The rates shown on presentation slide 13, were
calculated by dividing the permit lb/h value, by the fuel input rate of each plant
(DEC =154.4, RG=153.2). Additionally, Council Members asked if the emission
values contained in the air permit and those presented by Black and Veatch were
the same in the Wartsila contract. Because the emissions rates contained in the
Wartsila contract are considered proprietary information, Black and Veatch did
not have access to the contractual rates. Instead, Black and Veatch used the
publicly available air permit emission rates. By law, the DEC must comply with
the emissions rates set in the air permit, meaning the contractually guaranteed
emissions rates must be equal to or lower than those in the air permit. Staff has
verified this data. As noted by Black and Veatch in their presentation, the City of
Denton has an exhaust emissions guarantee in the contract that requires Wartsila
to meet the exhaust emissions rates set in the contract. Staff contact: Bryan

E. Mural at 122 N.Locust St. on the Square—On Monday,November 13,the Historic
Landmark Commission approved a certificate of appropriateness for a large mural
to be painted on the north and east facing walls of the building at 122 North Locust
Street. This building is presently known as Andy's and is located on the northeast
corner of the square. The building is a locally designated landmark. The
landmark commission approval was by a 5-0 decision with no controversy and
strong support. The approved certificate of appropriateness also includes deferred
maintenance such as awning fabric replacement, damaged wood veneer
replacement and removal and replacement of a non-contextual steel front door
with one more befitting if the existing fagade.
The painting is estimated to take 3 weeks and to begin this week. Below is a

F. Bonnie Brae Phase 1 —Below are a couple recent photos of the South Bonnie Brae
Widening and Improvements Phase I Project, which began construction on July
12, 2017. The limits of this project are from Roselawn to north of Vintage Blvd.
The Contractor, Ragle, Inc., was awarded a contract with a low bid of
$11,810,220.07. The construction work completed to date consists of clearing and
grading, embankment, bridge columns and beams, and storm drain. The Phase 1
construction is 25 %complete with an estimated completion date of July 11,2019.
This project is currently on schedule. Staff contact: Galen Gillum

G. Award for Preservation Denton Program — The City of Denton was awarded 1st
Place at the 16th Annual Texas Association of Telecommunications Officers and
Advisors (TATOA) for its Preservation Denton video series program. These
awards recognize excellence in broadcast, cable, multimedia, and electronic
programming produced by local government agencies from across Texas.TATOA
recently held its Annual Conference in San Antonio, Texas November 2nd & 3rd.
There were 213 entries for the awards and 27 categories that are further divided
by city budget. The City of Denton competes in the larger city category including:
Austin, Dallas, Houston, and San Antonio. DTV and Development Services
partnered together to produce the video series to recognize well-preserved
buildings in Denton and educate residents on active preservation efforts in the

H. Core Values Poster— In August 2017, City Manager Hileman rolled out 4 Core
Values to the organization: Integrity, Fiscal Responsibility, Transparency, and
Outstanding Customer Service. These core values have been integrated into all
City letterheads and templates, discussed in the employee internal newsletter, and
inserted into the new employee orientation and HR trainings. Staff has created a
poster that will be displayed in City facilities (please see attached). This initiative
will continue to be a high-priority focus to ensure that employees are aware of the
common expectations and core values of this organization. Staff contact: Todd

I. Villages of Carmel—At the November 7,2017 City Council meeting,Council had
some questions regarding the Villages of Carmel. The following description and
chart is intended to capture the ins and outs of the deal and why the $400,000 was
not necessarily a bad deal when taken into context of the value of the other
property transactions, which are typically how development deals are done. Staff
could have explained this item better and will be in the future. In fact, a core team
of employees from Capital Projects, Finance, CMO, and legal will oversee all
deals from now on.
Description:
The Parks Department desires to purchase the 6.4-acres on the southwest corner
of Edwards Road and Swisher Road,which is currently owned(but not platted)by
the developer. If purchased on its own and in its unplatted state, the Parks
Department would be responsible for improvements along Edwards Road (for a
total of about 400-feet). The developer has agreed to construct the portion of
Edwards Road that would be the Parks responsibility while constructing the
developer's required segment of Edwards Road. The developer also agreed to
absorb the Park's platting costs through the platting of the Villages of Carmel
Phases 5A and 5B. The developer further agreed to sell the park property at a
discounted rate to the City (current value $53,700/acre, agreed sale price is
$43,488/acre).
Additionally, the future alignment of Post Oak road is being dedicated by the
developer. Being that there is no guarantee that Post Oak will be constructed
within a specific time frame, consideration is given to the Post Oak dedication as
it effectively bisects the developer's tract and makes the portion (3.85-acres)
undevelopable. Under other circumstances,this property would be acquired at fair
market value upon initiation of a City capital improvement project.

