WHEREAS, the City has solicited, received and tabulated campetitive bids for the
construction af public works or improvements in accordance with the procedures of State law and
City ordinances; and
WHER AS, the City Manager or a designated employee has received and recommended that
the herein descriUed Uids are tl e lowest responsible bids for thc construction af thc public warks or
improvements described in the bid invitatian, bid proposals and plans and specifications therein;
NOW, THEREFORE,

SECTION 1. That the following competitive bids for the constructian of public works ar
improvements, as described in the "Bid Invitatians", "Bid Proposals" or plans and specifications on
file in the Office of the City's Purchasing Agent filed according to the bid number assigned hereto,
are hereby accepted and appraved as being the lawest responsible bids:

SECTION 2. That the acceptance and approval of the above competitive bids shall not
constitute a cantract between the City and the person submiiting the bid for canstruction af such
public works ar improvements herein accepted and appraved, until such person shall comply with all
requirements specified in the Natice to Bidders including the timely execution of a written contract
and furnishing of performance and payment bonds, and insurance certificate after natification of the
award of the bid.
S CTION 3, That the City Manager is hereby authorized to execute all necessary written
contracts for the performance ofthe construction of the public works ar improvements in accordance
with the bids accepted and appraved herein, provided that such contracts are made in accoi°dance
with the Notice to Bidders and Bid Proposals, and documents relating thereto specifying the terms,
conditions, plans and specifications, standards, quantities and specified sums contained therein.
1 "'l`7'e. The City Council of the City of Denton, Texas hereby expressly delegates the
authority to take any actions that may be required or permitted to be performed by the City ofDenton
under the IFB 6792 to the City Manager of the City of Denton, Texas, or his designee.
SECTION 5. That upon acceptance and approval of the above competitive bids and the
execution of contracts for the public works and improvements as authorized herein, the City Council
hereby authorizes the expenditure of funds in the manner and in the amount as specified in such
approved bids and authorized contracts executed pursuant thereto.
SECTION 6. That this ordinance shall become effective immediately upon its passage and
approval.
