II. General Information & Status Updates A. Organizational Updates — Please find below an update of recent organizational changes: 1. Capital Projects — Director of Capital Projects Galen Gillum has announced that he will be leaving the City of Denton, effective December OUR CORE VALUES Integrity • Fiscal Responsibility • Transparency 0 Outstanding Customer Service 31, to pursue other career interests. We greatly appreciate Galen's leadership over the last year to create the Capital Projects department,help organize processes, and move forward key capital projects and improvements. We wish him the best of luck in his future endeavors. Todd Estes,City Engineer,has been named the new Director. Todd joined the City of Denton in July 2017 from the City of Fort Worth where he worked for over four years to deliver$91 million in capital projects of all types and complexity. Prior to Fort Worth, Todd worked as the City Engineer for the City of Marble Falls and he previously worked in private consulting as a project manager and design engineer for private development projects. Please join us in thanking Galen for his service and congratulating Todd on his promotion. We look forward to continued progress under his leadership. 2. Finance Department—Director of Finance Chuck Springer has announced he will be resigning his position with the City of Denton to accept a position with the Town of Prosper as Executive Director of Administrative Services. His last day in the office will be Friday, December 29. Please join us in thanking Chuck for his service and leadership. He has been a pleasure to work with and we wish him well in his future endeavors. Antonio(Tony)Puente,currently the Assistant Finance Director,has been promoted to Finance Director. Tony first started with the City of Denton in 1999 as a Code Enforcement Officer, briefly left to work as a Budget Analyst for the City of Grand Prairie, and was rehired by Denton in 2001 as a Revenue Analyst. Since 2001, Tony has held various positions in the City of Denton's Finance Department overseeing the City's budget office, accounting, payroll, accounts payable, purchasing, municipal court, cash handling, investments and debt management. Please join us in congratulating Tony. 3. Municipal Court Administration—Municipal Court will remain under the management of the Finance Department;however,the division will report directly to Customer Service Manager Tiffany Thomson effective immediately. This change is designed to improve customer service, provide stronger oversight, and enhance the administration of payment transactions in City Hall East. 4. Communications and Public Affairs—Brian Daskam, Public Information Officer, and Robby Stengel, Public Communications Manager, have announced their resignations for the month of December to pursue other opportunities. We thank them for their years of service and wish them the best of luck. With the vacancies, management has analyzed restructuring Communications (Public Information Office, Public Communications Office, DTV, and Reprographics) and evaluated other organizational functions that could create better alignment and outreach to the residents, community, and other governmental agencies. As such, a new office will be created in the City Manager's Office called the Department of Public Affairs and Intergovernmental Relations. Sarah Kuechler has been named as Director and Jessica Rogers, currently Energy Services Manager in DME, has been named as Deputy Director. The office will lead and manage Communications, Intergovernmental Relations, and Strategic Initiatives (including the strategic plan, performance measures, managed competition, and special projects). Additionally, Community Development will be moved from Development Services to this department to provide a stronger connection to the City Manager's Office, enhance communication and oversight of programs and services,and provide a more holistic approach to addressing housing and homelessness. Council Work Session Room—On Saturday, December 9, a contractor will install a"smart glass"window for the Council Work Session Room to allow for the room to be easily transitioned for closed meetings. The "smart glass" consists of a film of liquefied crystal between two glass panes. In a neutral state, de-energized, the glass is opaque. When it is energized, through a simple on/off switch, it causes a reaction within the glass allowing it to be transparent. Staff contact: Mark Nelson C. Ethics Ordinance — The next meeting for City Council to work with Alan Bojorquez on development of an ethics ordinance is scheduled for a Work Session of the City Council on Tuesday, December 19 at 1:00 p.m. in the Council Work Session Room. Staff will work with Mr. Bojorquez to put together a schedule for the remaining sessions with an outline of planned topics to be discussed at each meeting. As directed, staff will draft the agenda to allow for Council to suspend the Rules of Procedures to provide an opportunity for public comment at Work Sessions where the ethics ordinance will be discussed. Staff contact: Bryan Langley D. TxDOT On-System Status Report — The December 2017 Texas Department of Transportation (TxDOT) On-System Report has