SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a Professional Services Agreement between the City of
Denton and Dannenbaum Engineering Company – Dallas, LLC for professional engineering services for
the 2018 Denton Sidewalks Project; amending the contract approved by City Council on June 5, 2018, in
the not-to-exceed amount of $183,839.97; first amendment approved by the City Council on September 10,
2019, in the not-to-exceed amount of $135,715.59; providing for the expenditure of funds therefore; and
providing an effective date (RFQ 6590-007 - providing an additional expenditure amount not-to-exceed
$112,879.60, for a total contract amount not-to-exceed $432,435.16).
INFORMATION /BACKGROUND
The 2018 Sidewalk Improvements Project was funded as part of the 2014 General Bond Election Program.
For this project, eighteen (18) sidewalk segments were originally chosen around the city. Currently, twelve
(12) sidewalk segments remain in the design as originally separated segments from University Drive and
McKinney street were combined reducing the total number of sidewalk segments.
Upon finalizing the design in summer 2019, funding to construct all the sidewalk segments was not
available. An alternative to prioritize and build at least five sidewalk segments were identified and started
implementation via the city’s on-call contract with Floyd Smith construction. Temporary construction
easements (TCEs) and permanent easement must be obtained to construct the sidewalks. As project
introductory letters were sent out, several property owners along Nottingham Drive, Old North Road, and
Bernard Street began to provide valuable feedback regarding their concerns about landscape and tree
protection plans. Further feedback from the City’s drainage division along the creek crossings (sidewalk
bump-outs) and coordination with franchise utilities have prompted minor post design adjustments for the
2018 Sidewalk project.
Forty-five (45) parcel appraisals for TCEs needed for the construction of four (4) sidewalk segments are
being processed through the City’s Real Estate division to expedite construction. An additional and up to
an amount of sixty-three (63) parcel appraisals could be necessary to implement the remainder sidewalk
segments; a crucial element of contract amendment No. 2.
On January 14, 2020, City Council approved Ordinance No. 19-2852 to reimburse capital program
expenditures of the General Government to fund various projects from 2014 and 2019 Bond Elections.
$1.2M out of the approved reimbursement request of $2.5M under the 2019 Bond Election Projects has
been allocated to the 2018 Sidewalk project.

Contract Amendment No. 2 is required for additional services to include but not limited to the following:
1. Real Estate professional appraisals services for up to 63 parcels ($63,000)
2. Survey Services ($17,110):
a. Preparation of up to an additional 18 easements documents for permanent or temporary
easements for the construction of the proposed sidewalks
b. Update ownership of previously produced easements documents (up to 10 parcels)
3. Engineering and Design Services ($29,770)
a. General Project Management
b. Coordination with PM, surveyor, appraiser, and stakeholders
c. Post 100% engineering design modifications
4. Special Services ($3,000 - only to be performed at the request of the City)
a. Provide staking for an easement in the field.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional
engineering firms (Ordinance 2018-331).
On June 5, 2018, Council approved a contract with Dannenbaum Engineering Company – Dallas, LLC in
the amount of $183,839.97 (Ordinance 18-829)
On September 10, 2019, Council approved Amendment No. 1 with Dannenbaum Engineering Company –
Dallas, LLC, in the not-to-exceed amount of $135,715.59 (Ordinance 19-2082).
RECOMMENDATION
Award Amendment No. 2 with Dannenbaum Engineering Company – Dallas, LLC for additional
engineering services for the 2018 Denton Sidewalks Project, in the not-to-exceed amount of $112,879.60,
for a total amended contract amount of $432,435.16.

ESTIMATED SCHEDULE OF PROJECT
The post design adjustments will be completed in July 2020 with acquisitions estimating to be complete in
August 2020.
FISCAL INFORMATION
These services will be funded from 2019 GO Bond Election account 250106473.1360.40100 in the amount
of $112,879.60. Purchase Order #185833 will be revised to the NTE amount of $432,435.16 to include the
second amendment upon approval. The total amount of this contract is $432,435.16.
