SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager, or his designee, to execute a construction manager at risk contract with Thos.
S. Byrne, Inc., a Texas corporation, for pre-construction services for the renovation of police headquarters
and development and construction of the police substation and firing range; providing for the expenditure
of funds therefor; and providing an effective date (RFQ 7249 – CMAR awarded to Thos. S. Byrne, Inc., in
the not-to-exceed amount of $45,000 for pre-construction services).
INFORMATION/BACKGROUND
The City of Denton’s Public Safety projects consist of the renovation of the existing headquarters building
to bring it up to standards of the industry and accommodate a more efficient layout; a new remote substation
to address the identified need in that location; and indoor firing range to allow the city the proper training
of the public safety staff. These projects were part of the recent bond passed November 5, 2019.
The design team, headed by Brandstetter Carroll, Inc., was awarded the contract for the design and
engineering services for these three public safety projects in second quarter of 2019. They were authorized
to complete conceptual design through August 1, 2020, and then suspended work pending the decision of
the voters. Design work re-commenced immediately upon bond vote certification, and currently continues
to stay on schedule.
Request for Qualifications (RFQ) for a construction manager at risk for the renovation of police
headquarters and development and construction of the police substation and firing range was sent to 866
prospective firms for these services. In addition, the RFQ was placed on the Materials Management website
for prospective respondents to download and advertised in the local newspaper. Five (5) statement of
qualifications (SOQ) were received. The SOQs were evaluated based on published criteria including
qualifications of the firm, proven project success, and the firm’s stabillity. Based upon this evaluation, a
short-list of the three (3) most qualified received a Request for Proposal and an Interview Invitation. After
scoring the interviews and the proposals received, the Evaluation Committee recommended Byrne
Construction Services (or “BCS”) as the most qualified of the candidates, subject to successfully negotiating
an agreement with terms acceptable to the City.

The negotiations with BCS resulted in the AIA A133 Owner-CMAR Agreement attached to the Ordinance,
which authorizes BCS to provide preconstruction services for the fee of $45,000. It is important to note
this Agreement is only for preconstruction services and anticipates an Amendment for the cost of the actual
construction itself, which may come before City Council for their consideration and approval later this year,
or first quarter of 2021.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On November 19, 2019, Council approved the use of Construction Manager at Risk (CMAR) delivery
method for the construction of the Public Safety Facilities (Resolution 19-2440).
On May 12, 2019, Council approved a Professional Services Agreement with Brandstetter Carroll, Inc., to
provide professional architectural design services for the Expansion of Police Headquarters and Public
Safety Dispatch Area and Construction of a New Police Substation (Ordinance 19-1114).
RECOMMENDATION
Award a contract with Thos. S. Byrne, Inc., for the renovation of police headquarters, and development of
the police substation and firing range, in a not-to-exceed amount of $45,000.

ESTIMATED SCHEDULE OF PROJECT
The preconstruction services in this contract will be complete by March 31, 2021, barring further unforeseen
circumstances or termination by the City for convenience.
FISCAL INFORMATION
These services will be funded from Public Safety Facilities account 100273473.1365.20100. Requisition
#146397 has been entered into the Purchasing software system in the amount of $45,000. The budgeted
amount for this item is $45,000.
