20-429 - 7228 - Ordinance ExecutedORDINANCE NO. 20-429 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL CORPORATION, AUTHORIZING THE CITY MANAGER TO EXECUTE A DESIGN-BUILD AGREEMENT WITH THOS. S. BYRNE, INC., FOR THE DESIGN, ENGINEERING, AND RENOVATION OF THE DEVELOPMENT SERVICES BUILDING, LOCATED AT 401 NORTH ELM STREET; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (RFQ 7228-AWARDED TO BYRNE CONSTRUCTION SERVICES (BCS), IN THE NOT-TO-EXCEED AMOUNT OF $206,150). WHEREAS, Thos. S. Byrne, the design-builder (the "Provider") set forth in this ordinance is being selected as the most highly qualified on the basis of its demonstrated competence and qualifications to perform the proposed services; and WHEREAS, the fees under the proposed agreement are fair, and reasonable; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Manager is authorized to enter into a design-build agreement, a copy of which is attached here as Exhibit "A", with Thos. S. Byrne, Inc., for the design, engineering and renovation of the Development Services Building, located at 401 North Elm Street for the City of Denton. SECTION 2. The City Manager is authorized to expend funds as required by the attached agreement. SECTION 3. The City Council of the City of Denton, expressly delegates the authority to take any actions that may be required or permitted to be performed by the City of Denton under this ordinance, to the City Manager of the City of Denton, or his designee. SECTION 4. The findings in the preamble of this ordinance are incorporated herein by reference. SECTION 5. This ordinance shall become effective immediately upon its passage and approval.
