AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICEPAL
CORPORATION, AUTHORIZING THE APPROVAL OF A SECOND AMENDMENT TO A
PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND GROUP
FOR HORIZON ENTERTAINMENT INC. DBA RANGER GUARD & INVESTIGATIONS,
AMENDING THE CONTRACT APPROVED ON MARCH 24, 2020, IN THE NOT-TO-EXCEED
AMOUNT OF $49,000, FURTHER AMENDING THE FIRST AMENDMENT EXPENDITURE
AMOUNT NOT-TO-EXCEED $33,000 FOR A TOTAL CONTRACT AMOUNT NOT-TO-
EXCEED $82,000, TO PROVIDE DEDICATED SECURITY OFFICER SERVICES FOR THE
CITY OF DENTON IN ACCORDANCE WITH TEXAS LOCAL GOVERNMENT CODE 252.022,
WHICH PROVDES THAT PROCUREMENT OF COMMODITHS AND SERVICES MADE
BECAUSE OF PUBLIC CALAMITY OR TO PRESERVE OR PROTECT THE PUBLIC HEALTH
OR SAFETY OF THE MUNICIPALITY’S RESDENTS IS EXEMPT FROM CON4PETiTrVE
BiDDnVG, AND IF OVER $50,000 SHALL BE AWARDED BY THE GOVERNING BODY;
PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN
EFFECTIVE DATE (FILE 7340 – PROVIDING FOR AN ADDITIONAL SECOND
AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $43,000, WITH THE TOTAL
CONTRACT AMOUNT NOT-TO-EXCEED $125,000).
WHEREAS, on March 24, 2020, the City awarded a contract to Group for Horizon
Entertainment Inc. dba Ranger Guard & Investigations in the amount of $49,000 for security officer
services, and on June 9, 2020, the City approved a first amendment expenditure amount not-to-
exceed $33,000 for a total contract amount not-to-exceed $82,000; and
WHEREAS, state law and ordinance require that certain contracts requiring an expenditure or
payment by the City in an amount exceeding $50,000 be by competitive bids, except in the case of
public calamity where it becomes necessary to act at once to appropriate money to relieve the
necessity of the citizens of the city, or in case of unforeseen damage to public property, machinery or
equipment or where the procurement is necessary to preserve or protect the public health or safety of
the city’s residents under Section 252 of the Local Government Code; and
WHEREAS, the City Manager has recommended to the City Council that it is necessary to
purchase goods or services due to the COVID-19 emergency conditions; and
WHEREAS, the additional fees under the proposed Second Amendment are fair and
reasonable and are consistent with and not higher than the recommended practices and fees
applicable to the Provider’s profession and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCE OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Second Amendment, increasing the amount of the contract between the
City and Group for Horizon Entertainment Inc. dba Ranger Guard & Investigations, which is on file
in the office of the Purchasing Agent, in the amount of Forty-Three Thousand and 00/100 Dollars
($43,000) , is hereby approved and the expenditure of funds therefor is hereby authorized in
accordance with said amendment. The total contract amount increases to $125,000.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
SECTION 3. The City Council hereby determines that there is a public calamity that makes
it necessary to act at once to appropriate money to relieve the necessity of the citizens of the city, or
to provide for unforeseen damage to public property, machinery or equipment, or to preserve or
protect the public health or safety of the City's residents and by reason thereof, the emergency
purchase of materials, equipment, supplies or services, as described in the Second Amendment are
hereby approved.
SECTION 4. Because of such emergency, the City Manager, or designated employee, is
hereby authorized to purchase the materials, equipment, supplies or services as described in the
Second Amendment and to make payment therefore in the amounts therein stated, such emergency
purchases being in accordance with the provisions of state law exempting such purchases by the City
from the requirements of competitive bids.