been attached for your review. This report is updated by ITS staff on a monthly basis and provides current status regarding TxDOT On-System projects that may impact mobility in the Denton Area. This report is included as part of the Council Mobility Committee Backup and John Polster, ITS facilitates a discussion of the report as part of the monthly Mobility Committee Meeting. This report will be posted to the City of Denton website on December 11, 2017. Staff contact: Mark Nelson E. Prolonged Closure of Entrance Ramp from southbound US 77 onto I-35E — On Thursday, Dec. 7, TxDOT officials announced that the entrance ramp from southbound US 77 onto soundbound Interstate 35E will be closed for up to one year,beginning this Monday,Dec. 11. The closure is part of a construction project aimed at adding capacity and easing congestion along I-35E. Please see attached press release. Staff is working with the TxDOT project manager to provide us with more advanced notice of such closures and to understand the remaining I-35E project sequencing and traffic flow impacts. Staff contact: Mark Nelson F. City Hall West (CHW) Committee Meeting — The City Hall West Steering Committee will hold its initial meeting on December 18 at 5:30 p.m. at the Civic Center. This will include a report on the background of the project, discussion of the initial proposal from Architexas, and review of the charges for the committee from the City Council. In addition the committee will be discussing the committee ground rules including the policy regarding open meetings, placing items on the agenda, how minutes will be taken, public participation, and subsequent meeting dates. This initial meeting will immediately be followed by a tour of City Hall West so the committee can see the current state of the building and begin thinking about the possible future uses that will be discussed in the following meetings. Cedar Street Parking Lot — Please see attached a rendering of the Cedar Street Parking Lot at the conclusion of the full reconstruction project; expected to be complete by April 29,2018. Once complete,the parking lot will be improved with 86 parking spaces including four additional handicap spaces. Updates will also include benches, new security lighting, enhanced landscaping, wayfinding signage, and brick banding of the sidewalk, similar to what is currently on Cedar Street. Staff will install the light poles that are in the historic districts as directed by City Council during discussion of potential downtown improvement projects at the December 5, 2017 City Council Work Session meeting. Parks and Rec Presentation Follow-up — In response to questions related to the Parks and Recreation Department's presentations to Council on December 5, 2017, the following information has been gathered. How many acres of park land have been acquired through the Park Dedication program? Approximately 97 acres of park land have been dedicated through the program. See the chart below. Denton Police Appreciation Day—The Denton Citizens' Police Academy Alumni (DCPAA) will be hosting the Annual Denton Police Officers' Appreciation Day from 6 am on the morning of December 14 until 11 pm that night at the Denton Public Safety Training Center. Members of the DCPAA serve food, drinks and snacks throughout the day to all Denton Police employees. They also give away door prizes. The Denton CPAA has been hosting the event for 21 years. Denton Police Department Career Fair—The Denton Police Department will host a career fair on Saturday,January 6, 2018,beginning at 10:00am, at the Denton Public Safety Training Facility. The Denton Police Department is dedicated to engaging the community in a collaborative effort to enhance public safety and is seeking individuals who are dedicated to meeting the challenges of policing in an ever-changing environment. Any interested persons are invited to attend to learn about careers with the Police Department from police officers, duty officers, detention officers, and public safety dispatchers. The lunch will take place on Tuesday, December 19 from 11:30 a.m. to 1:30 p.m. at the Denton Public Safety Training Center. All donations will benefit the Denton Community Food Center (DCFC). See attached TxDOT construction report. • Other: Sidewalks are being constructed on both sides of the project, except from Hinkle to Carroll Boulevard due to ROW constraints. The District stated that the schematic was completed when sidewalks were not typically included in state projects. However,prior to letting the project, it was decided to add sidewalks everywhere they could be added. Mike Hainline, TxDOT's project manager at the time, stated that there is not room horizontally or vertically in this section of US 380. He also identified several conflicts at cross streets and Grandy's driveway. The primary issues were grade, right-of-way width, utility conflicts, and drainage concerns. • City participation: Funded city utility relocations. Will be working with TxDOT on landscaping. The closure is part of a construction project aimed at adding capacity and easing congestion along I-35E. BACKGROUND: On November 7, 2017 Council requested that staff research the possibilities of designating the