AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF A THIRD AMENDMENT TO A
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND
TEAGUE NALL AND PERKINS, INC., AMENDING THE CONTRACT APPROVED BY CITY
COUNCIL ON OCTOBER 16, 2018, IN THE NOT-TO-EXCEED AMOUNT OF $167,500;
AMENDED BY AMENDMENTS 1-2 APPROVED BY CITY COUNCIL AND PURCHASING
STAFF; SAID THIRD AMENDMENT TO PROVIDE APPRAISAL SERVICES FOR THE WEST
HICKORY STREET DRAINAGE, PAVING AND SIDEWALK PROJECT; PROVIDING FOR
THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE
(FILE 6590-043-PROVIDING FOR AN ADDITIONAL THIRD AMENDMENT EXPENDITURE
AMOUNT NOT-TO-EXCEED $64,625, WITH THE TOTAL CONTRACT AMOUNT NO-TO-
EXCEED $341,425).
WHEREAS, on October 16, 2018, by Ordinance No. 18-1664, the City awarded a contract to
Teague Nall & Perkins, Inc. in the amount of $167,500 for Engineering Related Professional
Services for the West Hickory Street Drainage, Paving and Sidewalks Project; and
WHEREAS, on March 26, 2019, by Ordinance No. 19-527, the City awarded a first
amendment to the contract between the City of Denton and Teague Nall & Perkins in the amount of
$90,300; and
WHEREAS, on July 17, 2019, the Purchasing Department awarded a second amendment to
the contract between the City ofDenton and Teague Nall & Perkins in the amount of$19,000; and
WHEREAS, the additional fees under the proposed Third Amendment are fair and reasonable
and are consistent with and not higher than the recommended practices and fees applicable to the
Provider's profession and such fees do not exceed the maximum provided by law; NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Third Amendment, increasing the amount ofthe contract between the City
and Teague Nall & Perkins, Inc., which is on file in the office ofthe Purchasing Agent, in the amount
of Sixty-Four Thousand Six Hundred Twenty-Five and 00/100 ($64,625) Dollars, is hereby approved
and the expenditure of funds therefor is hereby authorized in accordance with said amendment. The
total contract amount increases to $341,425.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
