AMENDING THE CONTRACT APPROVED BY CITY COUNCIL ON JANUARY 15, 2019, IN
THE NOT-TO-EXCEED AMOUNT OF $1,010,208; AMENDED BY AMENDMENT 1
APPROVED BY PURCHASING, SAID SECOND AMENDMENT TO PROVDE FOR THE
ADDITIONAL PURCHASE OF RESEDENTLAL REFUSE AND RECYCLn{G CARTS AND
REPLACEMENT PARTS; PROVDEqG FOR THE EXPENDITURE OF FUNDS THEREFOR:
AND PROVIDWG AN EFFECTIVE DATE (FELE 6926 – PROVIDING FOR AN ADDITIONAL
SECOND AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $ 190,000, WITH THE
TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $1,200,208).
WHEREAS, pursuant to Ordinance 2003-017, the U.S. Communities Cooperative Purchasing
Program (“U.S. Communities”) has solicited, received, and tabulated competitive bids for the
purchase of necessary materials, equipment, supplies or services in accordance with the procedures
of state law on behalf of the City of Denton; and
WHEREAS, on January 15, 2019, by Ordinance No. 19-061, the City awarded a contract to
Rehrig Pacific Company in the amount of $ 1,010,208 for the purchase of residential refuse and
recycling carts and replacement parts; and
WHEREAS, on September 11, 2019, Purchasing awarded a First Amendment to Rehrig
Pacific Company for additional carts for yard waste; and
WHEREAS, the additional fees under the proposed Second Amendment are fair and
reasonable and are consistent with and not higher than the recommended practices and fees
applicable to the Provider’s profession and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Second Amendment, increasing the amount of the contract between the
City and Rehrig Pacific Company, which is on file in the office of the Purchasing Agent, in the
amount of One Hundred Ninety Thousand ($190,000) Dollars, is hereby approved and the
expenditure of funds therefor is hereby authorized in accordance with said amendment. The total
contract amount increases to $1,200,208.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval
