SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with Brycer, LLC, for the inspection, testing, and
maintenance report system, The Compliance Engine, for the Denton Fire Department, through the Public
Procurement Authority Contract Number 1406; providing for the expenditure of funds therefor; and
providing an effective date (RFP 7372 – awarded to Brycer, LLC, for a three (3) year term, with the option
for one (1) additional two (2) year extension).
INFORMATION/BACKGROUND
The Denton Fire Department (DFD) is responsible for tracking the inspection, testing, and maintenance of
fire protection systems within the City of Denton. Occupancies that have fire protection systems installed
are required by the DFD's adopted fire code to have the systems inspected and tested on a regular basis.
Currently, the City of Denton Fire Department is the only city in the DFW metroplex that requires a fire
inspector to witness annual fire protection system testing. Then, the DFD charges the business owner or
building owner $35 per fire protection system tested in addition to fees charged by the testing contractor.
There are fire protection systems in the City of Denton that go untested on an annual basis due to a lack of
resources.
With the addition of The Compliance Engine, a web-based tool used to monitor the status of fire protection
systems, a fire inspector will not be required to witness the testing of all fire protection systems. Instead,
the testing contractor will conduct the inspections and testing, as they already do, then they will submit their
reports directly to the DFD via Brycer’s web portal. This will facilitate a more efficient review, tracking,
and follow-up process with occupants to correct deficiencies and maintain systems. The Compliance Engine
will provide the DFD with a list of all fire protection systems in the City of Denton and their statuses. A
DFD fire inspection will not be initiated unless there is a deficiency with a fire protection system. Instead
of the business owner paying the fee directly to the City, the testing contractor will pay the fee of $35 per
fire protection system at the time the report is uploaded to The Compliance Engine. Then, The Compliance
Engine will pay the City, after collecting a 6% fee.
The service will be no cost to the City or Denton Fire Department. The Compliance Engine will increase
the amount of revenue generated for the City. It will also allow for a highly efficient use of Fire Prevention
resources.
Pricing obtained through the Public Procurement Authority (PPA) has been competitively bid and meets
the statutory requirements of Texas Local Government Code 271.102.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On December 4, 2018, Council approved the interlocal agreement with the Public Procurement Authority
(Ordinance 18-2049).
RECOMMENDATION
Award a contract with Brycer, LLC, for the inspection, testing, and maintenance report system, The
Compliance Engine, for the Denton Fire Department, in a three (3) year, with the option for one (1)
additional two (2) year extension.

This is an initial three (3) year contract with option to extend the contract for one (1) additional two (2) year
period, with all terms and conditions remaining the same.
FISCAL INFORMATION
The service will be no cost to the City or Denton Fire Department. The Compliance Engine will increase
the amount of revenue generated. Revenue received will be deposited into the Fire Inspection account
1000.4412.