Construction costs for both the City obligated and developer obligated portion of
Edwards Road is anticipated to be $475,000 if the City has the work done through
an existing City contract. As part of the recent agreement on the sale of the park
property, the developer is asking for a credit of his impact fees and a cost
participation for the construction of the road in the amount of$75,000 in exchange
for a developer's cost participation of $400,000. Staff recommends
reconsideration of this proposal as the net value of the Post Oak ROW and Parks
Property exceeds the requested City financial participation. Staff contact: Todd

J. Recorded Meetings — DTV recently began recording 4 additional committee
meetings for EDPB,Mobility Committee, Traffic Safety Commission,and Zoning
Board of Adjustment. Please see below preliminary information for average
number of views per meeting online and average of total DTV staff time required
to record and produce a meeting. Staff would like to collect a few additional weeks
of data and then could bring back a policy discussion to City Council to consider
which Boards/Commissions/Committee should be recorded and the staffing

Thanksgiving Operating Hours and Closings
City offices closed Nov. 23-24
DENTON,TX,Nov. 15,2017-City of Denton offices will be closed on Thursday,Nov. 23 and Friday,
Nov. 24 in observance of Thanksgiving.
Libraries
All three libraries will close at 6 p.m. on Wednesday,Nov. 22 and remain closed Thursday,Nov. 23 and
Friday,Nov. 24. Regular hours will resume on Saturday,Nov. 25.
Parks and Recreation
Denton Senior Center,Denton Natatorium, Denia Rec Center,MLK Jr. Rec Center,Denton Civic Center,
American Legion Hall,North Lakes Driving Range, and Goldfield Tennis Center will all be closed
Thursday,Nov. 23 and Friday,Nov. 24.
North Lakes Rec Center will be closed Thursday,Nov. 23 and reopen Friday,Nov. 24 from 8 a.m. to 9:30

Public Safety
Public safety personnel will be on duty during the holiday. The Denton Police Department can be reached

Solid Waste and Recycling
There will be no curbside collection on Thursday,Nov. 23. Thursday's route will be collected on Friday,
Nov. 24.
The City of Denton Landfill at ECO-W.E.R.C.S will be closed on Thursday,Nov. 23 and will be open 7
a.m. to noon on Friday,Nov. 24. Check www.dentonrecycles.com for current schedule information.
Utilities
Customer Service will be closed on Thursday,Nov. 23 and Friday,Nov. 24, and will reopen on Monday,
Nov. 27 during normal business hours. To report a utility service emergency, call utilities dispatch at
(940)349-7000.
Airport
Air traffic control tower services are not affected by the holiday and will remain open from 6 a.m. - 10
p.m. and the airfield will remain open 24 hours per day.

TO MAYOR AND CITY COUNCIL
SUBJECT:
New Municipal Annexation Procedures as it relates to Senate Bill 6.
BACKGROUND:
On August 12, 2017 the State Legislature approved Senate Bill 6 (SB 6), and is scheduled to go into
effect on December 1, 2017. The new legislation provides for revised municipal annexation
procedures for both voluntary and involuntary annexations.
The legislation divides counties and cities into two categories, and these categories determine which
annexation procedures a municipality must follow. A"tier 1 county" is a county with a population of
less than 500,000, and a"tier 2 county"is a county with a population of more than 500,000. A"tier 2
municipality" is a city wholly or partly located in a tier 2 county. Denton County is a tier 2 county,
and the City of Denton is a tier 2 municipality by virtue of being located in Denton County.
As a"tier 2 municipality"the city's authority to annex is divided into three categories as follows:
1. Petition by landowners(voluntary annexation).
a. The city must first negotiate a written service agreement with the property owner
which lists the services that will be available on the effective date of the
annexation, and a list of services that will be provided at a later date.
b. Two public hearings must be held, not less than ten business days apart. The first
public hearing will provide interested persons an opportunity to be heard. During
the second hearing, the governing body may adopt the annexation ordinance.
The process for voluntary annexation is expected to be as follows:
• Receive petition for voluntary annexation from landowner(s);
• Negotiate and execute the written service agreement;
• Schedule two public hearings with City Council to be held at least ten days apart;
• Provide written notice to school districts and public entities before the publication
requirement below;
• Publish notice in the newspaper for each public hearing at least once, and post the
notice on the city's website, leaving it up until the date of the hearing(s); and
• Conduct the second public hearing. Conduct the first reading of the annexation
ordinance and conduct the second reading within 30 days to adopt the ordinance.
2. Areas with a population of less than 200 (involuntary annexation).

