SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a Professional Services Agreement with O’Brien Engineering, Inc.
for engineering services relating to the erosion issues along Cooper Creek, in a section behind Burning Tree
Lane; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6590-066 –
Professional Services Agreement for engineering services awarded to O’Brien Engineering, Inc., in the not-
to-exceed amount of $64,446).
RFQ INFORMATION/BACKGROUND
The City of Denton has experienced stream bank erosion issues along Cooper Creek, specifically behind
the properties along Burning Tree Lane. The existing stream bank has eroded away in some areas to near
vertical slopes. Approximately fifteen (15) years ago, concrete bags were placed along the bank to slow
down the erosion. The intent is to analyze the existing conditions along the eroded section of the Cooper
Creek and develop feasible solutions for restoring the stability of the stream bank slopes.
Request for Qualifications for professional engineering services was solicited using the City’s formal
solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018, and
June 5, 2018 (Ordinance 2018-331).
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional
engineering firms (Ordinance 2018-331).
RECOMMENDATION
Award a contract with O’Brien Engineering, Inc., for the supply of engineering services relating to the
erosion issues along Cooper Creek, in a section behind Burning Tree Lane, in a not-to-exceed amount of
$64,446.

This project will be started upon approval with a completion date by May 2020.
FISCAL INFORMATION
These services will be funded from the Cooper Creek Erosion Project account 650124561.1360.21100.
Requisition #143263 has been entered into the Purchasing software system in the amount of $64,446. The
budgeted amount for this item is $64,446.