Fine Arts Theater building (113-115 N. Elm St.) as a historic landmark and the Downtown Square as a historic district. The Fine Arts Theatre is not currently specifically designated as a historic landmark. There are three different levels in which a building or area can be designated as historic. This can be achieved in several ways: • Federal: the National Register of Historic Places (NRHP) through the National Parks Service; • State: Recorded Texas Historical Landmark(RTHL) through the Texas Historical Commission; • Local designation: historic landmark, historic district or historic conservation district. Currently, the Denton Courthouse Square is listed as a historic district through the National Register of Historic Places. The Denton County Courthouse is also designated as a Texas Historical Landmark, as well as City Hall West and the Campus Theatre (214 W. Hickory St.). DISCUSSION: Consideration of options to designate the Fine Arts Theatre as a State or local landmark or the Square as a local historic district. The following provides specifics on the each of the three levels of historic designations. National Register of Historic Places (Federal) Currently the Downtown Square is listed on the NRHP as the Denton County Courthouse Square Historical District. It was given this designation on December 28, 2000 and included a number of buildings as contributing towards that designation. The Fine Arts Theater is listed as a contributing building for the district along with 29 other buildings, sites, structures, and objects that can be found in the National Register Nomination File. The following applies to all buildings within a NRHP district: • Federal preservation grants for planning and rehabilitation are available. • Federal investment tax credits are available up to 20% of eligible costs. • Preservation easements for non-profits. • International building code fire and life safety alternatives available. • Property may be eligible for additional state tax benefits and grants. Texas currently offers a credit worth 25% of eligible rehabilitation costs. • NRHP designation puts no restriction on what a property owner may do with a property unless federal assistance is received. • Does not automatically invoke local historic district or landmark designation. Date: December 8,2017 Report No. 2017-086 Recorded Texas Historical Landmarks (State) Currently there are three buildings in the Downtown area that are designated as Recorded Texas Historical Landmarks: City Hall West, Campus Theatre, and the Denton County Courthouse. Buildings on the Downtown Square eligible for RTHL designation are those buildings at least 50 years of age and retains the integrity from a period of at least 50 years ago. (RTHL and NHRP designation are separate and are not a prerequisite for either designation nor do they guarantee listing in the other register.) The following applies to all RTHL buildings: • Buildings qualify for a 25%tax credit for eligible rehabilitation costs, but it is not necessary to receive the state tax credit. (An NRHP designation also allows a candidate to receive the tax credit.) • If a building is a RTHL then notification must be made to the Texas Historical Commission at least 60 days prior to any alterations being made to the building. • If the changes made to the structure are unwarranted or appreciable then the State Marker Review Board may withdraw the designation. Locally Designated Historic Landmarks or Districts (Local) A building or district can also be designated at the local level through the City Council. There are seven buildings, as shown in Attachment 1, that are local historic landmarks in the Downtown Square. The Fine Arts Theatre is not currently a historic landmark.The Denton Development Code lists 13 criteria that allow designation of a landmark and one is "Recognition as a recorded state historic landmark, a national historic landmark or entered into the National Register of Historic Places". Typically the owner of a property applies for a historic landmark designation. There has been no precedent where the City initiated a designation. An informal staff report was provided to the Historic Landmark Commission (HLC) in 2013 about the designation of the Courthouse Square as a local historic district,but there was no interest from the property owners at that time. In January 2018, the HLC will receive a report and hold a discussion regarding locally designating the Downtown Square and surrounding area as a historic district. The following applies to buildings designated as a local historic landmark: • Eligible for exemptions of 50% of city property taxes for 10 years may be granted based on certain criteria. (Denton City Charter; Chapter 10; Article VI—VII) • Buildings within a historic district are not eligible for the tax exemption unless those buildings are also separately designated as a historic landmark. • A Certificate of Appropriateness is required for any work except routine maintenance. • Applications for a Certificate of Appropriateness must be approved by the HLC prior to beginning work on a historic landmark building or on buildings in a historic district or conservation district. BACKGROUND: Over the last several weeks, the