Scope of Work Towing Services The scope of work shall be finalized upon the selection of the Firm. The respondent’s submission shall have accurately described your understanding of the objectives and scope of the requested products and services and provided an outline of your process to implement the requirements of the Scope of Work and Services. It is anticipated that the scope of work will include, at a minimum, the following: SPECIFICATIONS Service Specifications: The awarded contractor shall provide vehicle towing and other related services primarily within the City limits of Denton, Texas, on an as-needed basis upon request of City personnel, 7 days a week, 24 hours a day. No calls for towing service may be referred or subcontracted to any other towing services or operator except on prior written approval by City personnel. In the case of an emergency situation that involves the need to tow multiple vehicles at the same time, prior written approval will be waived. The awarded contractor shall provide one phone number for all requests for towing service. The phone number provided shall be answered 24 hours a day, seven days a week. Contractor shall respond to all calls within 30 minutes of notification by City personnel. If needed, additional trucks shall be provided within 30 minutes of notification by City personnel. In the event that Vendor is unable to provide towing services as requested by the City, contractor shall immediately advise the requesting employee in order that additional towing services may be obtained. Pursuant to this agreement, upon arrival at the scene of any vehicle accident, contractor shall promptly remove from the roadway all debris, including glass, resulting from the accident and dispose of said debris in an appropriate manner. In doing so, contractor shall comply will all traffic laws and regulations and any direction of City law enforcement or other public safety officers, and shall exercise reasonable care in performing such work. Pursuant to this agreement, upon arrival at the scene of any vehicle accident, contractor shall promptly cause the absorption and removal of vehicle fluid spilled on roadways as a result of the accident. In doing so, contractor shall comply with all traffic laws and regulations and any direction of City law enforcement or other public safety officers, and shall exercise reasonable care in performing such work. Service Specifications (Continued): Before towing a vehicle, the contractor shall check the following items to verify accuracy and completeness: Verify license number, year, make and body style of vehicle if possible; Inspect the vehicle prior to towing and ensure that the officer has marked all significant damage, items missing off the vehicle and any and all property therein. The contractor shall do everything possible to minimize further damage to vehicles. All City vehicles towed from the scene of a collision shall be delivered to a location specified by City. No inoperable vehicles may be left illegally parked on a public street or alleyway. Contractor shall make available competent supervision of employees to assure complete and satisfactory fulfillment of the work and the terms of this agreement. A capable, fully authorized representative of the contractor shall be available during all work activities to receive any and all instructions from the City. Contractor shall be thoroughly familiar with all safety measures pertinent to towing vehicles and equipment. This shall include, but not be limited to, any local, City, County, State, and Federal rules, ordinances, laws and regulations as set forth now and enacted in the future and shall continue throughout the term of this agreement. Contractor shall comply will all changes in City ordinances, State or Federal laws within 30 days after said change is made or sooner, if required. Contractor shall be responsible for instructing employees in all measures and compliance. Contractor shall operate as an independent contractor and not as an agent, representative, servant or employee of the City. Contractor shall be solely responsible for the acts and omissions of its officers, agents, contractors, subcontractors, servants and employees, and nothing in any agreement shall be construed as creating a partnership or joint enterprise between the City and contractor. The City shall refer exclusively to the contractor all requests for towing services, except in the following instances: When contractor cannot perform towing due to limitations of its equipment; When contractor cannot provide the number of tow trucks needed; When contractor fails to respond promptly to a request; or The City of Denton will not be responsible for any fees associated with towing or related services of privately-owned vehicles. Invoices for the towing of City-owned vehicles and equipment shall be emailed to fleetservices@cityofdenton.com within 2 weeks of the provided service, and the invoice shall contain details of vehicle towed, the date and time of service, and an itemized listing of all service rendered. Invoices not received within 2 weeks of the date of service will be deemed to be a gratuitous service by the contractor, and the invoice will not be paid by the City. Equipment Requirements: Contractor agrees to maintain and operate all equipment used to provide service under this contract in compliance with Texas statutes and regulations. Contractor shall have a minimum of two (2) one-ton tow trucks with a minimum of 10,000 lbs towing capacity, and a minimum of one (1) additional one-ton tow truck with the same towing capacity available within ½ hour upon request by City personnel. Contractor shall have a minimum of one (1) tow truck having a towing capacity up to 70,000 lbs available within ½ hour upon request by City personnel. Only factory tow trucks, or tow trucks equivalent to factory tow trucks in parts, function and modernity, not exceeding 20 years in age (unless the tow truck is inspected and approved by Fleet Services) may be used to provide services under this contract. Each tow truck must be equipped with the following items, in good working condition: Dual rear wheels; An operable winch with workable, safe, un-frayed cable of 100 feet x 3/8 inch; Flashing warning lights that comply with TEX. TRANSP. CODE ANN. §547.305 (Vernon Supp. 2004-2005); One set of dollies; One set of snatch blocks; One set of scotch blocks (rear wheel blocks); Vacuum, electric, hydraulic or air lock for brakes, in addition to regular emergency brakes; Tow sling, mechanical lift, or hydraulic lift which is sufficient to prevent the swinging of any equipment or vehicle being transported; One pair of hook chains (on older models); Adjustable wrecker booms or boom; Rope, wire, or straps suitable for securing doors, hoods, trunks, etc.; Adequate tools to remove drive shafts, wheels and other parts of vehicles; Push broom, large shovel or dustpan to remove all debris from the roadway; Adequate containers to store glass and debris removed from the roadway; A kit that includes, at a minimum, one crowbar or wrecking bar, a spotlight or flashlight, extra batteries, fire extinguisher, rags, jumper cables, small first aid kit, small 1 and 2 inch blocking devices, vehicle door unlocking devices, air compressor or air pumping devices adequate to inflate an automobile tire and current maps of the City and County; Three portable red emergency reflectors, orange safety cones, or flares; and Portable magnetic auxiliary tail lamps and turn signals (red or amber) to be used on all vehicles that do not have functioning lights. Personnel Requirements: Contractor shall employ and maintain sufficient personnel and staffing to operate a minimum of two (2) tow trucks available within 30 minutes upon request by City personnel. Contractor shall conduct a thorough background investigation of all personnel, including a check of both driving record and criminal history, and shall not assign to operations within the City at any time personnel who have been convicted of any crime of moral turpitude, burglary or theft, any felony, a DWI, or DUI. In addition, no personnel shall have any history of addiction or abuse of alcohol, substance abuse, or reckless or negligent driving, or who otherwise demonstrate that it would be unsafe for such employee to be allowed to drive. To the extent legally permitted, contractor shall conduct drug testing of employees prior to hire or prior to the initiation of services under this agreement, and no employee shall be assigned to operations within the City at any time after positive results for any illegal drug. Every driver providing service under this contract shall have a valid Texas Driver’s License of the type required for the vehicle operation.
