SUBJECT
Consider adoption of an ordinance of the City of Denton, Texas authorizing the approval of a sixth
amendment to a professional services agreement between the City of Denton and Freese and Nichols, Inc.
(FNI), amending the contract approved by City Council on June 16, 2009, in the not-to-exceed amount of
$301,545, amended by Amendments 1-5 approved by the City Manager and Purchasing staff, said sixth
amendment to provide additional engineering services related to the PEC 4 Drainage Improvements Phase
1 and 2 project in the amount of $62,000; providing for the expenditure of funds therefor; and providing an
effective date (File 4437-providing for an additional sixth amendment expenditure amount not-to-exceed
$62,000, with the total contract amount not-to-exceed $466,289).
BACKGROUND
City Council approved a contract in the amount of $301,545.00 with Freese and Nichols, Inc. (FNI) on June
16, 2009 for engineering services associated with the PEC 4 Drainage Improvements Phase 1 and 2 project
(Exhibit 2-Location Map). Since the contract’s execution, there have been five (5) amendments to the
contract. Amendment 1 was in the amount of $750.00 was for additional survey work for a temporary and
permanent easement. Amendment 2 in the amount of $25,950.00 was for the survey and the design of
approximately 500 linear feet of storm drain along Locust Street. Amendment 3 in the amount of $15,700.00
was for the survey and design of a 6-inch sanitary sewer line on Wainwright Street. Amendment 4 in the
amount of $27,363.00 was to incorporate the Locust Street Water and Sewer Relocation Project plans with
the PEC 4 Phase 1 Drainage Project plans in order to bid them as a combined project. Amendment 5 in the
amount of $32,981.00 was to adjust the PEC 4 Phase 2 Drainage plans to resolve conflicts with the Elm
Street Utility Relocation Project, the design of additional storm drain along Elm Street, and add structural
modifications to the transition between Phase 2 and the future Phase 3 of this project (Exhibit 3). All of
these amendment dollar amounts were within the approval authority of the City Manager or Purchasing
staff.
The purpose of Amendment 6 is to allow Freese and Nichols to finalize the Elm and Locust utility plans,
paving and striping plans, and corresponding specifications (originally being done in-house), along with
the addition of plans and details for the inclusion of conduit for future fiber optic facilities. The change in
scope necessitates additional design and bid effort adding $62,000.00 to the lump sum portion of the basic
services fee for a revised contract fee of $466,289.
RECOMMENDATION
Approve Amendment 6 to Contract 4437 in an amount not-to-exceed $62,000 for a total contract award of
$466,289.

ESTIMATED SCHEDULE OF PROJECT
The consultant is prepared to begin the services associated with this Amendment immediately with the
goal of completing design December 2017 to facilitate construction to begin April 2018.