Annexation may occur only if the following conditions are met:
a. The city adopts a resolution stating intent to annex the subject area.
b. Consent to annex is obtained by petition. The petition must be signed by more
than 50 percent of the registered voters in the subject area.
c. If the number of registered voters own less than 50 percent of the land in the
subject area, the petition must be signed by more than 50 percent of the
landowners in the area.
If the petition fails,the city must wait until the first anniversary of the date of the
petition period ended to begin the process again.
d. If a petition protesting the annexation of an area is signed by a number of
registered voters equal to at least 50 percent of the number of voters who voted in
the most recent municipal election and is received by the city secretary prior to
the end of the petition period,the annexation may not proceed without approval
of a majority of voters of the municipality at an election called and held for that
purpose.
The process for involuntary annexation of an area with a population of less than 200 is
expected to be as follows:
• City obtains and verifies consent to annex the area by petition;
• Adoption of resolution of intent to annex area, including services to be
provided;
• Not later than the seventh day after adopting the resolution of intent, mail
notice of result of petition to residents and property owners in area.
• Provide written notice to school districts and public entities not later than the
seventh day after the adoption date of the resolution of intent;
• Conduct at least one public hearing not earlier than the 21 st day and not later
than the 30th day after the adoption date of the resolution of intent;
• Hold final public hearing not earlier than the 1 Oth day after the date of the first
public hearing..
• If a petition protesting the annexation that is signed by a number of registered
voters that is equal to at least 50 percent of the number of voters who voted in
the last municipal election is received by the city secretary before the petition
period has completed,the city cannot complete the annexation until an
election is called and held for the purpose of permitting voters to decide
whether or not the city should annex the property.

provided;
• Not later than the seventh day after adopting the resolution of intent,mail to
residents and property owners in area notice of the proposed annexation that
includes:
o Notice of the initial public hearing;
o Notice that an election on the question of annexing the area will be held;
and
o A description, list and schedule of services to be provided;
• Provide written notice to school districts and public entities not later than the
seventh day after the adoption date of the resolution of intent;
• Conduct at the initial public hearing not earlier than the 2 1"day and not later
than the 30th day after the adoption date of the resolution of intent;
• Conduct at least one additional public hearing not earlier than the 31 st day and
not later than the 90th day after the adoption date of the resolution of intent;
• City obtains consent through election and, if needed,petition;

• If a petition protesting the annexation that is signed by a number of registered
voters that is equal to at least 50 percent of the number of voters who voted in
the last municipal election is received by the city secretary before the petition
period has completed,the city cannot complete the annexation until a
citywide election is called and held for the purpose of permitting voters to
decide whether or not the city should annex the property.
• Conduct citywide election if petition protesting annexation is received;
• After an election has determined that the majority of the registered voters of
the subject area are in favor of the proposed annexation, the city will:
o Provide notice to the residents of the area to be annexed;
o Hold a public hearing at which member of the public are given an
opportunity to be heard; and
o Hold a final public hearing not earlier than the 1 Oth day after the date of
the first public hearing at which the annexation ordinance may be
adopted.
o Conduct the first reading of the annexation ordinance and conduct the
second reading within 30 days to adopt the ordinance.
CONCLUSION:
The Planning Division will begin implementing the new annexation procedures beginning
December 1, 2017.

Small Area Plans and Overlay Districts
BACKGROUND:
On November 7, 2017 the City Council considered a Resolution to create a Steering Committee for a
Small Area Plan and Implementation Strategy for the area generally bounded by on the north by
Panhandle Street, on the east by Fort Worth Drive/Carroll Boulevard, and on the west and south
by Bonnie Brae Street and Interstate 35 East. At the meeting there was discussion regarding the
status of the Fry Street Small Area Plan and the Fry Street Overlay District if the proposed Small
Area Plan and Implementation Strategy is accepted by City Council.
DISCUSSION:
To understand the difference between Small Area Plans (Area Plans) and Overlay Districts it is
important to know the purpose of each. Area Plans allows long term planning for specific areas
in the city and allows for community members and stakeholders to provide input, create a shared
vision,and influence future development policies for a specific area. An Area Plan is the document
that contains all this information and recommendations for action. The Area Plan can recommend
new Overlay Districts within the plan, recommend areas for city-initiated zonings, recommend
code amendments, and recommend for capital improvement projects to be focused in the area.
Area Plans address the issues and challenges of a portion of the city regardless of the size of the
area. Area Plans cover a specific geography that often has a cohesive set of characteristics that
citizens and other stakeholders of the area want to protect and enhance.
The creation of or amendments to an Area Plan is adopted by Resolution by City Council and is
printed as a separate document. The City currently has four accepted Area Plans. Since 2003 with
the Downtown Master Plan and the Downtown Implementation Plan, the City has not accepted a
new Area Plan.

Overlay Districts are established to protect and enhance certain specific lands and structures
which, by virtue of their type or location, have characteristics that are distinct from lands and
structures outside such special districts. The districts contain necessary development
requirements to insure the protection and enhancement of said lands and structures. Such
requirements include, permitted uses, maximum density, height limitations, site design,
elevation requirements and parking requirements. Properties within an Overlay District shall
remain part of the underlying zoning designation. In the event of a conflict between the
underlying zoning designation and the Overlay Districts, the provisions of the Overlay Districts
shall apply.

The creation of or amendments to an Overlay District approved through the adoption of an
Ordinance and incorporated into the Denton Development Code. The City currently has seven
(7)adopted Overlay Districts. The last Overlay District adopted was the West Oak Area Historic
District.

CONCLUSION:
An Area Plan is a guiding document that establish a shared vision and sets development policies
for a specific area. An Overlay District is a Planning tool that outlines development requirements
that is consistent the vision and policies contained in the Area Plan. Often when an Area Plan is
updated, the associated Overlay District also is updated to reflect any major changes.