City Council has received numerous citizen letters regarding requests to implement and/or improve multifamily recycling, composting, and construction material diversion. Last week, a resident contacted Solid Waste staff and stated that representatives from Texas Campaign for the Environment were canvassing their neighborhood and distributing the attached flyers. Many of the letters being sent to Council are likely the result of this group's efforts. The resident also stated that the canvasser requested donations and claimed to be working directly with members of the City Council. On November 22, 2017, Council received the attached email from the DFW Program Director for Texas Campaign for the Environment. More information about this organization can be found by visiting https://www.texasenvironment.orW. The subject matter highlighted by the flyers and citizen letters are key focus areas for the Solid Waste department. While City of Denton recycling services are available to all commercial and multifamily entities, staff acknowledges the need to improve upon the 41.5%recycling adoption rate for multifamily properties. Staff is actively working on strategies to increase recycling accessibility for multifamily tenants, and an update on these efforts was provided to the Council Committee on the Environment on November 6, 2017. A copy of the presentation is attached. Staff continues to work with the Committee on the Environment on strategies to improve multifamily recycling, and will bring a final draft of these efforts to the Public Utilities Board and City Council when completed. In regards to composting, a staff report detailing the City of Denton's Dyno Dirt operation was provided to Council as part of the November 10, 2017 reading file. As for the diversion of construction materials, Solid Waste's Building Materials Recovery operation diverts,processes, and sells construction and demolition materials such as wood, concrete, and metal. The Solid Waste department is dedicated to waste minimization and sustainable business practices, and staff appreciates our citizens' input and commitment to improving our city's performance in these areas. However,businesses and apartments are recycling much less,with far fewer properties even offering recycling services to their tenants and residents. Denton is undergoing many development changes—Including re-zoning many areas to attract new businesses and residents. With these rapid expansions,Denton needs to ensure that it is developed sustainably,or it runs the risk of needing to construct a new landfill at the expense of its taxpayers. 16 Last year,the Denton sanitation department created a 10-year plan to reduce waste and extend the life of its landfill.This plan did not include many programs that traditionally raise recycling rates,and one major piece of the plan—mining the landfill for resources—was completely abandoned before it was started.Denton is now in a position to reconsider its priorities in planning for increased recycling. Our organization is excited and eager to hear recent developments on the city's pursuit of an ordinance to expand access to multi-family and commercial recycling throughout Denton. Universal recycling ordinances have been effective in a number of cities throughout Texas and the U.S. in helping reduce waste and increase resource recovery. Like most cities, the majority of Denton's waste is generated by commercial and multi-family establishments, and without good standards or requirements for providing basic recycling services, many tenants and residents are left in the lurch with no option but to trash everything they discard. I've attached some professional research from other cities on multi-family recycling.You'll see one of the reports was generated with funding from our Zero Waste project and it includes focus groups with apartment tenants and managers in Dallas.The other resources were generated by a consulting group outside of Texas and contain some good universal info for local governments on this topic. I hope you find these resources helpful and informative as you seek the best policy measures to address recycling in the city. Texas Campaign for the Environment is continuing to organize in Denton communities to build support for universal recycling. Our supporters have already written hundreds of letters to your offices—not only on this issue, but on other waste diversion programs as well.The City of Denton has undergone many recent changes in staff and leadership, including the Director of Solid Waste, which has resulted in changes to Denton's 2016 Strategic Plan for solid waste and recycling. (By the way,we congratulate your recent decision to disband the landfill mining project, an all-too-expensive and dangerous endeavor.) We believe the city's strategic recycling plan should reflect the values of the city's new leadership and the will of its citizens. In addition to our recommendation for a Universal Recycling Ordinance,we also urge you to reconsider the strategies and goals of this plan by involving residents, businesses,and community leaders in public discussion on how the city can continue to innovate and strive for a more circular economy for its resources.
