SUBJECT
Consider approval of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with McMahon Contracting, L.P., for the construction
of the Hickory Creek Road Phase 1 (East) project; providing for the expenditure of funds therefor; and
providing an effective date (IFB 7206 – awarded to McMahon Contracting, L.P. in the not-to-exceed
amount of $1,515,949.07).
INFORMATION /BACKGROUND
The Hickory Creek Road Phase I (East) project consists of the extension of eastbound lanes from FM 2499
to Nautical Lane, a traffic signal at the FM 2499 intersection, and an acceleration lane along southbound
FM 2499. The road is currently two-lanes undivided (one lane in each direction). This project will involve
construction of two new lanes, both of which will be eastbound. The existing eastbound lane will be
converted to a 2nd westbound lane. There will be room to construct two additional inside lanes (one in each
direction) in the future if desired.
The southbound acceleration lane along FM 2499 is to address a safety issue resulting from TxDOT's recent
construction of a sound wall along the west side of FM 2499, north of the intersection. Vehicles approaching
the intersection from the west, intending to turn southbound along FM 2499, have their view of the
southbound traffic coming from the north side of the intersection obstructed by this wall.
These improvements will improve traffic flow and traffic safety in the immediate area and is a part of our
multi-phase Hickory Creek Road corridor improvements.
The engineer’s opinion of probable construction cost (OPCC) for the base bid was $2,282,031.91. All the
bid prices fell within the engineer’s OPCC range.
The project total cost of $1,515,949.07 for Hickory Creek Road Phase 1 (East) project construction consists
of: $1,443,761.02 total base bid; and a $72,188.05 contingency. A five (5) percent contingency allowance,
if any, is for the sole use of the City and will be subject to written authorization by the City’s Project
Manager and Program Manager.
Invitation for Bids was sent to 371 prospective suppliers of this item. In addition, specifications were placed
on the Materials Management website for prospective suppliers to download and advertised in the local
newspaper. Six (6) bids meeting specifications were received. The lowest bid was received by McMahon
Contracting, L.P.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 22, 2018, Council approved a design contract for Transystems in the amount of $240,000 for the
Hickory Creek Phase 1 Project.
On October 14, 2018, Council approved Amendment #1 to the original design contract in the amount of
$56,884.00 to add an acceleration lane to Southbound FM 2499.
RECOMMENDATION
Award a contract with McMahon Contracting, L.P., for the construction of the Hickory Creek Road Phase
1 (East) project, in a not-to-exceed amount of $1,515,949.07.

FISCAL INFORMATION

250045444.1360.40100. Requisition #147027 has been entered into the Purchasing software system in the
amount of $1,443,761.02. The budgeted amount for this item is $1,515,949.07.
