SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a Professional Services Agreement between the City of
Denton and Pape-Dawson Engineers, LLC, amending the contract approved by City Council on July 17,
2018, in the not-to-exceed amount of $607,550, amended by Amendment 1 approved by Purchasing Staff
in the not-to-exceed amount of $638,050; said second amendment to provide for professional services
related to the 2019 Street Reconstruction Project to reconstruct the roadways, replace damaged curb and
gutter, analysis of two drainage areas, and inventory the sidewalks along roadways and to provide
construction services such as review of submittal, Requests for Information, Change Order, etc.; providing
for the expenditure of funds therefor; and providing an effective date (File 6590-006 – providing for an
additional amendment expenditure amount not-to-exceed $36,000, with the total contract amount not-to-
exceed $674,050).
INFORMATION /BACKGROUND
The 2019 Street Reconstruction Project consists of the reconstruction of roadways: Windsor Street between
Locust Street and East of Old North, Hercules between North Locust Street and Sherman Drive, Scripture
Street between Thomas Street and Jagoe Street, and Thomas Street between Panhandle and Oak Street. This
reconstruction shall include new curb and gutter ADA compliant ramps at sidewalks, asphalt or concrete
roadways as well as upgraded drainage, water, and wastewater facilities.
The original Professional Services Agreement did not include construction management services. At this
time, it has been determined that these additional construction management services are necessary to keep
this project on schedule. The construction management services will include a review of contract submittals,
review of requests for information, review of possible change orders and submittal of as-built plans. These
services will be performed on an as-needed basis as approved by the City of Denton Project Manager.
In 2019, the project was sent out to bid and awarded to the lowest bidder, Quality Excavation. The project
is currently under construction.
Request for Qualifications for professional engineering services was solicited using the City’s formal
solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018 and
June 5, 2018 (Ordinance 2018-331).

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional
engineering firms (Ordinance 2018-331).
On July 17, 2018, Council approved a Professional Engineering Services Agreement with Pape-Dawson
Engineers, LLC in the amount of $607,550 (Ordinance 18-1107).
On September 16, 2019, Purchasing Staff approved Contract Amendment #1 to the Professional Services
Agreement with Pape-Dawson Engineers, LLC in the amount of $30,500.
RECOMMENDATION
Award Amendment No. 2 with Pape-Dawson Engineers, LLC, for additional design services for the 2019
Street Reconstruction Project, in the not-to-exceed amount of $36,000, for a total amended contract amount
of $674,050.

These services will be funded from CO 12 2019 St Reconstruction account 350496402.1360.40100.
Purchase Order #186324 will be revised to include upon approval the amount of $36,000. The budgeted
amount for this item is $674,050.
